because it's been a very news week. thanks for spending time with us today. don't forget to set your dvr so you never miss an episode of "the five." have a great fox news alert. breaking details on that deadly highway crash on the new jersey turnpike that has left actor and comedian tracy morgan in critical condition. we've just learned a wal-mart truck driver from georgia is charged with death by auto. police say the driver allegedly rammed into a chauffeured limousine bus that morgan was riding in, setting off a chain reaction crash, killing a member of his entourage and seriously injuring two others. morgan was rushed by helicopter to a new jersey hospital where he's being treated for serious injuries. new jersey state police say the truck driver may have dozed off and failed to see the traffic

slowing down. wal-mart's president and ceo, bill simon, releasing a statement regarding that accident, read not guilty part, quote, this is a tragedy and we are proceed foundly sorry that one of our trucks was involved. we're working quickly to understand what happened and are cooperating fully with the law enforcement to aid their investigation. the facts are continuing to unfold. if it is determined that our truck caused the accident, wal-mart will take full responsibility, end quote. i'm eric shawn and this is a brand-new hour of inside america's news headquarters. >> i'm arthel neville. topping the news, growing fallout overt controversial exchange of army sergeant bowe bergdahl for five taliban commanders held at gitmo. next, why president obama said he didn't inform congress about his decision to go forward with the swap. >> in about an hour's time, we

could see history in the making as we will bring you all the action live from the belmont stakes. plus, some workers now pushing hard for a nationwide hike in the minimum wage, but is that what is best for awful america's workers? we're going to have a fair and balanced debate on that one. >> now army sergeant bowe bergdahl, we will not be hearing from him any time soon. that's because bergdahl remains in stable condition, we're told, at a u.s. military hospital in germany. this as questions continue to grow over whether bergdahl deserted, or walked off before he was captured by the taliban. we're told bergdahl still has not spoken to his family, even though it's been one week since that release in the very controversial swap for those five top taliban accused terrorists. molly henneberg live with the very latest details on this. hi, molly. >> reporter: hi. president obama said he could not go to congress before

swapping five top taliban leaders for army sergeant bowe bergdahl because, as he told nbc news, he had to act fast, quote, in a delicate situation that required no publicity. >> it was a unanimous decision among my principles in my government and a view that was shared by the members of the joint chiefs of staff and this is something that i would do again and i will continue to do wherever i have an opportunity if i have a member of our military who is in captivity. >> reporter: others say the president should have gone to congress as the law requires before releasing gitmo detainees. they're questioning whether the obama administration acted in the nation's best national security interest by giving up five taliban fighters. >> these guys weren't in gitmo for stealing bicycles. they were in gitmo as the baddest of the bad and they are essentially going to run around

in qatar and then -- nobody is really monitoring them. nobody is keeping an eye on them. they'll be right back in the fight before we know it and i just can't imagine what the president was thinking, who advised him, and how he couldn't see that this was going to be an absolute unmitigated disaster. >> obama administration officials have said there was a credible threat that bergdahl may have been killed by the taliban if word of the deal got out prior to a transfer. but senate intelligence committee chair woman diane feinstein said she had seen no evidence of that credible threat. eric? >> that controversy not being doused any way. >> not for a while. federal officials sending undocumented immigrants, including hundreds of children, from texas to arizona. the feds say they will continue to do it because the homeland security department is overwhelmed in texas. meantime, arizona governor jan brewer says she's disturbed and outraged.

dominic denatale live with more. >> hey there. that's certainly putting it lightly. governor brewer lambasting the president over the federal government's dealing with the situation, primarily because there is no indication it will stop any time soon of the they average 500 children coming across the border on their own every single week. now 2,000 of them in arizona having been moved there, transferred from texas to arizona because the federal facilities that they have in texas can't take any more. but the authorities in arizona were not told that homeland security was putting them on buses and driving them to phoenix and also to tucson. basically letting them off the bus with a bottle of water in their hands and sending them on their way to an unknown fate, quite frankly. emergency centers have been set up and we understand down on the mexico border, a new facility is being opened up by the authorities there to try and hold more of these kids. lawmakers and local enforcement agents are absolutely shocked by

this. listen. >> the government is frustrated in a lot of ways and maybe having a real difficult time addressing the problem a little more humane way. i'm hoping that they come up with a better solution than that >> the fact that nobody knows whose decision it is to actually put them in arizona, nor actually be able to have a better plan on how to contain these numbers that are coming across. she issued a statement saying how unbridled her anger was. this is what she issued. she said i'm disturbed and outraged that the president obama continued to implement these dangerous and inhumane policies, meanwhile, neglecting to answer crucial questions on citizens' demand and deserve. that's how possibly can children be treated like this. of course, no answers yet at all from the government and the crisis escalating by the day. back to you. >> dominic with the details there in a west coast bureau,

thanks. we're learning more about the shooting that occurred on thursday at seattle university. police identify that suspect as this man, 26-year-old aaron ebarra, former local janitor in the area. investigators say he confessed to fatally shooting a 19-year-old student and also injuring two others. he is now on suicide watch and ordered held without bail. police also say that an engineering student and volunteer security guard was able to douse the alleged shooter with pepper spray, tackle him to the ground as he was reloading a shotgun and that certainly saved more lives. now john is being called understandably a hero, and get this, he's due to marry his fiance later on this month. so turns out thankful strangers paid for the entire wedding. the gift registry and paid for their honeymoon. >> i love that story. very good. dr. toby dozen grove, ceo of cleveland clinic, is deciding to

take his name off the table to become the new secretary of veterans affairs, saying in a statement, quote, this has been an extraordinarily difficult decision, but i have decided to withdraw from consideration from this position and remain at the cleveland clinic. cosgrove attributing his decision to the cleveland clinic, its patients and the work that still needs to be done there. meanwhile, new developments in the growing veterans affairs scandal. acting v.a. secretary gibson now says 18 veterans died while waiting for appointments at the health facility in phoenix. elizabeth prann with a report from washington. >> reporter: despite the departure of eric shinseki, republican lawmakers are continuing to pressure the administration over the mismanagement of the department of veterans affairs. >> this is the biggest health care scandal in the v.a.'s history. america deserves to know whether

the president is committed to doing whatever it takes to make things right. you deserve to know whether he will personally step in and see this through. >> reporter: this while doing legislation in both chambers. the house passed a accountability act of 2014 just last month. the bill would allow the v.a. secretary to remove anybody he deems underperforming. while the senate is work on a similar piece of legislation with some added protections and a section granting veterans more access to alternative facilities. meanwhile, acting secretary gibson is moving ahead with improvements prior to any new legislation. >> we will be revising and enhancing our scheduling. our scheduling directives, the policy, all of these things designed to begin the process of earning back trust of veterans. veterans have to feel safe when they come to v.a. for care. >> reporter: gibson says after

now a quick check of the headlines. at the u.s. capitol, that building, the library of congress and supreme court, were briefly evacuated. a single engine plane entered restricted air space in washington, d.c failed to communicate with air traffic controllers. as soon as they were able to establish communication with the plane, all those who were cleared from the buildings were let back in. the faa is investigating. a former republican national committee chairman and lobbyist, ed gillespie, has won.

he will face democratic senator mark warner in the fall. and get this, new claims in the top doctor saying being fat could be good for us. his new book, he writes that excess fat can help you fight disease and possibly live longer. his claim began when he noticed heart disease patients started to live longer after they were diagnosed than his thinner heart disease patients. seattle approving the highest minimum wage in the nation, $15 per hour. what happens if president obama's proposal to raise federal minimum wage to 10.10 is approved? joining us to talk about it, tammy bruce, radio talk show host, a fox news contributor, along with jehmu green, former president of the women's media center, also a fox news contributor. good to see both of you. >> hi there. >> hi.

so tammy, i'm going to start with you. jehmu, you'll get the final word. so tammy, reportedly a company in seattle, now charging customers a living wage surcharge so the company can pay for the increased minimum wage. are you concerned, tammy, that the foreshadowing of who would pay for a federal minimum wage hike? >> yeah, look. there is a lot of repercussions to this. obviously their wage is the highest in the country. and there is a lot of pushback on this. one, you've got this 8.25% living wage surcharge. also consider the fact that businesses already there is numerous reports that small businesses deciding to not open up either franchises or smaller restaurants. one burger joint said look, i was going to open autopsy place in seattle or the area action that's not going to happen. you have locals who are maybe going to order more on line who are not going to do more business with local businesses.

>> so i see what you're saying. >> management is taking on more responsibilities and they're not even hiring other individuals. so it will affect the employment rate. >> jehmu, as you just heard, opponents of the federal minimum increase to the -- hold up. the federal minimum wage increase is what i'm trying to say. if people get paid 10.10 as a minimum wage salary, the people who oppose it will point to seattle as an example of what would happen on a national level. and you push back by saying what? >> it's not a fair comparison. i think we should start with the fact that in our country, if you work hard and you play by the rules, you should be able to make a living wage, live with step city and raise a family and that is not the case for even the 46% of people who are making the minimum wage nationally,

have college degrees. they are working hard and congress has let them down for over a decade congress refused to raise the minimum wage. seattle shouldn't have to do this. congress should act on this. we have a situation where the minimum wage hasn't increased at the time where corporate ceo's increases in salaries have gone up 875%. that is creating income inequality in this country. that is extremely destructive to the american dream, which is something everyone should have an opportunity to achieve. >> jehmu, let me stay with you for a second. when you say the two words, income inequality, a lot of people hear that you want to take from the people who are successful and give to the people who are less successful. is that what you're saying, or no? >> i'm saying that success in america has come from the

infrastructure, the contributions that we all make, that we all contribute to our society. so yes, if you are successful, there are contributions that you've gotten from everyone and to continue the success of our country, we need to make sure that that ladder of opportunity still exists. and unfortunately, because we have not increased the minimum wage, because cities like seattle have to take it into their own hands and places -- it's great that costco and trader joe's understand that when you pay your workers more, they work harder, and those revenues actually come back multiple times to your community because people making the minimum wage, they spend their dollars. they go into the stores. they spend those dollars, hard earned dollars in that community. and that helps the local economy. but seattle shouldn't have to do this if our members of congress would get off of thank you -- their hypeds and act on raising

the minimum wage. >> tammy, i said i would give her the last word, but i think she ran longer. in fairness, i'll give you ten seconds and then i have to go. >> for the minimum wage to matter, you've got to have a job and the rising minimum wage means these jobs for young people will not exist. we already have an over 50% unemployment rate between 16 and 19 years old in certain western cities, and this is why. this has killed jobs. all of this argument means nothing when you're unemployed. >> i'm sure the people who are making minimum wage, they disagree with you. but i will add this to the conversation and that is that since may 1, 1974, the federal minimum wage has been raised 14 times. so that's it for today. jehmu green, tammy bruce, thanks for each of you having such a strong position on this. >> thanks. all eyes on the belmont stakes right now as california chrome will go for the triple

away and he was right there at the hospital. he was the first one there. >> reporter: the racetrack chaplain fee is a nonprofit program completely funded by donations. in new york, lauren green, fox news. >> the national anthem will be sung to start 2430 major league baseball games this summer. tonight one will carry a special tribute of hope and faith. at the new york yankees-kansas royals game in kansas city that's due to start within the hour, the national anthem will be sung by 14-year-old rate underwood. his rendition will be played on videotape because he was one of the three victims in that deadly shooting and suspected hate crime attack two months ago. he and his grandfather and another were gunned down at a jewish retirement home. he was going to a singing competition. here is part of what will be shown tonight.

leaders from guantanamo bay in exchange for sergeant bowe bergdahl, rapidly becoming a political flash point on capitol hill. meanwhile, the released taliban commanders you see in this photo here saying they intend to abide by the conditions in the agreement hammered out between the u.s. and qatar. amy kellogg has the latest. >> reporter: arthel, the five released taliban prisoners who some have referred to as the taliban dream team, are theoretically joining us with other comrades from the taliban and been here for some time. they came to qatar for the purpose of peace negotiations for afghanistan. negotiations that never really got off the ground and that has been a grave disappointment to those people who always assumed prisoner swap would be part of a bigger package deal that would lead to negotiations and peace. but in the last few days, at least one taliban fighter has been quoted as saying that one has nothing to do with the other and this does not mean talks for peace will be happening any time soon. the at that caris have -- at

that carries have -- qataris have agreed to keep the terms of the negotiation secret. the local security services will be keeping an eye on them and many people believe the u.s., which has its biggest military base in the region here, and an embassy, will be watching, too. qatar citizens are the world's richest in terms of per capita wealth. the gdp has risen six fold in the last decade. qatar is the world's largest exporter of liquefied natural gas and is a small state with outside influence. some say positive. some say negative. it is a major player in the region. arthel? >> amy kellogg, thanks. just a week ago, army sergeant bergdahl was being called a hero. that quickly changed in the days that followed as members of his infantry unit spoke out about that questionable behavior of his before he was captured by the taliban, raising the issue of whether he was a deserter. meanwhile, hillary clinton in an interview with abc news is

defending the president's decision to swap those five top taliban accused terrorists for bergdahl. she called it a hard choicering which happens to be the name of her new book. susan estridge, syndicated columnist and professor of law and political science at usc and fox news contributor joins us. susan, police clinton is out there talking about her book, calling it a hard choice. can this potentially affect presidential run if she does run in 2016? >> well, i don't think people will necessarily hold her responsible for president obama's decision, but it can't help but think knowing what we do and knowing what they knew, why did they hold that big press conference? why did they have that big celebration on the white house lawn with the president and the whole thing? i mean, it was a hard choice, i'm sure, and in many respects a close call. so why turn it into a celebration? i think that was the big mistake for which hillary really can't

be held responsible. >> you've been at the top levels of washington and a national presidential manager. that happened a week ago right about now, when we saw the president come out with bergdahl's parents. would you have staged that? what should he have done? >> it's funny. i was sitting here with tammy bruce and last saturday at this time we were talking about the fact that if she reminded me there were very substantial questions around bergdahl's disappearance, jake tapper had been out tweeting about this. this was in the news media. we all knew. i said to tammy, there must have been somebody at that table in the white house who said look, let's do this quietly. let's do this under the radar, quiet announcement, not a hero's welcome, a difficult choice, make sure we've consulted with the senate. tamp this down. i got to believe there was somebody, it's not such a brilliant idea that we shouldn't have a press conference.

and for whatever reason, the people around the president convinced him that this was something to celebrate and something to make a big deal of as we all know, it blew up right in their faces. there is the picture. >> do you think this picture could potentially hunt the president in the next couple of years? you wrote in your column that the way to find out if he deserved it was to have a court-martial. >> right. people are convicting him without a trial and that troubles me because there are serious questions. but we have a system of justice in the military and it may well be appropriate to charge him. that's a decision the military has to make. so yes, i absolutely think, eric, that that picture was a picture you don't take, you don't put out there and you let the system work its way out. i can see and understand that you don't want to leave him with the taliban, as we're leaving the country. but on the other hand, you don't make it like saturday afternoon follies, we were all excited.

it was all so positive. and yet, they had to know it was going to blow up in their face. >> how do you think this will play out? he's in germany. he's supposed to go to texas where we assume his parents will meet him face-to-face. they haven't even talked to him yet. then eventually get back up to idaho where they canceled the public celebration. what do you think will happen -- >> the parade. >> yeah. how do you think this will affect the view of the president and this administration and what they did? >> i saw interviews, and i'm sure you did, the widow, the womans who husband may have been killed out searching for him and i think there is going to be enormous pressure on the military to conduct a full and thorough investigation of the circumstances surrounding his capture by the taliban. if appropriate, to bring proper charges. he would have the right to counsel and a proper procedure. i think in the meantime, you'll see the white house which was embracing this, now trying to defend it, distance it and change the topic. >> all right. we'll see if that court-martial
