parents in idaho. national correspondent steve centanni live from d.c. with more. what can you tell us about this, steve? >> reporter: well, here on capitol hill that debate continues, okay, over the administration action to free bowe bergdahl. critics say it will be difficult or impossible to prevent the five detainees who were freed from guantanamo from returning to the battlefield and harming or killing americans in the future, and they say that controversial exchange of the taliban prisoners for bergdahl creates a dangerous situation for americans serving overseas. they say it could be dangerous because the terrorists on the battlefield could see extra value in americans serving overseas and kidnap them for money or for the release of some of their people. the obama administration also criticized for failing to tell congress about the planned release, but the secretary of state says there was one important principle behind the

whole thing, that you don't leave somebody on the battlefield, and he's not worried about those detainees returning to the battlefield. here's the >> what i'm saying is there's plenty of time for people to sort through that. what i know today is what the president of the united states knows, that it would have been offensive and incomprehensible to consciously leave an american behind. >> kerry says the militants who were freed may eventually end up on the battlefield but could also get killed in the process. kerry says he's confident the gulf state of qatar will keep an eye on them for at least a year which is part of the deal. >> steve centanni, thanks a lot. >> with bowe bergdahl back and as his medical treatment continues, some of his former platoon colleagues tell fox news they believe that he did desert. there are calls to eventually court-martial bergdahl and put him on military trial to try to get the truth. is that fair, and can his claims of mistreatment at the hands of the taliban ever be proved? joining us now is former u.s.

ambassador to the united nations john bolton, fox news contributor and senior fellow at the american enterprise institute who is in boston this morning. good morning, ambassador. >> glad to be with you. >> do you think sergeant bergdahl should eventually face military justice? >> i think based on the information that's publicly available certainly that's a possibility. he's entitled to give his side of it. we'll see what happens, but this is -- this is i think very much an issue that we're going to have to confront, and it raises questions about what exactly the president knew about sergeant bergdahl before he agreed to this trade. i think that's very important. >> what do you think the president knew and what troubles you most about bergdahl's history and the reports of that considering the president may or may not have known about this going into this deal. >> well, it would be stunning to me if the president didn't know about this history. now, that's not to say that that msnbc you just leave bergdahl behind but it certainly raises the question of exactly what

benefit the united states thought it was getting by trading these five high-level taliban officials back. you know, i haven't heard anybody say that it was worth any price to get bergdahl. we keep hearing this incan'tation about never leaving a soldier behind. i understand that tradition, but would we be prepared to leave a foreign service officer behind? would we be prepared to leave a missionary behind, and in any case if it's simply the principle of getting an american back, were we willing to pay any price? is secretary kerry willing to give all 160 inmates at gitmo back to the taliban to get bergdahl. that's the serious question that i don't think the white house is answering. >> what kind of answer would you want to hear about that price? >> well, i think as in any transaction like this there is some price we're not willing to pay. it doesn't mean we give up on the principle of getting bergdahl or any other american back, but it means we're not

simple police willing to do whatever the enemy says. if the taliban has said we want these five taliban officials and we want $1 billion, would the administration have paid that? i don't even think the obama administration would have paid it. let's be clear. they have been leaking about how this potential trade has been under negotiation for four or five years. what caused the earlier talks to break down? it could we will have been the taliban's price was simply too high and that this deal occurred because the president now is virtually willing to pay any price to get out of afghanistan. that's one reason, among many others why this deal is so bad. >> and this morning secretary of state john kerry saying about the top five taliban terrorists that they will pay a great risk if they go back into the fight. how can we prevent that? >> that has to be one of the most foolish statements that secretary kerry has made during his tenure at secretary of state or perhaps even during his

tenure as a senator. number one, in qatar there's no enforcible restrictions on what they do, so they will be able to talk to their fellow taliban leaders. they will be able to seek support in other -- among other islamic radicals, and then if they do go back to the battlefield at the end of one year, assuming they stay in qatar that long, i think circumstances in afghanistan could deteriorate very rapidly, especially if the president pulls our troops out ahead of the schedule he set in 2016. i think the notion that we can get these guys later is -- is just a way of trying to justify or explain a very bad trade that's been made, and i think the administration either didn't think it through or they were just overcome by ideology. >> all right. ambassador john bolton, thank you as always for your insight and ten minutes from now we'll be talking to lieutenant bill cowan and whether or not bergdahl in his view should face military justice.

ambassador, thanks very much. egypt's former army chief taking the ost office as the new president. the inauguration of al sisi coming less than a year after he ousted the country's first freely elected president, islamist mohamed morsi but the new leader faces monumental problems, including ongoing violence and a broken economy. in his speech today he stressed the importance of developing freedom away from chaos but didn't mention human rights or democracy. >> now to actor/comedian tracy morgan who remains in critical condition in a new jersey hospital one day after he was involved in that deadly six-vehicle crash that occurred on the new jersey turnpike. police charging a walmart truck driver with death by auto in the accident. he may have fallen asleep when he smashed into the cars. morgan was on his way back from a show in delaware and police say that truck hit the limousine

bus he was in. the limo flipped over and killed morgan's close friend and mentor comedian james mcnair who is known as jimmy mac. two other women riding in that limo are also now in critical condition. >> we pray for all of them for sure. >> be sure to stay tuned for the news cast when half an hour from now we'll talk about the doctors and how we can protect ourselves if we find ourselves in the horrible situation of being involved in a terrible car crash. >> a small airplane sparking a panic in our nation's capital when it violated restricted airspace and could not be reached by radio. the u.s. capital and surrounding buildings were all evacuated as the plane drew near. a pair of f-16s were scrambled and escorted to an airport at mt. airy, north carolina. the pilots were interviewed and it was determined there was a problem with the plane's communication unit.

a fox news alert. pope francis is preparing to lead an unprecedented middle east summit today in st. peters square. he's invited the israeli and palestinian presidents to the vatican where they will pray for peace through a combination of jewish, christian and muslim prayers. greg burke joins us by phone. he is the senior adviser for communications at the vatican, and, greg, i tell you, by all accounts of course this is an unusual summit, certainly unprecedented with, again, jewish, christian and muslim prayers whisper in the shadows of st. peters basilica. if you could start, if you would, by talking about the significance of this occurrence. >> reporter: sure. no doubt about it. thanks. it's interesting. i read a great tweet today. somebody said, you know, i didn't pay any attention in the news for a week and all of a sudden you have the israelis and palestinians praying together at the vatican, whoa, so it is certainly unprecedented, and

this is something that pope francis wanted to do on his holy land trip, and it was just too difficult in terms of pulling it all together in what was a very short trip, but that was just two weeks ago. he did manage. he launched the invitation there officially sunday two weeks ago, and two weeks later it's happened with a lot of work certainly on everybody's part. it's very complicated, you know. it's a -- what they are talking about bringing people together to pray. all sorts of concerns on every side that we can't sort of mix religions and pretend like they are all the same but they are coming together. there will be three different moments basically in chronologically order. first a jewish prayer and then christian and then the muslim. now what's happened right now is shimon peres has just arrived about five minutes ago and he's sat down with the pope in the pope's house. mahmoud abbas will arrive in about 15 minutes. he'll also have a one-on-one with the pope or a small

greeting with the pope, and then they will all go together into the vatican gardens where the actual prayer will take place. >> if i can jump in there, greg, because you're talking about israeli president shimon peres and palestinian president mahmoud abbas both going to be there and each having private meetings with the pope, but as the pope calls for prayers for peace, peres and abbas, i understand they are expected to discuss political developments when they will meet in private after the prayer so what do you think the two leaders hope to walk away with, greg? >> reporter: well, i think they hope to walk away with goodwill. i mean, it's basically they will have to speak for themselves, but at least from the franciscan prayer, this is a prayer break what, we hope is a start for hope, okay. nobody thinks that peace is going to break out because of one day of prayer, but this will get people praying. it will perhaps instill, give some sense of home.

we certainly get that idea from the pope, you know, that we need -- we need to do something different from just what we've done up until now because it hasn't worked. >> yeah. you can't get to peace in the middle east without hope to start with, and hope starts with prayer so let's hope that when the jewish and christian and muslim prayers are whispered there in the shadows of st. peter's basilica somehow we can get some understanding and start to get to some peace there in the middle east is my hope there. greg burke, it will start about 45 minutes from now? >> reporter: yeah, that's correct. the actual key moment will be at about 7:00 local. hopefully it will cool down a little bit. when i left my house ten minutes ago it was 88 degrees out here so there is a bit of a breeze so that will be a help. >> greg burke, so nice to talk to you, and we'll talk to you again. thank you. >> reporter: thank you, arthel. >> sure. >> back here at home, california chrome recovering from a gash to his foot today, an injury that

one of his co-owners blames for possibly costing him the triple crown, the loss sparking a heated reaction from coburn who is outraged that the top two horses who run did not even compete in the firstces, the kentucky derby and the preakness. the latest details now. julie? >> reporter: eric, perhaps if the races were spread out the results would have been different or had all the horses competed in all three legs, the kentucky derby, preakness and belmont we'd be talking about another winner today but instead we're talking about a sore loser, upset the winner of the belmont didn't race all three legs, california chrome's co-owner steve coburn wants the racing rules changed after his horse fell short of nabbing the triple crown, a title which hasn't been awarded in a record 36 years. coburn's bitter reaction getting more attention than the race itself today. >> it's not fair to these horses that have been in the game since day one. i look at it this way, if you can't make enough points to get

into the kentucky derby you, you can't run in the other races. it's all or nothing because this is not fair to these horses that have been running their guts out for these people and for the people that believe in them, to have somebody come up -- this is the coward's way out in my opinion, this is the coward's way out. >> of the 11 horses who competed in the belmont, only three, including chrome, also ran the derby and preakness, and with three tough races in just five weeks, racing experts say it's just too demanding for any 3-year-old horse to win all three with little time to rest in between, chrome was a favorite where 100,000 fans came to race. they were hoping he would become the first horse to win the triple crown since 1978. >> i think he has a point. >> hero, deserter or traitor.

what should be the course of action? lieutenant colonel bill cowan is a former news -- fox news military analyst. good to see you, sir, this morning. >> thanks, arthel. good to be with you. >> i want to start here. do you think bergdahl should be court-martials? >> well, look, i'm a combat veteran. my son's on his fifth tour in afghanistan. i've heard what all the young men who served with bergdahl have to say. i'm with all of them. this guy needs to be charged with; but the problem is going to be the element of proof in whatever he might be charged with which could range from awol, away without official leave, desertion which is the key word people are use right now, or in james rosen's report, corroboration with the enemy, a lot he could be charged with. the question is what are the elements of proof that are going to get a conviction, and it will be difficult, no matter what. >> so you definitely believe he should be court-martials. i ask you, would a psychological evaluation have to take place first to determine if or when bergdahl would be ready for a trial?

>> yeah. that's a great question, arthel, that, i mean, among many other things. we know he's in germany not only getting a medical evaluation, certainly talking to intelligence people who are trying to glean whatever they can about where he was held, the circumstances, things like that, and we also know that he's going to be talking to investigators who are trying to peel away the truth here about what really happened, so, against that entire backdrop there may be real questions about his emotional state, not only before he left his unit but certainly now coming back, so there's a long process we're going to go through before a lot of questions are answered. >> a long process indeed. is it possible for sergeant bergdahl to plead the fifth, if you will, and avoid answering certain questions? >> i don't think he has to answer anything. his miranda rights, miranda rights in a military and civilian trial are somewhat different, so there may be a lot of stuff gleaned out of him before they decide to mirandize him. that's another issue that comes up. i think at the end of the day, arthel, it will be very difficult, no matter how much we

want it to happen, me included, i think it's hard to charge him with much of anything and may end up pleading guilty to awol which is minor and will forfeit all pay and allowance and administratively discharged. i think the real question that comes out is whether or not he's granted prisoner of war status. we've already had the president say he's been a prisoner of war, the secretary of defense, national security adviser, and if he's afforded a prisoner of war status, i think there will be a furry of outrage from people because a p.o.w. gets special privileges and benefits from our government as all legitimate p.o.w.s should. the question is bergdahl a legitimate p.om.w. >> boy, such an emotionally charged story for sure and now there's reports that his parents are receiving death threats and we're hearing such strong testimony from his fellow soldiers through the media, so, you know, i have to leave it there, and it seems like you have a have to strong position on this at well, duly noted,
