who were killed looking for him will never be fully comforted by whatever punishment might be meted out for sergeant bergdahl and those five terrorists that we turned loose will likely kill again. i'm not sure what words of comfort president obama could give to the families of those future victims of these horrible monsters. now, many questions yet have to be resolved. why did the president act in direct violation to the law that required him to notify congress at least 30 days in advance of some detainees released at gitmo? even the president's sympathizers can't deny that he clearly broke the law with his actions. although some defend it because of the argument that bergdahl was sick and needed immediate medical attention. why did he violate our longstanding policy and even negotiate with terrorists at all? does that not endanger more americans from capture so they can become hostages to pressure the president to open more doors from the lockup at guantanamo bay? if we traded one suspected

question that this curious case brings up and forgive my cynicism. was it to take the disgusting and outrageous maltreatment of our veterans in the v.a. system off the front page and somehow make the president look like a hero for getting a soldier out of captivity? the president and members of his team have repeatedly justified their hostage swap of terrorists because we leave no man behind. well, america doesn't desert its soldiers, apparently even if they desert us. so then here's my question for the president, and honest to god, i really want an answer, if you were this committed to saving sergeant bergdahl, so much so that you would break the law and let five mad dogs loose, then why, why on god's green earth didn't you do something to rescue the four americans slaughtered at benghazi? why -- [ applause ]

graham earlier. this past wednesday, you made a statement that if the president were to continue allowing gitmo prisoners to go free as we've seen this past week, that you think there would be republicans calling for an impeachment. do you stand by that statement, that this could be that big of an issue? >> well, the question what if the president just unilaterally emptied the jail on gitmo. we have restrictions on prisoners going back to yemen, we have notification requirements. if the president tried to empty the jail, it would be a constitutional crisis of great proportion between the congress's power and that of the president. the 30-day notice requirement is a debatable issue but we do have the ability of congress to deal with detainee matters. there's some restrictions on gitmo. if he decided to empty the jail one day because he was tired of

the war. >> he's clearly wanted to get rid of gitmo from the beginning. he campaigned on that basis. he said he's going to do it within 30 years. is this a political move on his part or is this a sincere effort because he wanted to get bergdahl out of afghanistan? >> well, all i can say that the deal is dangerous for america. this is an incredibly bad deal. this president embraced a normal concept in the military that we don't leave people behind. we don't undercut the military and put them at risk. we've let five taliban hardened dream team, these are the people who killed women in soccer stadiums for sport, can you imagine how young women in afghanistan must feel today that our country let these killers

loose, all those that fought along our side how they must feel in afghanistan and can you imagine the threats that americans face today because of this president of dealing with terrorist and every american over seas is subject to getting kidnapped now and the taliban commander acknowledged that to time magazine. this is a very bad deal for america and this is the same president who embraces never leaving any american behind, and never bothered during the fight in benghazi. >> you've made it clear that this isn't some bush league terrorists pick up for speeding. these are really the worst of the worst. does that give you concern? it wasn't just negotiation for a few guys who were marginal but some of the leaders? >> i think he was looking forton to get rid of some of the bad

guys. he wants to close gitmo to a fault. it would be fine with me if these guys had died in jail. we're at war with radical islam. the taliban is a partner with al qaeda that attacked our country. the intelligence is not to release these guys. they did not reform themselves. there was no evidence that they became safe to release all of a sudden. i think he tried to do two things in one week. end the war in afghanistan by declaring our withdrawal by 2016, which will be a disaster for us. we've told the enemy when we're going to leave. we should have had a couple of bases left in afghanistan as a line of defense against future attacks for us as an insurance policy. what he didn't realize that most americans are really upset that we let five hardened killers committed to our destruction who have killed americans, war criminals, back on to the battlefield within a year, they will be back in afghanistan and god help the people of

afghanistan. the president really hurt our own national security. this was a dumb and dangerous decision. >> senator, you have the unique distinction. you've heard in the jag arm of the military for many years. there are a couple of questions. there are reports, our own james rosen this week reported that bergdahl had converted to islam and that had declared himself to be an enemy. now, again, those are reports that have been published, they have been leaked out. i want you to speak to it from the standpoint of the military process. does this change anything? how should the military process and deal with bergdahl if in fact he deserted his post and ended up joining with the taliban, joining with the enemy? what does that do? >> okay, this is a very good question. one, you and i believe in the rule of law for everyone. so this man deserves due process when he gets home. he will be part of a

investigation. you've heard from members of his unit about what they think happened. he will have a chance to provide information on his own behalf, and if there's evidence of a crime here, his commander can convene a court martial and he will be assigned counsel. he should not be tried on television or the internet. let me say this, when someone desserts their unit in a time of war, that can be a capital offense under the uniform code of military justice, article 85. i am all for due process. everybody is presumed innocent until guilty, but i assure you the military will investigate this man's conduct, because if the allegations are proven to be true ks he put his unit at great risk but we will not try him based on media information or internet gossip. there's a process in the military. i've been a military lawyer for 31 years, but desertion at a time of war is a capital offense under the ucmj. that's how serious the military treats it. this man is presumed innocent.

but let me just say one other thing. we have the right to hold these detainees until the end of hostilities. withdrawing from afghanistan is not at the end of war. we're not at war with the people of afghanistan or the government of afghanistan. we're at war with terrorist groups like al qaeda and those who provide material support to al qaeda like the taliban. this war is far from over. as a matter of fact the enemy is stronger today than they have ever been. so the end of hostilities will be when the taliban surpders. we're a long way from there. i hope the president releases that. >> do you think this whole thing blew up in the president's face and he underestimated the reaction of the release of those five terrorists? >> at the end of the day, i think there was a political dynamic to this, the rose garden ceremony blew up in his face. here what the president doesn't understand, radical islam hasn't been decimated. it is on the march.

>> an american soldier was missing so when sergeant wd bergdahl walked away from his base in eastern afghanistan in 2009, the tactical operations center in the south of the country dropped everything to find the missing sergeant. major rusty bradley who was the center's chief at the time is author of an outstanding book called the lions of kandahar. >> i appreciate your being here to give us a little clarity on what happened. i want you to walk me through the day that you got the call about sergeant bergdahl. what did you do and what were your responsibilities as the tactical command center director? >> if you don't mind, i'll start with my responsibilities first. we're responsible for all the operational control, the logistical control, close air support and medical evacation of

every operations and special forces unit in southern afghanistan so when their troops are in contact and they need help or resources, the top chief and at that time myself was exactly who they talked to over the sat com radio. when that red line message came across the secure system, we realized very quickly that this was the first time and the only time we had seen a dire circumstance like this in afghanistan and when the first thing i had to do was brief the commander and the second thing is start looking at what resources can we pull from teams that are currently not in an active fire fight and push them to the east if in fact they need support from special forces in the south. >> so clearly you are moving assets around from combat to go look for this soldier. you know, we're hearing things now major that there were a lot of indications that he walked away. is that your understanding? is that what you were told at the very beginning or were you just told this guy was captured?

what was the message early on? >> the very first red line message we received was that we had an american soldier that was missing and that's all we knew. so we were fully prepared to move heaven and earth and the report at that we received within 24 hours essentially stated that, number one, he had left a note saying that he didn't agree with certain things that were happening with our efforts there, that he had left his equipment, and we also had matching intelligence reports that stated that he had essentially made communications with some local vilers and was inquiring to the location of the insurgency which was in that area was the haqqani fighters. >> so major within 24 hours of his disappearance, it become pretty clear with everybody in the command that this guy left voluntarily, that he walk off and he did it intentionally and he was joining up with the

taliban. does it become very clear to a military member, regardless of who he or she may be what the rules are about walking away? how black and white is it for any soldier to understand the repercussions of that? >> governor huckabee, it is so clear from the time you join the army from basic training to advance individual training, to the 20 to 40 powerpoint shows that you get in the two weeks prior to arriving in theater of what your requirements are, what you are legally obligated to do, what you are obligated not to do, from everything from separation and detention to your engagement with the enemy for -- during the rule of engagement, so there's really no -- there's nothing that's not clear about what your obligations are as an american service member. >> he was so trained, it would

how dangerous is it to let them loose? >> these are probably the five-most highest-ranking taliban insurgents that were held in gitmo. their war crimes and their crimes against humanity equal what the nazis did during world war ii. unfortunately, in -- as far back as 2005, 2006, when i first arrived in afghanistan as a special forces commander, we were already starting to see some of the earliest releases from gitmo arriving back in afghanistan and rejoining their tribes and their clans to begin combat operations against u.s. forces there. so let me clearly let the american people know that these five will return to afghanistan or pakistan and u.s. and coalition members will be maimed or killed because these guys

were released. >> does that outrage you as a soldier who put your life on the line and dodged bullets in iraq and afghanistan? does it kind of tick you off that these guys are running loose? they are not going back to open up a starbucks. they are going to hurt people. >> these guys deserve lead poisoning and unfortunately i'm not in the position to be able to administer that anymore, but it goes beyond infuriating to know that special forces and special operations members, u.s. service members, civilians, contractors are still over there fighting with no support from the administration, and they are doing it because of what they believe in. they are doing it for the american people, and these guys are going to be -- these guys are going to be no better than they were when they were captured. >> you know, one of things that the president has tried to tell

us is that was necessary to get bowe bergdahl released and it was worth it. you know, i would love to find out. i'm not asking you to seek the office, but you've been there. we have now known that the president didn't listen to the military and intelligence counsel that he was being given, all of which said don't do this. but he did it anyway. what should have been the advice? what would you have done? what would you have advised the president if you were sitting in the oval office and he said, okay, major, i got a guy over here. we need to get him out, what do i do? what would you tell him? >> if an insurgent contacted a member of my administration and threatened to kill a detained u.s. service member, i would have them put me in direct contact with their leader and i would tell them very clearly that if you harm him in any way for propaganda purposes i'll destroy you. i will set aside everything on my desk.

murdered officers weapons and ammunition and went to a nearby walmart where they shot a bystander before taking their own lives. investigators describing the event as a murder-suicide pact. in pakistan, an attack on that country's busiest airport is now over. 13 people are dead. heavily armed militants stormed the airport around midnight. it's not clear what sparked the attack. now back to huckabee. well, we have some great news on 16-year-old justina pelletier. on friday, massachusetts health and human services filed a motion that agrees to return justina to her home in connecticut. her parents anticipate an order that gives full custody back to them. we are thrilled that justina will soon be returning home.

of the movie's executive producer dr. jim langelar. dr. jim, kelly. let me begin with you, this is a story that relates back to members of your own family. your ancestors. how did you come across this story? was it something that's been passed along or did you happen upon it? >> well, it happened over 250 years ago, in 17'' at the very start of the french indian war. they had 70 years of peace and they weren't expecting it. these two little girls along with eight other people were taken captive. it was recorded at that time, but basically lost to history, and my mom came across a write-up in a lutheran

publication of the story and she noticed barbara and regina, same last name of ours, and my youngest daughter who was nine at the time really related to little regina and she decided to write a book about it when she got older, which she did. mir acculossly, the book sold thousands and thousands of copies. three different producers said this was a wonderful story. we got to make a movie of it. i'm glad you did. it's a powerful film. kelly, you played barbara in this particular film and i'm curious, as you studied for the role, found out more about this really remarkable story of the girls and their disappearance for a long tomb and then finally being able to be able to come home, what drew you to the film

and from that, what do you feel like it did for you as a person, not just an actor? >> how much time do we have? i think there's multiple things that drew me to the role. i think being a true story, and being history, is always something really great because if you can have an inspiring story from history that we can learn from, and learn lessons of character and perseverance and faith, that's something that draws me to a project. so many reasons. but another i think is i love to be parts of stories that inspire. people that encourage people and give people hope and in the midst of this world it's just so crazy at times. i think this story has a lot of those aspects. there's a lot, in fact, as far as take aways from this film, i hope families take away from this the impact that they have on their children, like parents, the impact they have on their

children. when you see this story and you see the little girls listening to their dad read the bible around the family table at night, and then you see their -- the song that their mom sang to them and the fact that was instilled in them, that carries them through these really hard trials. they were years and years in the indian villages, captured guns, to see their faith sustain them and bring them back together is really a beautiful. >> do you find roles that you play, one like this that brings hope and encouragement, does that give you a greater sense of fulfillment from an actor's standpoint? >> i think it does, because i think when you are really proud of things that are you are a part of it, it's inspired your life as well, and you really want to do that. the reason it's still being told today hundreds of years later, they went through really hard times and they overcame and i think it's encouraging to me, in
