very happy to be here. bright and early in the morning as well as brian. we've been here awhile but this is great. i'm looking forward to it. >> this is a big news day. let's get to it. new fallout over the taliban prisoner swap that freed an american soldier. bowe bergdahl's parents were allowed to take part in secure, secret video conferences with top u.s. officials. perhaps as many as 20 times per your. and as we're learning, that would have been unprecedented access. weesh -- we're getting reports of bergdahl's treatment of the captors and he's refusing to talk with his parents. all of this as the white house appears to be in damage control. secretary of state john kerry says any idea that the prisoner exchange for bergdahl puts american lives at risk in his words is baloney. >> i don't think anybody should doubt the capacity of the united states of america to protect americans.

nobody. no one should doubt the capacity of america to protect americans and the president has always said he will do whatever is necessary in order to protect the united states of america. >> but top democrats like dianne feinstein remain uneasy about the release of what they're calling the taliban five. >> i heard john kerry this morning say don't worry about them. it's hard to be comfortable when you really haven't been briefed on the intricacies of carrying out this agreement. >> that sounds like a registered complaint. heather, i want to go to you first on this about this information we're learning. you've been looking at some material that that family got to see >> that really concerned me, especially after we know that there were comments from the father himself. he tweeted out his support for al qaeda and the taliban and i have this article that was put in the washington times and it quoted a former government

official involved in american hostage situations and said that he had never heard, ever, of a family given such access and he questioned whether the sensitive material and the information could have been conveyed, you know, to the bergdahl family or should have been. >> so what you're saying is were there any secrets that were given away? >> exactly. especially when we know what the father was saying outside of these meetings. >> and one thing we've been doing on "outnumbered" and other news cast is we can't confirm the tweets. >> one of the arguments they made for why they didn't go to congress is because they were so afraid this information could potentially get out. they didn't go to congress because they were worried the information could get out but they could let the parents in on this top secret information on these video conference calls. that argument doesn't hold anymore. >> it looks like his parents were briefed at a greater detail than congress was.

when you have senator feinstein not even tip toeing the idea that the white house didn't inform them as much, we heard the word misled. not only when this first came out did she say they completely broke the law in totality when it came to not giving congress the 30-day notice but now we're a week out from when the swap took place and the announcement in the rose garden took place and she's on a sunday show saying, i still have no information. it's not like they did it, went to her and said here are the details of what went ong. we're sorry we didn't come to you first, and now we're hearing reports the family was getting more details than senator dianne feinstein. >> she's on the intel committee. it wouldn't matter how much they were friends or not, she's supposed to be trusted with this kind of material because she's on the intelligence committee. something else that dianne feinstein has said is that this was talked about, this type of swap and we know this, too, from hillary clinton, was talked about as much as two years ago.

and her feelings were then that there were some pretty strong voices inside congress against this swap. was this sort of a political thing that the president would have gone around congress? >> i think so. i think he probably realized he's going to get pushback if he does this. why don't we tell him and say it was an urgent matter. really? turns out physically it was an urgent matter and there's no sense also that his life would have been taken anymore in may or june than last may or the june prior. you're always in danger with al qaeda. i think one of the biggest things i took from the sunday shows is the senator dianne feinstein has not been really in. >> do you think something happened and we don't know about it? >> she came out yesterday and said i still can't answer questions. i still don't understand. i watched secretary of state kerry this morning. all the white house had to do was reign her in and say, listen. sorry about that.

one of the guys who was released go immediately as he landed state publicly, i'm going to get become to afghanistan and i'm going to attack americans and i not just about u.s. troops in afghanistan. it's about americans here at home. let's not forget, these guys were actually involved and really good friends with all of the people who planned 9/11. >> it's not the first time that mixed messages have come from the white house so that's not entirely unexpected. but what you're getting to, the next thing that will happen here is that this puts our troops and americans at greater risk because the taliban and other terrorist organizations, they see what america is willing to do. >> you know the other thing that incentivizes them and we've heard mike rogers from michigan talking about it and john mccain talk about, too, is the fact that you have five guys who survived gtmo and you want to talk about a recruiting tool.

"time" magazine has bowe bergdahl on the cover with that one ge. what's going to be interesting is whether bergdahl gives our intelligence agents any information about the taliban and how cooperative he is when it comes to giving them the

>> welcome back to "outnumbered." former secretary of state hill ry clinton sitting down for an interview but not saying whether she'll testify about the consulate in benghazi. >> i'm not going to say one way or the other. we'll see what they decide to do, how they conduct themselves, whether or not this is, you know, one more travesty about the loss of four americans or whether this is best tradition of the congress. >> and in the meantime, a poll finds 50% of americans disapprove how clinton handled the benghazi attack. only 37% approve. you heard her interview there.

she immediately goes to the political side, right? she says, well, depends on how they conduct themselves. i have no doubt that they're going to issue her a subpoena. we have the new benghazi select company. i don't think that we can get to the bottom unless they have hillary clinton testify. you see there she went political right away. >> if she's running, she's better testify because immediately, republicans will have the talking point of where is the transparency? what are you hiding? if you have nothing to hide, why aren't you going to testify? with that being said, i would warn people when you look at the polling, hillary clinton very popular. 67%. 60% say she's honest and trustworthy so could this change everything if there's a hearing and things come out? and all of a sudden there's a lot of accountability she has to take? absolutely. that's what she's worried about. she can't just hide in the background if she's running for office. she has to be the woman who goes out there and tells the truth.

what she has already given an indication of how she'll do it, i can't tell you the thickness of blasting walls. i can't tell you how many guards i need here. i'm more interested what happened that night and what happened after. so she didn't have the right security there. the department was too thick for decisions like that to get to her to protect her friend but i want to know, were people covering your butt that night and were you not doing everything you can to get the truth out? >> she has a lot on the line here. running against president obama, she did 3:00 a.m. phone calls and i think people will use that against her. >> this was the equivalent. i think it happened around 9:00 p.m. but it was equivalent to the 3:00 a.m. phone call. how did she handle it? did she answer the phone call? let it ring, ring over to voicemail? will the book be enough to wipe that away? if you don't testify, then you have to go on the written word of "hard choices." i don't know if there's enough

in that book that qualifies for congressional hearing testimony. >> she doesn't want to undergo that. her whole legacy at the state department is there as well. >> if it's not already. >> another portion of the book she doesn't think we'll ever be close to knowing exactly what happened. >> how does she know that? >> but how is that accessible? it's an easy answer for her to say. it gets her out of the way. >> all right. i have to shift this over to something in education which has me heated. parents at a milwaukee catholic school after the city's archdiocese announces it would use the washington backed common core standards at its 110 proem yal schools. some are turning to home schooling. more than 1,000 parents have launched a campaign to stop the move saying if they wanted their kids to have a public school curriculum, they would have sent them to public school. the archbishop says they're using the standards as a

reference along with catholic school standards. oh, man. all right. brian, this is a great point by parents, i think. they're saying, look. we sent our kids to private school to avoid this kind of government mandated curriculum and now we're subject to the same kind of thing. do the parents have a choice here? do you think their voices will be heard? >> they have over 1,000 signatures. people are rally around it. i sent my son to a catholic school. new york has a standard which you have to take a test, no matter what school you're into. if you don't like it, don't sign up. i think a lot of people will make that choice. this is just that one ar archdiocese in the state of wisconsin. i think it will force parents to say, do i need to write that $5,000 to $7,000 check in order to do something that i can get everywhere else? that will force the archdiocese because money does matter even when it comes to catholic schools. that will force them to say,

okay. we'll get off that standard. i understand why you're here. >> what do you think this will do to home schooling? there's a lot of uproar about common core, some problems. i watched a video the other day where it was like a weird diagram that she was doing on the black board s. this really going to boost home schooling across the country? >> i think that might end up being the only option for parents and i was reading where some parents were talking about the difficulties that they have in helping their children with homework and talking about fuzzy language, specifically math. unfamiliar terms like rectangular array and arium model. >> i'll explain that to you afterwards. >> they're discussing math. i think that home schooling will definitely be perhaps an option that parents are left to consider. >> i think brian hit the nail on the head. parents aren't going to write

that extensive tuition check to have the same thing that you can get at a public school. they're really -- in a time when parents are struggling to get by and scraping every dollar not only to save for college but get by, they'll have to rethink whether they'll pay for the tuition that they can get at a public school z. if you were in this situation and put your child in a private school and now this was happening, what would your reaction be? how do you think it's the best approach for parents to respond to this who are really unhappy with all of a sudden this government imposed curriculum invading their schools? >> as a parent, and i agree because your taxes are paying for something public, i would keep the $5,000, $7,000 in my pocket. i would also use the google machine and look to see what my other options were. if they could make a god reason for this, right, there wouldn't be parents literally protesting in school districts across the country pushing against core curriculum. but i haven't seen the compelling argument for it. what i have seen is teachers

the lows mirroring what's happening nationally. the president at 43% but if anyone in the white house thinks the president can bounce back in the polls, politico going all the way back to the truman days says don't bet on it. we've seen the administration try to throw things out there to try to get the approval back to student loan issues and that's something they're trying to get out there to get a good, positive note on the administration side. >> minnesoimum wage. >> i think you're right. if anything was out there to do the popular movement to get his popularity up, his reflects on congress is midterm elections. if you think his popularity is huring now, pick your word, controversy is the mild one. then you just wait until it happens after the midterms. then all bets are off.

approval, for a long time everybody liked him personally. >> i think they still do. >> i don't know, though. >> and he his wife are popular. >> the american people know and have said in polling they think he lied to them about health care and about keeping their plans. that's when his approval on everything has kind of gone to the tank. >> i think it has more to do with jobs. they can like him as much as they want but some issues you're mentioning might play a role. the biggest issue for this president has been just the fact until last week, they were still not generating enough jobs to get us back to 2007, 2008 level. that's a huge problem. we find negative growth in a quarter for this country f. that happens again, the white house might look at other factors but most economists a grgreagree, y two quarters of that and then we're back in recession. if the president can come out with any kind of a jobs plan that didn't involve part time

i think we're in for a couple of long years here. >> an apology from the owner of california chrome. steve coburn was hoping his race horse would take the triple crown at belmont stakes. california chrome finished in tie for fourth place. coming in behind a fresh legged winner who hadn't run either of the first two races that make up the triple crown and prompting this reaction from the coowner coburn. >> these are the horses, they always set them out. they set them out and try to upset the apple cart. it's not fair to these horses that have been in the game since day one. i look at it this way. if you can't make enough points to get in the kentucky derby, you can't run in the other two races. it's all or nothing. this is not fair to these horses that have been running their guts out for these people and for the people that believe in them or -- this is a coward's way out.
