the crowd will pay attention. ms. megyn is next. the spin stops here. we're definitely looking out for you. breaking tonight, a new warning about the safety of americans as a result of the president's decision to release five top taliban commanders in exchange for one american soldier who may face desertion charges. this is the united states house wraps up a classified intelligence briefing and lawmakers are furious. welcome to a busy "kelly file", everyone. i'm megyn kelly. some are outraged and speaking out accusing the president of misleading american public and claiming that he approved this deal without the required congressional notification because he supposedly feared a leak. this as we learn tonight that

nearly 100 administration figures were told of the deal in advance. no fears of a leak there, apparently. the vast majority of veterans thinks this swap was a bad move. 68% say it was wrong, just 16% say it was the right move and not just the ranken file voicing concerns. ralph peters is here with us with reports some members of the pentagon are fuming over this deal and the white house is handling it. rick helping some of these members of bergdahl's platoon who fear possible legal ramifications is here on the attacks against these guys including most recently by "the new york times" and the navy seal's story, turned into a loan survivor. he's here with what he thinks about bergdahl refusing to speak to his parents, demanding not to be called sergeant and how the

taliban treated him while he was in captivity. but we begin tonight with stunning, breaking news as a major crisis at our southern border is unfolding and yet you probably heard next to nothing about it. a massive surge of illegal immigrants is underway right now and we do mean massive. this is unprecedented. leaked pictures show hundreds, hundreds upon hundreds of children packed like sardines into detention centers. most of them here illegally without parents and the boarder patrol totally overwhelmed and unable to care for them. children sleeping on plastic tarps lacking basic necessities. in one facility in phoenix they have four showers for nearly 300 children. after a couple media outlets started to focus on this, the media held a background conference call but the crisis is building for months. the feds decided to take some children from the defense

centers, put them on buss and simply drop them off on street corners like phoenix. the big warning, we're told this problem could go from very bad to much, much worse in coming weeks. we got judge napolitano and dennis michael lynch has been warning about this for weeks. he has eyewitness accounts from the boarder. trace gallagher starts us off live with what is driving this surge, trace? >> megyn, we've heard for months people are fleeing central america to escape the gang violence but the ambassador to the u.s. says that's not true. he says they are coming for two reasons, one to meet up with family here and two because smugglers guarantee to get them into the u.s. in fact, many illegal immigrant whose arrive here believe the u.s. has a catch and release policy if they cross the boarder, they can stay and look at the increase. 6,500 unaccompanied kids crossed

in 2011. this year it estimated to be 90,000 and next year 147,000. many in texas, california and oklahoma are housing them and look at the pictures leaked by boarder patrol agents showing children crowded into chain linked holding centers. food, showers, beds in short supply. >> just imagening being in their shoes, they have terrified faces. they don't really want to speak because they are scared. >> then the thousand mile plus journey to get here riding in the trunks of vehicles, the backs of trailers or on the beast, a so-called death train where children often fall off or become victims of crime. unlike mexican citizen, illegal immigrants can't just be sent home. they are turned over to health and human service whose release

them to family and friends. they are supposed to go through immigration court but many don't and hundreds are dropped off at bus stations in tucson and phoenix, arizona governor january brewer says quoting here, i'm disturbed and outraged that president obama'sadministr implement this dangerous and inhumane policy. president obama has yet to respond to governor brewer but the president has asked for an additional $1.4 billion to handle the wave of illegal immigrants. critics want more security at the boarder, megyn, but it's difficult when boarder patrol agents spent most of their team processing undocumented children. >> this is unbelievable, trace, thank you. for more, judge andrew napolitano is our analyst with a look at the legal ramifications of this and dennis michael lynch is here with a documentary film maker heading down to this area tomorrow and made two films with this issue. we begin with the judge. this is incredible and

undercovered. last year we had 6500 children come. 90,000 is the protection by the officials. it could be as high as 150,000 children who are going to come across the southern border. we can't handle them and the question is why, suddenly why? >> i don't know why but how. remember when the president has the telephone and a pen and knows how to use them? he can stop all of this with a telephone and pen. instead, he caused the president of the united states personally and directly caused this with a telephone and a pen. >> how? >> when he said to illegal immigrants if you do the following things, and he ticked off 13 different things, i will not let the government deport you. he made up the 13 events. when he sent that signal to presently residing in the united states of america illegal

immigrants, he sent a signal to people in south and central america, send your children here and they won't get deported and then you'll have an excuse to come here to be with your children and you won't get deported. megyn, the president has taken an oath to uphold the law. he has some leeway in enforcing the law but when he does, when what he does prevents the law from being enforced, when he does the opposite of what the law says, he's not doing his duty. >> they say in 2012, president obama issued this directive called deferred action for child arrivers that allows illegal immigrant children who come to america to defer deportations but only applies to children here as of 2007. apparently, these children didn't read the law, judge. administration wants to blame them for not understanding that policy. >> the ad pin station caught to know that no one watching this television show now and you're the only one breaking this will believe it the fault of these children. it is the fault of the federal government of the united states of america, the executive branch

which is run by president barack obama for not enforcing the law. his duty is to enforce the law, and that means discouraging illegal aliens not encouraging them. >> dennis, you have been in your defense sounding the alarm. we just had you on a few weeks ago and you said the southern boarder patrol was overwhelmed. they would collapse given the influx of children and now we have pictures, which were leaked. they were leaked and now the boarder patrol is told don't take your phones, no more pictures. they are trying to shut them up. you're raising the flag and we see the evidence. it's as bad as you warned. >> about to get worse. it's about to get worse. i told you that the intelligence i was being given was saying right now it would be worse than it was two weeks before. entire villages are emptying out and coming from central america through mexico to the united states. they will be hitting in the next couple weeks.

attest to what bergdahl went through. i wasn't out there for five years, it was five days. i know when the taliban had me, it wasn't a good time. i don't think there was plans for them keeping me and ransoming. they were trying to kill me the entire time, cut my head off, shoot me. if it wasn't for the villagers, i wouldn't be here today. >> when you know that, i can only imagine the fear, you're a trained navy seal but you're a human being. there had to be fear. when you hear reports of bergdahl being tortured, put in a cage, that was for one stint because later we're told that it got better. what goes through your mind like when you saw the tape of him getting on the helicopter? >> sure, you got to break him first. when they capture him, they aren't going to immediately trust him even if he said i'm here to help. they don't trust americans.
