following the breaking details. >> reporter: a spokesman for the islamic state of iraq has proclaimed their eyes are set on baghdad after seizing two key cities in the north. they did so reportedly in an audio posting. this after reports that militants reached the city of samarra on wednesday, about 80 miles from the iraqi capitol. excuse me. i'm going to have to pass it back to you. >> no worries. we're going to continue all that for you here. >> let's look at what happened. on june 5, samarra falls. kirkuk is being attacked yesterday. tikrit went down yesterday. one after one. people say it is a civil war. it is not a civil war. in a civil war people fight back. right now iraqis are laying down the arms we sold to them and are walking away. >> devastating to see.

>> absolutely. what they're doing is these extremists, what they're trying to do is create, they're trying to force out the good guys essentially and trying to create a pan-islamic state that reaches from the mediterranean to the country of iran. the problem is, when you look at these images, they're heart breaking, how many lives were lost trying to help liberate the people of that particular country all because of a campaign promise to get out. here's what's going on right now. over the last month the country of iraq, through the person of prime minister al-maliki, he's gone directly to centcom and asked for help. he said you know what we can do? we're not asking for anything other than drone support. if you could give us drones we could blow up these guys in their staging areas and repeatedly the federal government and the administration have said no, we're not going to give you drones. we already gave you stuff.

we're not going to help you. >> a spokesperson for the security council declined to comment on the request. she said -- quote -- "we're not going to get into details of our diplomatic discussion." >> let's get this straight. this group that believes the same thing as al qaeda but not adhere to al qaeda, they are going in and are so brutal, that you are reputation seeds them. the iraq -- their reputation exceeds them, they have actually taken an oil-rich area over so they have control over refinery. al-maliki has a heck of a nerve too. he immediately iced out the sunnies. he's allowed the sunnis to

say i have no choice but to align myself with this new al qaeda group who is sunni, by the way. he iced them out. why don't we have iran give airstrikes? you know who is the biggest threat right now? if you look at where iran is and see the rise of sunni militants, they are under threat. assad has given up half his country reluctantly to this same group. now they're forming their own country while we watch. >> you've got this combination. you've got the fact that the united states will not help with air support. give them some drones so they can beat back the extremists. brian, you're right. al-maliki will not include leading sunnis in his government and they are steamed and they are on the march. now it looks as if the u.s. embassy in iraq is about to be evacuated. lieutenant colonel ralph peters has been looking at this. it's not good. it is not good in an historical way. listen. >> in the middle east, the united states is now in its

weakest position since 1945 and the birth of the modern middle east. jihadis are winning because they're willing to die for their fan national cal cause. the iraqi soldiers, syrians anders -- and others are willing to die for their dictators. we are faced with the problem exacerbated by obama's dilatory incompetence, we're facing a problem that is going to plague us for many years to come. >> it was predicted when alawi won that election, he won as the runner-up of a legitimate election in iraq after we suggest we implement the surge, we did nothing to lift a finger to help broker some type of thing so al-maliki retained his job, he forms this government and that is where we are right now. this is stunning and this is aggravating but this is not unpredicted.

experts and the those in the military -- they say they're not that bad. >> people on capitol hill have questions. the president was supposed to tell us 30 days in advance. tell us about that. there was a report that the president of the united states didn't sign off on this operation. it was chuck hagel himself. why does the white house keep changing the story? first it was we had to act because he was sick. then it turns out he wasn't really sick. we had to act because he was really in danger. then he wasn't really in danger. a lot of questions. unfortunately, our secretary of defense didn't have a lot of answers. listen to this. >> have we made other trades with the taliban? >> with the taliban? i don't know. we don't know if the taliban subcontracted to the haqqani's. we don't know all the pieces. i don't know all the history of that transfer.

i'm done, essentially. here's one theory. the theory is that since he was with the u.s. chamber of commerce and the business round table supported it, and a lot of people are so upset about what wall street did to the economy that he would adhere to that -- >> i think there's a lot to that. i'm 80 miles from richmond. i live in washington, d.c. i have a lot of friends there. when i asked them about this, they said we're still angry about the bailouts and that nobody was punished, nobody went to jail here. you know, eric was kind of too connected to those business groups and big banks. he was seen as crony capitalism. i don't think that was fair but i think it is a reflection of what happened in that election. >> one reason why your book is so appropriate because people are seeing what is happening in texas and florida and seeing what is not happening in florida and in many degrees new york. they are scene one commonality, you lower the taxes, people are voting with their feet.

>> the big economic story in this country, brian, is the jobs, the people, the capital and the businesses are moving to the south. they're moving to those red states. they're moving to texas and they're moving to florida and arizona and states like that. by the way, where you live in the northeast, states like new york and new jersey and connecticut, my home state of illinois getting creamed. we're getting creamed because the jobs are moving out. you did the story last month, remember about toyota moving out of california into texas. that's happening every day. >> in your book, you chronicle the differences in what's happening right now because we don't have to examine norway and look into sweden. we have to examine and compare california and texas. you have democrats like jerry brown, governor, saying guys we've got to start getting our spending together. >> and the taxes down. if you're someone who is high income and you live in a state like california or new york with a 13% income tax, you know what's the income tax in texas and

diagnosed with cancer, so i wanted to do something. i was so fortunate to be able to work with the school and put a web cam in his classroom and one at home. you should have seen the smiles on the faces of matt and his friends on that first day we connected. and when he lost his hair, his friends could see that. his face ballooned up from the steroids. his friends were there with him, joking with him, that would help him take his minds off things. when he went back to school in the fall, his hair grew back, he was so welcomed by his pals because they were with him the whole way. i thought i've got to find a way to have his kids have the same connection. we started this charity, called it hope cam because we wanted to send a message to kids and their families that it is not a question of if you're going back to school. it's when. >> and keeping your friends close by. what did that mean to you, matt, being able to look at your buddies and them being

the legalese. from custody battles beyond state line to make sure your elderly parent isn't exploited, your fox have been pouring in and bob massi joins us right now from vegas to help answer the questions. good morning to you. >> good morning. >> first question comes from our friend irma in florida. she writes, our son is in the military. he has 50% custody of his daughter. the court prohibited the mother to move the child out of california. she left and took his daughter. what can he do? >> she's in violation of the court order. most jurisdictions in our country say that whoever has primary custody, before they

move that child out of state, there either has to be a stipulated agreement between the noncustodial parent or a court order. since that's already in the court order, what her son needs to do is get the lawyer involved as soon as possible to get that child back into the state because if -- the longer that child remains in another state, that state could get jurisdiction over that child and then it's a little more difficult to get the child back. but right now based on what they're saying in this e-mail, there is a contempt citation where a court will be very upset and also her son could most likely move for custodial rights because they're in violation of the court order. get an attorney involved right away for purposes of getting that child back under the court order. >> sure. i actually know somebody that had the same instance and that was what happened. all right. karen from alabama writes: i received a deed transferring my mother's home to her living trust. she has alzheimer's. what affect does this have on the deed and how does it impact my mom? >> i actually called karen when

i got this e-mail because i was confused of her question. i had her fax me the documents. let me look at these things. what actually happened here, karen, is that her mother and her husband transferred the property into their living trust, which is a part of an estate planning thing that you do when you create a living trust. it's called funding the trust. the fact that mom had alzheimer's, that transaction in and of itself as what was provided to me in no way hurts the mom. it's actually protecting from no probate down the line. assuming everything was down by an attorney, the transaction is legal. there is nothing to worry about at this point. so i don't think it's all ado about nothing. don't be that concerned about it, from what you provided to me at this point. >> okay. it's great you followed up with the facts. time question from john in texas: i bought my mom a house in 2008. i paid off the mortgage and can't get a release of lien from the lender. what should he do?
