tv Justice With Judge Jeanine FOX News June 15, 2014 1:00am-2:01am PDT
1:00 am
that's it for now. this is mike huckabee from l.a. goodnight and god bless. stay tuned for justice with judge jeanine. hello and welcome to justice. i'm judge jeanine pirro. breaking news tonight on the growing crisis in iraq. the pentagon today moving the air craft carrier uss george h.w. bush to the arabian gulf closer to iraq. as the president refuses to commit to any source of action. all the while isis militant forces continue to march toward the capitol of bag baghdad. more on the iraq cries s but first to my open. i spent a great deal of time over the last two years analy analyzing and criticizing what i believe are major blunders by the obama administration more interested in winning elections,
1:01 am
changing the demographics of our nation and creating a socialized state where dependency is the norm than protecting the safety and security of hard working americans. now you know me, most of the time i'm fearless. i have spent my life fighting and investigating and prosecuting and sentencing the worst of the worst. tonight, i'm worried. you may not know where places like baghdad or tehran are. but if you don't think that what happens there matters to you, you're wrong. i don't care if you live in beau mont texas, new york city or anaconda montana. you need to be afraid. because of his feckless foreign policy, president obama, a man with no foreign policy experience who doesn't learn a thing from his foreign policy
1:02 am
blunders, our nation, once the world superpower has been minimized on the world stage and is neither respected for feared. obama has proven toputin, to as ayatollah, they can cross any red line that he draws with impunity. the latest disaster, of course, the bergdahl trade of five of the worst savages. terrorists who wear their 12 years at gitmo as a badge of honor. our commander in chief has literally replenished the enemy in a time of war but not to worry -- >> these five guys are not a threat to the united states. they are a threat to the safety and security of afghanistan and
1:03 am
pakistan. >> if they are not a problem, why did you keep them in gitmo for 12 years? if they are not a problem, why was your president afraid to tell congress he was even letting them out? today, another example of obama's ineptitude. american's evacuated from baghdad as a sand of the worst barbaric terrorists marchs from the north onto baghdad to reclaim iraq. they've released prisoners and they've added thousands of fighters to their ranks as they move through the country. they are the richest terror group in existence. 5,000 citizens have fled mozal in fear of them. as they continue their march, the u.s. moves an array of aircraft carriers and destroyers into the north arabian sea and the persian golf. we spent $1 trillion.
1:04 am
the blood of 4,500 men and women. and 32,000 of us injured in iraq let obama left irrack contrary to the advice of military leaders and those like senator mccain who said he left too earl early when mccain stated on the senate floor three years ago that the decision to do a complete early pull out was dictated by politics not our national security. senator mccain said that history would judge president obama's leadership with the scorn and the disdain that it deserves. america left iraq as a state not able to stand on its own. the head of this band of savages is a man named abu al bagadi. the new obama bin laden. a man released by obama in 2009 who started isis a year later.
1:05 am
when he left buko where the worst of the worst were held in iraq. he threatened his american jailers, saying, i will see you in new york. as the nation of iraq teeters on the brink of total destruction, there is no question that the march will inevitably continue toward the west as the united states. as though out of a movie, the march of sunni militants, along with isis troops, deemed by al qaeda to be too militant are letting criminals out of jail to let to their-wsç ranks. burning choices and reheading and stoning and shooting police. even civilians from the maliki government. isis is dedicated to building an
1:06 am
islamic state but barack obama is really tuned in. >> the world is less violent than it has ever been. it is healthier than it has ever been. it is more tolerant than it has ever been. >> although there were only 800 isis soldiers against 12,000 iraqis trained by the united states, the iraqis were so fearful, they dropped their weapons. they dropped their uniforms, and they even let the bank open for blunder. now, isis has a half a billion dollars in its hands. the bottom line, the country of iraq is another burning cauldron in the middle east being overrun by those who seek to create an islamic state who considers us infidels and is dedicated to the destruction of nonbelievers.
1:07 am
yes, indeed you need to be worried. that's my open. now, earlier i spoke with senator john mccain on the iraq crisis. >> senator, i said something very bold yesterday. you said that the president should get rid of his national security team. get a new one. just tell me why you said that. i mean there had been a lot of blunders but now you've had it. you're fed up. >> it has been a complete fair failure. these are the ones that i predicted would see a collapse this iraq because we could have left troops behind. we could have left them as we did in japan. germany, bosnia. as we did in korea as a stabilizing force. i predicted when he pulled them all out that it would be doomed to failure. i predicted it three times. more than that. i think it's been an utter and total failure both in iraq and now it's going to be in afghanistan. so we need a new team. we need david petraeus.
1:08 am
we need the ones that won the war. what this administration is obscuring, we had that war won thanks to the serge and thanks to general petraeus. we blew it and we took everybody out and we didn't leave a residual force behind. that's a tragedy because we lost over 4,000 brave young americans. >> having lost those 4,000, more than 4,000 brave young americans, does that demand that we go back in this their honor or does it mean in your mind that maybe we should call -- just end it now. end our losses? >> i think the question is will these people be a threat to the united states of america? this group of isis in the estimate of our director of national intelligence will plan attacks on the united states of america. it has really almost nothing that do with the casualties. it has everything to do with the threat that they pose. we need to use air strikes. right now if we don't do
1:09 am
anything, then you will see the iranians come in and they are already in. you will see them in greater numbers if maliki feels he can not get help from the ut et cetera. he should help down in favor of a coalition government that can bring everyone together. >> the isis are the worst of the worst. even one of the extremist groups can't stand them. >> you will see the rest of my interview with senator mccain and why he thinks that the taliban trade has put america at risk later. but first, developing tonight, radical insurgents in iraq who have ever taken over several cities are now just miles from baghdad. with me fox news military analyst k analyst colonel david hunt.
1:10 am
why is this hunt happening? >> there's a couple of reasons. why isis -- 800 to up to 2,000 terrorists which you've already described own part of a 400 square miles. they've been able to get part of this in syria and they came south. what happened is this terrorist organization was able to make an army -- at least one division of iraqis to run away. because maliki who's the prime minister had fired all of the generals and the army that we spent $19 billion training. so it's a combination of isis gaining some momentum. sunni, shia, conflict and incompetence of the maliki government and a military that won't stand and fight. >> all right so now what we have is this march toward baghdad as i understand it they are about 60 miles from baghdad right now. did we know about this?
1:11 am
i mean all of a sudden it seems like the white house was caught by surprise. >> this activity started going towards baghdad taken about two weeks. however, the national intelligence community for the last year, in writing, has been warning the white house that isis is going to be trouble. they have an agenda not just in syria where they are gaining power but in iraq. the other part of this, of course is iran coming in to help making them even more inthrew int shal. >> iran because they are right next door to iraq. they see this vacuum as well so they are going in as shiites to help the maliki shiite government against the sunnis who are now aligned with isis which is the worst of the worst. >> yes. underlining this is a tribal nation. sunni, kerds, shia.
1:12 am
what we try to do is nationalize them and bring them together. in my opinion, the top third of iraq is gone. it's a question of how much more that isis will take control of before probably iran comes in to save the day. >> bombing isis or killing all of isis won't cure it. >> stick around colonel. coming up breaking news on beau bergdahl. how does the bergdahl trade effect america's security. tweet me at
1:15 am
1:16 am
your reaction to this breaking news? >> this is ridiculous and unbelievable. >> why? >> 2009 -- because 2009 sergeant -- specialist bergdahl left a note, packed his bag, walked off the base. had a cell phone. called his unit and said by the way i'm leaving. there was an investigation at that time in writing that said sergeant bergdahl left on his own accord. we have to understand if you leave the military for one day without approval, that's called absence without leave. if you are gone for 30 days, you will automatically classified as a deserter and then when you come back, there has to be a court martial and the government has to approve. the difference between desertion and peace time in war is that in war you can be shot for this. but the 30 day window is absolutely. it's an administrative term that classifies the soldier. this is ridiculous on the face of it to put a two star general in the middle of investigation that can be done -- that was done by a lieutenant back in
1:17 am
2009. >> what you're saying colonel is that statements that he made ahead of time, statements that he made after the phone call all indicate his state of mind and his intent? >> yeah. it's beyond question that he left on his own accord. i'm telling you that after that, 30 days is automatic administrative classification of desertion. why he wasn't classified up to even now is a matter of political consideration not military judicial practice or administrative prak practice this issue of two star generals investigating something that was done in 2009 is absolute crap. >> thank you. back to iraq. lindsey graham described this crisis in iraq as the next 9/11 in the maybing. how much of a threat is isis and the sunni extremists to the united states. >> isis right now is not a threat to us. it can be. if it keeps going will be.
1:18 am
as you mention they have half a billion dollars. you have to understand the issue of 9/11 was that there was a place for very bad guys called k al qaeda to train. if isis stays in iraq with the support of iran who supports hezbollah and hamas among other things then you have a country where they can train and plan. also they are the second largest oil producer, iraq in the region second only to saudi arabia. >> and with them having all of this oil, i mean, how is that going to affect our price is? how is that going to effect what happens in this country, immediate effect. behind saudi arabia, it's an immediate effect. what you have now is a group that was too nasty to be in al qaeda. who is in effect taken the top third of 400 square miles of territory in a very troubling
1:19 am
area between syria and iraq. the one winner in this is going to be out iran who is supporting assad in syria and the only way this thing gets turned around in iraq is people on the ground. it's not going to be us. we can bomb them all day if we want. it's going to be people on the ground. that's iran. >> the president talked about convening his military people to consider what options are out there. what options do you think should be considered? >> i don't think we ought owe get in the middle of this. we've spent -- as you mentioned, thousands of soldiers have been killed. thousands have been wounded in over 500,000 iraqi civilians killed and a trillion dollars spent. let this thing burn out. >> what do you say colonel to those who say maybe 4,500 americas died in vane. >> they didn't say in vane.
1:20 am
iraq is a tribal nation. bombing them into the next century will not stop sunni shiite conflict. the only way you can affect this is on the ground. air power alone will not do this. we cannot go back on the ground after the member of years we spent out of respect for the 4,800 and thousands wounds we should not be in the middle of this as we shouldn't be in syria. >> thanks so much. coming up iraq on the brink. has the president's fe
1:23 am
1:24 am
for president gw bush. ambassad ambassad ambassador james jefr ri. is iraq on the brink of total collapse. >> it is on the brink of total collapse. as you started the segment, that's something we should all worry about. >> why is this happening? >> it starts with the fact that iraq was basically an artificial creation after world war i. when we went in and we didn't go in for simple reasons, we went in because iraq had been a problem since saddam took part in 1980. when we went in this 2003 we thought that a western constitutional system could bridge the divide. in the end we were wrong. we succeeded militarily as you just heard but we didn't succeed in changing the underlying culture of that country.
1:25 am
>> i think, didn't prime minister maliki take away from the impiteous we had by literally letting go those who were sunnis that we had already trained and spent enormous amount of time and effort training as part of the police as well? isn't maliki partially responsible for this? >> oh, absolutely. he led a sectarian government and he ignored and to some degree he bullied the awaken awakenediawakeneing ara arabs. they were only reluctantly paid. many of the sunni arabs did not want to acknowledge that 80% of the country is shia. there's plenty of blame to put on every side, i'm afraid. >> you know senator mccain says that the president should fire his national security team. now you're a former deputy
1:26 am
national security advisor. what do you think of that? >> first having been one, i know how difficult it is. secondly having worked in this administration and knowing very well all of these people, i will reserve judgment. but in the end, i think this is a very important point, judge. without any doubt, the decisions being taken are those of president obama. whether you like them or don't like them or i like them or don't like them, it isn't that he's been badly advised. he's being well advised in many cases but he sees the world prap perhaps differently than mccain does and to some degree, i do. >> what's interesting is when you get someone like susan rice who says it was that video or she's saying that bergdahl served with distinction. you wonder -- i agree with you. it's ultimately the president but at the same time, you know, when his people go on and say things that are clearly not true, you have to wonder if they are in the loop themselves.
1:27 am
>> you're pursuing an interesting line of argument but as i said i've worked and know these people so i will reserve judgment at this point. >> what should obama do in iraq right now. >> okay. judge, he has two problems. one, you've shown it on the map. the colonel laid it out, we've got a growing islamic radical al qaeda off shoot state between syria and iraq. the president was right yesterday when he said we can't solve this with troops opt ground. we need the local people to rise up as happened in 2007 against al qaeda in iraq. but to do that, that requires the right government in baghdad. that requires diplomatic work in the region. all of the things the president said. we might be able to provide diplomatic assistance, pressure the maliki government or whoever comes after malyk a and provide military support and including heir support. but we can't do the job our
1:28 am
sflds. that's a longer term thing. right now these motorized columns are moving to the south and north of baghdad. they've moved out of the sunni area and they are trying to invii invade shia areas. if we don't intervene to provide air support for the iraqi army. these people will seize much of the areas. that will suck iran in. that's my fear. that's why the president needs to act. >> ambassador james jeffrey, so much for your your insight. coming up the latest

log onto fox nenews.com. >> now it's time for fast justice. the irs actually told congress they can't find an untold number of e-mails to and from the learned lois learner, a central figure in the obama political targeting scandal. the irs says her e-mails prior to 2011 are gone because her computer crashed that year? really. how come it never crashes in our favor? >> we actually have the woman at the center of one of the biggest corruption scandals in american political history who has been dodging and hiding from telling
1:34 am
the truth, answering our questions, while getting paid at the same time. and when time is up, they say, the computer crashed. now where i come from, it signalled a lot of things like tampering with evidence, destruction of evident, obstruction of justice. contempt. conspiracy and disregard for the rule of law. republicans were incensed. there needs to be an immediate investigation and forensic audit for the department of justice as well as the inspector general but i say it's time for a real prosecutor to come in. attorney general eric holder is not only in over his head but he's far too political to even care about the violation of the rights of americans if they are in his opposing political party. plus, he's really, really busy. going after the boy scouts and the little sisters of the poor.
1:35 am
>> now the rest of my interview with senator john mccain. the former pow gave his take on the bow deeau bergdahl prisoner trade. >> thanks for being with us. beau bergdahl back in texas. you were a prisoner of war. what is it like for him coming home? >> for us we had been in large group and rather than -- in solitary confinement so there was kind of a period where we were all sort of all together. i think there is obviously much more of a challenge for somebody who has gone from being by himself to return to the united states. it's very different. we were a very close-knit group of pows. we relied on each other. we restrekted our children of
1:36 am
command. >> don't you think it's unusual that there has been no contact between him and his family? >> i don't know what is transpiring there. since i don't know his mental state when he came out. obviously we would assume you would want to see your family but it's hard for me to know exactly what his mental state is. we're all glad he's home. i just -- i thought the price was too high. that's all. way high with knees taliban that are going to be back in the night and put the lives of men and women who are serving in greater danger. >> 30% as you well know go back onto the field and then we have hillary clinton saying these guys are not dangerous.
1:37 am
do you buy that. >> of course not. by the way the leader of isis was in camp buka. that was the prison camp that we ran in iraq for four years. they come out tougher. they come out harder. they come out in leadership positions because it's a badge for them to have been in guantanamo. these are mass murderer. i guarentee two will go back to the fight. these are incredibly bad, hard core people and they are dedicated to killing americans. >> senator, you are very cautious about what you say. everybody respects what you have done and what you've been through but i'm going to ask you, why do you think the president did this? i do not know accept perhaps he thought that getting completely
1:38 am
out of afghanistan and by the way we're not out of iraq but -- that this would be kind of a capstone to that. that's the only thing i can assume that that's what he must have been thinking. but i'm not sure. >> as a lawyer, what i'm thinking is -- okay. you know they are the worst of the worst. but when you piece that together with the fact that he didn't tell congress when 80 or 90 people in the house knew. that people in qatar knew not necessarily our friends in qatar. what does that tell you. >> it tells you he made a very serious blunder particularly when he didn't tell senator finestein who's chairman of the intelligence committee. that's their job. >> they knew she were going after bin laden. she didn't talk. >> i think it was a serious air
1:39 am
particularly when we know that 80 or 90 were wb within the state department. another problem is honestly that when any of us who know about this know the krend ecredential these five who were selected by the taliban, not us. it really does not hold water. in the military you are a unique profession. you put your life at risk. one of those responsibilities that's there is not to have something happen that puts the lives of your comrades in fwr t greater danger. >> coming up, new developments on the american pastor held captive in
1:43 am
well beau bergdahl is now safe at home in the united states, innocent americans are still being held overseas. the american pastor has been held in iran since 2012 because of his christian beliefs. with me now is the pastor's wife and her lawyer jordan of the american center for law and justice. all right, tell us about the latest developments with your husband this week. >> good evening, judge.
1:44 am
there was a team of religious leaders, i believe there was 30 of them that wept to iran in the end of may. we know that they discussed him and asked for clemency for him but the iranian government -- >> all right and what happened? what was the response? who did they meet with? we don't know. we know they said they met with the right person -- person. we don't know what the response was. it was a positive trip. for me and my kids, the 7-year-old and 6-year-old, it's been such an emotional roller coaster. we are hopeful this is a good sign that he will be released soon. really we've had such an emotional roller coaster of believing he will be home soon and not seeing much. tomorrow is father's day. it's a very painful day for the kids and i. in a few weeks, the end of this
1:45 am
month is our 10th year anniversary. the only way for me to get through this is really my faith. >> when you say beatings and tortures, he was in a hospital but then he came out. has he been tortured or beaten since then? >> no. he did -- he was -- i think it was last month, he was taken from a hospital and butte en pretty badly in front of his family members. his parents who were there at the hospital who were with him. his been recovering since. his parents were able to see him this last wednesday, a few days ago. he was beaten up pretty sad by. >> he was taken by the hospital and put in prison and his family visited him at the prison. >> what do you say, i'm sorry.
1:46 am
>> and his family visited him at the prison two days ago. >> i'm going to go to jordan. who are the spiritual advisors who went to iran to try to negotiate for her husband? >> the lead is pastor joe hunter. wife actually reached out to him through one of our middle east experts and have gotten some more information about the meeting. he's been very piefate about that now because he's sharing it with the white house. it's joel hunter. he is close to president obama. he has given players at the inauguration. he is someone -- it seems like the state department blessed this because it's good news because we needed more from our government. i it tell you over the next two weeks, the state department is currently reengaging this. i don't know if it took him being reasefrrested but certain there is something better happening. >> are you saying the white
1:47 am
house is sending the spiritual advisor to negotiate. >> the state department did say they blessed a release. they do bless these kinds of efforts by members of religious faiths to try and bring dialogue. it was something they had no clue about. whether they directed the pastor to do this but they gave their blessing. as we are trying to get our government and hoping their renewed engagement by voice has led to these renewed efforts to actively get him back from a very key day, july 20th. that's when the nuclear deal is supposed to get done. that could get extended. if we're on that schedule. i think you guys for coughing this. >> jordan, wouldn't you agree that it's up to the president if we're going to try to negotiate for nuclear considerations and
1:48 am
not a religious leader who should be making these requests? >> what i'm hoping is that they are getting a tone. a sense. this is my hopes and prayers. when they get down to the negotiating table in the final month here, that they actually put something together because ultimately what our state department, the white house has to do is say, no deal even if they've got everything done until this american is home. >> thanks so much. coming up, the former gitmo interriggator on who could be released next. how does the trade and the how does the trade and the crisis in iraq effect
