about including a change in iraq. >> this morning president obama is going to make the case for sending special forces to iraq when he meets with leaders today. this is a magnificent change. originally he said no boots on the ground. now the thought of having them there seems to be entering his mind. he's going to apparently take a consensus. >> he's going to sit down with harry and with man is i and with john and with mitch as well. and what he's going to do is reportedly, according to major garrett at cbs, it isn't a pre-program thing. he's going to try to come to some sort of consensus which is going to be tough because nancy pelosi herself has said boots on the ground? absolutely not. now he's going to say we've got to do it because otherwise you can't order airstrikes with any effectiveness. >> security? that's one of the reasons. number two, find out firsthand what is going on other there. i guess we actually really is no one there. i was hoping it was a wink

and a nod we have no one there. we actually don't have any, which is astounding to me. i know presidents need a break, but the president had a couple of fund-raisers and played golf over the weekend. he had three fund-raisers yesterday and on wednesday gets around to a consensus meeting on a way forward in iraq. this should have been this weekend. this should have been friday. i'm sorry u.c. irvine, i cannot be your commencement speaker. this is an emergency. i'm sorry whoever i'm supposed to golf with out in the desert. i can't do it. i'm president. >> it was said al qaeda was on its heels and dealing with this from behind instead of aggressively in the front. >> he boxed himself in. he said no boots on the ground. now he's going to say okay, maybe boots on the ground. interestingly enough, hillary clinton weighed in on a myriad of topics. >> look at all those cities where isis is, where they traveled and where they're heading. today as we start our show, we understand they're going into a city where the refinery is over in baiji.

they have 75% of that city. a lot of people say how are they going to keep the economy going in that region long term? you have a refinery 75% and you have a way of revenue along with humvees and tanks. >> i've seen another tank where baghdad is surrounded on three sides by the isis forces. it is much more bleak. now it looks like they're going to act but how soon they are going to get there, don't know. >> bret baier and greta van susteren did a fantastic job to sit down with secretary clinton. she went through some things which may help the situation in iraq, one of them separated a bit from what the president has been saying. she actually said mall can i should not be -- maliki should not be in charge there. doing a bad job. here are her comments. >> are we losing all the gains in iraq as well? >> too soon to tell. i think if we can persuade or basically bargain with

al-maliki so he does what we've been trying to get him to do, with an inclusive government -- >> put us in bed with iran? >> i'm not in favor with any formal negotiations with or agreements with iran at this time. if there's going to be a real stand against these extremists who are worse than even being reported publicly in terms of what they're doing and how they behave, then there has to be a different government. and i don't think maliki is the person to lead iraq. >> the problem is he was elected. we did nothing as alawi got more votes, somebody we could do a deal with and then maliki went into iran and said al-sadr, why don't you come over here, bring your people and we can form a government. that is because we did nothing for nine months and the country was in deadlock. two years later we have this mess. the good news is the mostly

shia army we have armed and trained is beginning to so call man up. they are beginning to mount some type of defense around baghdad. at least they are going to stand up for themselves before they give away all the stuff we gave them. >> during the course of the interview there was some sort of, i believe, tone that kind of went over where perhaps looking at 2016 hillary clinton was backing away from some of the things obama has advised throughout the administration so far. she had the if i were president question tossed at her particularly as it relates to khattalah and what is going to happen here, as we look at benghazi and mistakes that were made she went back with really no answers. she didn't remember meeting with panetta. >> mr. khattalah is the fellow who it was announced yesterday the president finally gave the green light, let's go get the guy. that's him right there. he's apparently on the u.s.s. new york at this hour somewhere in the

mediterranean. he's going to be taken to washington, d.c. he's supposedly the ringleader of the benghazi thing. he also has been hiding in plain sight. how many reporters have actually gone out and talked to him? the reporters could have done a citizens arrest and we could have had this done two years ago. >> we were waiting for the go sign. we had this guy lined up. we practiced at fort bragg. they didn't get the go sign i believe until friday. >> that's right. the president gave the go on that and the delta force got in there showing courage and precision getting him after four americans were killed in benghazi. our spwar -- ambassador chris stevens one of them. so many questions swarmed around that and now there is an investigation into the lives that were lost. when you see this being being transported here and wondering is he going to get this trial, she said if i were president, i'd make the call to go get him and i'd give him a trial.

tell me what you think of this. >> if i were president and the f.b.i. and the justice department and our law enforcement came and said we're finally ready, mr. or madam president, to go and capture and detain this terrorist, and we have enough evidence to successfully prosecute him in our courts which have proven very successful at prosecuting terrorists, i would say i'm ready to give the order. >> i like the little madam president part right there. we should point out a lot of republicans say this is exactly the wrong way to do it. he shouldn't be taken to a federal courthouse in washington, d.c. he should be hauled down to gitmo could interrogate him and keep him. but a national security council spokesperson said since day one of the obama administration, not one additional person has been added to gitmo and we're not going to take anybody else down there right now. >> let's talk about the i.r.s. you're not going to believe this. as you know, lois lerner lost all her e-mail. her computer crashed. she tried banging it on the

side and restarting it up. >> right after she said i'm having technical difficulties. >> she can't say that out loud because she took the fifth. for two years we don't have e-mails. the good news is it is not just lois that lost her e-mails. six other high-ranking i.r.s. officials have had their e-mails disappear. what an insult that is to logic and our intelligence for the i.r.s. defense to be i lost my e-mails. it seems as though from cnn to ron fortier on the national journal, even they are beginning to say this is ridiculous. >> the i.r.s. either has the world's worst i.t. department -- it crashed and everything is gone, it is kind of a 2001 problem. that is not a 2011 problem. everything is backed up left and right. they either have the world's worst i.t. department or else there has been data destruction across the board which means if it's caught people will go to prison. darrell issa, who is going

i'll take that change any day. the first legal induction took place last night since that one that happened a few months ago that was botched. last night georgia executes a georgia inmate after the supreme court refuses to block it. the court denied a last-minute appeal for marcus wellan convicted of the 1989 rape and murder of a teenager in atlanta. his death sentence was carried out by legal injection. one day after rare twin tornadoes ripping through nebraska, it has happened once again and take a look at this incredible new video coming in to fox. >> that is violent. yeah, very violent. holy cow! >> holy cow indeed. this tornado hitting about 45 miles north of pilger, nebraska. 75% of that town has now been demolished. look at those pictures. total devastation. the winds in that community reaching speeds of 200 miles per hour.

benghazi whistle-blower gregory hicks of the u.s. state department. good morning. they had known where he was. we interviewed him. everybody's interviewed him. >> right. you know what this reminds me of? you remember that movie "wag the dog" where right before the election the president is caught having an affair with a younger woman -- imagine that -- and in order to distract people he wages a phony war? well, this is the distraction. this is the wag the dog. you've got the d.a., you've got the i.r.s. but most importantly you have the benghazi special committee. i don't think it's any coincidence that around about the time the benghazi special committee was announced was when the president gave the okay for this to go ahead. this didn't just happen over the weekend. this was several weeks ago in the making. >> this would be after a string of long and bad news, this would be an easy win for the administration? >> it was in the bag. you know, he knew that his indulgence, add --

adulating, adoring press would go along with it. "the washington post" this morning calls it a major victory. it's not victory unless we know what kind of intelligence we got and unless there is a conviction. unfortunately, i'm having to say that because that's the posture that they have put us in. it surprised me, steve, that they put it, this case in the d.c. court. usually, as you well know, they go to northern virginia where the juries are a bit more reliable. but those d.c. juries, you never know how a d.c. jury is going to go because i practice there. they put them there and there's all kinds of procedural issues, like the brady rule. if you're a bank robber and they accused you of being in the bank robbing there and you say i wasn't there, you get to call all the witnesses that were in the

bank. >> victoria, it is curious why they're sending him there. meanwhile last night hillary was asked about her responsibility regarding benghazi and she said this. >> i took responsibility for being at the head of the state department at that time. that doesn't mean that i made every decision, because i obviously did not. and it also means that as a leader, i have a responsibility to try to figure out what happened and then to put into place changes that will prevent anything like that from happening again. >> and you write in the "wall street journal" today that she says she didn't make any real security decisions on benghazi, but that really is her job? >> well, by law, it is her job. there is a 1999 law that says that the secretary of state is required to make certain security decisions about certain embassies, not all 270 as she likes to say, but vulnerable embassies like benghazi.

the state department has a whole lot of security rules but two of them that are applicable here is that everybody is supposed to be housed in the same building and the building is supposed to have a 100-foot set-back from the public. so if it doesn't meet those requirements, the secretary of state personally by law has to make that decision and cannot delegate it to anyone else. and do you know why that law was passed, steve? the 1999, it was right after the 1998 bombings. >> during the administration of william jefferson clinton. who curious is that? -- how curious is that? it is all laid out in your "wall street journal" op-ed. victoria toensing, thank you very much. did you see this? >> winds are going to be with us. whoa. oh my gosh. this is live on air. >> a meteorologist rocked

quick headlines now. actor michael j. spice facing a judge on murder charges today. he is expected to enter a plea in his wife's shooting death. police say he shot his wife in the family home while his children were in the room. remember the new jersey teen who sued her parents. she graduateed from high school. 18-year-old rachel cannon claimed neglect and abuse but dropped the suit and moved back with her parents. now she is headed to college on a $56,000 scholarship. we shall overcome.

>> an oklahoma city meteorologist proving the show must go on. >> winds are going to be with us. whoa! oh my gosh! i'm so sorry. this is live on air. that was way bigger than what we just saw earlier. that was well over 4.0 -- >> the 4.3 magnitude earthquake that struck live on earth was one of 20 quakes to hit the state in the past week. >> and there aren't even any major fault lines in the area. only small ones. so what's going on? let's talk to maria molina here to explain the phenomenon. i remember growing up in kansas, there would be random wild earthquakes, tiny little ones. but to have so many in oklahoma right now, what are some of the theories? >> there are several theories going around because no one really knows what's happening underground. no one knows why these earthquakes are happening. but the big concern out here in oklahoma is that there have been so many earthquakes recently and

scientists believe that when there are a lot of small earthquakes that could be a precursor to a very large one and potentially very damaging. so this is a very big concern. the first theory -- and this is the most liveliest one -- is waste water injections from fracking. it is not the actual fracking that could be potentially causing these earthquakes but scientists believes waste water injections could be creating some friction or loosening things underground and that could be creating tension and some of these earthquakes. >> the fracking people say that's not true. >> of course. they're not going to agree with it because they don't want that to be true. another big concern i have with that theory is that's just too simplified. that doesn't really explain a lot that's going on underground. it is a lot more complicated than just these injections. but the big concern why scie be true is the recent spike in earthquakes has correlated with the recent spike in fracking. >> they pump a lot of oil

from under the ground in oklahoma. but it can also be creating a void under there. that's my point. >> that's a good theory. >> you're getting your masters in climate change. the second theory is what? >> underground aquifers, underground lakes that are in place. it doesn't really have so much to do with climate change or anything like that but it's just the belief that water is very heavy. we know that. that's a fact. if a lot of heavy rain comes down and fills up these aquifers, the weight of water is great. that could be creating pressure under ground and potentially start creating some of these smaller earthquakes and then there's the last theory, this liberty lake, the small lake but a lot of earthquakes recently have been centered around it. so people are wondering if maybe the water levels of this lake and all the weight of the water could

that dog watching. meanwhile, just this morning, isis taking control of a lot of iraq's largest oil refinery area, this as oil prices are up to nearly $107 a barrel. >> with no end in sight to the violence there what does this mean to your wallet? stuart varney to weigh in on that. this is hitting americans right tphe pocket right at the pump. >> already. the bottom line is you are paying for the president's policy failures in iraq. the price of oil up again this morning. the price of gasoline up a little bit this morning. triple a says watch out. because of iraq, the price of gas will rise at the pump. you're going to have to pay that. private analysts say you're going to get a ten cent per gallon rise in the price of gas that you pay at the pump because of what's

happening in iraq. you're close to $4 in new york and illinois and other big-population states. you're already very close to half the country, half the population paying $4 a gallon and it's rising. >> keep in mind when president obama took office i believe it was $1.85 a gallon. >> that is correct. >> nothing has really happened. we haven't slowed down. the barrels haven't stopped. this is all projected impact. >> it's fear of what's going to happen in the future. you've got this oil refinery taken over by the jihaddists. you've got pressure on the iraqi oil fields coming from iran. that means you've got the expectation of a cutoff in supplies, so the expectation that prices will rise some more. so they do. that's what you've got. >> now the president announced, apparently, according to cbs, apparently, the president is thinking about boots on the ground maybe to help protect the oil refineries. >> june, prices ordinarily go down. >> prices go down but not

on his personality. >> are entitlements and other government lift up black americans actually doing more harm than good? our next guest says absolutely. here to explain is fox news contributor jason riley who wrote a book called "please stop helping us: how liberals make it harder for blacks to succeed." what do you mean stop helping us? >> i think what blacks need to develop as a group are certain habits, certain traits, certain sensibilities and attitude. to the extent a government program however well intentioned undermined that self development it does more harm than good. >> what proof do you have? >> look at the unemployment rate of blacks which has been double -- >> let's look at it together. right now as of may it's 11.5% for black americans as opposed to the national average of 6.3%. >> one of the methods by the government used to try and close that gap has been the minimum-wage law. but the minimum-wage law

disproportionately harms blacks by pricing them out of the labor market. >> what do you mean by that? >> to the extent you make it more expensive to hire people, fewer people get hired. the minimum-wage laws are sold as an antipoverty measure but most poor people already make more than the minimum wage and most people who make the minimum wage aren't poor. people who are poor are poor because they don't have a job. not because the job they currently have pays too little. >> but in society people will say you know what? we need affirmative action because too many white people weren't hiring black people. we had to put things like that in there. >> the black unemployment rate and labor participation rate used to be much closer to whites before we started implementing things like minimum-wage laws. it's just not true. at a time when there was much more rampant racism in the world, the 30's, 40's and 50's, black unemployment and white unemployment was quite similar. today it is more than double among blacks. >> it's not unusual for an

employer to say i need a criminal background check. let's look into that. how does that not balance the playing field? >> when you limit the amount of information an employer can have about a prospective hire, the employer is forced to act based on generalities, paint with a very broad brush. if they know most blacks in their neighborhoods are committing most of the crimes and they can't check out a black applicant they are more likely not to hire any blacks at all. if you let them do the background check and find out if this particular black fits that profile they are more likely to hire the black. >> let's talk about the way we do in our society. a lot of people say jason is doing well and he doesn't understand what other african-americans are going through. have you come against racism in your life? >> sure. i think you'd be hard pressed to find a black who hasn't or a jewish person who hasn't experienced antisemitism. there are plenty of biases.

the question is whether these biases prevent economic or social advancement in america. i think it is not true that they do. i think the left uses racism as an all-purpose excuse for bad black behavior in essence. what i think blacks need to do is focus on themselves. only blacks can help blacks succeed. that's the point of the book. to the extent, again, the government interferes with the black self-development that needs to take place, that other groups have had to do in order for them to rise from poverty to prosperity, to the extent that gets interfered with it does more harm than good. >> you talk about soft on crime laws, how that has a boomerang effect. >> black on black crime is most crime. to the extent we have tough on crime laws, you are helping blacks. back in the 1990's we had 2,000 murders a year, 70% or 80% of them were black. a couple of years ago that within the down to 400. or the high 300. those are tens of thousands of black lives that were

between when we captured him and when we give him full up miranda rights. look, this may betray my background, but as far as i'm concerned, this is all about the intelligence. what can we learn from this man? >> you'd like to see him go to gitmo? >> as a first order, i don't see a problem sending him there. but actually, i should be careful here. there may be a legal issue. on what grounds do we send him to gitmo? does he come under the definition of the enemy that we're still using in the authorization for the use of military force? those folks responsible for 9-11 and those who support them. that law, that thread is getting very, very thin now. it's a happy day, we got him. >> hopefully we have the right guy and we get the other guys 'cause it wasn't just one man. in 2008, you said al-qaeda was on the verge of a strategic defeat in iraq. here we are in 2014, can you say the same thing? >> oh, god no. in fact, the situation is

reversed. frankly, brian, i don't think i'd want to claim to undo my statement in 2008. i think it was true then. it's just not true now. lots of things have happened. we've left. we no longer had that powerful kind of terrorism arm there. we no longer have a shaping effect on the actions of al-maliki, the prime minister of iraq and probably most important, you got a raging terrorist sanctuary just west of iraq now in syria. all of that turned the trend line around there, unfortunately. >> how do we get iraq back? >> well, i think the first thing i'd suggest to you, brian, is quit talking about iraq. i don't think that country exists anymore. it's certainly not going to exist in the future. this is a fracturing of several states. iraq, syria and very likely and very unfortunately lebanon all created about 100 years ago. there are now three entities in iraq. kurdistan, which really does want to be a friend to the

united states and we should take advantage of that, a sunni stand that now straddles the old border between syria and iraq, then the remnants of the iraqi state, which i'll call shiastan. i think we need to operate under that principle because there is no way, i believe, that the central iraqi government is getting all that territory back. >> powerful statements. as a former c.i.a. director, if someone asks you to define our enemy, who is our enemy now? >> right now the enemy is isis, that terrorist group that's taken over that state i described for you. those are the ones who will cause harm to our friends and potentially eventually cause harm to the united states. so to a first order, that's the group we need to put a cap on. brian, not unlike the way we capped al-qaeda prime in the afghan-pakistan border area.

>> what would you like to see emerge from the president's meeting with his elected officials today? he wants to try to get a consensus on a way forward in iraq. what would be general hayden's way forward? >> marginal support to the maliki government. not to make it able to regain all that lost territory, but to stabilize the current line so that you mentioned, brian, that oil refinery, that's got to be within their control. so some modest help for them, but we can not turn into an enemy of the sunnies of iraq. secondly, i think we ought to get up close and personal with the kurds and frankly, take their offer to allow a long-term security presence there from which we can shape regional events and again, perhaps keep a cap on isis. >> general michael hayden, powerful statement. great analysis. thanks so much. >> thank you. coming up straight ahead, the feds flying illegals from state to state and it's all on

good morning to you. >> good morning. thanks for having me. >> the word is apparently the white house is considering among the options for iraq were it's a desperate situation, to send in some special forces. i know in the past he had said no boots on the ground. this would be boots on the ground. what do you think? >> they're not combat troops. i think that's a big significant difference there. i think he's weighing air strikes versus this option. i do think what i've said all along and i think the president has come out to say this, they need a regional strategy with their allies to get the sunnies and shiites together against the extremists. maliki has totally blown the situation by failing to include the sunni tribes ever since we left in 2011. the president of the united states failed to negotiate a status of forces agreement which i believe has put us in this very situation that we're in today. we wouldn't have had that had he been able to negotiate that. looking forward to afghanistan, that will be very important.

but having said that, i think action does need to be taken. these extremists, as you have heard, they are very dangerous. al-qaeda itself has renounced them because they are so brutal and so vicious. and they are the biggest threat in my judgment, to the homeland as they operate out of iraq and syria. there is a vacuum created now that's being filled by al-qaeda and now you have iran looking to the south where the shia -- which potentially could be a power grab as well. >> the peril with us doing air strikes going forward is the fact that the bad guys over the last week or so have captured a couple of weapons depots. they've got stinger missiles. they've got humvees. they've got ak 47s. they've got all of our good weapons. >> they have all our stuff. they have half a billion dollars in cash infused into them. they're recruiting. you can imagine how that works for recruiting. they released the prisons that are all basically jihaddists,

they're joining now isis. so this is a very volatile, dangerous situation that demands immediate action. i've said before instead of going out to play golf and palm springs in california and have a fund-raiser, he should have been with the top advisors, not just his team giving him political advice, but the commanders and i think the diplomats who won the iraq war, who had the best advice, the people i talked to, like ambassador crocker and some of the senior military officials. >> sure. meanwhile, let's switch gears for just a minute. it was announced yesterday congressman, that abu khattala, regarded as one of the masterminds on the attack in benghazi, libya on september 11, 2012, he has been captured by delta force. he's currentsly on the uss new york somewhere in the mediterranean heading to washington, d.c it is kind of curious timing, some in washington have said. you know, we've known where this guy has been all along.

bunch of news operations, including fox, have talked to him in open. why do you think they grabbed him now? >> well, first let me say this is very positive development in the benghazi case. i think as with any terrorist you capture, you can get great intelligence. i would say the intelligence gathering far outweighs a criminal prosecution. i would prefer to see him go to guantanamo bay. this war is not over and yet, we're seeing a reversion back to the clinton administration where we're treating terrorists as criminal defendants. the timing is interesting. the indictment, as i understand, was filed in july of last year. why it's taken almost two years to apprehend him when we had cnn interviewing him in a cafe. we had fox news interviewing him. we had the "new york times." he was really out in the open. i don't understand why it took so long to apprehend him. but that's one of those questions that remains unanswered to this point in time. >> to your point, the most
