imploding. that has now gone viral. you can check it out on facebook.com/megynkelly if you want to see it. we've also posted an update on the justina peletier case. see you tomorrow night. welcome to "hannity," and this is a fox news alert. militants still on the move in iraq, clashing with forces at the country's main oil refinery, reportedly seizing about 70% of the facility. iraqi security forces are saying they stopped the insurgents and also regained partial control of the city of talifar, which isis took over last week. iraqi prime minister al maliki said the government has launched its counteroffensive and he vowed to teach the insurgents a lesson. joining us now, sky news reporter sam kylie. sam? >> reporter: the government of nuri al maliki has appealed to united states for the support

for its troops on the ground from united states air power. that inevitably on a tactical level will mean the deployment, albeit covertly, of american special forces to call that power in. they could ultimately find themselves working alongside not only shia militia, but shia militia augmented by the guard sent in by tray reheran. that's going to be very difficult for the obama administration to control in terms of the republican and democrat response to a long standing third party. but nonetheless, i think the tactical threat of air strikes coming from the united states could at this stage start to drive back the sunni insurgency. the important thing is -- and this is a critical matter for the central government, there isn't a lot of time for them. their calculation is that they need to be able to start pushing back this insurgency, pushing

back isis before other sunni militia who have been sitting on the fence, who reject the ideology of isis, start thinking they look like they might win and therefore need to throw their lot in and become part of a wider sunni revolution against the shia dominated government of nuri al maliki. he, of course, is also under pressure to try to throw his arm around sunni groups and bring them into the government to prevent just that revolution, but ultimately, the real question is why is it that his army collapsed so quickly, and the answer lies probably and certainly in the view of many people in baghdad with two things. collaboration and corruption. and there is already evidence emerging quite rapidly from isis itself that members of the former bath party administration of saddam hussein, senior officers are actually orchestrating the isis campaign, and that may explain its meticulous planning that's emerged in the recent report, the annual report published by isis, which looks like the

brochure for large multi-national. in many ways, this is an intended brochure to recruit people internationally, try and drive funds towards them, but also reveals that they do have strategic intent. >> sam kiley in baghdad. while the crisis appears to be getting more serious every day, president obama met with congressional leaders in washington earlier this afternoon to discuss possible u.s. involvement. ed henry is standing by with the details of that meeting. 100 special forces. is it too little too late? ed. >> reporter: that is one of the options the president is weighing. i can tell you the situation is getting more tense in the persian gulf tonight. fox has confirmed the u.s. military is using fa-18 fighter jets to launch surveillance missions over iraq. these are very loud attack planes, so this is meant to send a message to the extremists on the ground about potential -- and i stress potential u.s. military action. it comes, as you mentioned, as president obama late today huddled here with congressional

leaders to discuss his next move, amid great uncertainty about what he will do. white house aides acknowledged today he may end up deciding not to take any military action, that basically everything is still on the table. every single option. to do nothing or potentially to do air strikes, do the use of 100 u.s. special forces that you mentioned for training and security. the other issue is that republicans today teed off on reports suggesting the president may rule out u.s. air strikes. republicans say that's the only way to help the iraqi prime minister deal with these extremists while the democratic leader harry reid said he believes his party has little appetite for any action at all. listen. >> give me a scenario where political reconciliation in baghdad has a snowball's chance in hell of succeeding as long as they're losing on the battlefield. >> the iraq war. now so eager to offer their

expert analysis, i now say thanks, but no, thanks. unfortunately, we already tried it your way and it was the biggest foreign policy blunder in the history of the country. >> now, that caution comes as iraq's largest oil field today went up in flames. exxon mobil decided to start evacuating their personnel from iraq. the senate republican leader mitch mcconnell, before this meeting, was demanding a plan from the president about the way forward in iraq. he left the meeting saying that the president is still formulating a strategy in iraq, which suggests that he's still putting the pieces together, and has not made any decision, sean. >> all right, thank you. as you just mentioned, fox news can confirm tonight that the u.s. is flying f-18 surveillance missions over iraq. for more details, we turn to our very over jennifer griffin, she's standing by tonight at the pentagon. jennifer. >> reporter: pentagon officials confirm the u.s. is now flying f-18 fighter jets over iraq to gather intelligence and surveillance. we've just received this video

from the navy showing the planes launching. it's important to note that f-18s are not a traditional surveillance aircraft. they are attack aircraft. and they make a lot of noise. as one u.s. official put it to me, it's not so much about looking as it is about being seen, a show of force, if you will. the uss bush aircraft carrier group was moved into position in the persian gulf this weekend. general martin dempsey was on capitol hill today where he revealed that the u.s. was already flying manned flights in iraqi air space. >> you know, we've maneuvered a great deal of both manned and unmanned isr to try to gain clarity on what exactly is occurring. >> the iraqi government has asked for u.s. air strikes to help stave off attacks by the sunni insurgency and isis. f-18s can carry up to six 1,000-pound bombs and a 500-pound bomb general david petraeus, the former top commander in iraq, weighed in

for the first time today, urging caution while speaking in london. "this cannot be the united states being the air force for shia militias, or a shia or sunni arab fight." meanwhile, the pentagon has drawn up a list of possible targets, which is fluid and being revised as we speak. the decision whether to strike rests with the president, sean. >> all right, jennifer, thank you. and as the situation in iraq continues to spiral out of control, liberals are very quick to come to president obama's defense. but let's go back in history. the real question tonight is how did we get to this point where all the gains in iraq had been lost in a matter of weeks? now, remember, prior to the iraq war in 2003, democrats were extremely vocal in recognizing this reality. that saddam hussein was, indeed, a threat. you may remember this. >> intelligence reports show that saddam hussein has worked to rebuild his chemical and biological weapons stock, his

missile delivery capability, and his nuclear program. he has also given aid, comfort, and sanctuary to terrorists, including al qaeda members. >> he may even miscalculate and slide these weapons off to terrorist groups that invite them to be a surrogate to use them against the united states. >> saddam hussein in effect has thumbed his nose at the world community, and i think that the president has been pushing this in the right sanction. >> good old senator harry reid, he keeps trying to rewrite history. the tape we just played proves that liberals helped get america into this iraq war. most of them voted for the authorization of the use of force. but you wouldn't know it by listening to them today. watch this. >> president obama and his advisers consider options to combat this. concerned members of congress -- i should say republican members of congress and their pundit cheerleaders are more interested in playing their favorite game, favorite game, blame obama.

doesn't matter what it is. it's his fault. >> guess what -- it is his fault. what you're seeing happening today, right now is a perfect example of how the administration let terrorism advance resulting in what is now a lost war. when the situation gets tough, we saw this. democrats, they retreated. they turned to politics, and what you're about to see is the party of the left, they ll do and say anything about this nation, but by the way, also our brave troops, regardless of the negative impact, that rhetoric has both at home and abroad. here's what i mean. >> there's no reason, bob, that young american soldiers need to be going into the homes of iraqis in the dead of night terrorizing kids and children, you know, women. >> as long as we follow the president's path in iraq, the war is lost. >> this war must end. the american people have lost faith in the president's conduct of the war. >> the american people have spoken. the congress has voted as of today to end this war.

>> there's no military solution to this. we've got to have a political solution. begin a phased withdrawal. and make certain that we've got benchmarks in place so that the iraqi people can make a determination about how they want to move forward. >> that is the type of language that takes winning off the table, and in this case helped diminish public support for the iraq war. this is flot the first time that we've seen the left and liberals use downright reckless rhetoric against america and our brave men and women in uniform. remember, what this future secretary of state once accused his fellow soldiers of doing. take a look. >> they personally raped, cut off ears, taped wires from phones to human genitals and turned up the power, randomly shot at civilians, razed vill e villages. >> that wasn't true, nor was it true when john kerry accused our

men of killing women and children in the dead of night. they dug in their heels, said it wouldn't work. then senator obama put out a statement in january 2007, it read, "i cannot in good conscience summit this plan." well, he was wrong because less than a year later, statistics proved that the surge not only worked, but it won the war. according to the american forces press service, the overall number of attacks in iraq, that was down 55%. civilian deaths in baghdad were down a staggering 75%. casualties among iraqi security force, that was down 40%. plain and simple, the surge that obama didn't support worked. the numbers do not lie. but even after this incredible turnaround, the left, they still couldn't admit that the surge worked. and in particular, president obama. back when he was campaigning to be commander in chief, he was out there crisscrossing the country, promising this. >> iraq is not going to be a perfect place. i will give our military a new mission on my first day in office. ending this war.

i want iraqis to take responsibility for their own future. and to reach the political accommodation necessary for long-term stability. that is victory. that is success. that's what is best for iraq. that is what is best for america. and that's why i will end this war as president. >> now we lost the war. the insurgency is back in charge. obama cared more about his political ambitions than he did about iraq's future and many warned what would happen if we pulled out of that country too soon. you might remember this. >> begin withdrawing before our commanders tell us we are ready would be dangerous. for iraq, for the region, and for the united states. it would mean surrendering the future of iraq to al qaeda. it would mean that we would be risking mass killings on a horrific scale. >> you could see in the shia south, the iranians reaching over and grabbing to take power.

you could see in the sunni northwest the al qaeda folks taking power and taking leadership in that area and establishing a base for terror that could be awful for us for many, many years indeed. >> they were right. and the chaos we now see in iraq can be attributed directly to our current commander in chief's decision, not george w. bush. a terrorist state has now been reborn. >> the fighting today is fierce. and ever closer to baghdad. each mark on the map now under control of the militant terror group. >> iraq's biggest oil refinery has been shut down over security concerns, as islamic militants continue to capture new territory. >> security officials tell nbc news the militants' next target may likely be baghdad airport. >> and today, city after city is now falling to the radical islamic group isis. air strikes will be meaningless if we won't fight to win, and if we're not going to fight to win,

welcome back to "hannity." as chaos erupts around the globe and illegals continue to pour over the southern border, each day we see more and more examples of how the administration is completely clueless, incapable of governing. joining us now, marco rubio. good to see you. >> thanks for having me back. >> i assume you saw the poll that came out where now we have a majority of americans, 54%, say the president is incapable of leading the country. what's your reaction to that? >> well, i think -- i saw a commentator today say that these polls they reflected with the obama presidency is over. i agree with that. i think it is in general. obviously he still has responsibilities that i hope he'll live up to. but whether it's foreign policy

or the issue on the border of the v.a. or the irs losing its e-mails or benghazi before that, it seems like every day now, every other day, there's a new crisis. almost like we're overwhelmed by the number of crisis and conflicts arising as a result of the incompetence and in some instances the design of this administration. >> i'm looking at the situation in iraq and here's what i see. what i just tried to lay out in the last segment is very simply this. they made the case for saddam hussein having weapons of mass destruction. everybody on the left, almost everybody, they voted for the authorization and the use of force. things got difficult. they turned it into politics. as a result, george bush kind of went it alone on the surge and he took a beating for it, and now the country city by city has fallen into the hands of radical islamists. now they're talking about 100 special forces, maybe pinprick stripes. is that a good idea? >> here's the problem. this is not about nation building in iraq. i hear people say that. harry reid went to the senate

floor and said let iraqis take care of their own problem, it's none of our business. that misses the point. this is about the national security of the united states, because 9/11 would have never been possible unless the taliban gave al qaeda an operating space to plot that attack against us. what this group wants to do now, isil, they want to create an islamic caliphate in portions of syria and iraq and from there they will carry out their plan to attack the u.s. and ultimately to try to destroy israel. we cannot allow that to happen. because it is a direct national security threat. i want this president to lead. it's a national security issue. this should not be a partisan issue. but like every other issue, he has no plans. he is not coming for the american people and saying here's why this matters, here's what we want to do. >> the surge worked, we had 4,000 americans die, and in just a few week period of time, city after city after city in iraq is falling. and the president's talking about maybe 100 special forces.

>> first of all, if there was a residual american force, a lot of this would not have happened. we have to do the best we can to cut off the supply lines from syria into iraq. that's how isil is growing. these are not iraqis. many are foreign fighters, including some from america and from europe. one from florida who actually detonated a suicide vest two weeks ago. they are pouring in into iraq and that's why they're carrying out these advances. we have to cut off these supply lines. >> so you're saying we've got to reengage in iraq. does that mean in your mind boots on the ground? >> first of all, i don't think the president should be ruling things out even if he never intends to send a single american back. i don't take that lightly, nor am i calling for that. but you don't start by telling terrorists, here's what we're not going to do. but second, i think we need to use american power, primarily air power and targeted missile strikes to wipe out the isil advance, particularly these supply routes that they now have

in place. again, this is not about saving maliki. this is about preventing these guys from setting up a caliphate that they're going to use to attack us here in the united states. >> it's also like a cancer. it will spread. it will spread to jordan. it will spread to lebanon, to turkey. then you've got the syrian iraqi connection. then you've got this other, the president and john kerry talking about getting into bed with the iranians is unbelievable. does this whole thing not highlight the need for energy independence and the need to control our nation's borders? to me, this -- >> yeah, first of all, it does. energy independence is important. certainly not just for economic growth, but for geopolitical reasons, but even beyond that, this matters because we can never again allow a radical terrorist group linked to al qaeda or anyone for that matter to set up safe havens from which they can carry out attacks against america. 9/11 may have never happened if al qaeda didn't have a safe harbor and a safe haven in afghanistan. we can't allow that to happen again. we just can't. american lives are put at risk by this.

a fox news alert. in the wake of a capture of the suspect linked to the benghazi terror attack that left four americans dead, and as officials prepare to try him in u.s. federal court, the debate about prisoners at gitmo being transferred to the u.s. judicial system has been reopened. we're on the ground tonight in gitmo with the very latest. katherine. >> reporter: the decision to spend abu khattala to federal courts is more evidence president obama is determined to close the detention camps and the extreme steps the administration is willing to take to avoid guantanamo. >> the fact that this administration has really been circumventing that process, putting them on ships, submarines, places like that for a temporary interrogation instead of a full interrogation, that's dangerous. >> reporter: khattala is being held on the uss new york and he's now a detainee which means he can be questioned but none of the intelligence can be used

against him, and he is at least the second operative picked up by the obama administration, held at sea and transferred to federal court. while military forces say the capture took 32 minutes just outside benghazi, if he stops talking, the administration will have to choose between sailing around in the atlantic or reading him his rights. >> we've seen this movie twice before in the obama administration. we saw it happen in 2011 and then we saw it with osama bin laden's son-in-law in 2013. although he one on the ship very long. >> reporter: a counterterrorism force describes khattala as the muscle on the ground during the benghazi assault and it could take considerable time to gain his trust. >> a type of guy that could take a while to figure out exactly who he knows and how this attack came together. >> reporter: khattala is not described to fox news as the brains behind the assault, but congressional forces who have investigated benghazi saying it was an al qaeda-led event. sean? >> catherine, thank you. here to share his thoughts, this is the father of benghazi victim

tyrone woods. charles woods, thank you for being back with us. so we're not going to treat -- the person that killed your son, that our government believed killed your son, we're not going to treat him as the enemy combatant terrorist that he is. no, we're going to mirandize him and give him a trial in u.s. criminal court? what's your reaction to that? >> well, first of all, sean, i want to really thank you for everything you have done to honor ty and the others who sacrificed their lives in benghazi. now, as you know, a week ago, it became public information that those terrorists who killed my son stole cell phones from the embassy in benghazi. then they used those cell phones during the attack to call their leaders. and those calls were intercepted. now, the question is, why since our government knew from day one the names and the phone numbers of the leadership, why did it

take one year and nine months to make this arrest? >> well, you raise my next question. and i've gotten to know you. i've gotten to know your family. gotten to know a little bit more about the story of your son. and ty was a hero in this. he was told to stand down. he literally risked his entire career, put it on the line to go save americans, which he did -- which he was successful at. so james rosen, fox news reporter, is literally talking to the state department official and asking wait a minute, fox news interviewed the guy for two hours. cnn interviewed the guy for two hours. "the new york times" interviewed the guy for two hours. the "times" of london reuters interviewed the guy. why couldn't you guys find him? watch this exchange. >> would you, in fact, agree that there has been a rather egregious delay seen in this case in finally apprehending this individual? >> i would disagree. this is a case where there's no one more committed than the

leaders in the united states government. >> you're still not addressing the central question, jen. you're not answering the question of why a reporter was able to get within six inches of this guy and u.s. special forces weren't for more than two years. what is the answer to that? >> well, the answer, james, is that reporters have interviewed a range of terrorists in the past. there's nothing new about that. >> at least five reporters spent hours with the guy. what is your reaction to that? >> well, my question that i ask myself, then why not dress up a special forces team as reporters and arrest him that way? you kn >> you know, i want to cry, but you're making me laugh. it would be that simple, wouldn't it? >> i never thought that our government would become as passive as they have been in executing the war on terror. >> it's pathetic. look at what's happening in iraq
