"outnumbered" starts right now. >> fox news alert, we're waiting to hear from the president on the growing crisis in iraq. at the bottom of the hour we expect president obama to make a statement at the meeting with defense secretary chuck hagel and members of his national security team. the u.s. is weighing what to do with the militant force sweeping through iraq taking overseas and towns on a march toward the capital of baghdad. iraqi government forces seem to be holding onto control of the country's largest oil refinery after it was stormed by sunni insurgents, the group called isis, who planted the flag on the ground at that refinery. we are hearing the president is coidering whether to send additional security forces to assist the iraqis.

fox business network where i talked to several it experts this morning, some veterans at microsoft in the distance for 30, 35 years, they said these e-mails can be on outlook e-mail servers, they should be at least, several files have to be kept by other employees and also any e-mails sent to other organizations or other agencies within the u.s. government, the e-mails cannot be lost, period. >> they quote them all the time, nothing digitally ever dies. what is telling is the way of the record-keeping at the irs. we have to keep the record seven years, they were keeping their e is for six months and it was up to the employee to determine whether an important e-mail should be printed and cap in a hard file. that is problematic already because now you're asking the person who does this part of the investigation to make the

decision not to do something to potentially protect herself? that is not reasonable to think that. if it was going to be thrown out, now you put it in the hands of the investigation. >> all of this plays into the favorability of the president, people not feeling confident about the government, so many scandals, do you think this one sticks? especially with this added layer to say we lost all the e-mails. >> it is definitely resonates with americans regardless if you're a democrat or republican, people are afraid of the irs and this smells. i remember i thought almost everything was backed up, that is the one thing i don't completely remember. went through extensive training of having to back up all of our official communications. they say they did not throw out their hard drive, the recycled it because it died but they are having some legal requirements.
