problem. your actions created it. on effective iraqi leadership can save the collapsing country. the leadership has thus far been the antis this of effective. president obama announced the united states will help iraq with up to 300 military advisers, but he had some strong words for iraq's prime minister nouri al-maliki, warning him in no uncertain terms the united states will not waste anymore blood and treasure in iraq. president obama noted prime minister maliki is to blame for fanning the flames of deep division that are now leading to all-out civil war there. >> we consulted with prime minister al-maliki and said to him privately, said it publicly, that whether he is prime minister or any other leader aspires to lead the country, that it has to be an agenda in which sunni, shia, and kurd, all

file they have the opportunity to advance. >> something the united states said from the very beginning when its first propped up the government, this must happen. something that nouri al-maliki had by every single fact available to all of us refused to do every step of the way. and now we have this. president obama again today stressed he does not want american troops in combat. in a country he says still bears the, quote, deep scars left by america's war. the one-time commander of american forces in iraq is now cautioning against our taking sides in the fight for iraq between the sunnies, shiites and the kurds, none other than david petraeus, and he in essence endorses the obama plan. he said the united states cannot be iraq's air force. fighting on just one side. general david petraeus said iraq needs a government that all its citizens can trust. so far iraq's military has not

been able to hold back fighters from the islamic state of iraq and syria, or isis. either they haven't been able to hold them back or haven't tried, and it appeared haven't triafed is more accurate. getting to baghdad will be a difficult task. the militants are right now engaged in a dramatic badle for iraq's largest oil refinery, and there are trouble reports of the isis black flag now flying above the compound there. more on the latest coming up. first we're getting reaction to the presidents a announcement today. some of the g.o.p. says the president's actions understatement the serious threat of the terror group. the chairman of the house foreign affairs committee, ed royce, says, and i quote, the step he announced or needed but fall short of stopping this

group from gaining power which includes drone strikes. presidentpresident obama will ln the possibility of drone strikes in the future. ed henry is live. what were your big takeaways today? >> i think you underliked a key point which is that the president said again and again, american forces are not returning to combat operations in iraq. important message, one problem, though, may be a bit of a contradiction because when he was pressed by a reporter on why he didn't leave and whether he had any regrets not leaving any u.s. troops behind in iraq, at the end of 2011, he insist threads wasn't a status of forces agreement so he could not get immunity for u.s. troops if god forbid in self-defense they killed an iraqi citizen, they could end up in jail. when a reported shouted, do the military trainers, the 300, do they have legal immunity? is there a status of forces agreement? he did not answer. so we have to see, while they're

not being sent into combat, if in fact they have to act in self-defense, they could get into combat pretty quickly because of these extremists. the other takeaway if not a shove there was a push of nouri al-maliki out the door. the president saying, iraq needs to form a new government. listen. >> i think the test is before him and other iraqi leaders as we speak. right now they can make a soars of decisions. regardless of what has happened in the past. right now is the moment where the fate of iraq hangs in the balance. >> fate of iraq hangs in the balance. strong words. the president calling this a crisis. and by the way, why he did not authorize u.s. air strikes today he seemed to leave the door wide open by saying he is prepared to take, quote, targeted military action itch that is needed. >> he said he would consult with congress if they have to do anything else. what details do we have on that?

>> he certainly has the big four congressional leaders, democrats and republicans, over here yesterday, but you have some one like harry reid in the president's party saying he doesn't want any troops in iraq, this their own civil war to deal with. doesn't seem like the president has a lot of support on then democratic side for anything in terms of iraq. on the republican side, john mccain was withering in his criticism listen. >> the president of the united states goes for fundraising and golfing, and now is fiddling while iraq burns. >> he was referring to the fact he wants to see u.s. air strikes. the president not doing that now, but leaving the door open. another thing he is doing is sending his secretary of state, john kerry, to baghdad, to try to work a diplomatic channels in addition to the military side of this. >> ed henry on the north lawn, thank you. let's turn to john busse from

"the wall street journal." mccain talking about air strikes. air strikes to support whom against whom? >> that's right. thus is what the administration doesn't want to do. it doesn't want to publicly support one side or the other because the other side more broadly in the middle east, sunnies, outside of the realm of the militants, will take notice of the fact that the president would be supporting a man who has led iraq down this path by keeping sunnies out of the government, al-maliki. so his walking a very careful line but in saying very explicitly he does not want to launch air strikes in support of one side or the other it's an incredibly clear signal to maliki he is not going to get support from the president. >> i wonder if john mccain doesn't suggest these wild and crazy things in an effort to put us in political turmoil over here. something which he has succeeded. more importantly, how can you

tell maliki you must do the following, though they have been saying that to him from the very beginning, and never done it. and given nudge to some political figure who might be able to facilitate such a thing. all they want is skouen anies, shias, kurds, the minorities christians to have a little bit of say for what happens in the country. >> if you push maliki out, who next? then saddam sad. one regime change is not enough. what comes after that? and the administration is thinking, what comes after that? you can understand on the republican size feel a harder line should be taken but a their are opportunities now clearly in a messy battlefield to take strategic hits against people that are anti-u.s. and who are seizing weapons and will use those, primarily in syria, and who knows where necessary the world. it's very difficult to do that knowing exactly what target you need to hit. and without it looking like

as the word is talking about iraq and the president is having a speech in the house of representatives they voted and electioned the majority whip kevin mccarthy, republican of california, as the new majority leader. he defeated a republican of idaho, more of the tea party wing. he will take over from the current majority liter, eric cantor, the republican of virginia, and he'll take over at the end of the month of july. now, with mccarthy's promotion this means we have a race for majority whip now, between representatives pete roccomo skim others. i want to get to the fox business network. rich, happened more quickly than we thought but actually the outcome not that big a surprise. >> it wasn't, shep. most folks assumed the majority whip would ascend to this. kevin mccarthy, well known in the tech industry, in

washington, dc, the tech industries believes they'll be helped now the fact he is in the majority leader's position. this is the undercard, the race that folks were not all that sure about. peter roscum, the number four republican in the house, running against congressman steve scalise, the chair of the republican study commitee, the more conservative part of the party. someone who will fight for conservative values, and they say eric cantor's loss is the proof that republican leadership needs to move farther to the right. congressman roscum is making the case he is conservative enough and should lead. he is the guy that gets on the house floor, counts the votes, making sure if the house republican leadership puts something on the floor, he makes

sure you vote for it. so it's an interesting question. how this plays out the rest of the year, house republicans and the entire congress have a fairly light legislative agenda for the rest of the year and we could be going through this all again because they have these as a function of congressional elections so after the mid-term elections they'll vote on this again. this leadership team has the next few months to make its mark in what most folks on capitol hill will assume will be a light legislative agenda. >> when tea party types knock eric cantor out of his office, there's talk they wanted more representation in the parter leadership, especially in the south. instead they elected a republican out of california. now, keep mind, eric cant you're had a 95 fors conservative record over the history of his record and that was not conservative enough. they elected a man to replace hem and the last people those on

the far right who elected eric cantor wanted was forking this election to happen in this way. i wonder what we'll hear from them. >> how exactly these folks are going to govern for the rest of the year. that's why i would say perhaps we might want to look at the next government spending fight. we have government spending levels set but it is required for the u.s. congress to pass those funding levels. so perhaps if the conservatives feel they haven't gotten enough out of the leadership elections there could be in the fall -- not saying it's going to happen but the only real major piece of legislation that has to go through the congress and the house is what funds the federal government when the fiscal year expires in the fall. so, that's something to look out for because they're going to want something they see this as conservative angst, the reason the majority leader cantor lost and they want some indication they're moving more right.

>> from what i've heard and read about his record he is a very moderate republican. by republican standards. and the thinking he is would operate things more of the status quo than anything of major change. in fact, quoting from "the new york times," california of moderate temperment says the "new york times" who is likely to be preserver of the status quo, and loyal to john boehner. i guess this internal battle of who the republican party is continues. >> it absolutely does. and kevin mccarthy was part of the leadership team been under house speaker john boehner for the last couple of years and also has been for increasing stem visas for signs and math people to come to the united states. that would have to be

incorporated into a larger immigration reform. so these are questions the republicans have been asking themselves when it comes to government spending and raising the debt ceiling, and mccarthy has been part of what has gone on in the house republican leadership that a number of republicans, what has gone on, what house speaker john boehner did to re-open the government in one sense, and have put on the floor, have had some problems with. >> rich, edson with some analysis. i appreciate it it h very -- appreciate it very much. again, kevin mccarthy has been elected as the new house majority leader in washington for the republicans. scott walker is the republican governor of wisconsin who is in a bit of a pickle of his own right now. prosecutors now allege scott whacker, the republican governor, participated in a criminal scheme. we'll get into that in a few minutes. first we'll go back to iraq

couple of hours north of baghdad. this video from isis reportedly shows sunni fighter s -- fighters on the streets. as of this moment the iraqi colonel says his troops have control and the man who claims to be a militant claims that to "associated press." the end of the story. its not clear how long the military can hold its grip, if it has a grip, on the refinery. there are varying reports and we want get in there. a witness says the extreme ye have the compound surrounded. conor powell is in our newsroom in jerusalem and not to pretend you can learn anything there but i'll ask you why this oil refinery is so critical. >> so, the oil refinery is one of the most strategic parts in iraq because it produces a

quarter or are so of iraq's domestic oil capacity, everything from gasoline to cooking oil. more importantly, right now, it's just an hour or so north of baghdad, and the iraqi military have made a big push to retake it. they're staking their mill sort of claim on this ground. if they fail, not only are there think concerns but also a massive blow to the maliki government and the iraqi military, who are desperately trying to re-assert control by showing maliki loyalists anywhere control and the military is capable of protecting baghdad. if diji falls it would spook baghdad and the shiite southern part of the country and set off chane reaction of people fleeing the country. >> we keep speaking over here of this as being these isis rebels, terrorists from syria and now fighting, an offshoot of al qaeda. but it's much more than that. a lot of different people with a lot of different agents and

problem -- different agendas and problems. >> definitely. we talk about how the isis fighters are sunni, but so, too, were the majority of the regime of saddam hussein, and chairman of the joint chiefs, general martin dempsey, said in his testimony, the regime loyal to "american saddam hussein have joined. and they're getting help from the republican guard. while this is impossible to know for sure it might help explain why insurgents were able to move so quickly across iraq and further confirms that any type of political solution where the baathists and the sunnies and she it shoulds and malikis -- shiites come together to end the conflict, is looking more and more impossible. >> looks like more a dream than reality. >> definitely. the talks of some type of

political sort of discussion and compromise seems so unlikely right now. >> conor powell, thank you very much. so, isis and all the other fighters who joined in now make their push toward baghdad, of that's what they say, and kurdish soldiers to the north are ready to protect their oil-rich territory from falling into the hands of the terrorists. kurd stan's forces are the only ones who put up a fight against isis and its followers. let's look at the region. isis fighters have captured areas of iraq shaded in red. they started in syria. worked across boundaries drawn by somebody else. these boundaries mean a lot to those europeans and british who put these lines in place, but they don't mean all that much to those people in the north. these are kurds. that's what they are. the green sharedded portions of the map show the autonomous kurdish region into there. that is turkey up there and this

is kirkuk and mosul on the border. their troops, the pesmerga have been effective, thousands of soldiers and refugees are heading to the green area to escape the problems happening down here. keep in mind the kurd are a much freer people compared to the sunnies in iraq. women can serve in the kurdish military. tensions between iraqi kurds and the central government in baghdad, that tension stretches back for decades, and longer than anybody watching this program has been alive in 1988 saddam hussein unleashed chemical weapons on the kurds. remember? yet kurdish fighters battled in the city of kirkuk. and now, kurdish forces say they're prepared for another potential showdown with these isis militants militants and alt along with them over kirkuk and its vast oil reserves. that's a huge prize for whoever can take it. the kurds say their weapons are

outdated, hardly working compared to the well-equipped isis forces because what they did was the iraqi military folded and gave them the weapons that we gave the iraqis. so they're fighting with our weapons. ben -- benjamin hall is imbedded with the kurdish fighters is and is live. what can you tell us about what you're seeing on the ground. >> i've been imbedded for five or six days now and they're a very efficient and effective fighting force. the thing is, though, the areas they have taken so far, kirkuk and the oil region were easy to talk because the iraqis have simply disappeared, and as far as that happened, they could push through south. they have now hit real, real forces of isisy and are in heavy fighting around a city called

jalala. >> is that clash still ongoing and what is the status of the refinery? >> the refinery's to the west and the city is on the main route from mosul to baghdad so securing the city of jalala. the last few days there has been heavy fighting and it was street-to-street. we were called back yesterday, so they could clear it. there are 20,000 civilians who were in there and they have been removed to from the city and the kurd are saying we are going to shell it. it's the only way to defeat them in that town. >> bases on your reporting there, when the curs say our weapons-outdated and these other forces have what is left over from american weapons, are they on point and if so what are the kurds insist they need?

>> well, they are, they are asking for air support. they asked for iraqi air support a few days oak. when iraqi helicopters arrived they fight on our placements and six people died. and they don't trust the iraqi air force and they're asking for american air force support. however, in terms of other weaponry they have, they have some artillery, but not enough to counter the force of isis using american weapons against them. >> benjamin, thank you very much. it's interesting to hear from these kurdish fighters, who are as tough as they come in all the business over there who are saying we can do fine except these terrorists whom we're fighting, they have america's weapons. the weapons and training that america gave to the iraqi forces, they iraqis melted away,

a potential 2016 presidential contender was in the mid of prosecutors call a nationwide criminal scheme to illegally coordinate fundraising with conservative groups, according to documents released in a federal court just made public. the man is this man, wisconsin's republican governor, scott walker. now charged, according to prosecutors, he has committed criminal activity. prosecutors claim the governor some some of his staffers talked about illegally working with groups and individuals, including republican strategists karl rove, who is a texas -- fox news contributor. but the judge says there was no probable cause to show anybody broke cam pan finance laws. no comment from the governor's

office. president obama announced he is ready do send as many as 300 military advisers to iraq to trains' support the iraqi military but not to get involved in combat. of course, these advisers will be armed, and tell their families they're headed back to iraq and see how they feel about it. they will include army green would berets. they're a very select group. they go through rigorous training. they deal with everything from drug lords to terrorists and humanitarian efforts. jennifer griffin has proper -- has more from the pentagon. >> the president authorized these 300 military advise years. most of these will be special force, green berets. they'll be divide into several small teams. each team made up of a dozen of u.s. troops, attached to iraqi

military brigades and establish the two joint operations centers that the president announced today in baghdad and in northern iraq. their first job is to assess. they'll give the pentagon an assessment of the iraqi military. the president authorized 275 troops to iraq earlier this week. 170 troops were sent to provide security at the u.s. embassy, and 100 air force personnel are in the region to help with airfield manage independent the event they need to evacuate the u.s. embassy. >> the history books tell us the concern with all of this, and we talk about this in other conflicts, burst the facts remain if you put armed folks in the middle of a region where we're requiring iraqis to be the ones who do the fighting, if the iraqis melt away it's not as if our guys aren't going to be in there fighting. they will. >> it's true. the other way to look at this is right now we have planes manned and unmanned flying over iraq but no clear
