weapons stockpile in iraq. that's according to the telegraph and not independently confirmed by fox news. if true, insurgents could have access to potentially deadly poisons including mustard and sarin gas. this as president obama announces a plan of action. elisabeth prann is live in washington to break down that plan for us. elizabeth, what do you have? >> reporter: good morning. not only is the president sending secretary of state john kerry perhaps in an effort to encourage nouri maliki to step down, he's also dispatching about 300 military personnel to help. we have john kerry on record. list ton what -- listen to what he said just yesterday. okay, looks like we don't have that sound. on the controversial topic of iran, the president says they will play a constructive role if they

informed about any sort of e-mails gone missing due to technical error. he was only informed a week ago when actually the i.r.s. informed the treasury department, he said, informed the white house about the missing e-mails in april. why did it take two months longer for this commission and the other to actually find out as it pertains to this investigation? >> let's listen. >> the i.r.s. commissioner told me on march 26 of this year they had the e-mails. somebody's not telling the truth. somebody is misleading us. i had the i.r.s. commissioner tell me personally that they had the e-mails and that they were stored on servers. so was he misinformed? was his staff misleading him? was he lying to congress? >> none of it is good. there is no that anything crashed. we're going on their word that it crashed, which is embarrassing. but if it didn't crash, they would rather take the slings and arrows than tell us where those e-mails are and what they contain.

there is no good scenario there because we are not getting the fact. another focus on the i.t. department. we have a problem, we call the help desk and the help desk helps us. other people in the i.r.s., i guess, you call the help desk and they are say let's throw it out. >> you call the help desk and say i lost my e-mail, they say we'll help you recover. what's interesting, if it's on the server, that would be a backup, they would be able to find it. there is an item in "politico" that said overnight darrell issa's committee is calling in one of the white house lawyers to testify what she knows. before she was at the white house she worked at the i.r.s. and she was in charge of trying to collect all those e-mails. even though she's working for the white house, she's now in a position where she used to be at the i.r.s., she can be called in and say, hey, did you know about these missing e-mails back then? what do you know about it? >> to the blind eye, you

say conservative groups were targeted before an election because of their tax exempt status. that could be anybody cause for concern. then you say in a two year period that certain e-mails were written, that may have something important to determine innocence or guilt as it relates to lois lerner and the i.r.s.'s targeting as they are accused, that might be interesting to look at too. but they've gone missing. suspicion and cranks except for nancy pelosi who says this is just the fact that they need an update on their computers. this is not about suspicion. >> what it convinces me is they need a new technology system at the i.r.s. they need to upgrade their technology. get it right. so that there's no suspicion about what agenda anyone may have. >> those sound bites she gives are so fascinating. if there is a problem with the computer, bang us out of it.

let's talk about immigration because governor rick perry knows all about it. he is the governor of texas and has been warning about the problem at the border for a long time. president obama tried to hand him a letter saying here's the problem. you've got to handle the border. everyone's ignored it. since october there's 47,000 kids have crossed the southern border alone. that is a 90% increase from last year. you think that's a problem? absolutely. here's governor perry last night with bill o'reilly. >> we've been flagging this issue, calling it to the attention of this administration since 2009. 2010 i gave the president a letter on a tarmac. in 2012, we brought to their attention flag, put the caution lights on that there were unaccompanied children, alien children coming in and it's only gotten worse. >> are you saying tonight, though, governor, that president obama doesn't care about the issue, he blows you off, ignores you? you've been telling him for years you need help and he

doesn't respond? is that what you're telling us tonight? >> if the track record is indicative of that, that is stkaebgt what i would be -- that is exactly what i would be saying. from 2009 until the kurpt time the president has not addressed this issue. >> apparently yesterday he did talk on the telephone to the president of mexico and he said we've got to come up with a strategy because they will not be able to stay. they won't qualify for legalized status for deferred deportation including the children, he said. we are send joe biden down to guatamala to talk to the guatamalans about do you really want to send your children there? it's dangerous, they won't get to stay. for us in the united states there are two problems. one is i was reading in a miami paper this morning they've got hundreds of thousands of new kids there, they have to put them in school. that means thousands of dollars per kid. where is that money coming from? taxes in florida are probably going to go up. also for all those people,

president obama addresses the growing crisis of isis in the middle east. he says america will not be returning to fight in iraq, so to speak. >> we're prepared to send a small number of additional american military advisors, up to 300, to assess how we can best train, advise and support iraqi security forces going forward. american forces will not be returning to combat in iraq. ultimately this is something that is going to have to be solved by the iraqis. american combat troops are not going to be fighting in iraq again. >> all right. that's good news for the insurgents. pete hegseth calls the response underwhelming. he is the c.e.o., concerned veterans for america and a fox news contributor and he fought there. captain, what do you think and what's the buzz among your colleagues about this 300 advisors, green berets in iraq. >> they can do a lot of damage especially if they're pulling triggers

but the president made it clear that won't be happening. what does advise and support mean? if it just means helping iraqi forces, you're going to get limited impact. if they're out there alongside guiding on the battle field you could see push-back by isis on gains made. i am very underwhelmed by this 300. it is not a strong showing of support. at the very at least it shows the grudgingly begrudgingly sees an interest in a terrorist haven in iraq. we're behind the curve but it's at least something. >> david petraeus backtracking a little bit saying he would support limited airstrikes against leadership of the isis group because isis targets the west, and that would be one way of protecting us. >> i think he's -- i'm glad to hear him say that. isis has shown a desire to hit the west. the caliphate expanding between syria and baghdad

is extremely dangerous. it looks like a pre-9/11 afghanistan. it is not something we can tolerate. these 300, hopefully eventually more if necessary. to push them back is critically important. what we can't fall into, brian, also is just becoming a too for the shia elements for maliki's army. he would want that because this has become a sectarian fight. >> the only people that have earned our loyalty have been the kurds. by the way, they're now overmatched because the sunnis have taken our humvees and our ammunition and our hardware and are now using it because the shia army we trained ran away. >> gave it away. the peshmering has to be a big part of this equation. it should include operators up north working with them to push isis back from that direction. they have been loyal allies for a long time. i did see they will include advisors up north.

while i did have fun operation angel thunder is about practicing serious skills for serious situations. that's me being hoisted to safety by the 38th rescue squadron. i'm playing a lost and injured civilian in the angel thunder exercise run by the air force. >> it is excellent training particularly for some of the youngerer ones in our squadron who have not deployed overseas. >> for two weeks 1,800 men and women from all branches of the military practice responding to real-world scenarios. everything from combat to natural disasters, the air force prepares for it all. that's because they respond to it all. >> whether it's bringing medical personnel to the injured, evacuating the injured or even just flying relief supplies to those locations. >> success during real-life missions like those depend on the skills taught at angel thunder. >> it gets us talking

equipped to rescue people across t is in water, in the desert, in the mountains. >> even in a storm? >> even in a storm. >> and i want to thank the u.s. air force, especially the 38th and 41st rescue squadrons. they include the p.j.'s and the helicopter crew involved in my rescue. >> it is official now, you are the "fox & friends" damsel in distress. >> anything you guys need. these men and women just incredible to be there on the ground, seeing all their skills and then rehearsing these possible scenarios that could play out. >> you say you had a laceration, they actually put blood on you and so the guy had to identify what was wrong with you? >> yeah. because they're setting up a scenario and not everyone knows what it is. so the people rescuing me weren't aware of what my possible injuries were. they put makeup on and faked the injuries so that the people rescuing me could figure out what that injury was. they even were about to put an i.v. in my arm.

me. >> maria molina who survived an earlier experience with the air force joins us now with a preview of the day ahead weather-wise. >> good morning. it is a beautiful day in new york city. we're looking at sunshine and very pleasant temperatures but i first want to show you this video that was shot on wednesday from south dakota. it is a tornado. you can see how it tears apart a home, a very scary situation out there. we've had several days of extreme weather across parts of south dakota and also parts of nebraska with several confirmed tornadoes, several ef-4's also confirmed. that means tornadoes could potentially have winds up to 200 miles per hour. devastating across portions of the plains. there is a risk today for severe weather across minnesota and northwestern wisconsin. it is a small chance but it only takes one storm. damaging winds that could produce significant damage in your area. by saturday that risk

expands to parts of south dakota, nebraska, illinois and across the state of iowa, you could be looking at severe weather. showers and storms in chicago and temperatures heating up into the 90's across parts of the southeast and also the plains. by the way, elisabeth, tomorrow marks the official start of summer early in the morning, summer solstice. let's head over to you. >> the i.r.s. commissioner headed to capitol hill today to answer questions about how two years of lois lerner's e-mails vanished into thin air. they claim her computer, her drive crash, a crash republicans consider suspicious. >> i think the american public gets it that when a disk drive, quote, crashes, the data is still there and competent authorities can recover virtually, if not all of that data. it's clear that this disk went to this -- this drive went to the bone yard at a convenient time with convenient information.

>> are lerner's e-mails really gone forever? joining me is text expert, curt the cyber guy simpson. a lot of questions here. you're going to hear more about it this afternoon. can these e-mails be gone forever if they're on a server? >> how come they don't lose my tax bill? it's outrageous to think these are gone forever. i don't think we've seen the end of the story. i think we're seeing the beginning of it. the drive that was like this that would have been on her desktop -- >> this is the hard drive? >> a typical desktop computer. it has inside of it a drive and drive controller. the story goes that not only did ms. lerner's hard drive fail at her desktop, but coincidently at the same moment six of the other people who may have been involved in this also had a hard drive crash. we know that hard drives will crash. there's a life span to a computer's hard drive even if it's the server that's storing the data and it's going to. but the likelihood that all

six plus ms. lerner's drive died at the same moment, hard to believe. so where is it now? where's all that e-mail? other possibilities exist and that is they could have been stored on her computer and saved there. there is a laptop now in the possession of somebody doing an investigation. there could be something there, although that's likely new. the servers that were used at the i.r.s. are unlike most modern-day servers. they're recorded on tape. the tape was kept for about six months and then reused so all the data that would have been back in 2011 long gone from that. let's x out that source. what about all the people who may have received that e-mail or sent e-mail? they've got a copy and i think that's where we're going to see a smoking gun at some point because there are 25,000 e-mails right now that have been uncovered. it's a matter of combing through those and seeing what may be sitting right there. >> you're saying the lost e-mails whom they were sent to, that will be the key to finding this information?

>> or who may have sent it the other direction. >> let me ask you this. would we be able to know technically if they made an attempt to recover those lost -- >> i don't know that anybody can deny there was an attempt being made. but there's a lot of stuff that can be done to try to recover missing data on a drive. one can be as crude as you and i putting in the freezer for a few minutes, cooling it down and then suddenly a hard drive will spin again and we get the information off to then we can spend with deep pockets all the money in the world, send this out to a forensic place and they will perform surgery as if it's an open-heart surgery and in many cases be able to get this information. what we're hearing is all that happened and yet humpty dumpty couldn't be put back together again. >> what i'm hearing from you is it is still possible to get that information. kurt, thanks for joining us. a high school accused of blocking websites like

actually implement a strategy if it was the case were e-mailing each other and if they were communicating through e-mail f we saw them, we'd be able to piece together the strategy if there was one. the problem is it turns out their e-mail, lois lerner's e-mail crashed for two years. they lost two years worth of e-mail and six other irs higher ups also claim their computer crashed and their i.t. department chucked out the hard drive. >> you know what's curious about this, there is an item in the "wall street journal" that lays out the time line and it shows that back in 2011, dave camp, who heads up the ways and means committee, and he's running things and they're going to bring in the commissioner today -- back in 2011, he sent lois lerner and the irs a letter and said, hey, are you targeting tea party groups and conservative groups? are you, are you? just about a week later, her computer conveniently crashes. is it a coincidence? i'm sure they will say yes. but none the less, mr. john

number one, did you just throw out these e-mails? did you destroy these e-mails? did you destroy the hard drive? or did they even crash at all? did they look at everything and say these are so incriminating, we're better off coming up with a ridiculous excuse than actually giving theme piece e-mail. >> the bottom line, whether you're republican or democrat, if the government is attempting to punish you prior to an election, your organization, because of your beliefs, then you have a problem there. so the american people deserve answers and lois lerner pleading the fifth, not giving info there. now these e-mails disappearing, and the time line that this targeting occurred. what's to hide, everybody is asking? and nancy pelosi stands by the fact, look, they need new computers. this isn't a scandal. >> it convinces me that they need new technology system at the irs. they need to upgrade their technology. get it right so that there is no suspicion about what agenda

anyone may have on that. >> okay. so she's saying they need new equipment. this is becoming a bipartisan scandal. people on both sides. people on the right say look, it looks like they destroyed government data. but there are people on the left who say the scandal is the irs does not have enough money to effectively screen groups like the tea party and whatnot. give them more money. if they're going to give them more money, give them more money to buy the cloud or some sort of back up so this never happens again. >> it was an hour later than he said he was going to. the president talked about a way forward in iraq and that will be halfway. or an eighth of the way. at least he's addressing it. 300 advisors will be dispatched to iraq to baghdad to take a look at aiding those who are trying to repel the despicable sunni extremist group, the terrorist extremist group, this

isis. he's going to go throughout and evaluate the situation. i understand drones are flying constantly and we have other aircraft in the area trying to assess the battlefield in seven cities that have fallen into enemy hands. the 300 advisors are going to get their hands dirty? shooting people? fighting back? the answer is no. advising al-maliki so far. >> we don't know exactly what they're going to do. the president made it very clear, there will be no combat troops, so it doesn't sound like these advisors will be shooting anybody. >> the green berets. >> so the suggestion was maybe they're sending in the advisors to call in the air strikes, but the president said yesterday there are no imminent air strikes. the problem right now is that -- charles krauthammer talks a little bit about this -- the president is telling the enemy a lot about what we're doing and what we're not doing. here is the doctor. >> it is always a mistake to say x is off the table. you can believe it. you can stick to it. you can tell people in private.

because he didn't want to indemnify our troops. but it one of our guys or women did something wrong, we didn't want to be subjected to iraqi laws. but the president never engaged in any long form negotiation about a residual force left behind. in fact, the president said the most he would leave behind in the best scenario is 3,000 troops. so al-maliki says for that, we don't even want it. so the president doesn't put any troops in there. he said al-maliki made that decision. well, that really stunned a lot of people who have been tracking this whole iraq war because we remember the 2011 debate with president obama and mitt romney at which time he was asked about this and about the pullout. mitt romney couldn't believe he was pulling out all the troops and thought it was a mistake to do so. listen to what he said. >> with regards to iraq, you and i agreed, i believe, that there should have been a status of forces agreement. oh, you didn't want a status of

a fox news contributor at one point. here to respond to the allegations is governor scott walker. good morning to you. >> good morning. good to be with you. >> so over the last couple of years, there has been some legal action out in wisconsin and some of the documents were unsealed yesterday. we got to point out, you were never charged with anything, but at one point they allege that you had a central role in a criminal fundraising scheme. okay. tell us what you did. >> well, don't just take my word for it, look at the facts. the facts are pretty clear. you had not one, but two judges, a state judge and a federal judge. state judge, a well respected court of appeals judge and another judge both looked at this argument and in the past, not just repeatedly, remember, this is not new news, it's just newly released yesterday, documents were opened. but no charges, case over. both judges said they didn't buy the argument. they didn't think anything was done illegal.

so they've not only said we don't buy it, but they shut the case down both at the state and federal level. so many of the national media and even some here in wisconsin are looking at the state backwards. this is a case that's been resolved. not one, but two judges have said it's over. we're just learning about it because it became open in documents yesterday. but there is no argument there. >> to that point, governor, there is an item in the new york daily news today that says gop star named in money scandal. these are documents that, for a case that does not exist anymore, they're just opening it up, it looks like they're just trying to trash you. >> i think there is no doubt. this is a prime example of what happens when you take on the big government special interests. they're looking for ways to come at us. they'll continue to do it. they did it two years ago in the recall election. they're going to do it again now. we've got another tough election this fall. they're going to come at it with just about everything out there and the media, at least many of the media, are willing accomplices to this. but the facts of the case are pretty clear. they're not something that i or

president's -- on the president's plan for iraq, senior advisor to the coalition in iraq during the george w. bush administration, dan. 300 advisors. does that seem like a good plan to you? >> i think what the president said yesterday, he did lay out to his credit, the strategic interest we have in iraq, that basically iraq and also syria up in a flames in a critically important part of the region, terrible strategic play for the united states. however, the solution that he laid out struck me as woefully inadequate. we can't do much to help them beat back this insurgency with just up to, quote, up to 300 military advisors. so look, the good news is he laid out the strategic interest and opened the door for more military engagement. but what he committed so far, no commitment from the joint operations command, special force, combination of air forces

and special ops proves successful. >> the biggest chunk of his press conference was the president said this maliki guy, maybe it started out as a good idea, but he's got to go. are the iraqis going to listen to us given the fact we have turned our backs on him? >> there is a complicated relationship in iraq which we've seen over the last deck indicate between security and political power and political influence. if you can't provide security, you can have very little influence. the peak of our influence there was during the surge when we actually turned things around 'cause we helped provide security. maliki right now has leverage. what's his leverage? iran. iranian revolutionary guard corp. is in iraq right now. >> they want to help me. >> if we say we're not going to help unless this or that, he can say that's fine. i have somebody else. the change in iraq without providing military capability that can actually have the influence, i think will produce

no results. >> quick note here on the blaming of maliki for the status of forces agreement not becoming word, it's how we got out without one. >> i was really struck by that. more than anything the president said -- >> you want to outline, here is what the president said yesterday and then you can tell me what you have a problem with. >> keep in mind, that wasn't a decision made by me. that was a decision made by the iraqi government. we offered a modest residual force to help continue to train and advise iraqi security forces. >> what's the difference? >> first of all, our military commanders, our secretary of defense at the time, bob gates, our chairman of the joint chiefs of staff recommended to the president numbers well above 10,000. from 10 to 16,000 troops should be left behind, not in combat roles. to help train iraqis, to advise iraqis, to do intelligence gathering. but not actually be in front line combat roles. so the president rejected that

ultimately, claiming because of these immunity issues. the reality is the president himself made a pledge to get all of our troops out of iraq by the end of his first term. when he -- fourth quarter of 2011 where he announced the full withdrawal, he said, i am fulfilling the pledge today that i made. it was about fulfilling his pledge. it wasn't about maliki's failure to cut a deal. if you look what he and other senior administration officials said at the time, they're saying the iraqi military is in great shape. it's proven, it's well trained. it's equipped. it can handle the situation. this is a success. now he didn't say my hands were tied. i had no choice. maliki made me do this. he said at the time, this is my choice. it is a sign of our success. >> he was checking a box and that's what he's done. >> that was said and he said, i didn't want to leave 10,000 troops there. >> right. so i mean, look, this was a campaign pledge and he fulfilled it. it's a shame because the

onward. there is plenty of blame to go along. as i said on this couch a week ago, i urged the president to use the un-- unleash the drones right now on this invading al-qaeda army. it's seven days later. he has still not acted. he's just now sending the 300 advisors to iraq to target air strikes so he'll end up doing it. but what happens in the week that we've lost? what happens is the invading sunni army had time to consolidate its gains, to dig in the bunkers, to eliminate the more obvious targets. they had a week to consolidate their games. i think it's a pity we didn't act sooner. he is going very cautiously now in terms of sharing the blame. yes, the shiite government of maliki bears a lot of responsibility for alienating the sunni people of iraq. that goes without saying. but this is an emergency, mr. president. first you stop the invading al-qaeda army, the most serious
