unity government and make a plan to fight back against the militants. what that means for al-maliki, i am not sure. it doesn't seem like he wants to leave. but evidently couldn't have done worse over the last two and a half years. >> kerry is going to sit down with maliki, going to go you're part of the problem. you got rid of the kurds and got rid of the sunnis from your administration. then mr. maliki is going to go you're part of the problem because you guys abandoned me. neither side is very cozy right now. at the same time you've got the iraqi army which is not in very good shape. any time trouble comes, they take off their uniforms and comes. >> the president, this comes on the heels of him saying he's not going to play whac-a-mole. >> james rosen is traveling with the secretary of state, will let us know a little bit what he's been talking about. he says isis, the group in that area is very

organized. they are literally a blend currently of saddam hussein's old army and this terrorist organization. they are very well organized, and they seem to have a battle plan. not only do they have a plan to take cities, they have a plan to hold cities. when it comes to the fighting, the group that is fighting back, steve you mentioned throwing down uniforms, the kurds are doing just the opposite. they are digging in, protecting kirkuk with all their oil refineries. i think their hope out of all of this is to have their own kurdistan. >> that is in the northern part of the country. it looks like the kurds will keep kirkuk. meanwhile maliki and other government fixtures are anxious. also, there is a fear of baghdad falling not as strong as it was before because maybe we'll provide something. we just don't knowwhat it is. it's not whac-a-mole but it may be something. >> perhaps boots on the ground. perhaps not. andrew mccarthy says we should do more.

any misconduct. as many as 40 veterans died waiting for care at the phoenix v.a. facility. this just in. three al-jazeera journalists convicted of aiding muslim terrorists. two were sentenced to seven years in jail on charges that include reporting false news. a third journalist was sentenced to ten years in jail for possession of ammunition and three were arrested in december as part of a crackdown on islamists supporters of the ousted president morsi. a michigan judge having a change of heart in a custody case involving navy sailor mathhew heinz. he was ordered to appear in court today and if he didn't show up he could lose custody of his daughter. the only problem is heinz is currently deployed in the pacific ocean. the judge is delaying proceedings until october. she says she didn't know he

was deployed when she ordered him to court. next hour, congressman mike turner who has been in close contact with the family and fighting for laws to make sure deployment isn't a factor in custody cases will join to us weigh in on this case and others. did you see this last night? kind of a heartbreak for team u.s.a. as a last second goal for portugal forces a tie. jermaine jones slammed one home to tie up the game. later in the half dempsey knocked it in to give team u.s.a. a 2-1 lead. scores tods left in the tie the game. team u.s.a. can still make it in the next ground as they face germany on thursday. a win or tie can see them through. hope is not lost altogether. those are your headlines. how are you feeling about it this morning, brian? >> to be seconds away from advancing and to be able to coast through germany and america watching 20 million strong and to see them give up that shot which is unbelievable, i think that

is the latest a goal was scored in world cup play. >> i think it is dumb they don't have a winner at the end of it. i hate a tie. >> all i can say is next round it's knockout. think of it as regular season. >> if people watch. they're a little bummed out today. >> we get off the mat, don't we, as a people? >> meanwhile, seven minutes after the top of the hour. it's been nine days since off-duty fire fighter michael herdman went missing in california's las padres national forest. he disappeared while looking for his dog. yesterday search team found the dog but no evidence of his. >> there is a break through in the search for michael herdman. his dog luke is found this morning and he's in relatively good condition at the trail head of the national forest where the trip began. duke is estimated to have traveled more than 12 miles since first going missing last week. >> the dog is exhausted.

i saw the dog. it was literally passed out in the lap of mike's sister. >> that is a bit of happiness but it comes as officials say they are scaling back the search for herdman. >> we've reached a point where we have to make a decision. and the decision is we will be reducing our search efforts to a limited but ongoing scale. >> a skeleton crew will continue to look for him after being missing for nine days now. nearly 400 volunteers have been searching out in the national park twice the size of the grand canyon and five of them have actually been injured during that operation including one who remains in intensive care after being bitten by a rattlesnake. herdman's family and friends are still hoping he will be found safely. they gathered last night to hold a vigil praying for his return. back to you elisabeth, brian and steve. >> thank you, ainsley. >> just 13 hours from right now the head of the i.r.s. is going back to capitol

hill for a round two of a grilling. it's interesting, the government -- rather the house oversight committee asked on friday, the guy, the lawyer in charge of knowing how all the e-mail stuff works, can we have him come up here and talk? the i.r.s. said no. last night the oversight committee sent to the i.r.s. commissioner 15 specific tech questions they want answered at the meeting. >> the chairman of that committee darrell issa sent over 15 questions with subquestions in there that they want answers to based on the fact that americans appear to have been targeted prior to an election in terms of tax exempt status. but they can't prove anything yet because they can't find anything yet. we have someone pleading the fifth. one of the questions of the 15 may be what about this private company that actually logged all the e-mails and archived them? >> that is a big one. what i got from reading the

15 is one theme. i don't believe you and i'm not even sure this thing crashed. it is questions like provide the data of the failure. was it software or hard drive? whose job was it to recover these? who first reported it? how did you learn it? they're saying so far all we have is your word they crashed. can you tell what you did to get it back. >> the gigantic news is yesterday it was revealed was apparently there is a company in california, ever since 2005 they have been archiving the e-mail of the i.r.s. that's fantastic. in fact they put out -- there was this tweet in 2009. if the i.r.s. uses our products to back up their servers, why wouldn't you use them to protect your servers? what's interesting, though, then is the fabt that shortly after -- is the fact that shortly after there was that epidemic crash in hard dives, about the time that dave camp, the chair of the house ways and means committee, inquired of the i.r.s. are

you targeting executives? it was about that time the i.r.s. said you know what, sonasoft, we've been working with you for years, goodbye, we don't need you. subsequently it looks like all of those e-mails probably destroyed. >> wait a second. if you hire me to archive your e-mails and then you unhire me -- fire me -- what obligation do i have to keep those e-mails? >> because they are of a confidential nature, i would imagine they had to destroy them. >> that is going to be the case. why would the sonasoft executive not respond to a request to appear in front of the oversight committee? >> according to the son0soft.com's quite, they quote -- their website, they quote to preserve critical business content, by that definition alone, this information should be readily available. >> it would be great if son asoft still had that

stuff but because it was of sensitive nature they were probably required to get rid of t. it could be coincidence that lois lerner's hard drive crash and those people involved in the investigation, they all crashed, and it could be a coincidence that they severed the relationship with this company even though they had been doing it for years. it could all be a coincidence. i just know if this were a republican administration, i would imagine "the new york times" by now would have called for impeachment of the president. >> perhaps they're thinking the punishment for the crime of a coverup may not be as deep as harsh for punishing americans for having a political columnist. >> a liberal columnist said i can imagine if the shoe was on the other foot but not one democrat stood up on friday, much to i think america's chagrin, and said this is outrageous. i was optimistic, you ended

90,000, that's how many undocumented children are expected to be arrested at the texas border this year and they're estimating another 140,000 in 2015. that is why there is a gathering in texas to address this crisis. what needs to be done and where do we go from here? what can the federal government do and are they just hurting things by examining it now and not taking action? joining us is the host of this week's national sherrifs conference. this theme, illegal immigration, can't be unique when you get together. what makes this year's more challenging? >> what makes this year unique is the influx, as you said, of the children. this is not an issue that has seen such young people come across the issue. this changes from a law enforcement issue to a

humanitarian issue. we can't deal with these children in the way we deal with adult illegal immigrants. they come across at the hands of human smugglers. they're all alone. they are young. they have no support system here. basically they are sent across and on their own and that leaves law enforcement here trying to deal with that situation. >> i understand they're landing in different states without telling the governor. in massachusetts, for example, they're coming in by the dozens into massachusetts, and the governor doesn't even know. what kind of plan is this? >> i don't know what kind of plan it is. is it a plan at all is my question. the sherrifs here are very concerned, sherrifs from across the country. sherrifs are elected officials. we have a lot of independent thinkers and people that think differently. i assure you the sherrifs are 100% in line with is this border situation has to get under control. we are left with so much problems tbr -- from this that the federal government is not dealing with that we

are very consistent that the borders have to be patrolled and the federal government needs to step up and really provide assistance. >> why now? south america, central america has always had their strife and warlords and inequity of pay and lack of opportunity. why now? why this year? >> i don't know why we have seen this influx of young people. i don't know that anybody knows exactly. the problem is that, as i said, we can't deal with it once they get to the border. once they get to the border it's too late. someone has to deal with this on the front end when these children are being victimized and being sent into the hands of these human smugglers. i don't know what has increased it but all i know is it has become a huge problem. >> sherrif, we're going to stay on top of t. if we keep the spotlight on maybe the government will be forced to act. we know they were doing something last week by flying down to those nations. at least the vice president was. sherrif anderson, thank you very much. straight ahead, how did

today. police say she beat up her sister and 17-year-old nephew while drunk at a party. she has been held in jail without bail. steve, elisabeth? >> thanks, brian. a brand-new poll revealing that nearly 42% of people say ptsd is a major factor from lawyers hiring a veteran. is it even legal to deny someone a job based on ptsd? here to way in on that is our employment attorney. i'm assuming this is illegal. >> you're absolutely correct, it is not legal. it is violative of the a.d.a. the law is unambiguous. the a.d.a. says you cannoteone t based on a disability and ptsd is a disability under the a.d.a. an employer cannot take ptsd into consideration and say we're not taking that

applicant based on this. >> the a.d.a. means the americans with disabilities act which protects vets since 2009 with ptsd. starts at the job application procedures, hiring advancement, employee compensation and job training are covered under all of those? >> absolutely. we need to make certain this doesn't just apply to the application process or preemployment process. these protections are throughout all employment. there's two prongs. there's either discrimination based on the actual disability or perceived disability by the employer. >> sp companies are getting it right. wal-mart hired 42,000 vets this year. you take the qualities someone who has been in the military brings to the profession. when you see a poll like this, it is disturbing. if you think you've been discriminated against because of your p.t.s. or ptsd, what should someone do? >> there are various remedies. what we were talking about under the americans with

disabilities act is the federal law. there is a double whammy in new york. you have an ability to bring an action before the new york state human rights division. you have protection based on disability but also protection based on your veterans status. that can change from state to state. but you can bring an action under the federal law and your local state laws. >> how do you prove when, you know, let's say you go for a job, you don't get it. and obviously they saw that you were in the army and you were in iraq or something like that. and then how do you prove that you were discriminated based on your ptsd? >> it is a tricky situation, especially with an applicant in a preemployment situation. what we look at is the applicant pool. who else was up for the job? who is the most qualified person? who ultimately received the job. sometimes you'll have a clear-cut answer. you'll say this person, this veteran was -- >> he was perfect except -- >> he was perfect and he didn't get the job. as far as that perceived

of years. used to be at "newsweek." the blood feud is between the clintons and obamas. according to to klein, they hate each other. >> he goes into something in the book apparently outlining something hillary's aides put forward saying in 2012 amid the benghazi attacks in libya that hillary clinton knew christopher stevens died and she had no doubt in her mind there was a terrorist attack there. okay? then president obama had other things in mind, and this is a tear-out from the book. it says, quote, after president obama here said that you've got to put forward a different story here -- >> the president called hillary at 10:00 and said hey, you've got to say it is a video. >> this is from the book. that story won't hold up as she is talk to go her husband bill. i know. i told the president it is an impossible story, billing said. i can't believe the president isn't claiming terrorism. maybe i can. it looks like maybe the president isn't going to allow anyone to say

terrorism isn't on his watch. >> who is the source? chelsea? how could you get in between them? >> according to the book it is one of hillary clinton's legal advisors gave this information to mr. klein. in a few minutes kenneth timmerman who wrote the book about the truth of what happened in benghazi, he says he doesn't believe the book because of the timing. the way it worked out, it was in his book too, the president called hillary at 10:00. at 10:08 she issued a press statement. how do you do that in eight minutes? >> i agree with you. i'll add something else to that. if you are hillary clinton and you're doing this because you work for the president, would you stare the families in the eye it the hangar and tell them a false story that a video killed your kid? >> according to mr. klein, he says while hillary is talking to bill clinton, they're talking about maybe i should just quit because i can't say that.

and they come to the point where it's kind of like, you can't quit. it could damage obama. and if you want to run for president, the democrats would never forgive you. so she decided not to quit. if she's going to be a woman of integrity and the president is telling you to tell a story that you know is false, quit. i mean, just quit. mr. timmerman says the reason people reached out to ed klein and are pushing this fake story is simply to preserve and save her hans to run for president in in 2016 because she bears responsibility for not providing security that night and also they've got that rapid response force, she didn't deploy them and she should have. >> let us know what you think about that. in the meantime heather nauert stands by with headlines. >> that was quite a story. >> no kidding. medical center at fort sam houston and will continue to receive medical and psychological care at that base. the army says his reintegration process will involve exposing him to more people gradually. this as an investigation into how and why he walked off base in afghanistan in 2009 will proceed once he is cleared medically. >> stress and heart attacks have long gone hand in hand for a very long time but now we may actually know why. a new harvard study shows a large amount of stress can cause an overproduction of white blood cells. white blood cells are usually considered the good one in the body but actually producing too many of them can lead to blockages in the bloodstream. researchers gather data by studying actual doctors working in the i.c.u. when the doctors were on the job the white blood cell count was a whole lot higher. a boozey boat party ends with a crash into a runway at new york's la guardia airport.

actually this pier just off the runway. now there are major security concerns about how easy it is to get so close to the planes there at the airport facility. police were unable to reach this point to figure out whether or not it was a threat for 30 minutes. apparently they don't have nighttime patrol. they say the reason is budget cuts and that boat, by the way, easily breached the 200-foot restricted water way which is around the airport. imagine this. you're outside doing some yard work and then the neck thing you know, you're thrown off your feet, sean o'connor says this happened to him. listen to this part, though. he was knocked straight out of his work boots after he was struck by lightning. look at those boots and listen to this. >> i could smell burned hair. i looked at my leg and i noticed my leg hairs had been singed. >> look at those work boots. those are laced up, blown right out of his boots. those boots were found on the other side of the

you talk about a terrifying experience, a couple falls off their boat near the florida coast and ends up spending the night in the ocean treading water for 14 hours. >> luckily they were spotted and rescued by a group of fishermen. steve couch was one of the fisherman and joins us now. you're in this boat fishing for dolphins and you see people. what did you think? >> our first thought was how in the world did they get seven miles off the coast? we didn't know if they were

snorkelers or somebody fell off or what. >> so you get to them and then what was the first thing you noticed about them when you saw them face-to-face? later we would find out they treaded water for 14 hours. what did you see? >> well, when we pulled up, we see a couple of people. i was shocked that they didn't have a life preserver or anything on them. they were basically treading water and probably had some big smiles on their face once they seen us show up. >> how long from the point when you spotted them to the point you got them on the boat? >> it was probably a few minutes. it was hard to tell because they were thinking more about getting them on board than really keeping track of time. i know some people thought we should have taken some video, but we were just thinking about getting them on board. maybe five minute. >> what did they say had they got on board to you? >> extremely thankful. a little bit in shock. they were kind of quiet and subdued, which was very understandable.

main thing we were concerned about is finding out if they were thirsty and obviously they were and needed food. >> i understand the man came across three or four jelly fish. but besides that, there was no big attack, shark or anything like that? >> no, not at all. as a matter of fact, we were talking to sean and he was expressing his distress he was going through wondering about shark attacks. and he said when he hit the jelly fish, it stung for a while, but just the whole entire situation of him worrying about other things a lot worse than that, i guess he was able to annual -- handle that fairly well. >> did we find out how they fell off their boat? >> they told us that he's evidently charter captain and they were heading out to sea out of key largo and they fell off the transon of the boat. i guess it was locked in forward gear and he said when he hit the water, he knew he was in trouble 'cause the boat was just continuing to go and they started treading water at that

iraq, what's gone on over there. we spend $2 trillion, thousands of lives and what do we have? we have nothing. we have people that threw us out. the day we left, they threw us out. we couldn't even call them and suggest what to do. so it's a mess. >> right. mr. trump, before you go, you wrote an op ed in the new york daily news talk being the five guys here in new york city who wound up -- they were part of the central park jogger case. you wrote, my opinion on the settlement, they got $40 million. of the central park jogger case, it's disgrace. one thing we know is that the amount of time, energy and money that's been spent on this case is unacceptable. the justice system has a lot to answer for, as does the city of new york regarding this very mishandled disaster. why was it a disaster? >> it is a disgrace and these are five guys that admitted to it and then later on their lawyer said oh, police brutality and et cetera. the standard stuff. certain cases i'm sure that's true.

but i don't know in this case. her doctor who was so brutally raped said that couldn't happen. and the jogger's doctor said it had to be more than one. there are so many different things in this case and this is a case that should have gone to trial, but it wasn't. they gave them $40 million. they were beating up and very, very badly hurting other people, according to what i've read. and it's a disgrace. they got $40 million from the highest taxed city in the country that needs its money and they settled for $40 million. i will tell you this, their lawyers are laughing all the way to the bank. and i wonder how much their lawyers got of the 40, or did the city pay them in addition to the 40, or did they get some of the 40 and some of the addition? so i think it's a disgrace. these are people that admitted they did it and then it was recanted. they said, well, we were forced to say that. lots of other factors. many other factors. by the way, they were in the park and they were doing damage to other people and very bad

a new book citing one of hillary clinton's top legal advisors alleges that president obama called her up and tried her to spin the benghazi happened because of that video. but as hillary is sending out aides to clear her record for 2016 and not perhaps tell the story? ken timerman is the author of the book, he joins us with his take. good morning to you. >> good morning. >> edward klein has a new book out coming up "blood feud." in it he says the night of the attack on september 11, the president around 10:00 o'clock calls hillary and says, hey, you got to say it's because of the video. and she eventually just a couple minutes later came out with the story with a press release that said, we're blaming it on a video. okay. that's what the official record is. what was going on behind the

scenes? >> we know, and i reported in "dark forces" on that phone call between hillary clinton and president obama at 10:00 o'clock. we know eight minutes later, she released the statement from the state department blaming it on the video. it wasn't that one phone call that lined up the story that created the story. i think that's where they agreed on the story between the two of them. it's something that had been going on for a couple of days. the u.s. embassy in cairo had been tweeting about this video. a lot of people believe that's what got the attention of some of the collaboration in tie cairo. nobody in benghazi had ever seen it and had absolutely zero to do with what happened in benghazi. >> according to the story in klein's book, what happened was the president called at 10:00 o'clock and hillary wound up calling her husband, the former president, and they had this conversation. here is an excerpt. that story won't hold up, bill said. i know, hillary said. i told the president that.

we don't have to have this morning. elisabeth? >> maybe he called for help on your phone, brian. >> maybe he did. thousands of immigrant children are pouring in to the borders and agents and aid workers are struggling to care for them with this influx, a brand-new worry arising, a possibility of outbreaks from any number of diseases, including some we haven't seen in years. so should we be concerned? dr. mark siegle joins us now. we see the amount of children they were predicting up to 80,000 children expected to cross illegally this year and 2014, along with the kids comes some sickness. what are we looking at? >> i think that this is a big public health crisis that's emerging. we talk about a problem with illegal immigration, but we're not talking enough about the medical side of this. if someone comes into the united states as a legal immigrant, we screen them for tuberculosis and for all kinds of diseases. we usually catch it before they come in. if they come in illegally, we're faced with a situation where

they're living close together, there is a lot less very good public health measures in place. we're having a scabies epidemic among them. that's skin condition with intense itching and rash due to a mite and it's highly contagious. and ten to 25% of the immigrants coming in this way have scabies. tuberculosis, we thought we were stamping that out in north america. it's now reemerging. multiple drug resistant tuberculosis, which is harder and harder to treat. denge fever, 50 to 100 million new cases a year world wide. in mexico, it is indemic. it's a terrible disease. you get fatigued, bones hurting you, muscles hurting. it takes weeks and weeks to recover from. no team. it's now emerging in texas because of the immigration crisis. >> measles and chicken pox and leprosy? >> absolutely. i don't want to scare anyone more than i already have.

leprosy, extremely rare. denge fever, you need mosquitoes. but they're starting to breed now in south texas. this is a major problem in texas and arizona now. >> given the close quarters that we see in terms of the holding areas and the transport of the kids here and then adults as well, we're looking at also a school season about to start. is someone working on cures for these and preventive steps that parents can take before the school season takes in the fall? what do we need to know? >> measles is going to spread among anyone that hasn't been vaccinated. it has a 90% ineffective rate. make sure now that your kids who are going to school had their mmr vaccine because if you're in that area of texas or arizona, it's probably going to spread among those children. 80,000 children. >> they're bussing many and flying up north. massachusetts the latest. this won't just be in the south. >> i would urge physicians to be on the lookout for these kind of things. somebody in that area has fatigue. think of denge fever because we don't have a vaccine for that yet. and mosquitoes may start to

life line thrown to a submarine. the michigan judge who said matthew heinze could lose custody of his six-year-old daughter if he didn't show in court today is now delaying proceedings until the petty officer is available. congressman mike turner has been fighting for national laws to make sure military deployment isn't a factor in child custody cases and this helped him get that point across. at least this judge wised up and realized what's going on, right, congressman? >> absolutely. we're very glad that she followed the law. previously she had said she'd go forward even without matthew heinze being present, which would have been a violation of the service member's civil relief act. it's good the judge is following the law. but we still have matthew heinze in a custody battle. >> this is not the only case. about a million people are going

back and forth in two wars over the last 13 years, marriages have frayed and custody battles have happened. why are you having trouble getting this case to resonate and become a national concern? >> the house passed five times a bill that i have put forward that would make a national standard that would protect service members from courts using their either past or future deployment against them. unbelievably, family law courts across the country have used deployment time to take custody away from service members. it's just not right. they're serving our country. we should honor their service and we should also make certain that this is not a stress factor for our service members where they worry about losing their children. >> here is what the ruling says, the custody statement is this: this court would not cause mr. heinze or any other person in military service to suffer prejudice as a result of their military duty while in service to our nation. do you think this will help you get it through the senate? >> it should, because this highlights exactly the circumstances where our hearts go out to the family and to our

service members who are concerned about being able to both seven their country and maintain the custody of their children. >> right. we're not taking sides in this relationship. we're just trying to give a military man a chance to give his side of the story and not be affected. do you believe that the fact that he is deployed elsewhere might affect the custody he gets awarded? >> absolutely. that's exactly what you just said. we don't want to put ourselves in the position of the judge or in the determination of custody. but we do believe that service members' time away, while they're deployed, should not be used against them. it shouldn't be circumstances of the judge saying, well, you've been gone, therefore, custody to the other parent. they should stand equal to the other parent with their service to their cray not being used against them. >> i'm sure matt is grateful for your support. congressman turner who says we're not getting things done in congress and people aren't doing it for the right reason, get it passed.l get wind at thanks so much. >> thank you. five minutes before the top of the hour.

which is grabbing land in iraq left and right. doug mckelway is live at the white house with the very latest on mr. kerry over there. good morning to you, doug. >> reporter: good morning to you. our james rosen, who is traveling with secretary kerry, enlightened us about an on the record background briefing from a senior state department official which is unusual. this official said that in the present chaos, which is iraq, it would not be unforeseen, it would not be unexpected for the kurds to maintain control of the city of kirkuk. that's the first time we've heard that from this administration, to my knowledge. this official also described current president al-maliki as extremely, quote, anxious amid the isis advance there and all of them are look to us for answers and solutions, like a magic wand. he also said that it's really important for reporters to understand that isis is an army and that is significant 'cause it's the first time we heard that from the administration or rather from other senior state department officials who have

described isis as a terrorist organization and a criminal syndicate, but not an army. that's a clear distinct and differentiation. earlier yesterday kerry addressed speculation that the u.s. wants al-maliki out and that it is involved in picking a new leader of iraq. he said that's not true. here is the secretary of state. >> that is up to the iraqi people. we have made that clear since day one. it is up to the people of iraq to choose their future leadership. >> reporter: kerry said also that the kurds are dissatisfied with the current situation, that the shiite are dissatisfied with the currents situation, as are many of the sunnies. he echoed calls coming from iran that it is vital that whoever leads iraq in the next couple of months not make the mistakes of the past and that it is vital that the leadership represent all of the iraqi people. we'll hear more as the secretary of state wraps up these meetings with al-maliki, which are in progress as we speak. steve, back to you.

as far back as five and as far back as 2009 this company connected the two. they said this, almost a little tweet advertisement here. if the irs uses sonasoft products to bang their servers, why wouldn't you choose them to protect your servers? >> this was all new to us until yesterday. hey, wait a minute, sonasoft was backing up the e-mail? that's great, because there is a trail because the irs said yeah, we only kept the tapes for six months. and we've destroyed them. great. now we hear about this company. but then we discover even though they started in 2005, they had a great business relationship with the irs, inex olympicably, and abruptly, the irs terminated the federal contract shortly after republicans in the house started asking questions. dave camp, the guy who runs the house and ways committee, sent a letter to lois lerner saying, hey, are you targeting people? just a couple days later, her hard drive crashes.

massachusetts, where reportedly so far at least seven planes have landed. richard moore is a democratic state senator from massachusetts and joins us live. good morning to you, richard. >> good morning. >> all right. so there are reports out there that at least seven different planes full of children, adults, illegals being sent to your state. what's your problem with this? >> there are several problems. one is that the public ought to have been made aware of that. we didn't become aware until we started hearing rumors basically on social media that planes were being landed and at the time at least the suggestion was that some might be actually released into the general population. the house republican leader did contact the secretary of public safety for massachusetts and her response is that we've had since the mid april, seven flights that ice has brought into the

state. of two them got diverted to logan for an emergency, but the others landed there. and under state police awareness and oversight, the concern is that while they do -- if we have hold them, the federal government does reimburse us for that. the concern is that if they are released or if they escape into the general population, or an earlier report you had on "fox & friends" today on the health issues that are accompanying illegal aliens that are communicable, if those are put in our jails, could be in a closed population like our jails, could easily be contracted by our own prisoners and many of those in the county jails particularly end up going home within a relatively short period of time. >> and as we look at those images right there, how many people might have tb or might have measles or something that

this weekend. the captain took off after the shark started nibbling at the boat's engines. we need a bigger boat. it's been nine days since firefighter michael herdman went miss not guilty california's national forest. this morning a huge breakthrough here. ainsley earhart here with those details and the very latest. what do you have for us? >> good morning to you. let me tell you what the latest is. late last night, rescuers had a glimmer of hope. his dog, duke, is found in relatively good condition at the trail head in loss padres national forest where this began. duke is estimated to have traveled more than 12 miles since first going missing last week. >> the dog is exhausted. i saw the dog, it was literally passed out in the lap of my sister. >> reporter: they might take him back on the trail to aid in the
