a federal judge regarding indiana earlier in the day. and this is a federal appeal's court that upheld a lower court ruling and striking down utah's gay marriage ban. the panel put that ruling on hold so that it can be appealed to the entire u.s. circuit court of a polls and perhaps to the supreme court. this will affect utah and the other states that are part of the 10th circuit and the ruling is on hold now. and a lot of people think it is something that the supreme court will take up because a number of states and federal judges ruled in state after state that gay marriage must be allowed to proce proceed. whether or not the supreme court agrees is yet to be determined. we'll stay with that on fox. and revise settlement on the

everyone seems to be okay. >> we go to our extreme weather now with a look at how today is shaping up. >> that smart mom get into a bathroom and center most room in your house put walls between you and the outside. that's how you get a much better chance of surviving this. a lot of weather out there today. none of it that will be hugely severe but big rain showers in some of these thunderstorms across parts of texas could cause flooding. same goes with these storms that we have across parts of the northeast and then the bigger chance for severe weather is out here across the high plains from montana and north dakota all of the way down through eastern parts of colorado where mostly we're looking at hail threat today. we can't rule out isolated tornado. the same goes for the next three days here and hail is the biggest story each time. some hail will be very large. we saw yesterday in parts of colorado some areas that saw 6 to 8 inches of hail. that causes a lot of damage across a lot of areas there.
