>> it is a unanimous opinion. all the justices agreed when the president decided to make three appointments to the national labor relations board the senate was in session and when he did so the president stepped over this is constitutional boundaries. justice stephen breyer wrote this we hold for the purpose of the recess clause the senate is in session when it says it is. it retains the acted to transact senate business. she senate made that here. >> there's a lot of danger in the executive branch keeping too much power. we need to be able to push back to the president and remind him he's not a king. >> but majority leader harry reid said they got it wrong. since president obama took office senate republicans have done everything possible to deny qualified nominees from receiving a fair up or down vote. president obama did right fon

behalf of the american workers. and monday the hobby lobby decision as to being devoutly christian and said it would force them to provide employees cost free access to 20 forms of contraception including four the hobby lobby owners believe can cause an abortion. we'll see monday what the justices think about that religious freedom claim. >> thank you. we'll be watching monday. another bombshell when investigators discovered shocking e-mail that disagreed irs official lois lerner targeted republican chuck grassley of iowa back in 2012 and e-mail showed lerner sought to have grassley audited after receiving an invitation meant to go to the senator. and we turn to carl cameron standing by in washington with all the details. carl, it never ends. >> now outrage and new calls for a special prosecutor all of this

comes because a nonprofit group wanted to invite both lois lerner and senatorbz5grassley t an event the invitation for grassley mistakenly went to lerner and an offer for taking expenses and lois lerner looked at that and thought there was a potential for an audit. that e-mail has since surfaced. senator grassley knew about it about two months and been very careful using language on three b by 5s in a new investigation of the irs scandal. so angry and outraged are republicans that ted cruz went to the floor of the senate and put in the historic record forever his charge that there should be immediately on the u.s. senate a resolution to appoint a special prosecutor and democrats should support it. and he said if eric holder the u.s. attorney general in the obama administration's appointee

there does not appoint a special prosecutor he should be impeached. very tough stuff. look for the house of ways and means committee to push his own investigation into this. he has jurisdiction over it. all across the hill the investigators are going back into this thinking they have another example of lois lerner's abuse of power. one thing on house speaker john boehner's lawsuit against the president. he's going forward with it now, that's clear, strengthened in part by the decision of the supreme court shannon was just talking about it. we have a decision how it will be done. the resolution's language has not been written but go to the bipartisan legislative advisory group two of the top democrats in the house and top republicans and the speaker in john boehner's case is a republican and 3-2 majority to approve it, sent to the house rules committee on the floor for a vote and the house has the majority to pass it and hoping this is so egregious they will pick up a few democrats to go along suing the president.

that was a lie. we had danny werfel dispatched by the white house last may and testified there was no wrongdoing even though the didn't interview until employees and that was a lie. >> and we can go back to other scandals, fast and furious and benghazi and seems to be a pattern of behavior and it gets worse. >> that's right. we learned today the commissioner of the irs, you heard his name a lot in the news, he's been giving to the democrats all these years upwards of $85,000 of his own money, the commissioner of the irs, since 1980 he has given to every single democratic presidential candidate including barack obama in 2012. that's when all the scandal was going on. first, we have the irs losing the e-mails and now we find out the epa has also lost e-mails. >> i heard about that, too. also, we went over the timeline

of that. the timeline is very suspicious. you have lois lerner and 10 days after the scandal investigation begins, hard drive crash, the other people's hard drive crash, they get rid of the company, the backup service. these e-mails were subpoenaed in august 2013 and knew they were missing in february of 2014. the irs commissioner said you will get all the e-mails in march of 2014. they didn't tell congress until june this month. >> exactly. she originally in 2011 asked for her it department. she said, i've lost some personal data, now, they're saying they have lost e-mails. what is it? personal data or lost e-mails. it seems very suspicious at this point. >> we've been talking to a lot of it. t. people. they think they may be retrievable. you'll be back. >> it's the best country in the world. can't we get the e-mails? >> and all this reaction of the boehn boehner lawsuit and scandal.

constitutional professor of george washington university is jonathan turley. thank you both for being here. ron, i was particularly interested in your comments. we had john on a number of times talking about a constitutional tipping point. you said you were naive to give obama the benefit of the doubt last year on the irs. why? >> thanks for having me on. because exactly a year ago i called for a special prosecutor because at the time, this was early on only six weeks into the scandal, it was clear to me we had probable cause for an investigation. it was clear to me the republican house was incapable, especially daryl issa of running a really they're r-- thorough deep investigation without grandstanding. and clear to me the white house if they wanted not to be credible to get the evidence out. i wrote in that column i'd like to believe if there was anything nefarious here it was not done with direction of the white house but we needed to get the facts out.

what's happened since then in the last year is shortly after that column the white house started talking about a tony scandal which is ridiculous because we haven't gotten to the bottom of this yet. a few days ago we found out we had these missing e-mails. yeah, i feel kind of naive for even thinking about giving them the benefit of the doubt which doesn't mean i stop doing my job. i called for a special prosecutor right away. now, we're at the point where we still don't snknow whether or n there was an abuse of power in the irs. we have both parties posturing and grandstanding and we still don't have a thorough investigation why i think we need a special prosecutor. >> i agree with you totally. you need objective eyes on this. now, with each developing part of the story, are you more suspicious that something nefarious was going on? >> yeah. how could you not be? i wrote the night the e-mails came up missing by the way happened on a friday night when you try to bury news, you can't

blame anybody now. you can't blame any american for being suspicious about this. the white house every time they blow this off and act smug about it they're undermining their own credibility. they have to realize they're undermining their credibility but the public's trust in government the core of the democratic party. this is bad politics, bad policy, bad governance. >> jonathan, you and i don't always agree politically but you have been an incredible watchdog as it relates to the constitution and separation of powers and co-equal branches of government. we've had you on talking about what we may be at a tipping point constitutionally in the country. as it relates to today's supreme court decision and in this particular case, and the president you said effectively has rewritten laws, crossed the constitutional line, what is your reaction to the courted decision today and what impact

will this have on the president moving forward? >> it was a fascinating decision. i testified at the hearing, the judiciary hearing committee after the appointments were made. i testified at that time i believed they were flagrantly unconstitutional. they are close questions, as i said to the committee in constitutional law, but this was not one of them. i'm still astonished that the obama administration litigated this case. they abandoned a long principle of past presidents not to push these to final decision. this decision today wiped out decades of efforts by prior presidents to try to increase their authority in this area. it's a major major loss. but it's the right decision. at the end of the day, it means the president again violated the separation of powers. this is becoming something of a serial violation for the president. what the president did here i can't imagine any competent

lawyer would look at it and say, yes, you do have that authority. it was clearly an effort to circumvent. there was a paragraph in this long 100 page opinion overlooked. the paragraph from the court says that this clause is not there for branches to work-around other branches. it essentially was a veiled referenc going it alone. the court said there's a clear purpose to this clause. it's not there to be used effectively as a weapon. i think that's a shot across the bow in a lot of these different areas. >> we have to leave it there. i wish we had more time, ron. nu and jonathan, as always, thank you. appreciate it. coming up, mississippi senate candidate, chris danie mcdaniels, why i he is not conceding to that cochran. and i want to show you new flyers we found today and later

pentagon welcome back to hannity. the gop fight for the mississippi seat is far from over. senator thad cochran narrowly won the runoff. his opponent refuses to concede and joins me to explain why. here for his first interview since tuesday's controversial result. chris mcdaniels. good to see you. >> thanks for having me. >> the first thing i want to ask is what was your reaction to this and more importantly the campaign? i'll show some of the things that were said about you in the campaign. what was your reaction to how they campaigned against you? >> it was shocking. i'm a two-term state senator. been a republican since i was 13 years old. i paid my due, gone door-to-door, given my money and consider these men and women to be my colleagues but desperation and push for power pushed them

over the edge. tuesday evening the republican primary in mississippi was not decided by republican voters, decided by 35 to 40,000 democrats. that's unprecedented and extraordinarily unusual. >> 6,000 votes now separate you. there is some issues whether or not people that voted in the democratic primary might have crossed over into this runoff, which would have been illegal. are you calling for a recount? >> it's not so much a recount. we're looking into the issue whether or not people who participated on june the i3rd primary crossed over tuesday night and we found more than 1,000 examples of that in one county alone. talking about widespread irregularities, in eligible voters shouldn't have been there in the first place. they were pushed there by an aggressive overt action by senator cochran full of

race-baiting, distortion and lies. he literally ran the latter three weeks on food stamps, ran on voter suppression and ran on pork. mississippi is a conservative state. one would think our party was a conservative party. this proves otherwise. >> let me put upthon screen, i have two flyers that were being circulated we've gotten our hands on here. the first one says the tea party intends to prevent blacks from voting. then they go on to attack the tea party. then there's racial terms you, chris mcdaniels, tea party voted against the mississippi civil rights museum, opposed federal funding for public schools, nursing home photo scandal, made racial comments on a radio show. we have another one that says tea party intends to prevent you from voting and at the bottom it says chris mcdaniels in d.c. is a step back wart for mississippi. we've come this far, can't go back now. then there was this robo call. i want you to respond to all three of these. >> hello, neighbors, the time has come to make a stand and say
