came in? >> there is a muslim edict that allows a person, a muslim, to lie, to cheat, to steal, to do anything if they're confronted with the enemy. so they'll lie about their treatment, lie about who they are, what their business is all in an effort to deceive us and to get out. and it worked. >> what kind of life do they have there? >> pretty cush. in a lot of ways -- one of my complaints -- their medical care is better than that for our troops. i was responsible for coordinating medical care for detainees and the guys and constantly complaining about the lack of adequate care for our guys. >> unbelievable. when you say these people on the outside are saying that is not what our country is about. we're not about gitmo, not about keeping people anyplace indefinitely, for a guy who's been at gitmo, worked there serving our

turns out you can breathe a little easier on this friday morning. nasa has been taking an out-of-this world look at our air quality over the years and results are in. joining us from the goddard space flight center in maryland is nasa scientist dr. michelle fallen. we saw these images and they are stunning. you have taken images from 2005 and compared them to 2011. explain what we're looking at and why the air is getting cleaner. >> yes, we have the satellite that's been up for almost ten years now and we've been looking at nitrogen dioxide which contributes to smog and ozone pollution. when you look at the united states, you can see the colors we have. the red areas show where there used to be a high concentration of this gas in 2005. in 2011 things are much better. in new york city, for example, you have a 32% reduction in this smog and

pollution producing gas in the last ten years and that's pretty significant. >> unfortunately i'm still living under the red zone. let's take a look at denver. >> the manhattan area. >> exactly and my county in new jersey. let's take a look at denver. they were in the red zone significantly. it's faded out. it's less red, more pink. what does that mean for the people who live a mile high out there? >> it means a lot of better respiratory health. nitrogen dioxide can be bad for your lungs. as the air quality improves we're going to see, we hope, less asthma attacks, less people advised to stay inside on one of those unhealthy days. this is attributable to cleaning up our emissions. emissions from power plants and cars. we're driving more cars, going more miles but producing less pollution. one car today only pollutes about 1/20th the amount

son. >> there was blood found on the child's clothing. they don't at this point know whose blood it was. according to the nbc affiliate in that town, the story is that apparently the kid was afraid of punishment because the kid was told to do 4,000 strides on an elliptical trainer. about halfway through he told his mom i have to use the bathroom. he then disappeared. the worry apparently the child had was he was going to be punished by the father because they also found a p.v.c. pipe that apparently the father used on him for punishment. currently the boy is with his mother in detroit. and the step mom is in jail on a weapons charge, probation problem. >> pretty dramatic moment on television. >> what do your gut instincts tell you today, why this could have happened? >> 11 days in the basement. >> i'm just glad he's okay now. where he will be in the future, let us know what

p.m. take a look at that, just incredible and so ominous. i do kind of want to explain a little bit of the difference between a water spout and a tornado. there is a misconception that a tornado or water spout is a tornado over water but that's not true. they are different. a water spout forms from slightly different ingredients and is also a little bit weaker than a tornado and a tornado can form over water. a little confusing but that is in mobile, alabama. look at that. incredible. we have the risk for actual tornadoes coming up today and also into this weekend. temperature wise across the country, highs widespread in the 80's and 90's as we head into this weekend. like i mentioned, we do have the potential for severe weather and flash flooding especially across parts of the northern plains. this is where we're expecting several inches of rainfall and there's a look at that severe weather risk coming up this afternoon from parts of oklahoma to north dakota. as we head into saturday and sunday, that severe

concern given the situation of tens of thousands of kids moving through this nation illegally. what are we looking at here with h1n1? >> it's indicative of the fact that these children and the people coming in can't be screened. this child had a fever for several days and nobody knew about it and nobody checked him. so now the flu spreads after about four days, four to seven days. he's leerily going to -- leerily going to spread it to people around him and health authorities are sending in 2,000 doses of vaccine. but the problem with the vaccine, which i completely agree with that move, but the vaccine takes two to three weeks to work. in the meantime, flu may spread to people around. >> and given the number of children and adults that are in these camps together right now, quantity alone and the ability to just contact somebody else and be able to contract this is high, i would imagine. >> 25%. and we're talking about a strain of flu that is particularly problematic for children and

pregnant women. we really have to be on the lookout for that. it's also a flu, because it was a pandemic five years ago, does not follow seasons 'cause people out there may say, why is this flu happening now? and the child came from central america. we were checking in on that yesterday. the receivable is the same as here. it's hot. but you can get this kind of flu even when you're not in the winter. >> if no up with is being checked, who knows what else is being passed along as well? >> highly infectious diseases. >> are we looking at a future pandemic here that may not be so distant? >> i don't think so, because we already had a pandemic from this particular swine flu virus. a lot of people have immunity to it. i don't want to scare people. i think it will spread. i think you'll see an outbreak as a result of this. it will not ignite a new pandemic. >> should we be getting a flu shot? what can we do to prevent this from coming into our homes? >> that's an excellent question. we all had flu shots, most of us had flu shots. that won't cover us now.

it's too late in the season for that. but i wouldn't recommend people get an h1n1 shot unless we see this spreading out into the communities and around. as you pointed out the other day, unfortunately, people are getting on buses from some of these centers. so this could show up in a distant state. right now i would not recommend the flu shot for this. but i would monitor it carefully. people in outlying areas, 'cause we've seen tuberculosis spread from these camps. i think people around artery should consider an h1n1 shot. >> in the season when some parents, if they don't get immunizations, don't do this at your doctor's office, are you recommending that people stay on track with immunizations because of this situation? >> hugely important. we were talking about this. measles especially. mmr vaccine, mmrv vaccine. school is coming up in a couple of months. if you live in texas, arizona, even outlying states -- >> massachusetts. >> massachusetts. everyone should have their childhood vaccinations before they go to school, period. this is a reminder. the cdc, i want them more actively involved in this

big question over the futures of some of president obama's most controversial appointees. here is what happened yesterday after yesterday's unanimous supreme court decision claiming the president lacked the authority to make those recess appointments because they weren't in recess. the senate was still in session. fox news judicial analyst judge andrew napolitano says this is bigger than those three people that the president illegally appointed and could reopen hundreds of cases they already decided. the president wants these people in. he knows it's going to be a heck of a time doing it.

charlie was found in the basement, so much so that the police chief was hugging this young child. the child looked relieved and happy. but the big question was next, where was he going to go? he went right to children's hospital at first yesterday. they went and checked him out, made sure he was all right. he was in the company of his biological mother. that's where he's staying right now. the latest on this case takes us back to that very town house where this little boy was found. 12 years old, found, according to him, he said his stepmother helped him hide out in the basement for 11 days. we're not talking to security personnel at the town house who say that's impossible. that place was checked out each and every day. keep in mind, this is not just a basement for individual units. this is a basement that essential israeli a hallway that connects to different units. he was standing or crouching next to a water heater in that area. the very latest information we're getting now is that that stepmother, who charlie says helped him hide out there, that very stepmother is now in police custody here with detroit police. why? has little to do with the

question. the president, his pen and phone, could this open the flood gates of reining the executive power in? >> maybe, given the composition of the supreme court with a conservative 5-4 majority. if they can get a plausible case to the high court, it could be a whittling away of the executive powers. the thing is, these things are trendy. this generation, they get more executive power, the next generation, more legislative power. the pendulum swings back and forth. but they're pretty narrowly defined. we have a brilliant, coming up on july 4th, a brilliant government executive, judicial, and legislative and it works pretty well. i think that we'll continue to prosper -- >> even if two are being ignored. >> even if two are being ignored, they may win one of the lawsuits. the problem is and this is the real bottom line, here you have a lame duck president. he'll be impossibly tied up in all of these various hearings.

police in some states where medical marijuana is legal are now thinking twice before seizing illegal marriage plants. why? because some people are actually suing to get their pot back. in cases where prosecutors decide not to file charges ultimately. so should officials weed out this problem? here for a debate we've got attorney who specializes in marijuana cases. he's out in denver this morning. and attorney gomez. good morning to you. >> good morning. >> brian, tell us why you think that going forward, if cops come into a place and there are a bunch of marijuana plants, for

instance, in colorado where marijuana recreational is legal and so is medicinal marijuana, why the cops should not seize the plant. >> we've had medical marijuana laws in colorado for 14 years. those laws do protect the rights of sick people to have marijuana plants. at the end of the day, the police should not destroy the property of innocent people. so we have medical marijuana patients are allowed to possess these marijuana plants. they're being confiscated by the police, charges are dropped. it's a basic tenet of our constitution that people have due process rights. the property that they have that's legal should not be destroyed and the voters of our state have spoken loudly on that. >> historically, marijuana has been against the law, and in fact, it's still prohibited under the federal statutes. so i get why cops historically, we used to go into back yards and pull everything out. i get why they do that. do they have to change going forward? >> the problem is the controlled

substance act says it's still illegal to possess marijuana. what you're doing in this situation is in colorado, and other states, you're filing a federal lawsuit under civil rights 1983 act. so you're basically saying the taking of an illegal substance and therefore, you should compensate me for it. obviously it doesn't make much sense. the issue in colorado is you have a right to get the marijuana back if charges have been dropped or if you've been acquitted. but there is no remedy. there is no remedy in the law. so what you're doing is clogging up the courts with these lawsuits. you're having judges decide this. you're having juries decide this and it's just simply not fair. allstate lawmakers have to do is write a remedies law. for example, if you took two plants, you should be compensated for the two plants if they fail to be preserved or if they die while in police possession. >> then the big question is, how much is one marijuana plant worth? >> that's what the lawmakers in colorado and other states have to decide. >> because some have suggested they're worth $5,000 apiece.
