on "the real story." i'm gretchen carlson. now over to harris falkner who is filling in for shep. have a fantastic weekend and great fourth of july. >> i'm harris falkner in for shepard smith and this is the the fox news deck. armed u.s. drones now flying over baghdad, but a senior official is telling fox news, president obama has not authorized combat operations there. so what exactly are the drones doing? drug cartels, sending enormous amounts of methamphetamine across the border. investigators say it's all because of a change in american laws. coming up, breaking bad mexico style. and german engineering versus american muscle, jerri willis puts the pedal down with a showdown ben a porsche and a corvette in matter of minutes. first from fox at this hour, the suspected masterminds of the terror attack on our u.s.
12:01 pm
consulate in benghazi, libya, will soon be an american soil. a senior official says the accused terrorist will arrive in washington sometime this weekend. his name is ahmed cat tall los angeles he has been on a navy ship sailing to the united states ever since our special forces captured him in benghazi nearly two weeks ago. he faces trial in d.c., accused of ore straighting the attacks -- orchestrating the attacks. ambassador chris stevens, state department officer sean smith, and navy seals glen dougherty and tyrone woods. we don't know what he told investigators about the deadly night but one's official confirmed they have questioned the suspect while at sea. catherine herridge is live at the federal courthouse. how soon could we see him in court? >> well, harris, the justice depth is not offering official comment on the timeline except to say things are highly fluid and the final call is up to attorney general eric holder. a short time ago, though, at the
12:02 pm
defense depth, they were fielding questions whether he was really kind of a big fish in this operation or essentially low-hanging fruit. >> we believe, and gathered the evidence to support the notion that he was a key figure in the benghazi attacks. >> in the last two weeks he has been held on the uss new york and has been questioned by a group known by the acronym the hague. high value interrogation group, made up of fbi agents, cia officers, as well as personnel from the defense intelligence agency. it's important to emphasize that anything he says in this context cannot be used against him. what we're looking at right now is a key marker or landmark in the case, because he is now going to make this transition from being a detainee on the ship to being a criminal suspect in federal custody and he will get the same rights and protections that any american would get in the federal
12:03 pm
judicial system. >> we'll get some legal advice on that in a moment. i'm really curious, as i'm sure millions of americans are, what in the world is this guy telling the people onboard that ship, any idea? >> what -- there's a tight lid on that but he has provided interrogators which is what is described as a history lesson on the ansar al sharia. a former fbi agent said to us that because we're not looking at what they're calling an imminent threat situation, an ongoing plot, this limits the time interrogators have with him. >> in a situation where there's not imminent threat you're more likely to see the investigators throttling back, being more patient in their interview and interrogation techniques than if it was just an attack was
12:04 pm
actually getting ready to happen. >> the key thing to look for, especially when the indictment is unsaled, whether there is -- unsealed, whether there is significant evidence he was a key player. he has been described as kind of the muscle on the ground and not the brains behind the operation. we have been pointed to is these individual with more firm ties to al qaeda, like a former guantanamo bay day takenee, and a form bodyguard for osama bin laden were the key players and brains and katala was executing their commands. >> you have to bet that's been the focus of some of the questioning on the ship. thank you very much. now, for more, let's bring in former federal prosecutor and justice department official doug burns, perfect person for this case. thank you for being here. let's talk about the jurisdiction in washington, dc. this happened off u.s. soil. why there. >> looked at the statute, 3238
12:05 pm
of title 18, and it says it's extra territorial jurisdiction, an action against a u.s. facility. and the statute says either try them where he is first brought or his last known residence, of if you don't determine either of those, washington, dc. i that's why it happened, by default. >> by default. now, it's my understanding that if tried as a civilian he gets the same constitutional rights that you or i would get. >> this is exactly the core, harris, of the whole debate about enemy combatants in a military trial at guantanamo bay vs. civilian trial. some people say why is he being afforded the constitutional rights to confront and cross examine witnesses, issuing subpoenas. >> to remain silent. >> because he is an enemy combatant. and that's a political discussion more than a legal discussion. legally the reality is, if do ochooses to go this court he
12:06 pm
gets all the rights. >> then if he is an enemy combatant, why not a military tribunal. >> exactly. that really would be my preference, frankly, and the reality is somebody who takes that kind of action, murders a u.s. ambassador and others, that's really an enemy combatant and should be tried in a military tribunal.

demonstrate beyond a reasonable doubt he did the crime, but i'm predicting that will be the case. z they had to wait 21 months extra to pick him up. people say -- the point is they were gathering evidence because it's in a civilian case and the depth of justice wanted to make sure they were dotting is and crossing ts. >> thank you for your time and expertise. we'll move on. a mississippi tea party official accused of lotting to take pictures of a senator in a nursing omahas apparently killed himself, according to police outside jackson. they say they found mark mayfield shot dead at his home this morning, along with a suicide note. he was one of four people police arrested after photographs arose of senator cochran turned up in a video online, the video seemed to suggest senator cochran had abandoned his wife and was having an fair with the staffer. the senator's children defended their dad. the suspects were supporters of his opposition candidate.
12:09 pm
senator mcdaniel says his campaign had nothing to do with the pictures and is refusing to concede the primary after losing a runoff and says he may challenge the results separately. >> the white house is now asking for a half billion of our tax dollars to arm rebels in syria and help take on the militants inside iraq. how do you know the weapons will not fall into the extremists' hands? that's coming up. geico's been helping people save money for over 75 years. they've really stood the test of time. much like these majestic rocky mountains. which must be named after the... that would be rocky the flying squirrel, mr. gecko sir. obviously! ahh come on bullwinkle, they're named after...

in the white house is requesting a half billion dollars to frame and arm rebel fighters in syria. u.s. officials say they would work with moderate opposition forces but there are alsod a kid linked insurgents in syria, some of whom are affiliated with isis, the same group of soup any extremists sweeping across northern syria into iraq. the red on the map shows just how much territory those militants and their supporters have already captured. that's a huge chunk of territory. secretary of state john kerry says the syrian rebels the u.s. is looking to aid are critical in the battle against those isis insurgents. jennifer griffin has more from1 washington. r֍6nnifer, all along the big question has been, how do you figure out who is good and who is bad in this? >> that is right. in fact what you're seeing in terms of the request for this $500 million from the white house, is a complete 0 about-face. president obama has now signaled
12:13 pm
he intends to ramp up the training of syria's so-called moderate opposition after resisting calls to do are so foe here toees. secretary of state john kerry flew to saudi arabia where he met with the head of the syrian opposition, day after the white house requested $500 million from congress to start the large-scale training by u.s. special forces. the request was larger than expected, and came as part of the administration's request for $68.5 billion in overseas contingency operations. pentagon officials indicated the training would not begin until next year. the training would last six to eight months but congress will need to approve the program. u.s. military trainers would take over a much smaller training program, covert program run by the cia out of jordan. the problem now is where to do it. the king of jordan is worried about becoming a target of isis if he allows u.s. trainers to continue using his kingdom for
12:14 pm
what could be large-scale training, harris. >> that's a valid concern. considering how much they've been able to accomplish and all the lives they've taken in iraq right now. will the united states be considering giving surface to air missiles to syrian rebels? just a year ago we were talking about red lines and how not to get involved. what has changed? >> well, the pentagon won't say in terms of these surface to air missiles about the syrian opposition has been asking for singers and for nearly three years. the u.s. does not want to provide weapons that could then make their way into the hands of isis fighters or al qaeda-linked terrorists who could use them to bring down commercial airplanes down the road. >> we're always concerned about the wrong stuff ending up in the wrong hands. but that doesn't mean that you stop the effort to try to enable and build the capacity of partners in a very tough part of
12:15 pm
the world. you don't just turn it off because there's a risk. >> the u.s. is in the extraordinary and contradictory position right now of supporting the syrian opposition, that was at one point alive with and spawned the isis fighters now returning to overthrow the iraqi government. >> you have been schooling us on who isis is for years, and now it seems like we say this word so much. jennifer, thank you so much. and now you'll hear it again in the same region isis militants are claiming responsibility for a bombing at a hotel in lebanon. investigators say 12 people were hurt, including an accomplice and three security guards. happened on wednesday in the capital city beirut. security forces were conducting raids for suspected insurgents when they approached the suspect in his hotel room, and he blew himself up. that marks the same such -- type of bombing in lebanon in less than a week. some republican lawmakers are set to send letters the white house, justice department, and the internal revenue service about thousands of lost e-mails they consider evidence. that's according to sources on capitol hill. lois lerner, the former irs official accused over targeting political groups for special scrutiny. she has pleaded the fifth to avoid answering lawmakers' questions. the head of the irs claims the agency has been trying to recover the e-mails on lerner's computer which he says crashed. not everybody believes that. fingers pointing and asking, are they hiding something? mike emanuel is live in washington. what else are we learning about the search for the lost e-mails? >> the notion these e-mails vanished makes no sense whatsoever and there into be an extensive paper trail of who handled lois lerner's hard drive and what was done. the irs commissioner admitted the e-mail disappearance was
12:21 pm
suspicious but reiterated he doesn't believe a crime was committed. house republicans are calling for a special prosecutor to investigate and wants outside government agencies towwñbb÷j h for those missing messages. >> every department that lois lerner had any blind copies or ccs to we want their e-mails, want them to go through e-mails correspondence with lois lerner, we want copies of those. >> expect lawmakers to keep up the pressure to make sure they track down more of the missing e-mails. >> what this latest from president obama on all of this? >> remember, the president telling bill o'reilly there was not a smidgen of corruption at the irs even though there were investigations taking place inch minnesota he suggest it the outrage is about politics. >> sometimes the news coming out is just -- he's are just washington fights. they're fabricated issues. they're phony scandals that are generated. it's all geared towards the next

12:24 pm
it economical? >> i'll give you the numbers. $73,000 for the corvette. so, 100,000 for the porsche. >> it's a bargain. so to speak. >> here's the other thing that blew me away. this thing is made out of fiberglas. you can practically pick it up yourself. i oversaid but it's light weight and has an engine the size of the engine in the escalade. so when i say mighty roar, i i'm not kidding. it's pretty darn impressive. you can see i spent most of the day there. sometimes you have to test things yourself. >> it's true. i noticed when jerri walked in she had a swagger going on. kind -- i knew something had gone right about your day. >> i think racecar driver -- although getting out of these things you need the jaws of life. you don't want to -- so hard to get out of. there's no lady-like way to do it. >> thank you for proving the details in the story. >> you're most welcome. happy to do it.

the united states is now flying armed drones over baghdad as an al qaeda spinoff group continues its march across iraq, takings temperatures we have fought for. that's the wore from a senior u.s. defense official who says throwns are only there for surveillance operations ruths now. the official also says president obama has yet to clear the way for any combat missions in iraq. and that official is saying the group i mentioned, isis, is teaming up with sunni supporters as they move closer to the capitol city, baghdad. here's another look at the areas that sunni militants have already taken. the captured areas in the red

12:33 pm
commandos has taken place in tikrit. but the reality is the isis fighters control a lot of territory just an hour outside of baghdad so it's not really clear that the military is pushed back or knocking the fighters back on their feet. there is some skirmishes across the country. the fighters still seem to be in control of a lot of territory, have taken the past few weeks but the military is regrouping in the sense they're beginning to launch these counter-offenses. now all of this is happening as we're beginning to hear that two different human rights groups say the isis fighters have executed hundreds, if not thousands, of iraqi police officers and soldiers in the past few weeks. the human rights groups have said they can document several hundred of the executions but say that the true number is probably in the several thousands. >> wow. conor powell reporting live. thank you. while they fight, this is happening. a power grab is unfolding in the

of an investigation into this re-call election campaign. that's according to a special prosecutor in the state. this comes after court documents indicated prosecutors believed the republican governor was at the center of a, quote, ongoing criminal scheme, to violate election laws. governor walker says he is innocent, and claims the investigation is politically motivated. prosecutors have not filed any charges in the case. mike tobin is in the newsroom. what did we learn. >> a statement came through an attorney representing the special prosecutor, saying as follows: it is wrong for any person 'ocontinue to to this sentence in a legal argument as a finding by the special prosecutor that governor walker engaged in a criminal scheme. governor walker zonkedded: -- responded. >> clear and important to report that not one but two judges made it clear they found that -- they basically supported our opinion in terms of this legal case.
12:36 pm
now you have the special prosecutor's attorney, further setting the record straight. >> it all came out of what wisconsin calls a john doe investigation. intended to be secret. there was a request for documentation that was released. those documents requested as part of the investigation may or may not indicate there was a legal coordination between governor walker and some conservative groups related to fundraising. it should benoted the john doe investigation had long been dismissed before the release over documents. >> what are the governor's criticking saying now? >> well, governor walker has a democratic opponent named mary burk.&vóás4÷ her campaign put together an ad aggregating the reporting about this. despite the statement from the special prosecutor, the campaign is refusing to take the ad down. >> thank you very much.

12:39 pm
out, that maliki himself is a problem. his behavior alienated the sunnies. he caused a rebellion amongst the sunnies. do they now support him? prop him up and contribute to the long-term problem of sunni unrest in iraq? do they withhold support? perhaps force a change in leadership? but at the same the entire counn over by militants and extremists. >> we have a u.s. embassy in baghdad, thousands of people, and some of our staffers have been moved. how safe is it in that city? we hear the insurgents are moving closer to baghdad. what's it like to be inside the capitol city right now. >> it's a pretty weird feeling, i can tell you. eights kind of quiet, kind of normal. we're looking at videos of the battles. nothing like that is happening in baghdad. it's much quieter than usual. you usually have a lot of bombs going off. we haven't had very many. almost too quiet for comfort.
12:40 pm
so, everybody is wondering what will happen next but at the moment it's quite normal in baghdad. >> we're looking at the streets of baghdad. normal except for the fact there are military soldiers everywhere. liz sly, thank you very much for joining us from the "washington post." your perspective and your reporting from the ground, we appreciate it. >> well, two men say they threw out their winning powerball tickets because they check the lottery web site after the drawing, and it showed the wrong numbers. now they are suing the new jersey lottery. can they win their case? i bought a car, over and tells you, and you're like. a good deal or not. that's what led up to us looking at truecar.com. and with truecar.com, there's no buyer's remorse.

lottery. let's bring in an attorney. evangeline gomez joining us now. do they have a case? >> well, let's start with what the lottery commission's rules are. first of all, a lottery is governed by basic contract law, where you provide the lottery commission with a winning ticket, not just any ticket. a winning ticket, and you get your award. now, you have these individuals here who are saying, those rules don't apply because we're not idiots. we weren't idiots for throwing out the lottery ticket. what happened was, you lottery commission, you were!éhu neglig. you were negligent, one in delaying the posting of the correct numbers, and you negligently induced us to throw away the winning lottery ticket. so the burden is on you. you caused this whole fiasco. >> any way to prove they had the winning lottery tickets? >> there are different ways to try to see where there is ticket came from, and there some reports saying it did come from the 7-eleven in%ñ,.]8-] mawa. it's now been a year and no one has claimed the winning lottery
12:47 pm
ticket. so there's something they're going to use in their lawsuit, proof this was the ticket. >> like surveillance video or anything like that. >> yes, again, that's also something that is very good. but their argument is it's in a dumpster. >> the way i read it, if you don't have the ticket you can't get the money. you have to have -- that's what it says on there, you have to have this ticket -- >> it's very clear. you provide a winning ticket and we give you your award. they're saying let's jet son the contract law here. enough it's tort law. the issue any judge will look at, if this case is entertained, would a reasonable person actually just throw out a ticket? >> well, sure, if they thought it was the winning ticket. >> maybe somebody may hold on it to for an extra day, and wasn't there a time stamp on the web site with this number that said, okay, these winning numbers correspond to today or now, should the lottery commission be responsible for someone who doesn't adequately read a webs? >> this is going to make me
12:48 pm
sound like the devil's advoca te winning ticket. >> there were two other tickets that were sold. >> would you take this case? >> no. it doesn't mean they won't prevail. >> if you wouldn't take it, they missed out on your skills. thank you for being here. >> thank you. >> the feds say they're seeing a sharp increase in the amount of methamphetamine coming into this country from mexico. we'll explain why it could have to do with a change in american laws, next.
