medical care. who is robert mcdonald and why him? >> why him is probably the big question. he ran procter & gamble for three years at ceo in the pick of a 61-year-old's ex-ceo is telling. officially it's run by a retired general or someone from the medical world for years mcdonald build a company product you have around the house. he's clearly being brought in to clean house. they were. a white house report on friday said the v.a. had, quote, a corrosive culture, a white house official today touted mcdonald's military back ground, mixed with business experience as, quote, the perfect person to lead the department of veteran affairs during this important time, end quote. mcdonnell went to westpoint, serving as a captain in the 82nd airborne, and an official

calling him one of our most accomplished business leaders and managers. he did run p & g for three years, but it would be impossible to call his short tenure at the hell a glowing success. had left after heavy criticism from a major investor for sending too much time on other corporate boards and his reorganization and budget cuts did not produce the long-term results. his sudden departure left many questioning if he was actually forced out by a board that lost confidence. mcdonald, the time wrote, during the past year much attention has been focused on me from several angles, which has been a distraction. he was actually replaced by the man who originally tapped him to lead the company. in the context here and history is important, mcdonald will face a potential grueling senate confirmation with lawmakers from both sides of the aisle cite nicing not only his character and experience, but also his performance. as you know, harris, in washington one of the few things

people can agree on is he has a road ahead which will be as different as important. >> this is not just been a scandal that has divided washington. it's something that has been bipartisan, people across the country, our military vets at the heart of this, and the way we care for them and show them respect for versus served our condition u that's what he'll deal with when he comes in. you know, arguably, just about every job in washington is political. so does mcdonald have ties to the white house? and if so, how so? >> we've only had his name for a couple hours. we've been doing as much digging as we can. he was at the white house for a meeting in 2012, but actually, most of the ties we can find political is money he gave to republicans. and to a committee called promoting our republican team. >> so it sounds like potential

he would have support across both sides of the aisle, but what you brought up before is interesting. that has to do with his job performance previous to procter & gamble. >> that will be interesting. how much does that play out during his senate confirmation? how many other people within the board do they call or at least interview to figure out what his experience was and why, after he left in just those three very short years. you get a sense of how the confirmation may go. bernie sanders, the chairman of the senate committee there, put out this tame, saying, quote, i look forward to meeting with mr. mcdonald to ascertain his views on these important issues. that doesn't say it's going to be a slam dunk. all right. we are watching it. thank you for coming in, as this story is breaking. thank you very much. let's go to the hunt for justice after a u.s. consequence lan was hit by terrorists. right now lawmakers are sounding off after the first court appearance of the only suspect

so far in u.s. custody. ahmed abu khattala pleaded not guilty in federal court to one charge in aiding and supporting a terrorist group. he was interrogated by the fbi, the cia and military intelligence aboard a u.s. navy ship before he arrived in the u.s. this weekend. his court appearance is the first step of a legal process which could yield new insight into what happened on september 11th, 2012, and possibly lead to more people being arrested. four americans died that night in the siege that went on for hours. the ambassador, sean smith and former navy s.e.a.l. glenn doherty and tyrone woods. not everyone is convinced khattala should fay a civilian court. mike mccall says khattala should be held as an enemy combatant at guantanamo bay. >> we have broad in foreign terrorists and given think due process rights under our

constitution here in the united states right down the street from where you and i are in the nation's capital. i don't think that's the right approach in prosecuting the war on terrorism. >> catherine herridge is now joining us live from washington, d.c. good to see you. >> i was hitting less than 25 peet from the suspect. while he appeared daysed, as the judge spoke, he became las laser-like. he stood with his hands behind his back as if handcuffed as fbi agents looked o his demeanor seemed to shift from dazed to focused and down, almost depressed as the gravity of his situation sunk in. today we're learning more about his interrogation on board the "uss new york" an official describing the suspect as compliant, but seemingly not being entirely forth coming. on the sunday talk shows, the quality of the intelligence gathered was debated.

>> you can imagine he was not obstinate, not pushing back, but he was likely not providing -- he could go into some details of some things, but not to the point where an fbi agent would say bingo, here we go, we've got something to turn into actionable intelligence. >> once read his miranda rights, he elected to make the court appearance about his newly assigned public defender. >> i'm crierius, when the president was running and he promised to close guantanamo bait, what does it mean for this debate? >> harris, we recently traveled to guantanamo bay, and touring, the officer in charge told reporters they were still getting useful information from detainees. at this point it's about who they know, their contacts. >> the value of it is not necessarily determined the day we hear about it. it could be something that it turns out to be of more value

later on when they're able to make connections. >> republican senator kellie ayotte said in a statement she wants a full readout of the process, and at what point khattala was read his rights and chose to remain silent. critics say the administration's use of these navy vessels is not a policy, but basically a workaround to avoid guantanamo at all costs. >> i've been asking this question and we've heard different answers, what's the latest on why it took nearly two years to pick up khattala? >> interesting enough, the charm also weighing in on that issue today, saying the apparent delay between identifying suspects and captures khattala, that there are at least a dozen others out there, and there are charge against them. as fog was first to report earlier this month, the target

iraqi soldiers reportedly knolls control the roads in and out of tikrit. the militants still hold most of the city, as more than 200 u.s. special forces now in iraq. announcing today the delivery of russian-made fighter jets from moscow. the u.s. has long promised f-16s, but baghdad reportedly turned to russia after continued delays with the american delivery. congress is reluctant to aid the malaki-led government. malaki if pushed out, the pentagon may up its military support. >> conor, thank you very much. the attorney for i.r.s. official lois lerner is firing back, saying the loss of thousands of her work e-mails was not deliberate. she remains at the center of a

a fox weather alert. a dangerous situation where people are facing historic flooding. minnesota appears to be getting the brunt of it so far. the worst flooding that the state has seen in 30 years. rivers overflowing, touching off mudslides and destroying homes and businesses. st. paul is under a state of emergency while officials keep an eye on the mississippi river, which is in a major flood stage. similar scenes of devastation playing out in south dakota, nebraska, wisconsin and iowa. and the dangers of a different kind in the southwest. a touch weekend for firefighters in two regions of the countries, where homes and lives are being threatened. one of those fires has charred nearly eight square files some arizona's white mountains. crews there reporting the flames are holding steady now that the winds have died down, that's a good thing.

communities near the fire remain evacuated as a precaution. firefighters in colorado are also made headway in the battle against the wildfire that's burned nearly 500 acres. at this hour, the fire is 10% contained. that's actually a huge improvement. but nearby homeowners have been warned to remain on standby for a possible evacuation. tomorrow is the final day of the current term of the u.s. supreme court. one of the final decisions is also one of the most closely followed cases in years. it focuses on two companies, hobby lobby and wood specialties corporation. they're seeing the obama administration over the requirement to cover contraceptives. steve, how did the justices react during oral argumentsening case? >> justices roberts and kennedy

seemed skeptical that a law could require coverage that includes birth control. those two are considered the crucial votes in this case, the ones who are most likely to be convinced that hobby lobby is right and that government is wrong. hobby lobby, which operates more than 600 arts and crafts stores, is one plaintiff. the other is a pennsylvania furniture manufacturer. both claim they cannot be forced as corporations to provide coverage that violates the religious beliefs of its owners. they're objecting to the mandate contained in the health care law. >> i think the statute itself as interpreted by the president violates the first amendment of the constitution. i'm hoping the court will uphold the rights of individuals for their expression of their religious freedoms. >> the court will have to decide whether a corporation is a person, for the purposes of these cases. harris? >> so tell me, what does a win for hobby lobby look like? what does that mean down the road, steve if?

>> opponents worry it could open the door to different types of discrimination by private companies. in this case supporters say women's rights are the central issue. >> the government will not violate anyone's religious beliefs, gull no one has the right to discriminate against a woman because of her own beliefs. i believe that the supreme court will find -- no business should be allowed to discriminate against women. >> if the court sides with hobby lobby, it would be the first time it recognizes the religious rights of -- >> this would be a hot topic coming up. thank you for tees it up for us, steve centanni. let's look ahead to some of the big stories this week. monday, president obama is reportedly set to can congress for $2 billion in emergency funding to try to contain the surge of illeap immigrants pouring across or southern border. that money will reportedly be used to help speed up the

deportation process. the oscar pistorius murder trial is set to resume. a judge ordered pistorius to undergo an evaluation to determine if he's fit to stand trial. and on wednesday, benghazi terror suspect ahmed abu khattala is said to be back before a federal judge for a detention hearing. he's already pleaded not guilty to one count of aiding and supporting a terrorist group. president obama has vowed on multiple occasions that he has a pen and a phone, and he will use them to carry out his agenda if congress won't act. but did the supreme court's decision to overturn some of hess recent appointments prove that the president might be overreaching with his pen, phone and executive powers? and congressional investigators growing more

this is the fox report, it's the bottom of the hour. here is what's happening. former procter & gamble executive robert mcdonald is expected to be named tomorrow as president obama's choice to head the department of veteran affairs. if confirmed by the u.s. senate, mcdonald will face the task of overhauling that department under fire for inefficiently running v.a. hospitals. that's putting it mildly. deadly violence has flared between ukrainian forces and pro-russian rebels, both sides accusing the other of shelling in a city. the latest round of fighting comes despite a truce. now they're considering new sanctions against russia. pope francis appears to be on the road to recovery. 77 years old, he celebrated a 90-minute mass in st. peter's basilica today, the first since being sidelined by a series of health problems.

to get her to talk so we can find out what happened? >> even if you gave her immunity, why would we trust a word she says? she's proven to be a partisan hack, who has probably already lied under oath, but definitely her whole demeanor has been anti-the truth. i wouldn't trust her. the other way to go is bigger picture. stop funding the irs until -- >> can you do that? >> yes, instead of shutting the whole government down, which they did last year, shut down the one department that nobody likes, which is the irs, until they turn over the e-mails. >> susan le may says on twitter, and i would ask, is that making too much out of her testimony, if you give her immunity? susan says -- no immunity for lerner, what's next? witness protection program? the government is saving the e-mails and text messages of citizens, what about the irs? pat? >> i think first of all, the

issue of immunity suggests there's a criminal investigation or invtigation going on. that's the problem. there isn't one going on. the obama -- the justice department appointed members, i think, some lawyer who was an obama donor and that's the lost anyone heard of him or the group, they were supposed to look into this. this is the greatest coughup in my lifetime in american politics. it beats water ghaith. it rivals watergate. in some ways it's worse. rosemary woods only lost 18 minutes of a tape, or disappeared. this is -- seven hard drives. not only lois lerner's but six other people just destroyed. this is ridiculous. what we should have is a special prosecutor not attached to the justice department, to get to the bottom of this abuse and what went on, and as far as i can tell, that's why i agree with john, that's why they

should shut the funding, until they come forward. >> a special prosecutor is something i have talked about before on this program and others, something not attached to the doj issue, as you just said. i'm seeing this tweet from patrice. she says if representative issa were confident there's a higher conspiracy, lerner would already have immunity. the uncertainly helps keep people angry. doug? >> well, that's certainly true, but we're not dealing here with prolonged uncertainty. i think political insiders agree that that is corrosive to american democracy. the reason why i think john and pat are on the right page here is we've got to get answers. it isn't clear to me that lois lerner has the answers or will share them. the only way i believe we can get to it is, as pat said, a special prosecutor, somebody with the independence that archibald cox or leone jaworski had during watergate. this is a threat to our

democratic values when you tie it into the executive orders of the president and arguable abuse of power. we really need to get to the bottom of what's going on, and i don't think that, frankly, immunity for lois lerner is the way to do it. >> all right. a couple things here. i want to pop up some numbers on the screen. the next question is how problematic or toxic is this issue? first we started sealing some polls dropping for the president right when the scandal brought about a year ago. look at what's on your screen? those surveyed said 76% believe that the irs e-mails were destroyed deliberately. and insiders, jeff goldman has just tweeted, if each of you was the president and you had been in office the past six years? how would you handle this? pat? >> well, first of all, i want to talk about the numbers, because these are startling. i think we have now the president has jumped the shark. 76% of voters saying that those

e-mails were deliberately destroyed, including 66% of democrats. you have a large numbers of people who believe -- it's a 15-point shift from april that we need more investigation. the president still keeps calling, apparently a phony scandal. the answer is, what we need to do is get to the bottom. the truth is serious business. the white house is tone-deaf, but they also know with the complicity of the mainstream media. match nothing like they did on bridge gate with christie. you would have to be blind not to see the cover-up. >> some of our viewers are actually tweeting each other. laila has just said, favoriting a tweet that she saw, the e-mails will be found on january 21st, 2017. john, the trust is really the problem here. >> oh, no question, yet the president still says there's not

a smidgen of corruption in the irs. that's an insult to everybody. i want to mention, there is no law on the books that you can use to authorize a special prosecutor. that law expired in the mid 2000s, the bush republican congress and bush white house does not extend it, so we would have to pass a new law v. it pass the house and senate, have the president sign it, not going to happen, to create a special prosecutor. >> let's pop up a second poll, should congress continue to investigator the irs until someone is held accountable? look at the jump. just ignore -- look at the difference between april, which was about the time that people were filing their taxes to now. so they've gotten their taxes out of the way and now they're concentrating on the future. doug? >> yeah, i think this is an extraordinary time in our democracy that the democrats can still maintain that this is a phony scandal when the ordinary american who pays his taxes and

works hard, understands that this is a really fundamental abuse of our democratic system, and harris, it's understandable that our audience would be aggrieved and angry, because we have to keep our records for seven years. if we don't, we're in harm's way. the irs apparently can have six hard drives disappear, lois lerner can apparently lie within impunity, and you know what? we don't have a mechanism to get to the bottom of this quickly, no wonder approval of all branches of government is sinking. >> jerry, shirley black tweets -- no immunity for lois lerner. up the whistle-blower ante. pat? you were saying? >> i think doug and john are right, let me just say, you know, that the bowery plain incident, which i consider far less egregious than this, george bush went ahead and appointed a special prosecutor which caused

some problem for mr. libby and others. this is clearly the president can do it, needs to be done to get someone independent. and by the way, you know, this is -- when you don't do that, all these suspicions. look, the country no longer believes the president by massive numbers, and the irs' arrogance. the arrogance, i've never seen the culture of arrogance in washington toward the american people, which is screw you, basic lit going back to johns 'argument, let's start a movement to shut their funding off until they produce those e-mails or until a -- >> you guys are fired up about this, and so are our viewers. >> the other thing that's happened with this scandal is it's not breaking into the so-called maintreatment media. it's not just fox. it is on the evening network news shows somewhat freakily and those numbers show that the

public does care about it. we will see in if the media will drive this against a democratic administration as much as they have against republicans. >> i want to continue to read twitter, because we're getting such response. d.j. says why hasn't the fbi raided the irs and seized the records already? >> because the fbi works for president obama. they're not going to do anything unless they're told to do it, and they're not going to do it. >> and, harris, the records have largely disappeared. we don't know where they are, did you doug, wait a minute, though. you know what? there is the -- you know, if you were that company that was in charge of archives the e-mails for the irs, you had gone out and told people how happy they were that they had their business, which is what i read. for your own reputation's sake, you would turn up those e-mails. do you think it mike a ticktock before -- what about the nsa? >> well, the nsa works for the president. of course, how about edward s w
