tomorrow night, the rest of my interview. how close was tow obama? have they spoken since mr. obama became president and what would it cause them to bomb america again? i'm megan kelly, this is "the kelly file." >> welcome to "hannity" this is a fox news alert. the supreme court of the united states delivered a major blow to president obama's health care law today in a major victory for religious freedom. in a 5-4 decision, the justices ruled in favor of the hobby lobby craft chain saying that closely held corporations can in fact opt out of the obamacare contraception mandate due to religious objections. the decision marks the first time the supreme court ruled that profit seeking businesses can in fact hold religious views under federal law. fox's own shannon breen is in washington tonight with the details. shannon? >> sean in, that opinion, the supreme court sided with the religious family owners of two

for profit corporations, holding that the religious freedom restoration act protects them from forced compliance with the government edict the family says in in conflict with their religious convictions. for more than a year and a half, green family, the founders and owners of the hobby lobby croft store chain is fighting this mandate stemming from the hk law. a federal regulation that would force them to provide employees cost free access to 20 different forms of contraception, including four methods, the green family believe can trig area borgs, something they refuse to do. but that refusal could result in fines in the range of $475 million a year. justice samuel alito said this, "we hold that regulations that impose this obligation violate rifra which prohibits the federal government from taking any action that substantially burdens the exercise of religion unless it is the least restricting means of government

interest." today the co-founder barbara green said her family was overjoyed. the court's decision is a victory for our family business and all those who seek to live out their faith. the court got it all wrong. "in a decision of starling breadth, the court holds that commercial enterprises including corporations and partnerships and sole proprietorships can opt out of any law. they judge incompatible with their sincerely held religious beliefs." both the white house and democratic members of congress are vowing to take action in response to today's upon. one of the first proposals comes from democratic senator dick dur bin who wants to require corporation that's limit contraceptive choices to be forced to disclose that to all employees and anybody that applies at the job as well. >> shannon in washington, thank you so much. we'll have more on the hobby lobby decision in a few moments. also breaking tonight, the sunni militant group that is taking

control of large parts of iraq and syria has declared the establi establishment of an islamic state. now in an audio tape posted online a spokesman for the group announced that the leader would hold spiritual and political authority from syria to northeastern iraq. we turn to jennifer griffin. she is standing by at the pentagon. jennifer? >> sean, other groups are calling the declaration dilutional. sunni extremists celebrated in syria after the fighters announced they were changing their name-dropping references to iraq, syria or the wider region to simply the islamic state. demanding that all muslims worldwide express their loyalty, "the official name is the islamic state from the date of this declaration." the shadowy leader who was released from prison in iraq and u.s. troops were preparing to leave iraq was declared the

left four americans dead pleaded not guilty during his first appearance in a federal court in washington on saturday. now fox's own catherine herridge is standing by tonight. >> i was sitting 25 feet from the benghazi suspect when he plead not guilty to a single count of facilitating a terrorist attack. during his brief appearance with a court appointed public defender, he initially seemed dazes. then he became laser like in his focus hanging on the judge's every word. it took 21 months to capture him. >> it was a pretty good indication that the united states of america and certainly this president doesn't forget. and if this is something we're focused on and determined to bring to justice those who are responsible for taking the lives of four brave americans. >> but a leading republican accused the administration of wasting time by letting him remain free for nearly two years after the attack. well, he gave multiple media

interviews. >> now we're finding out that the reason why he wasn't apprehended as quickly is because we were so focused on building a criminal case rather than capturing the suspects who were responsible for the attacking benghazi and killing our u.s. ambassador and three others. >> we're also learning more about the interrogation onboard the uss new york. the u.s. officials describing the benghazi suspect as compliant but not forthcoming providing details but not enough that intelligence could be immediately acted on. u.s. officials say there will be more charges soon, critics say that when a full readout from the administration about his detention and what point he was read miranda rights and stopped talking. sean? >> now we'll have the mother of one of the benghazi victims tonight. also breaking, president obama delivered remarks on immigration reform at the white house this afternoon and announced his intention to take executive action yet once again to pass some aspects of immigration

reform. now because he's doing so, waiting for house republicans and he's done waiting for them to act. fox's own wendell goaler is standing by. he has the latest. >> sean, the announcement came today after john boehner told the president on friday that house won't pass comprehensive immigration reform this year. boehner said he can't trust mr. obama to enforce the law. the president says his hand is being forced by tens of thousands of unaccompanied children turning up at the border to escape violence in honduras, guatemala and el salvador based on their parents' belief they won't be sent home. >> the children who are fortunate enough to survive it will be taken care of while they go through the legal process. but if most cases that, process will lead to them being sent back home. >> actually, in most cases, the kids have placed with relatives here in the united states and never show up for their deportation hearings. the president wants authority to money to process the kids more

quickly and authority to send them back home quickly. 2008 law allows kids to be quickly deported if they're from mexico but not if they're from central america. >> joining me with more on the monumental supreme court decision in favor of the company hobby lobby and against obamacare, we have senior counsel, hannah smith is us with. and from the american center for law and justice, jay seculo. let's get reaction. a big victory. by any objective measure for religious freedom today? >> it was a great day. both for hobby lobby, for the beckett fund and religious freedom. >> well, explain why in your opinion, look, a-4 decision is still a 5-4 decision, very close. the arguments of the majority were solid. that is your religious freedom doesn't end just because you're part of a corporation. >> well, that's exactly right. and the majority opinion written by justice alito joined by the four conservative justices said that just because a family opens up a business, they don't lose

their religious freedom rights. and that religious freedom restoration act protects them when they open up this family business. >> were you hoping for perhaps a wider interpretation that would have xenlded to any corporation? >> you know what? we actually got a great opinion today. justice alito's opinion was excellent on all the major points. you know, he said not only do the family owned businesses have religious freedom rights, but this is a substantial burden that the government placed on them by assessing them these huge fines if they with the mandate. so he said they have a substantial burden. and then he went on to say, you know, but government probably has a compelling governmental interest here. but they could have achieved this in such different ways than going about trying to force these religious objectors to pay for this mandate. so they said there was a less restrictive means of accomplishing this goal and because there was a less restrictive means, this mandate just simply cannot stand. >> you know, if you look at the three decisions, jay, if we go back to the recess appointment

the house in that case. it was their job to determine when they recess, not the president. they rebuked the president's overreach on that one. you take a look at the union case you mention today. people need to understand, obviously the hobby lobby case was a gigantic victory. it overshadowed the labor case. a woman's mother taking care of her child at home against a small state subsidy constituted a state employee only for the purposes of union agency fees. and the supreme court there said, no. you don't get to do that. and this -- go ahead. >> let me ask you about this. between the recess appointments, changes to his own signature bill, obamacare without going back to congress not enforcing immigration law, eliminating work requirements for welfare, you can't do these things unilaterally. now john boehner is taking it a step further. he is suing the president. i would argue he may not have standing. they have constitutional authority not to fund these

things. but there seems to be a consensus here from the court that this president is not living up to his oath as it relates to the law and the constitution. >> i think that's exactly correct. what the speaker is talking about is a president that said he's going to operate by pen and phone. and that's not the way the constitution is set up. you're right, there is a legal question regarding standing. that is going to be something that courts have to decide. but the merits of the case, the principle of what the speaker is talking about is this consistent pattern of government overreach. you know, can you look at the irs scandals and it's a common theme. they overreach, they get caught, they pull back a little bit. then they move it forward. in this hobby lobby case, i don't think they have any room. it's a big win for religious freedom. the same thing tfor the union case. but the president was checkmated to day. >> you know what else i have to say? you know, they're still waging a war on the nuns, the little sisters of the core are still being fought by the government in the lower courts.

together. >> the legal opinion, you're wrong on that. >>, no i'm not. >> person includes corporations. the supreme court looked at the statute and they said that there was a compelling state interest to give away, to make this company buy these abortive fashions. but at the same time, it was wrong that they couldn't impose their will on the owners of this company. and so 5-4 they decided and said, yeah, religion does count. >> would it count in general motors? >> it doesn't in this case. >> you're saying the statute says that. does that apply to general motors? >> they didn't ask that. >> i'm showing his example and showing where that doesn't hold up. if you put this thin membrane between the owners of this corporation because it's a one family and a close corporation, does that not koupt? >> sean, when i read the decision, i thought to myself, aa(ápunbelievable that only five

of the nine recognized that our constitution makes it very clear that we have religious liberty and in this case based on the legislation that we have in the religious liberty -- >> by the way, there is not in the health care law. >> no. >> this is the health and human services secretary mandate. >> the constitution, great american experiment placed religious liberty at the forefront. and here the court thank god said you cannot put a substantial burden on somebody who has a religious objection to a -- >> i think we have to understand this law goes back to 1993. written by democrats, passed by democrats, signed by bill clinton, a recognition then that religion as a first amendment means everything in this country. so you can talk about gm, you can talk about ford, we're going to talk about this case where this company was facing half a
