7:00 pm
fascinating exchange about america today. they come at it from different van damage points, what's good and what's not so good. thanks for watching, everybody, i'm megyn kelly. you can see the entire ayers interview at facebook.com. see you tomorrow. >>. >> welcome to hannity, this is the knox news alert in favor of hobby lobby and religious freedom and against the obama care contraception mandate. the white house is criticizing this decision. josh ernest told reporters that it not only jeopardizes women's health, but congress should act and try to mitigate this ruling. for the latest on the administration's reaction we turn once again to ed henry, standing by tonight at the white house. i bet there's pretty fierce reaction? >> that's right. >> the president is not backing down at all. instead today signaling he's going to double down on the go it alone strategy. dares speaker boehner to go
7:01 pm
forward with his lawsuit to try to stop executive orders. the president saying, so sue me. the white house secretary made clear, that includes congress not to act. the bottom line is, republicans were firing back today they think the president right now should be pulling back, not going full steam ahead. >> if congress won't act, the president will consider a range of options for addressing this problem. the fact of the matter is, we're still reviewing the situation. still reviewing how large the group of people is that's affected by the decision. >> i would have thought the supreme court would have humbled the president. i think it's just business as usual for the obama administration, it's just kind of the way he does things.
7:02 pm
democrats see this as a way to fire up their base. executive action on immigration reform could fire up hispanic voters before those midterms as well. josh ernest noting today the president has ordered a review of what he can do on his own to reform immigration, fix the broken system without congress, that review is expected to be done by the end of the summer. right before the midterms, the press secretary mentioned there's no connection to politics. >> it's hobby lobby, the recessed appointment decision. also issues involving his legislation on obama care not enforcing immigration law. dick durbin used the phrase borrowing power about can one borrow constitutional power? >> no, look what's happening as you see, the president having his wings clipped a bit here over executive power.
7:03 pm
if republicans on the hill are not going to move forward, he's going to double down on this strategy. >> ed henry, thanks, appreciate it. we're going to have much more on the hobby lobby decision throughout this hour, developing today is president obama's plan to bypass congress once again in an attempt to push through his agenda when it comes to immigration reform. the commander in chief announced his intention blaming house republicans on their failure to enhance an overhaul. bill, what's going on? >> just yesterday president obama announced that he intends to use some type of executive power to completely skirt congress and get something done regarding this immigration issue. typically when we think about illegal immigration, we picture people trying to climb over the border fence or dig their way underneath it, a border patrol spokesman tells me that's not what's happening. these immigrants are showing up
7:04 pm
to border crossings all across the state of texas, and asking for help. here in el paso, we've been getting buses full of these immigrants sent here by the federal government because the south texas agents are simply so overwhelmed, border patrol agents are telling me as soon as those immigrants arrive here in el paso, they're given a medical screening, if they pass it, they're turned over to ice, if they don't pass it, they're sent to local hospitals. i've been in contact with four of those hospitals, they told me they've been treating dozens of these immigrants for minor things like fever, lice and skab ease. they've already wracked up a $60,000 bill treating these immigrants. it's not going to get better any time soon. the hospitals all told me they've been informed by border patrol to expect at least one busload of these immigrants from south texas to arrive here in el paso every day for at least the next three weeks. that means, all these hospitals
7:05 pm
they're going to be put on a roundtable, each day, one separate hospital is going to be responsible for getting medical care to these immigrants. the big question, who's going to pay for all this, according to the border patrol, the federal government is, they're telling me a federal program run by ice is going to pay for it, basically what it is, it covers these detainees, their medical care, dental care, overall health care, and border patrol tells me, every single detainee is covered. >> thank you, meanwhile, disturbing news tonight out of mississippi, where new allegations are surfacing about dirty politics being involved in last week's gop primary between senator thad cochran and chris mcdaniel. fox and friends co-host is here. >> the allegations today the list is long. the cochran camp was accusing
7:06 pm
mcdaniel's camp of being associated with the kkk. student loans, and then there's also the race baiting we're going to talk about tonight. this is one week after the runoff election between the gop senate candidates, and the primary was on june 3rd, mcdaniel won by 6,600 votes. they didn't get to 50%. cochran won by 25,000 votes, 35,000 democrats voted for cochran in the gop runoff, which is very unheard of and very rare. if he hadn't gotten those democrats to run or vote, mcdaniel would have won the election elections. >> you have a baptist pastor saying the cochran campaign was paying $15 a vote? >> yes, you have this pastor, very well known pastor, lives in
7:07 pm
meridian, mississippi. he's accuse iing cochran of buy the vote. he says he was part of the extreme, and he also goes on to say that cochran's camp paid thousands of dollars to democratic voters in the black community, paid them each $15 to go and vote and support cochran. >> it was also an allegation, and i know the mcdaniel campaign, if you are a democrat and you voted in the original primary. >> right. >> and then crossed over, you were -- >> exactly, it's not legal for you to vote in the republican primary at that point, and the mcdaniel campaign believes there might be thousands that did that? >> yeah, exactly. in the state of mississippi, not every state is like this, you can vote as a democrat in a republican primary, as long as you didn't vote in the democratic primary three weeks before, what many people -- it's been announced there's a lawsuit. they're going to be looking into it. illegal voting and indications of double voting there were also
7:08 pm
some radio ads, our producers have been working all day long. the producers say they're anti-tea party adds. we spoke to the radio owner today, he confirms these adds did air. stern electra teethic marketing paid for these ads, $672. and they're associated with the citizens for progress, they're taking responsibility for this. that's the super pack that is related to haley barbour's campaign. >> take a listen to this. >> if someone tells you that by voting today, you cannot vote in november, it's just a tea party bald faced lie. you're saying take away all of my government programs, such as food stamps, early breakfast and
7:09 pm
lunch programs if you don't vote. everything we in our families depend on that washington will be cut mississippi will never be the same. will you spend $5 on gas to vote or allow the tea party to set us back to the old bad days. vote against the tea party. vote thad cochran. >> the owner of this radio station is saying this came directly from one republican group against another republican? >> at the end of each of those add adds it has to be connected to a group. that group is haley barbour. >> he's got some answering to do on that. >> we did reach out to both camps. they're saying these are baseless and false. >> cochran, i don't believe that for a minute that's my
7:10 pm
editorial. >> let me read the statement, not including the votes which were allegedly bought by the cochran camp, our grassroots volunteers have already found around 2500 ineligible votes, that is votes cast in the republican runoff on june 24th, by voters who voted in the democratic primary on june 3rd, we are examining all the data that we can gain access to in order to launch a legal challenge, and our preliminary findings indicate that further investigation is certainly warranted after we've examined all the data, we will make a determination about possible legal recourse. >> great reporting, ainsley earhart, we'll be watching tomorrow morning. as the fallout continues from the monday amount ool supreme court decision in favor of hobby lobby, against obama care, reaction from the left, it's been pouring in, and some of the most outrageous rhetoric comes to us courtesy of the national organization for women president.
7:11 pm
>> apartheid in south africa was justified on religious grounds. there are some religious beliefs that we no longer honor in our government, and the supreme court is simply wrong to honor gender bigotry that hobby lobby stores and conestoga wood are promoting, it's just wrong. it's bigotry to keep women away from basic health care. >> apartheid? really? here dana lash and former president of the national organization for women. it's been a long time. former president patricia harland. do you know how many forms of birth control hobby lobby offered as part of their plan? >> no, i don't know. i know that some of the most effective forms of birth control they have decided are against their religious brief. >> that's not true. >> i'm wondering how a for
7:12 pm
profit business can have religious beliefs, that's another topic. >> it's a family business, and there were 16 -- every birth control, and then some that i have not heard of. >> yes, that's absolutely right. 16 out of 20 or so that were mandated that hobby lobby not only provided already, but they were providing birth control to their employees who they pay way above minimum wage by the way, and gave sundays off. they were doing this before obama care was even a thought. so the idea that women are somehow being denied anything, look, my rights have not changed after this ruling, sean, and women who work for hobby lobby, they still have access to birth control as provided by hobby lobby. >> that's the point. i don't see, how do you make a indication when they were providing 16 of the 20 mandated items, and the ones they didn't was like the morning after pill, because they believe life begins at conception. can't you respect someone's deeply held religious views? >> first of all, i don't believe a commercial business has --
7:13 pm
>> it's a family business. it's a family owned, run business. >> i don't believe. >> okay, and what if that family were christian scientists, could they deny all health care? i think we've taken the idea -- >> that's a horrible misrepresentation -- >> i'm sorry, i'm quite familiar with religious freedom. >> apparently you're not familiar with it. >> i'm sorry, do i get to speak, or is she just going to dominate over -- >> i'll correct you. if you want me to dominate -- >> all right. perhaps i could make my statement sean, or is that not allowed. >> yeah, but the point is, the 16 of the 20 -- >> i would like to make my statement. >> 16 of the 20 -- >> okay, you can keep talking too, because it is your show. it's not dana's show. >> all right. >> perhaps those four might be the kind that i needed in particular. but i really don't believe that a woman's rights under a federal law to health coverage should be zee nied based on the corporations owner's views, and i come back to, what if the
7:14 pm
corporations owners don't believe in any medical care or taking the idea that -- >> stick to the facts of this case, this is a family owned business, we still have a constitution, the free exercise there of. either we believe in religious freedom, and that would extend to one's business life, and personal life, or we don't, dane is that, that's how i see it. >> you know, sean. >> you believe in federal laws or we don't. >> i have to jump in here. >> dana, go ahead. >> what really bothers me, sean is that we have -- i'm sure patricia is an educated woman. it does women a disservice when we have women speaking out about this topic and they don't understand the facts at hand. >> i understand the facts at hand. >> no, clearly you don't. i'm going to educate you. >> well, you -- >> hang on.
7:15 pm
>> the freedom restoration act, businesses have to sit here and provide business owners, would have to prove to the government that their religious beliefs, that they -- their first amendment rights are being threatened and restricted. the hypothetical slippery slope, ridiculous argument, they could deny all health care, that wouldn't be supported by the religious freedoms restoration act. we're wasting time discussing it. >> we are out of time. thank you all for being with us. >> coming up tonight. president obama vows to use his position to tackle the problem of illegal immigrants crossing our southern border every day. joe arpaio is here. the president needs to deploy our military. we have more on the campaign tactics that were used in the mississippi runoff race. that and much more tonight on hannity. we're moving our company to new york state.

the secretary of homeland security and attorney general to move appropriate and viable resources to our border. >> that was the president arrow gantly announcing he will use executive power to make major changes to the nation's immigration system. he decided to take matters into his own hands, the house would not vote on comprehensive immigration legislation this year, earlier today, fox business host took on the president's plan, take a look. >> that's what this president is doing, de facto amnesty is what he's creating. there is a rising backlash against this president for what he's created and his political exploitation of the tens of thousands of young people is utterly unconscionable. this president, i don't think has thought this one out very clearly at all.
7:20 pm
>> here with reaction, maricopa county sheriff joe arpaio. >> do you know what mexico does if someone enters their country illegal my? >> it's not humane. >> they deport them immediately or they put them in jail, right? >> yes. >> what with not be humane about saying to people, you didn't accept our laws. and give them a plane ride home. >> that's what we do. >> no, we do not. >> eventually. the last time you had me on the show you came up with a proposal. and i said, where do i sign. >> i agreed with you, you came up with a great proposal, i said, there's a compromise. i didn't say i liked all of it.
7:21 pm
>> where are the compromises by both sides. >> neither side will act. >> there is one kid died today or late yesterday. you have all these kids, i have images of people crossing the rio grande. if they get one foot on american stole, they're staying here right now, is that what you see going on in your state? >> yeah, it's unfortunate. i went on your station three weeks ago, when they dumped a thousand kids in the greyhound bus terminal. you know what i said then, this is calculated by the president to cause controversy, hope the congress does something. and then get the executive order which he did. they can't control the border, this is a game plan. >> sheriff, let me ask you a question -- >> if i had a bus full of
7:22 pm
illegal immigrants and i entered arizona, they were literally dumping busloads of people, would i be handcuffed, perpendicular walked, would my mugshot be all over tmz? >> it's not the buses. >> i apologize. >> sheriff, if i did what they did. >> yeah, yeah, yeah. you know, they should be arresting these people in mexico, they should never get to the border. what is mexico doing about it. you brought up a good point. they should be stopping these kids before they cross the border. >> a part of what we talked about was securing america's boarders. you support me, every inch of border ought to be secure, and those people that don't respect our laws and sovereignty, ought not be left in, awe degree with that, right? >> look, even my biggest critic,
7:23 pm
brian johnson agrees where you, that yes, you actually offer measurable ways to secure the border. they are not ambiguous, and then you came up with three or four other proposals that were fine, we've been screaming for different reasons for the federal government to act for about ten years. >> but i want to know. by the president not securing the border. >> yes, the president is -- >> you agree the president's creating a humanitarian crisis where people are -- >> no, i disagree. >> you don't agree with that? >> because there's nobody going to believe that the president is banking all these people -- >> excuse me, that's not my point. if the president doesn't do his job and secure the border, is there a humanitarian crisis at our border or not? >> yes, there is a crisis, we have to secure it, i agree with you mr. hannity, why are you arguing with me? >> sheriff? >> i agree with you, congress is not doing anything, we have the republicans saying no, no, no,
7:24 pm
no, no. >> they're saying no to amnesty. >> sheriff? >> they're not asking for amnesty, both sides have to give up their sacred cow. >> yes, sean. >> is there a humanitarian crisis because the president failed to do his job? >> yes, of course, this is planned. let me tell you, i just wrote to the homeland security secretary again last night, we have 3,500 people in jail that are there for all different crimes, we checked them out, their turnover to ice and guess, what they keep coming back, over and over ag n again. either their let out the back door or they're deported and they come back again. >> you're still not addressing the point, what are we going to do about it? >> secure the border. >> what are we going to do about it? >> secure the border. >> let's put something in congress. let's move on it. >> the president wants his
7:25 pm
amnesty bill. if he doesn't get that, he's going to borrow power, is what the democrats say. >> let's go with marco rubio. >> he doesn't support the bill, because he thinks it's the wrong bill. >> let's go with your proposal. >> my proposal is secure the border first. >> you have to do it at the same time. >> all these people are coming over getting amnesty. >> we have an obligation, terrorists may cross that border one day, and blow up an american city. we need to have -- >> we need to have a secure country. >> you're intent on disagreeing with me when there's no disagreeing. >> stunning proof, dirty politics at play in the mississippi senate runoff, and later, did hillary clinton call president obama incompetent, ffectless? a bestseller is here and says she did. starts with back pain...

neighborhoods. they accuse mcdaniel and other tea party members of wanting to prevent blacks from going to the polls. on last night's program, ainsley earhart -- take a listen to another example that should make your blood boil, take a look. >> time is running out. please hurry. walk, drive or run to your voting precinct. if the tea party with their racist ideas win, we will be sent back to the 50s and 60s, you've heard what bennie thompson has said, with other elected officials, so vote today. >> our future is at risk. please don't stay at lomb. you can vote after work. polls close at 7:00 p.m., say no to the racist agenda of chris mcdaniel and his tea party. >> here with reaction tonight from the new york civil rights coalition michael myers, nationally syndicated dennis prager. let me put up on the screen again, let's look at these
7:30 pm
flyers that were distributed in predominantly black neighborhoods. the details are even worse, and they basically portray mcdaniel's is a racist, the tea party prevents you from voting, and then you have the robo calls, this was done by republicans to republicans here. i couldn't if i lived in mississippi, i would not vote for thad cochran under any circumstances, this crosses a line for me, democrats play this against republicans all the time and it infuriates me. >> it's infuriating on every level. i share your fury. there's an original sin here, and that is these open primary type things where anybody votes in the other guy's primary. this is it a way to destroy the parties, that's what really was the intent in many like in california. there's -- all it does is invite mischief, i can vote in your primary or general primary to

undo the guy i think will win. >> i totally agree with you, but here's the point. thad cochran saw the polls and was going to lose. >> correct. >> he made a conscious decision, his campaign and supporters, those around him. >> to smear. >> to smear, besmerch and race bait. >> look, when you got to win, you got to win, and you play to keep. you got to know the rules, and you got to know the loopholes. when thad cochran and his supporters lose, they use the rules, what they did was, they said, hey, black democrats on radio -- the radio ads were terrific by the way, they were not hateful. >> was it race baiting? >> no, it wasn't race baiting, it was condescending. >> was it -- >> let me finish my point and you'll understand it.
7:32 pm
>> the radio said, you have $5 for gas money, don't throw in your buts and accept being lazy. get to the polls. if you can't do it, come and vote. >> we don't have a filibuster here. let me play this. >> i was just going to say to you, that in the culture, in the water, in the air. barnes said, the tea party is the taliban wing of the american politics. >> do you believe that? >> no, i don't believe that, it's in the culture. and that's why they -- >> you said there's not race baiting. let me play another radio ad here where they mention the ku klux klan. >> it's black talk radio. it's condescending. >> the group of tea party radicals scares him, we should listen. last with the leather was able to tie mcdaniel's campaign to an

ally of the ku klux klan. this supporter was a klan lawyer that represented sam bauers, if we stand by and don't go to the polls and vote today, do you understand what we could lose? >> motivational or race baiting. >> no. it's the ap again de of the left adopted by a republican. it's vile. >> would you vote for cochran -- >> this is a terrible tear in my heart. the thought of losing the senate because of cochran to the democrats who have done so much damage in the last six years, that's actually even more painful than allowing the guy who has done terrible things. i think this can be undone. if you check all the voters, i believe mcdaniel -- >> i agree with the original sin, you should not be allowed to cross party lines. >> i am a registered conservative, if republicans want to be democrats and run campaigns like the missouri
7:34 pm
radio ad, if you elect republicans, black churches are going to burn, or the naacp ad, i'm not going to support them, this is a bridge too far. >> sean, you are really overestimating these voters, they were told on black talk radio, you don't want to lose your food stamps, you don't want to lose your government program, free breakfast, get to the polls, that's motivation, it's not hateful. it's condescending. that is condescending. >> and it's racist. >> the tea party is racist, it's not condescending. >> i wish that were true. i would say 90% -- >> they say the tea party finds barack obama objectionable, that they disrespect limb. so am i, but i'm not the national tea party. >> 90% of college professors believe the tea party is racist. >> that's interesting. you're wrong on this. >> you want --

it's very troubling that a sales clerk at hobby lobby who needs contraception, which is pretty expensive is not going to get that service through her employer's health care plan, because her employer doesn't think she should be using contraception. >> here now is the author of a book that's doing better than hillary's book. blood feud. first of all, she's a lawyer former first lady smartest woman in the world. there are 16 plans they offer. it infuriates me when people lie like that. it drives me nuts. >> well, she was under sniper fire in bosnia, if you remember. >> good point. you were discussing earlier today, that she's angry. your book's doing very well.

bath, and i wouldn't be surprised if there were some heads rolling at simon and schuster. >> for paying that kind of advance to somebody? >> really. >> i don't know what their expectation was. i have been playing on the show, something the rest of the media will ignore, hillary clinton defending a child rainist who passed a polygraph that she said, i gave up all my faith in polygraphs, meaning she thought he was guilty, and got him off with time served. and yet she goes out with this contraception issue, like she's the one that cares about women. >> women and children, right. here she is on tape tackling her hillary cackle. >> the woman has spoken out now, and she's outraged and feels she was victimized by hillary. >> i think it's unfair, but i can understand it, i don't understand how in good
7:43 pm
conscience they could ignore that tape. >> neither do i. and it's the shame of the media, somebody should write a book, used to be the shame of whatever it was in the progressive air remark this is the shame. we're living through a time now when the media is absolutely abdicated its responsibility to people. this woman who was raped and whose rapist got off because of hillary, nobody's covering the story except you. >> a very prominent person was watching you on this program last week, very prominent and said, everything that ed klein says that bill clinton said, he has said to me, multiple times, bill clinton does not like barack obama. he loathes him. >> he does loathe him. >> how bad? >> he's called him the man he hates most in the whole world, but you know, sean, he believes that barack obama -- let me go off, let me start again. bill has been checking with state chairman, democratic state chairman all across the united
7:44 pm
states about what obama's up to, he's come to the conclusion that obama's looking for a mini-me, a clone of himself to make sure that hillary doesn't get the nomination, bill feels his biggest enemy is barack obama. >> unbelievable. >> so in other words, they're looking for another barack obama to replace barack obama? >> exactly. >> i think the country is fed up with barack obama. how are they all reacting to monica lewinsky being back in the news? >> it's an embarrassment, but she embarrasses herself by referring to her virgin harassment. what a word she chose. >> i never -- i don't really want to bash monica, i blame him. he's the president. >> and she was a kid. >> she was an adult, but, yeah, young kid, young adult. >> congrats. appreciate it. >> coming up, tonight right here on hannity. this is quite a dangerous thing that we're seeing unfold here, it's probably not 9/11, but it's

welcome back to hannity, here to talk about the day's top stories. the co-host of the five, dana parrino. your column today, i don't know if you've had a chance to see this yet, literally led to a one hour conversation on my radio show. because you actually researched the 16 contraceptive methods that the hobby lobby health care plan allows for their employees and the four that it does not. >> correct. >> i would like to consider myself a pretty well educated person, i know a little bit about birth control, i don't even know what some of these things are. >> yeah, there's a whole list of them. there's this idea now that women won't be able to get any contraceptives whatsoever, and hobby lobby runs this outfit where women wear burkas and have a baby every nine months. you have access to 16 different
7:50 pm
types of -- >> you want to read them? >> i don't have them in front of me. >> you get male condoms, female condoms. spoungs with sperm site. sperm side alone. >> i prefer you read it. >> 16 different kinds of birth control. not just access, they pay for them. the company pays for them. >> we just had the former president announcing they can't have access to birth control. >> they won't cover plan b, ella, or two types of iuds. the owners of hobby lobby believe they kill fertilized eggs. >> life begins at conption. >> now, if you want to use those, you can go to dwayne reid or somewhere else and buy them with your own money. if you don't want to use those,
7:51 pm
there are 16 available and they will pay for them. there's no more polite or correct way to put it than that. >> what has happened to the woman's movement in america? i know all three of us have spoken out about sharia law, the mistreatment of women, four male eyewitnesss for rape, not being able to drive, go to school, go to work. it seems that feminism in america today is being defined as one issue, which is available to anyone in drugstores all across the country. >> a lot of things they initially try to get, such as the vote the right for women with the right to vote, when nine men on the supreme court say that abortion would be legal. that's the roe versus wade decision. five men said that four
7:52 pm
abortions are not allowed to be covered. that's their argument. they're grasping for an issue. the other thing is, it's political, they need to turn out the vote in 2014 and 2016, it's an emotional argument for now and other feminists to say. the corporations, the men in america, they are trying to usurp your choice. we're not going to let that happen to you. that's an emotional response. the logic of the case and how narrowed and measured the court was, it's thrown out the window. what of the window what. do you think is the argument bringing people to polls? it's one they can get young people to believe they're going to be hurt by their government. >> do you think this lie works? this, i guess would you say, fundamental principle? they're telling every woman in america now hobby lobby offered no contraception. your column blew that out of the
7:53 pm
water. >> the idea is to paint hobby lobby as american taliban. again, they're lying there is no more polite way to put it than that. i think people need to get educated people on the right. most people don't know this. . >> i think most support contraception >> exactly. >> and responsible behavior. if you buy these other four you can buy them with our own money. and another way to get out of this is idea you have to get health insurance from your employer. >> that, i think is a bigger important point. why don't we keep our own money in the form of a tax credit, then you get to make your own choices for your plan. >> the bigger obamacare decisions that are still to come. this is about obamacare. it's a little bit we've been
7:54 pm
losing sight of that. they make this about contraception whether than heavy handed government, poorly thought out, not legislated appropriately. now, it ends up hurting jobs and everybody else. >> another ruling is coming. >> in a nut shell in front of the court they'll have to decide if people that signed up under state exchanges versus federal are eligible for the subsidy. and inspector general of health and human services reports 2.8 million they can't account for and can't figure it out. they don't know the citizenship. >> the media was just celebrating president obama for the overcoming adversity for
7:55 pm
today, it's not partisan. this is the inspector general saying they can't identify 2.8 million. >> people disappeared? the population of los angeles, california? just vanished? amazing. >> great to see you both. and a video have you to see to believe. the president making a joke about crack cocaine? that is next.
