still dealing with the flooding and other destruction left behind this weekend. we are going to begin now with the growing protests breaking out over undocumented women and children pouring into the u.s. sparking more protests in southern california and outrage in border states this weekend. the heightened tensions raising the stakes for all sides in the debate over immigration in washington. doug mckelway with the latest from d.c. >> things are really tense in murrieta, california, after rumors spread more busloads of undocumented women and children would be arriving friday at the scene where protesters blocked their exit from buses earlier in the week. what happened instead were duelling and sometimes heated protests between pro and anti-immigration troops. police separated them and made six arrests. that won't end the tension. the flood of young illegals into the rio grande valley into texas, blown to other states,

forced to the limit and pitted those that want a preer form of immigration against those who want stricter immigration controls. during a naturalization ceremony yesterday president obama paid homage to the u.s.'s strong tradition of immigration. >> we shouldn't be making it harder for the best and brightest to come here. create jobs here. grow our economy here. we should be making it's. >> i critics say the president's refusal to enforce the law sent a signal throughout central america the welcome mat is open and not just for the best and brightest but for anyone, including children left on their own. many with communicable diseases and conditions including measles and lice. >> we don't even know all the diseases and how extensive the diseases are. this federal government, this administration, wouldn't even admit for a long time that they knew they had h1n1. when that's communicated human to human, you are talking potentially life threatening.

>> the president has made repeated calls for comprehensive immigration reform. speaker boehner's office said that won't happen in this congress, quote, the american people and their elected officials don't trust him. meaning the president, to enforce the law as written. until that changes, it is going to be difficult to make progress on this issue. in the meantime, the president is asking for more funding to better accommodate the undocumented women and children fleeing into this country. >> all right, doug mckelway. thanks for that report there from d.c. as the immigration battle heats up, president obama is promising to add executive order to deal with this issue. what exactly can he do? we are going to discuss a little later in the show. six people have been hurt in a shooting in a music festival in houston. witnesses say a gunman opened fire on a crowd of several thousand people inside of an arena that was hosting a caribbean music festival. this is video taken by an amateur and appears to be a cell phone video from inside the

arena. four people were shot and two others were injured while running from the scene in a panic and ensued. police say that one victim is in critical condition. and so far in this case, there have been no arrests. in philadelphia, investigators there are now saying a deadly fire that swept through a group of row houses may have been started on a couch that was sitting out on a porch. the flames erupting early this morning leaving a number of homes gutted and four people dead. >> this is a tragic, tragic day in the city of philadelphia. philadelphia. we lost four children today. >> those children being identified as twin 4-year-old girls, a 4-year-old boy, and a 1-month-old boy. four other people were injured. a or pieing shooting in indianapolis has injured at least seven people and it happened in a popular neighborhood known for its night life. one cop says he heard the shots go off just about at 2:00 a.m. in the morning.

one man is in critical condition. the other sustained minor injuries. so far month one has been arrested. ask the motive for this shooting there on a busy street in indianapolis is still unknown. in leyland a deadly boat collision claiming the lives of at least three people, south florida police say it happened late last night and they believe that the boaters had been out celebrating the fourth of july holiday when one boat crashed into the other. eight people were taken to shore and two of them later died at the hospital. emergency crews also found two unconscious women on the other boat. one other person is still missing. overseas now, al maliki, the prime minister of iraq is removing the chief of the army's ground forces and the head of the federal police from their post. the dismissals are part of his shake-up of the security forces. as the battle against isis continues, the sunni terrorists have seized control of large parts of syria and iraq and declared the establishment of islamic state.

last month al maliki fired three generals who had been deployed in the northern part of iraq. the conflict in iraq now spilling over into syria, the commander of the western backed free syrian army is callings on the international community to prevent a, quote, humanitarian disaster. he says rebel forces need more guns and ammunition to stop the advance of fighters from isis who have seized a huge chunk of the country's border with iraq. and are now making further gains into rebel-held territories. also in the middle east, clashes between israeli police and palestinian protesters are now spreading out from jerusalem and into other towns of israel's north. palestinians say an arab teenager that was burned to death in a revenge attack after three israeli teens were found dead. david three miller is live in jerusalem with the latest on the violence today as it is coming up around 10:00 p.m. in jerusalem. have things calmed down?

>> reporter: for the moment he is there. the situation remains very, very volatile. especially in light of this latest development. palestinian officials say that initial autopsy results show that mohammed abu khedr when he was set ablaze. the teenager had injuries on the side of his head and indicating that he may have been hit by a rock or another hard object. israely media is now reporting that police are focusing their investigation on suspects who might have killed the 16-year-old palestinian and n retaliation for the kidnapping and newder of three israelis and many palestinians believe revenge was the motive in the attack. further heightening tension is disturbing. amateur cell phone video that appears to show israeli police beating the 15-year-old cousin of the murdered palestinian boy. the cousin is an american citizen that goes to school in florida and taken into custody by israeli police during a street demonstration shortly before the funeral.

no criminal charges had been filed. the boy's parents say that he was noting low stones and accuse police of abuse. >> this boy, 15 years old, is dangerous? he has a gun? find gun? okay. after you hurt him, you hit him again and again and again in his face. >> an official investigation sunday way concerning the attack caught on video. the israeli cabinet minister said it has to be viewed in a broader context of the ongoing violence in the region. following yesterday's burial of the 16-year-old palestinian, clashes took place in east jerusalem and west bank. a sign that the violence is spreading, there have been clashes between israeli arabs and israeli police taking place in the northern part of the country. another sign the situation here violence-wise is escalating. there were some 14 rockets fired

by palestinian militants in gaza targeting israel today. one of those rockets targeted a city the longest-range rocket we have seen fired in the ongoing conflict. there has not been a rocket fired that went that distance since 2012. in this case, the rocket was hot down by israel's iron dome missile defense system. but since this current conflict got under way, at least 150 rockets have been fired by militants in gaza and the israeli air force has struck some 70 targets in gaza. things here remain very, very tense. back to you. >> very, very tense. obviously as -- evening there in jerusalem. we will have to see whether the nighttime hours bring any month air strikes by the israelis inside gaza in retaliation for the rockets.

thanks, david. get you caught up on weather now. hurricane arthur being downgraded to a post-tropical storm. not before causing serious flooding problems for people on the east coast. today people in north carolina are in cleanup mode after arthur plaided homes and businesses and knocked down trees. thousands also left without power. the storm is barrelling past canada right now leaving at least 200,000 people without power. arthur is expected to continue moving northeast with wind speed in the 70s. outrage is bidding in southern california. at this hour over a shocking video that shows a highway patrol officer holding down and beating a woman on the sued of the interstate. this is the video that's causing all of the outrage. we have the latest the investigation and video itself to give us context.

>> hey there. yes. this video is very -- let's show it to you so you can see it one more time and show what's going on there. a man driving down the i-10. he saw the woman you can see on the ground, originally in the laid -- laying on the freeway staggering towards the side there. the police officer, california highway patrol officer, you can see there, apparently called to her and we don't actually get to see this on the video. that's when the altercation started there. if you look at him, he is a very strong guy there. he really is. point of ordering her quite heavily. no indication from the exchange they had, why he was actually forced to do that. the person said he agitated the situation and didn't help at all. >> i was shocked that in broad daylight where in plain sight a

man is beating a homeless, maybe mentally disturbed woman, you can hear them -- the pounding and you also see her head bouncing off of the concrete. >> if you look at a series of stills that just sort of describe that process, you can see that the officer is very well built, big arms and he's heavily striking down on her. then you see he has a colleague who is apparently an off-duty police officer who comes in to help restrain her. the california highway patrol issued this statement. a pass cal altercation ensued as the pedestrian continued to resist arrest. at which point a plainclothesed officer assisted in amying the handcuffs to the pedestrian. when asked if she sustained any injuries the pedestrian did not advise of any nor were any located by the officers on the scene. this took place near a slip way

on the i-10. santa monica freeway. there was a homeless place nearby. month indication that this has been prior problems there or if indeed that's where she was living. weigh don't know the name of the woman at this time. it hasn't been released. we do know that the officer, whose name also has not been given, is on administration i have leave. that's quite important. that's actually standard policy as the investigations get under way. and chp saying they needily assembled an investigation team. we hope over the next couple days did there will be more details on exactly how that video came around to be. it is really quite extraordinary stuff. >> we will be polling this story. developments that come out of that investigation. thanks. well, the energy department will allocate billions for so-called green energy projects. but republicans say that energy and independence begins with the keystone pipeline. the latest on the debate next.

there are growing and serious concerns that middle east supplies could be vulnerable. rising gas prices right here at home especially during the summer travel season. the worries are now bringing the issue of energy independence to the forefront in the nation's capital. we have more from washington. >> reporter: the energy department is announcing plans total indicate $4 billion in loans from renewable energy projects to reduce greenhouse gas emissions. now the gop is weighing in saying that energy independence begins with more immediate means. >> it starts by building the keystone pipeline, put thousands of americans to work and show we are serious about our energy future. we set into motion more plans, pipelines, transmission lines, bringing low-cost energy safely to consumers across the land.

>> reporter: republicans say president obama is catering to a base that claims that the keystone pipeline would negatively affect climate change. a state department study claims that the pipeline would create more than $42,000 direct and indirect jobs while house lawmakers passed a bill approving the pipeline without the president's signature and efforts in the senate have stalled. the new loan program backs the president's push on climate change which he addressed last month. >> what we are doing is not enough. that's why a couple of weeks ago america proposed new standards to limit the amount of harmful carbon pollution that power plants can dump into the air. >> reporter: there are five areas the government would consider supporting. fist is advanced grid immigration and storage. another is drop in bio fuels with the goal of meeting existing fuel quality specifications. waste energy projects, projects that would enhance existing hydroelectric facilities and lastly, efficiency improvements. this comes as gas prices remain at the highest levels this time of year since wait and mainly

because of the crisis in iraq. . back to you. >> elizabeth prann in washington, thank you for breaking that downpour us. the immigration crisis becoming more desperate. a wave of undocumented women and children flooding into the u.s. sparking protests across border states that are bearing the brunt or -- that are bearing the brunt of the problem. president obama responding to the increased criticism now considering executive orders to ease the crisis. >> if we can't to keep attracting the best and brightest beyond the shores, we have to fix timgration system which is broken and pass common sense immigration reform. we shouldn't be making it harder for the bestand brightest. we should be making it's easier. i'm going to keep doing everything i can to keep making the immigration system smarter and more efficient.

>> the congressional reporter for the washington examiner is here. susan good to see you. >> hi, arthel. >> you wrote a piece called "five things obama could do on immigration without congress." i want to go down those five items and then get your take on it. number one, you say expand and deferred deportation program. why might the president do this? >> because he's already done it for children who came here with their parents illegally and may not be adults. they won't be deported now for a two-year period. what obama may do is expand to include their immediate family members. in other words, a spouse, a child, parent, may be able to remain in the country with the same two-year provisional status. in other words, they wouldn't be deported. the president can't provide them a path to citizenship. but what he can do is through executive order change the deportation policies. i think that this is at the top of his list because immigration

rights groups have been really pressuring him to expand this program to -- keep families together. president t president talked about keeping families unified and this would fall into that category. >> okay. number two, you said allow some family members to come back. how would this work? >> that's interesting, too. some of the family members have returned to their home countries hoping that re-entry in a legal way to the united states. they would have to wait currently under the current law up to ten years to be able to re-enter the united states. this would put them back in the front of the line and let them come back here and be -- wait here for adjudication so they would not have to go home. would come back here and wait and apply for a green card. you would really -- basic lib end this deportation issue where people are not able to be reunited with loved ones. that i think is more controversial than allowing folks who are already in the country to stay. it is on the wish list of immigration rights groups and i think it is under very serious

consideration. >> number three, allow illegal immigrants to join the military. >> this one has legs. some republicans like it. not all republicans. there is a bipartisan bill in the house that would allow certain individuals, not everybody, to join the military even if they are here illegally. that could provide them a path to naturalization. the president held naturalization services for members of the military who are immigrants. this could be a pathway for hem to stay in the country permanently and legally. i think it is something that some republicans will agree to. thus it has much more of a likelihood of becoming an executive action. >> i'm going to squeeze the lasting two together. we were running tight on time. the fourth is expand the hardship exemption. five, you say add resources to immigration courts. >> these go together. humanitarian issues instead of saying, hey, they want to make it much more of a legal definition of what is humanitarian crisis for these folks that would allow them to

stay here and want to include mental health issues, what's the state of their country back home and what hardship that's would face. that allows more people to stay here under that hardship waiver. the court system needs more money. the president may through executive action try to provide more resources and are heavily backed up. almost double the number much pending cases in the past ten years. it is a big on the top of the list for the immigration rights groups. they peel that the adjudication is taking way too long because the courts don't have enough resources and it is taking forever to get to most cases. i think that's a real like within. >> good article. i want to -- i had our brain room pull research for me. as of january 2013, regarding children who live in the u.s. and who have -- always been in the u.s., and parents have been in the u.s., et cetera. you can -- 138,149 are homeless. 18 years and younger. as of january 2013. according to the usda in 2012,

we are talking about children with households with children, 10% suffer from food insecurity. they are not sure if they will food to eat. that's people who are here. >> right. right. so this is part of the compelling argument against bringing more folks in. the borders being flooded right now with children. we have to pay for them. we have to take care of them. that's why you have a lot of folks that are not going to be thrilled with executive action that may allow more people to stay and maybe encourage more people to flood the boarders because of our much more generous executive actions that the president may put in place regarding immigration. all of that together, you know, really -- it is -- it is going to make whatever the president does, very controversial. >> all right. susan, thanks so much. >> thanks. a shark attack -- yes. on a popular beach this holiday weekend. this is something we have been seeing a rise in sharks and a lot of places around the world. ing the frightening details that are putting nerves on edge.

bottom of the hour. time for the top of the news. early-morning shark attack in california. lifeguards say the victim was swimming off of manhattan beach when he was bitten by a 7 to 10-foot shark. the victim right now in stable condition. police in new orleans arrest ad 20-year-old suspect in connection to the deadly bourbon street shooting that happened last tuesday that killed one person and injured nine others. she facing multiple charges including first-degree murder. world cup host country brazil facing a massive blow to its team after its star player is sidelined for the rest of the tournament. he suffered a broken back after friday's match against colombia. brazil later defeated colombia and will play in the semifinals come tuesday. the statute liberty has been one of our nation's most iconic similar bombs of freedom. she stands at nearly 200 feet, though. making it a little too high up

for us to see. thanks to a new art exhibit, visitors are now getting an up close and personal look at this gift. good to see you back at home. >> reporter: thanks. it is good to be back. 140 years ago the statue of liberty was first built in france and then disassembled and sent over to america in 214 wooden crates where it was reassembled and built. an artist created an exact life-sized deacon instructed replica. re-creating each individual piece that makes up the statue using the same copper material and technique used to make the statue. he tlespent three years doing t. all for an art exhibit called we the people which is now in new york where visitors can see 50 of these pieces at city hall park and brooklyn bridge park.

>> people's faces wreck clang as they recognize is a piece of the statue of liberty. this is enormous and just one little piece. it has been quite an imaginative experience, i think, for our audiences. >> the actual statue is 151 feet tall. it is made of a copper that makes up the statue only as thick as two pennies. the inside of the stat eye is actually hollow. she's held in place by an eiffel tower at the center. still nearly a century and a half later this new art exhibit is helping people learn new things about lady liberty like the significance behind pieces of a broken chain at her pete. >> this symbolizes the end of rule by britain, independence of the united states with england. end of british rule and beginning of the united states is people and that's what the statue of liberty represented when she was unveil. >> the other 200 pieces are spread in over 15 countries including museums and private

collections. a really great exhibit. hi no idea about the broken chains on the feet. >> i know. it is fascinating. it is always good to see it if you can up close and personal. a great story you brought to us. thanks. president obama taking an aggressive tone taunting republicans saying, quote, so sue me. as he faces a possible lawsuit from house speaker john boehner. but what are the legal hurdle must be overcome for the president to take speaker boehner's threat as a serious legal battle cry? and who better to ask than two lawyers. robert shaw. there has been much made over the unanimous decision from the supreme court that said that president obama went beyond his powers in the case against the senate. the question is does that make things easier if the house wants to sue the president? >> i think that this is the whole point of striking while the iron is hot and a point where the supreme court ruled 9-0 against the president. there is going to be a time for

speaker boehner to file his lawsuit now may be that time. the only issue i point out they could prove suffered injury and biggest issue we will talk about is standing and whether or not the house of representatives has standing to sue the president in this situation. >> you pointed out 1997, the supreme court basically said congress can't sue. it is a little bit too far-fetched to get the standing you need go in and even if you have a good case. does things change in this case? >> i think that raines v. bird will be used as president and in any case that john boehner -- initiates against president obama if he cannot find a private plaintiff. that's because in that case, congress exclusively said that six congressmen that challenge the president's line-item veto power, that -- the congressional power that the loss of congressional power, that injury was wildly abstract and very --

incredibly dispersed. one of the requirements is there is an actual injury. there has to be a particularized injury. >> did you say it is very difficult to come up with an individual who you can point to in this case in the immigration rights that has a real injury. >> right. speaker boehner is not telling anyone where he -- what challenge under the executive orders he would go after. i don't think that there is any order that he's brought down where he will be able to find a private plaintiff. however, if he can prove that no such person exists, he can actually proceed with the lawsuit saying there is month private plaintiff and we will be representing the plaintiffs in this case. again, it is -- it is very murky waters whether he will be successful. >> i agree with robert 100% because all of the actions that they are say president obama expanded -- overreached on his executive authority, been event leapt in nature. unilaterally changing obamacare, raising the minimum wage for federal workers and lake robert

said, immigration reform. it is going to be really hard to find -- >> did you say they are benevolent. a lot of republican was not argue. they would say this is bad for the country and a larger sense. so any american who now see it is raising of the national debt thanks to minimum wage, something like that, or influx of immigrants into towns, then that actually creates a problem. could you have a city in california, one of the cities in texas, that's affected by this, could their mayor be the person who has standing? >> again, based upon the case law as it currently stands i don't see that happening. i just don't see how they are ever going to be able to articulate that person being injured in that situation. >> they can bring the case 100%. there is no -- no guarantee a judge will hear the case. hay may throw it out immediately. >> we will have a problem with the judiciary, whether or not they want to throw their hat in the ring and say we are going to grant you standing and now every time that there is going to be a question between the house of representatives and the president, they are going -- it is everything is going to take --

>> more work. >> what a court could say in that regard is there is no need for judicial intervention in this scenario because congress can always use the impeachment power while it is very unlikely here since we have a democratic senate. but that's their remedy and part of standing is that will is no other remedy aside from judiciary intervention to bring the case. >> i appreciate you guys taking the politics out of this. in the sense there is a lot of political posturing on both sides of the issue from president obama as we saw from house speaker boehner. the question also has to be asked whether this is an academic debate because it takes a long time for a case to get to the supreme court. president obama only has about 2 1/2 more years left on his term in office. doesility matter if there is a lawsuit? >> i think it does. there's always a first time for everything. look at all these cases that set the president for the country. this question needs to be answered and whether or not it is answered at a u.s. district level, supreme court level, president obama will be long

gone. >> by the time it gets answered. it needs to be -- this needs to be cleared up because you can ask ten different lawyers where it stands and five lawyers will say one thing and five will tell you something else. >> also, this is like robert said, john boehner to strike while the iron is hot. going back to the canning case earlier this week, unanimous 9-0 decision. >> that's rare good very rare. to say that obama overreached his executive authority. >> we will see if the supreme court wants to weigh in. if they are looking for taunt they can. >> obama may be gone but -- >> all right. robert shaw and ben levine, thanks for being here. we have two lawyers. we got two opinions. that's a new one. thanks so much. >> thank you. thank you very much. a tense rescue operation under way after the entrance of a gold mine collapses leaving several workers trapped inside. >> the dow topping the 17,000

this is indeed a very good victory for the new administration of borshenko. tactically and operationally, it is -- as an important victory for ukraine and the new government. and i think gentlemen yo politically, though, as you mentioned putin still has quite a few cards to play and quite a bit of intimidation to do to shape the political outcome inside of ukraine. >> it is not like putin is going to say, okay, i will walk away from the chess board. he is going to assess what's happening, back away momentarily. and then come back with a vengeance. do you agree with that assessment? >> i do. i think he has quite a few political tools. he is looking at diplomatically the engagement with the germans and the french. the foreign minister just met with his counterparts in berlin.

he's also got the united states interesting enough, mr. putin called president obama yesterday to wish the united states a happy birthday on four fourth of july celebration. he's really looking at still -- >> wait a minute. what's behind that? i just feel like every time there is something like that, that seems to be a nice extension of camaraderie or nicety, what's coming after that? >> what's coming after that is the continued importance for vladimir put sxwrin russia to be seen as a geopolitical power. that is the incentives of the russian's interest geopolitically and as you recall, mr. putin said that the end of the cold war was a very tragic circumstance for the russian federation, for the soviet union, how it ended. there are quite a few russian people that are dispersed across the former soviet union and that still look to moscow for leadership for a affinity of the russian culture and the message of vlade mir putin.

the u.s. economy is appearing to gain momentum with the dow hitting a record high and a new jobs report touting an unemployment rate of 6.1%. that is the lowest number in nearly six years. once you include the people who have stopped looking for jobs

all together, that number almost doubles to 12.1%. here to talk about it and break it down, the founder and managing partner of harrington capital management. are either of these numbers the most important ones? or do we look to gdp spending which is not as rosie? >> we need to look at all of those. when you look at gdp growth that we have, at best it is sluggish. when you look at consumer spending and the average consumer keeping more money in their pocket, as i believe they should in this tumultuous economy, the problem is, that the stock market is really focusing on this jobs number. and are people going back to work. you just highlighted it. the labor participation rate, the amount of people looking for work is at a very low point. so what happens here is that we can show 225 or 295,000 jobs in any given month and say that

we've consistently shown over 200,000 jobs. but the devil is in the details. a lot of those jobs are part-time jobs that people will go to work for a few months and then be back unemployed. >> when you look at this though from the sense of the way things are going, moving forward. which comes first. the chicken or the egg. the dow with 17,000 and on the run up or a good economy for the middle class. >> it's a good question. certainly a psychological barrier that the dow jones has crossed by crossing 17,000. a lot of market watchers, including myself, are looking at that number saying, wow, this number has gone significantly higher. what i suggest is main street is not watching wall street at this particular time. i don't believe the jobs margaret has gotten any stronger. i think people are still going month to month in terms of their paychecks and i think what we need to do is focus on the entrepreneur in this country and unlease the regulatory burden and tax burden on those

individuals so real sustainable long term jobs will be created. i want to play a quick quote from president obama. take a listen. >> we have now seen the fastest job growth in the united states in the first half of the year since 1999. >> it was president kennedy who said, if a society cannot help the many who are poor, it cannot save the few who are rich. is president obama doing enough to help the many who are poor? is his policy they know middle class or not? >> absolutely not. i don't think what calculator president obama and his administration is using, but i can tell that you the average person that i speak to day in and day out at our firm, when they're talking about their jobs and their work, don't feel like the economy and the main street work force has gotten any stronger. >> we'll leave it at that. thank you very much. and we'll be back at 6:00 p.m.
