welcome to "the kelly file," everybody. i'm in tonight for megyn kelly and there's new video coming in from murrieta, california. look at this. this is now the third plane that is unloading illegal immigrants in there less than a week as new fears and some big concerns are growing over the sheer numbers, disease and security. you're watching this all day. this is a mess. and this is heartbreak, anger is escalating on the ground there and this may not end well, everybody. protesters on the border and at town halls in several states are demanding that the obama

administration do something. we got all the breaking news on the developments of the crisis and why the president will not go there to the border but will attend a campaign fundraiser that's just a couple hundred miles away. ed menry and mark just ahead on that. also developing tonight moments ago a response now from the government and the top irs lawyers to demands that it preserve the data from the woman at the heart of the scandal targeting conservative groups. right now it appears the government is refusing to budge on the issue of investigating these hard drives and where that information went or even allow independent examiner to come in and look at lois lerner's computer system. chief congressional correspondent mike emanuel reports. >> reporter: there will be significant pressure on the irs this week both on capitol hill and in the federal courts as leaders and groups seek answers. late today i spoke to a member

of congress who suggested upcoming hearings should feature irs and justice department officials answering questions side-by-side. >> the biggest part of this is what involvement did the department of justice have as well. you know, you got the irs. you got interactions back and forth with the department of justice. and so having both of them together would be a real critical thing, so one cannot say well we didn't know. >> fox news has learned irs commissioner john koskinen will return to capitol hill wednesday after a couple of bruising hearings. somehow lawmakers have picked apart koskinen's testimony and sources say the commissioner wants to clear up any discrepancy, for example koskinen testified that former official lois lerner printed out a lot of her emails but her attorney says that wasn't the case. of course lerner isn't talking, refusing to answer lawmakers questions and the agency is blaming a hard drive crash for wiping out two plus years of her

external emails. then conservative group true to vote will be in u.s. district in washington on friday. the organization clearly isn't buying the irs crashed hard drive excuse and wants to have a forensic expert determine how those emails were lost and if any of that missing information can be recovered. true to vote sued the tax collection agency last year over the targeting of conservative groups including itself. officials say the irs has been asked to put its own internal review on hold while the treasury inspector general investigates the missing emails. congress continues to demand answers and some groups harassed by the irs are applying their own pressure through the federal courts. >> mike, thank you. so now that the government has responded to she's groups that are seeking some kind of justification in all this in the courts, the ball is now in the judge's court. could and should the judge order the irs to hand this information over or to let computer experts

in there to see if they can get in there. judge napolitano is fox senior judicial correspondent. we just heard a little while from the attorney for true to vote, let's bring in outside investigators to look through your hard drives and figure out what's in there. they came back with a resounding there's nothing here, there's no evidence to dig into. basically back off. >> well, you know, the irs lawyers are making a circular argument and basically saying because these things don't exist there's no evidence for us to give you and because the crash of mrs. lerner's hard drive happened before you sued us, there's nothing in that crash that could conceivable affect this lawsuit. you know what? they are saying to it the wrong judge and the wrong forum. >> why? >> this judge is a very, very strong which would guy who is nobody's pushover. he's not the government's

pushover. if he suspects that a litigant before him is playing fast and loose with the rules in order to prevent their adversary from seeing what they have a right to see he'll come down on them very hard. it's really the beauty of our system. the irs has stonewalled the congress to the frustration of two-thirds of the nation. the congress can't get to first base on this. but here you have a private litigant, true to vote and they have the irs, the great grand inqisitor, the irs to the wall and they are inches to close of getting what congress can't get which is mrs. lerner's hard drive. >> lois lerner said i called the i.t. department i wanted to see if i could get back information. if she really wanted to get back the information why wouldn't they welcome an outside investigator. she told us there's nothing

there. there's nothing there. i did nothing wrong. they are stonewalling to the point where, as you say this, had to be pushed into the court system to get anywhere and final true to vote will get an an. >> i have a feeling -- i can't predict what he'll do. i won't suggest what he should do. he's a terrific and superb federal judge who calls things as he sees them. but i have a feeling that some light is going to come out of this. he's going to demand, he's going to insist the irs do something which the congress is powerless to do. i'm not blaming the congress. >> if they destroyed this evidence that's one thing. if they didn't save the evidence they are guilty of breaking law, correct? >> correct. but for them to say there can be no evidence in this case because the hard drive crashed before the case started is not an argument that will resonate well with this judge. for them to say we won't help you find what was on there because we don't even want an

outside person to look at this hard drive, just belies common sense. look, 16-year-olds that know more about computers than you and i do, certainly than i do, do not believe mrs. lerner's excuses and the excuses of the irs. >> if they have nothing to hide, open the doors. say come on in. we have no rob with you looking at everything that's in here. john koskinen this poor guy sat before congress and said we'll produce all temp males four. i'll be back here and produce them. now he's forced into a situation actually she never did print them out. somebody told me she printed them out now she didn't. >> there's two potential crimes. one is an out right lie under oath and below the radar screen lie where you say things to mislead. but the irs is in a position they don't want to be in right

children who arrive here in the united states illegally. now i just spoke to a top white house official who is pushing back insisting to me that the president sent a letter days ago to congressional leaders of both parties saying he'll seek this expanded power. they say he's sticking with that. but we should note that it was just yesterday, nbc's "meet the press" jay johnson was iffy on the situation. asked repeatedly whether he'll enforce the current laws on the books jay johnson would not answer. >> what are those additional options? is he enforcing the law or looking for other options. >> when he's talking about additional openings he's talking about more efficiently procession them through the system. once they go through the immigration system it's our view it's unlikely most of those kids will qualify for humanitarian relief. if they don't qualify for that humanitarian relief and don't have a legal basis for remaining

in this country they will be sent back. >> reporter: now the president will be in texas this week, wednesday and thursday doing some fundraising but he's under pressure now not just from republicans but de well to go visit the border for himself. democratic congressman from texas says he thinks the president should get an up close look at the crisis. he was critical of the president said he should have seen this crisis coming much sooner, should have done more to deal with it. john earnest pushed back on that and said the president has no plans to visit the border because he's been briefed by top aides, full y briefed on the situation. >> there's been times before where they weren't concerned about the optics of these kind of situations when pressed to be hands on in some of these different stories. former presidential speech writer and american enterprise institute fellow, mark, good to

have you here. this big question is what is the president thinking? on this issue? what is he planning to do? everybody is trying to figure that out. >> it's a mystery, quite frankly. look, it looks terrible for the president to go to state of texas for a fundraiser but not go to the border. the problem isn't he's not is going to the border. the problem is he doesn't have a plan to deal with the crisis at the border. if you show up at the border and don't announce a plan that's worse than not showing up. nobody knows what he's going to do solve this crisis. >> when you look at this situation and josh earnest sent the message a lot of these kids will be deported. that will be a lengthy bureaucratic process. in the meantime you have kids sleeping on the floor with red cross paper blankets over them and seems to be no, no impetus

to do something. the president appears to be somewhat neglectful or has been somewhat neglectful because this has been coming for some time. >> he caused this crys is. 60% of americans think president obama is personally responsible for this crisis at the border and he's right. he issued an executive order on the deportation of unaccompanied minors that said if you're here illegally we'll delay your deport jays. that sent a signal if you get here you can stay. tens of thousands of people come. now he doesn't have a plan. last week he told congress that he's going to seek this authority to send people back to central america the say way we do with mexico. now the associated press is reporting that's not the case and that he's backing off on that under pressure from liberal groups. if that's true that's a troubling scenario. what that means he cares more about appeasing liberal

immigration groups than getting control of our border. >> it sort of speaks to a larger issue that's being criticized about. you know, across the board does he have a plan. does he take action. whether it's iraq or health care or the irs. you know the list goes on, mark. and it's really across the board on the sunday programs, all over the networks, everybody is asking the same question. does he care? is he neglecting his duty? >> his presidency is engulfed in crises in three areas. in abroad, at home and at the border. i don't know where else you can have a crisis. the va scandal. you have the irs scandal and implosion of the emails at home. the obamacare problems that are happening. abroad you got iraq imploding and rise of isis and this border crisis and he doesn't have a handle on any of these things. polls shows americans hold him responsible for these problems. so, going to the border and having a press conference and sort of showing he cares is not going to solve it.

these are real problems. you're not going to change public opinion until you changed the conditions on the ground whether it comes to iraq, whether it comes to the scandals that are engulfing or already it comes to this border crisis. >> obviously a big part of being president is crisis management. when something happens you have to act. and i think that is where, you know, you look at the polls. this isn't my opinion. look across these polls that we've been watching throughout these last several weeks. people feel that he's not -- there's a lack of competency in the white house. peggy noonan pointed out that it doesn't appear he's bothered by that. >> i think she's right. if you look at it, gallup poll, confidence confidence in the president dropped from 51%. quinnipiac poll, worst president since world war ii. i mean people feel that this

. developing tonight a new lawsuit against teacher tenure. a group of students in new york city claiming tenure violates their constitutional guarantee to a quote sound basic education. this almost a month after a california judge struck down teacher tenure rules in that state. al brown is a civil rights attorney and children's advocate. kyle olson is founder of aeg news.org a news service dedicated to education reform. gentlemen, welcome. good have both of you here. there's 11 students in new york who said they believe they are not getting their constitutional right to an education because there are teachers who aren't teaching them and those people are impossible to fire. in fact, the new york board of

education says it takes approximately 830 days or two years and three months to get through the process of firing a bad teacher. how can that be possible? >> well, first of all we have to acknowledge this. putting teachers last does not mean we're putting teachers first. when we look at the process that's in new york it's to protect those that are on the front line educating our children every day. tenure and the process that they have to go through only means a teacher and due process and can't be fired because of political or other reasons. >> are there not bad teachers who should be fired? i mean, is that what you're saying? >> there are evaluation processes, there are ways to remove teachers that aren't performing. before any teachers are given tenure there's a three year period where they are evaluated and trained to see how effective they are as teachers. if that three years isn't enough it can be extended even further before they are given the tenure. >> we have a huge education

problem on our hands and students themselves, 11 of them come forward and say i'm not getting the education i deserve. their parents have a union called the new york parents union. kyle, what do you think about this move on their part? >> i think it's a good move. unfortunately, in states like california, in new york, parents and students have to turn to the courts because the politicians aren't doing anything about this problem. what this comes down to is you have the politicians putting in place these policies like tenure and seniority where teachers are kept based on how long they have been there and not based on the job that they do. that's how they are judged. this is the result of big labor coming in to schools and putting this sort of policy in place. >> you know, if you're doing a good job, you shouldn't have to worry about being fired. that's the way it works in most business organizations in this country. so what are they afraid of? >> well, what we're talking about is tenure is a way of rewarding teachers that are

experienced. it's a way of protecting -- >> why not reward them with merit pay. reward them with more pay. if students do well -- go ahead. >> there are people in their institutions that will jeopardize the jobs of teachers whose ideas they don't like. jeopardize jobs of teachers whose politics they don't like. we're protect what's going on in the classroom, passionate teachers that to teach our kids. >> how would you feel if your child had a bad teacher and you said to the principal, i can document this, these kids are not learning anything and they said to you i'm sorry that teacher is tenured. your child is stuck. what would your response be? >> number one that's not realistic. second of all, there are things put in place to evaluate teachers and move bad teachers out of the classroom. we have a process in place. they are just saying we don't like it. >> hold on. kyle, is that process working? >> the reality is it costs

hundreds of thousands of dollars to move teachers out of the classroom and so, unfortunately, a lot of cash-strapped districts will actually pay a teacher to go away and give them a letter of recommendation to go to another district where they do the same sort of thing, than actually spending the money on legal fees to get rid of that person. it's a broken system. it's taking parents and students to try and fix it through the courts where politicians are not doing their job. >> so many efforts to push these things through the legislature and they failed much like the irs story. same kind of thing. so now they are going to the course to get some resolution and we'll see how they do. gentlemen we got to leave it there. thank you very much. so there's a disturbing new message from the leader of a terror group a leader called more anti-american than osama bin laden delivering this sermon from a city america fought and gave lives for.

while away. do you think he would be supportive of her, that he would give her 100% of his effort? >> first of all, how good is it for him to give 100% of his effort in 2016 if he keeps going the way he's going. yeah he's inclined. there's a super p.a.c., priorities, usa action. obama's campaign manager is co-founder of the group. buffy wintry mix there was. there's another group out there, ready for hillary. mitch stewart is involved in those groups. and jeremy bird. i don't think people from obama's campaign would flow into things strong for hillary unless they got a green light from the white house. joining me now is robert zimmerman a democratic strategist that worked for the

clintons. why do you think? a lot of people take issue with this story, not sure if they are putting credence in it. what do you make of the fact her name is floated out there. there's a reason for everything. >> first of all, hearing karl rove lecture the political party on democratic strategy is hearing lectures by dick cheney on weapons of mass destruction. there's no credibility in it. the reality here is while karl was indirectly trying to give this story legs, ultimately he's auditioning for tmz or to work for paris hilton. he was forwarding the agenda. he was trying to keep this story day live. the fact of the matter is and what karl failed to bring up is that elizabeth warren said she's not running for president. b, she's supporting hillary clinton and has joined all the democratic women in the senate signing a letter endorsing hillary clinton and encouraging her to run for president. >> rocket, you know as well as i do the last time around hillary clinton was the inevitable

candidate and then along came a little known senator named barack obama and changed all that. why are you so sure? why are you so convinced that she is inevitable at this point. she was last time too. >> first of all i never said hillary clinton is inevitable. nobody gets handed the keys to the white house or the nomination. if she chooses to run she knows better than anyone how hard a task it is and how hard she will work. everyone knows whatever you may say about hillary clinton she is a very hard worker and very intellectual. the point here is if you're wondering about the buzz we have friends in the right-wing who try to create some buzz and try to create some distraction. they will do anything, martha, but talk about solutions for the problems america is face. we don't have a republican agenda on health care, on infrastructure, on jobs. >> the gop has put through 40 job bills that have not been entertained or taken up in the senate.

>> what they put through was job bills that was partisan votes. if you look at the bipartisan deals that senate struck on immigration reform, highway infrastructure bills, on a whole range of agendas the republican house even though the leadership supports it blocked it because they are afraid of the tea party minority. my advice to the republicans they are better off reading jackie collins on the beach if they want to get good fiction. >> you think elizabeth warren is a nonfactor. >> i don't think she's a nonfactor but she's not running for president. she's clearly endorsing hillary clinton. >> how about vice president? >> well, first we have to have a presidential nominee picked and that's the first step. i personally hope it's hillary clinton. i'm committed to seeing her run. that's way far afield to see who the vice presidential pick would be. it's not my choice it's the nominee's choice. >> that's true. thought i would ask. robert, thank you very much. all right. coming up a new warning about a potential terror threat and why this is upping security at airports around the world.

security. tsa officials say in a statement that the security measures affect direct flights to the united states. so, something to keep an eye on. media coverage now because there are new questions being raised about the mainstream media's coverage about a recent poll that came out on president obama. in a poll that questioned more democrats, more democrats than republicans, one in three registered voters say that president obama is the worst of the 12 presidents that we have had since world war ii. while some media out lets ignored the poll, others down played the bad news for president obama. welcome to you both. good to have you here. so do you think that statement is true? did they ignore it? >> this poll got a lot of coverage. it should have gotten more. it's a fascinating poll.

it's a quirky poll because when this question is asked worst president people tend of the incumbent or his immediate predecessor. same question, same poll president bush 36%, richard nixon was driven out of office 17%. >> pundits are making a lot of excuses for this poll. they are saying the sample size is too small, the word cigarette wrong. well presidents in their second term always are down in the polls. when the reality is that president obama has had a disastrous second term. at the va, irs, iraq, this immigration situation. >> there's no doubt in my mind that this is worth discussing this story. right? so there are, you know, abc didn't cover it. nbc didn't cover it. i guess chuck todd made mention it but said these polls are a

moment in time kind of thing. when we look back in 2006 george w. bush as you said got the same moniker, worst president since world war ii and called the same poll devastating for him. >> news organizations like to play up their own polls which they pay a lot of money for. so when chuck todd said voters thought president obama's presidency was over when a nbc poll said majority didn't think he was competent to run the government this quinnipiac poll said the same thing. president obama hasn't accomplished as you said in the second term but not getting an easy fried the press. >> he is in many ways from the press. take a look at the "the washington post" story that talked about his social media office and how great that was doing. oh, how does he get notes in the white house, oval office. he gets them when his secretary comes in and gives them to him. the world is falling apart and "the washington post" is

focusing on notes and how they are handed to the president. >> i just think the press, some of which swooned over barack obama in 2008 and in the first term is now disillusioned with him. think he's treating them like a lame duck. that's reflective in the way in which he's trying to turn the blame -- >> he turns it on the media. >> i saw over the weekend the d.c. bureau chief of the "new york times" said he was incompetent, questions about the competency of the president. i think that, you know, the tide has turned in many ways and reporters at some point are forced to do their job and actually cover the story that's out there, in this case many of them ignored this poll. i can't figure out why. it's a great topic of conversation. it's heavily democratic. 31%. independents made up 35%. >> it's an interesting poll. it was not covered as much as it should be. there are a lot of other polls that haven't been covered as much either that also show him down. what he's doing combat this is

southeast asia. it was also destructive to the u.s. armed forces. president nixon ended military conscription in 1973 and we were just becoming a volunteer force in 1975 when the helos were lifted off our embassy. it took six years before we could rebuild our military. today is the very first time since the american revolution where everyone in a u.s. uniform is a volunteer. unfortunately, the guys doing the psychological warfare for the caliphate really are good. they've terrorized the civilian population in iraq with mass killings, just like hitler forcing captives to dig their own graves. the capture of these cities is a major hit at the morale of u.s. military. i don't think our president, our commander-in-chief who is headed to texas tomorrow gives a damn about it. unfortunately many of the guys who fought in places like mosul and falluja and ramadi where i spent most of time during that war see as those cities fall in the hands of terrorists that no

one in the obama administration is talking about the effect on our troops coming in to service or the ones who are still there. it's a terrible scene. >> wow. what has happened in that area is huge. i mean, the establishment of an islamic terrorist state is something that osama bin laden never had, you know, a pulpit to stand up on and a people to call out to who are somewhat organized. they have money and power and, as you point out, precious little is being said about it and we haven't really done anything at all to stop them at this point. >> you know, before i came in here i went through the wires, all of the wires, the international and domestic wires. there's not one story coming out of iraq right now. everything else is dealing with things domestic, things like china threatening their neighbors, the philippines, japan, the economy, and israel is the only real ally we have in the middle east now under attack at this very minute.
