ride. it was filled with people and it slammed into a tree and went off the tracks. how does that happen? heather childers has more on the frantic effort to save almost two dozen people who were stranded up there on the coaster. >> how does it happen and what does that feel like? sunday at a california amusement park turns into a nightmare as a roller coaster heading 55 miles an hour aun a corner smashes into a huge tree branch that apparently had fallen on to the tracks and then derails. 22 terrified riders on the ninja coaster at six flags magic mountain were left dangling 30 feet in the air for nearly three hours as day turned into night. >> it comes around, hits the tree. the fire department had a chain from the cart to the track for precaution. >> you can see fire fighters bringing the trapped wrierdz down one

by -- trapped riders down one by one. four people who were sitting in the front of the ride suffered injuries to their knees and necks. >> i was really shocked at first. i had no idea that that could even happen. and it's just a really big shocker. >> the ninja roller coaster will remain closed until a full inspection is complete. can you imagine three hours stuck up there? would you guys get on a roller coaster again any time soon. >> sure as long as there aren't any trees around it. crazy trees are so close that a branch could come down on the tracks and derail the darned thing. >> that rarely happens. i'm glad we don't have the

>> those are your headlines. i'll see you back in a bit. a busy news morning. >> speaking of busy, the president of the united states later on today is going to ask congress for $2 billion in emergency aid essentially to speed up the processing of these kids and their families down on the southern border. while he asked for the $2 billion to speed up the process, however what he's not asking for is the legal authority to quickly deport the kids, which because they are from noncontiguous countries -- not canada, not mexico -- we actually have to go through a legal process rather than say turn around, go home. >> $2 billion as far as we know to go for more judges, for more border patrol agents and also more facilities to house these illegal immigrants who are coming to the united states. not more money to get rid of them. what's going to happen? what we're hearing is the problem isn't over. more and more are going to be coming across the border.

in a couple of months are we going to be asking for $2 billion more from congress? >> 39,000 families overall. what you're referring to possibly, anna, is the report out of a texas radio station that 300,000 are expected from central america. they are en route to the u.s. right now. what about this money? conflicting reports. some saying that the president is going to back off on deporting most of these kids. "the washington post" saying he's going to get tough and deport most of these kids as soon as he gets the technical legal authority. i can't imagine republicans standing in his way on this if you give him the freedom to go through that 2008 order. >> keep in mind, you know, a lot of democrats are saying george bush signed this law. and absolutely right, this law was passed in 2008 and what it did was if you were the victim of a sex trafficking, come to the united states, we'll take care of you. are all these people victims of sex trafficking? probably not. the left people on the political left are saying

it is a humanitarian crisis. you've got to bring the children here and we will take care of them. if you look at murrieta, california, where they turned around a couple of the buses, the mayor there has detailed the fact that kids who are coming here, we're not treating them so right. >> these kids, these women, children, they're being transported all over the country. come to find out they didn't have the health screening they needed, didn't get the care they needed. they wanted to come here and spend the night in a jail facility which is no place, it is not even humane for people to do that. >> a lot of attention is going on that one little town and a lot of people from all around -- a lot of people who are just concerned about the country and their own safety are being mislabeled, i think, as people that are intolerant towards immigrants. it's illegal immigrants and these families. who's going to pay for all of this? at the low end $34 billion and a country that owes $17

trillion. how many tens of thousands can we bring in? i think in my humble opinion that we're missing the point when we're talking about the president going from texas, go going to the border. more than going to the border or not going to the border, i would love to see him have a policy and say here's what i'm going to do, here's what we're going to implement. i don't care if he goes and grabs his binoculars. >> at the moment we don't think he is going to the border. he's going to be in texas to give a speech on the economy and try to get some democrats reelected. the white house press secretary seeming to think we're really not worried about the way this looks. we're not worried about a p.r. campaign right now. on the other hand, one democratic congressman from texas is saying this could really damage the president. listen. >> we're not worried about optics because the president is very aware of the situation that exists on the southwest border. >> i'm sure president bush thought the same thing, that he could look at everything from up in the

sky. i hope this doesn't become the katrina moment for president obama saying he doesn't need to come to the border. he should come down. >> an excellent point. it could become the president's katrina moment because he does not seem engaged on this either. and when you look at the politics of it, you've got a humanitarian crisis on our southern border. people from the political left have for years said we don't need to build a wall. it's secure down there. you've got five-year olds walking across all by themselves, and that's the problem. so many people right now, as you can see the images right there, thought the border was secure. but right now nobody is really guarding the border. all those agents are baby sitting right now. >> can anyone actually say, from the democratic side or the republican side, that the border is sealed? that is one issue that i think we can all put to bed. the border is not sealed. small children are getting through. >> it never was.

tweet a couple of days ago from at barack obama. throw back to last week when a woman, not her boss, made her own decisions about her health care, hash tag tbt, throw back thursday. jonathan carl yesterday during the press meeting said does the president really feel like that? keep in mind, the hobby lobby thing had nothing to do with banning birth control pills or anything like that. it simply allowed employers who didn't want to pay for drugs that end lives to not have to pay for them. josh earnest was asked whether the president knows what his twitter account is doing. the answer is surprising. >> i'm not sure if he's aware of that. again, because the twitter handle is maintained independent of the white house, i'm not aware of it. >> when the president of the united states takes on another branch of government even through a tweet, he should at least be willing to back it up and the spokesperson should be saying it.

chick-fil-a cup. got plenty of hate for that. then she posted this. the left is attacking her and she's received rape threats. she says try to rape me. i've got a whistle. this terrorism is assinine. a woman exercising her constitutional rights. it is a matter of free speech. women shouldn't be vilified by the left for speaking out for what they believe in. >> i'd love to chat with her, this conservative mother of three under fire for expressing her beliefs. let's talk about some myths you can debunk. you say the first one is the democratic party is the party for women. >> right. we hear this all the time. democrats are the party for women, republicans hate women. the fact is it was republicans who wanted to push for women's suffrage. it wasn't until democrats thought it was convenient for them that they hijacked the movement and have had credit for 50 years for being prowomen's rights.

when you look at the history as i do in my book, you'll see it was republicans who wanted to give women equal rights and it was democrats who voted against it. >> break out the history books. how about hillary clinton being the ultimate female role model? >> hillary clinton is america's most notorious enableer of abusive and powerful men. if you look at her history from the 1970's until now, she has a very bad record when it comes to defending women's rights despite portraying this idea she is all about empowering women and girls, whether it is defending her husband while she allowed him to drag the name of the women he abused through the mud or whether it was ignoring allegations of sexual assault and even rape in some cases of diplomats of young women overseas while they were on her trip. that's something i think people should take into account when she's claiming especially in 2016 if she decides to run that she is a proponent for women and girls. >> the next democratic

a michigan man is under arrest after he tried to board a detroit plane with a knife that agents say was artfully concealed in his shoe. the knife was found inside the bottom of the lining of the shoe. take a look at this. it was hidden in the guy's carry-on luggage. the t.s.a. says he should have packed it in his checked luggage. the guy was arrested and he was released while prosecutors try to decide the charges. this comes as intel officials are on high alert right now, worried about an al qaeda plot to make a bomb that could go undetected through security. it happened once again. another reason you may not want to own a cat. a pet cat goes wild on its owners and draws blood. theresa gregory says her cat attacked her and her husband trapping them in their bedroom just north of orlando, florida, and that's when they had to call 911. >> my husband and i were locked in the bathroom all day. i let her out and she was

does he have a case? will they hear it? and what could happen if he wins? here to break it all down is fox news senior judicial analyst judge andrew napolitano. good morning to you. >> steve, good morning. >> first of all, senator johnson says what? >> senator johnson says that there's a provision in obamacare that requires that members of congress be burdened with the same choices as everybody else in the government with respect to health care. so they have a package that they can choose from of one of three. they don't get any reimbursement for additional costs depending on the size of the family or the package they choose. >> however in reality they do get a reimbursement. >> like in the hobby lobby case when the department of health and human services tried to change a regulation administratively, the same thing happened here. the obama administration found cash somewhere for members of congress and issued a regulation saying members of congress will be, and their senior staff members will be reimbursed

for excess cost incurred by obamacare. so in fact they are not having the same sting, so to speak, the same financial sting as everybody else in the government who is forced to choose from among the three packages being offered. so senator johnson is suing to say this is illegal. you're forcing me to accept this money. the legislation says i can't. we promised that we wouldn't. and because you're forcing me to break the law, you're damaging my reputation and i want you to be stopped. >> damaging my reputation with the people who voted me into office. if i say one thing and something else happens. it comes down to now whether or not senator johnson is regarded by the judiciary as having standing. >> yesterday in wisconsin -- excuse me -- in d.c. from wisconsin, the lawsuit is in d.c. this case was argued. you can't tell which way a case is going to go by a judge's behavior, questions and comments during oral argument. but he has a very, very strong case because he's

actually able to show individualized harm to him. and that's the test. if you can show that you as a plaintiff have been harmed, specifically harmed by what the government has done, you have what's called standing, which is the right to force the government to come in the courtroom and answer to your complaints. >> we don't know why whether or not the suit will go forward, although it sounds promising for senator johnson. if he is successful, if the court hears it, what's going to happen? >> he has, i think, a very good argument. it is identical to hobby lobby. in hobby lobby, the congress did not enact a contraceptive mandate. an administrative bureaucrat made it a rule. in this case, congress did not enact subsidies for members of congress. an administrative bureaucrat acting at the president's behest made it a rule. can a rule trump legislation? of course not. is the president back to

border, but i think they are caving somewhat to political pressure. what changed? it's not just republicans like rick perry pressing the president. you had henry cuellar telling neil cavuto that the president should have seen this coming and that as a texas democrat, cuellar says the president should go to the border. what the white house is trying to do politically is finding middle ground. they don't want to cave totally to governor perry and have the president get a photo op because it's a crisis on theand that's y look bad for the president to get caught up in the middle of that crisis. instead, the white house is trying to put it on their turf and say let's have a round table meeting with the president, governor perry, faith leaders and others to try to discuss the problem. i suspect there will be some republicans who say we've been talk being this problem for a long time. how about you secure the borrowedder and take action? it will be more pressure on him. but i think the white house is trying to show some good faith here to say let's meet in the middle. >> in that letter that you got

from valerie jarrett, it does refer to what's going on in the southern border as a humanitarian situation. three or four times. and that's new. suddenly there is some urgency to that. but then at the end it goes, the humanitarian situation at the border is but the latest example of the great cost of congressional inaction. forget about we were supposed to secure the border years ago. it's all congress' fault. >> sure. two things there. one, you're right. very important to point that out. that is a shift from the white house because with the white house itself, the president and others suggest this was humanitarian crisis. now call it a situation, shows they're trying to turn the temperature down perhaps, trying to suggest that this is not as bad a situation as even the white house suggested a few days ago. i do think the white house makes a fair point that long-term, the republicans can continue to beat up on the president about this short-term crisis, but long-term republicans haven't really put a substantive plan on the table to deal with the immigration system, but certainly you're right, that the president can in

that fight over broader immigration reform, has been weakened by the fact that you have this crisis in the short-term. the president claims that the border is secure and we can move on to a path to citizenship and comprehensive reform. that hand is weakened when you have this crisis down at the border. there are a lot of people in both parties, including henry cuellar, the democrat, saying let's fix this and then we can move on to broader immigration reform. but you can't do that if you've got a crisis on your hand right now. >> political chess need to go on? we saw initially president obama offered a handshake on the tarmac with governor perry. then when governor perry asked for this substantive meeting, he said yes, there will be other people there. a round table of sorts. should the governor say yes or we need a one on one and we need that one on one at the border? >> sure. certainly i'm not going to pick sides and advise the governor, but i think you've got a fair question, which is if the governor throughout there, the president should go to the

border and the president is trying to meet him halfway, it would make sense for the governor to sit down with the president. the governor can come out, have a news conference and say he needs to do more. he needs to go to the border. at least the president is showing some good faith to sit down with the governor. but it's a smart move by the governor to say let's not just do a handshake photo op. let's do a real meeting and it sounds like those at the white house agreed. >> do you believe that what you got yesterday, what the a.p. is reporting yesterday, what the "washington post" is saying today, some say he's going to say most of these kids will be deported. others say he's reevaluating, giving in to his left. where do you think the administration is on what to do with the 52,000 plus children? >> frankly, i think as you laid it out, it's still confusing what their next move is. i think the shortest way to say it is last night the associated press suggested under pressure from liberals, the president is going to back down on his promise to deport most of these kids if they turn out to be

he has time to do fund-raisers. that's fine. he's raising money for the mid terms. but texas is ground zero now for this humanitarian crisis. he's the president of all the states, all 50 states. so he should, while he's there, give the courtesy to the governor of texas to actually engage with him on this issue. i think he's worried about being seen in one of these detention facilities, guys, because that could be a photo op that would blow up in his face. he's worried about what that would look like, i believe. for the president to confront this face-to-face would be a startling picture. he doesn't want that picture out there. i think that's a lot of what's going on here. >> sure, because so many people say that his policies have been the reason for it. so that's why he doesn't want the picture. something else we want to talk to you a little bit about. this is something else that the white house would love to have go away, but fox is not going to let it go away. there's a scandal at the irs, a op ed page thate "wall street

says, hey, where is the director of the f.b.i.? turns out the f.b.i. director didn't tell congress about the missing e-mail and the worry is that the f.b.i. could possibly be carrying water fort white house? shouldn't they be the ultimate g men and women out looking for the truth? >> yeah, jim comey, as an f.b.i. director, we would imagine should have known that these documents were missing. they're doing the investigation now for almost a year, or exactly a year. this investigation has been going on. but we're to previous he didn't know about these missing documents? if he didn't know about the documents, then that's bad. if he knew about the documents and then didn't tell anyone, then that's also bad. but again, you can't imagine if these documents have suddenly disappeared in an investigation of a private company that the f.b.i. would be engaging in the same conduct, sort of slow footed conduct, an investigation that is happening right now.

that's right. it takes custody from there. orr, as it's known, has a division of children's services. and the orr budget for unaccompanied alien children last year was $868 million. it's got to be blown out this year. >> substantial. meanwhile, what are the children entitled to? >> they're entitled to what any children are entitled to really in the united states. shelter care, legal assistance, family reunification, and kids that remain in orr get government-funded education, mental and medical health services to make sure that they're okay. >> who is going to pay for the school? >> you are. we are. the taxpayers. the american taxpayer is going to pay with an increased taxes? the budget may double this year. >> when will the children be released? >> that's an interesting question. the child remains in a shelter or with a foster parent until a real sponsor is identified. between 2008 and 10, the length of stay in these orr care averaged 61 days, went up to 700

days. the average length of stay now is allegedly 35 days. i question that. >> okay. so after they're released, they go where? >> again, interesting question. they go four, five or six different places. to a parent. parent in guatemala sent to america, mexico, to a legal guardian, perhaps here in the united states. three, an adult relative. four, a licensed program willing to accept legal custody of these children. and right now the federal government has got a request for proposal for a half billion dollars for such programs, or an adult or entity approved by the orr. >> here is a final question for you. it is what david gregory tried to get the answer to. will they be deported? >> let's see what the law is. they'll be judged on a case by case basis, involves an interview with immigration services agent. there is about 260 immigration judges in 59 immigration courts in the usa. listen to this statistic.
