even though rick perry at one point said i'm not going to just shake your hand on the tarmac, there he is shaking his hand on the tarmac, unless we have a substantive meeting. they did have a long meeting. >> governor perry made an appearance on the channel last night with sean hannity. here's what happened. here's what was talked about during that meeting. listen. >> i thought, mr. president, you can deal with this. you can unilaterally direct the department of defense to put those troops on the border to do that work, and he starts talking about a philosophical issue that he may or may not have with that. we're past that. i didn't want to go just show up on the ramp in austin, texas, shake his hand and say welcome to texas, mr. president, when the fact is we have a humanitarian crisis on our hands on the southern border, and the president needs to be engaged. the president needs -- he's coming to texas. he's 311 miles from austin to mcallen. i mean, air force one is a

pretty fast ride. i think about the criticism that george w. bush received when he didn't go to new orleans, katrina. this is no different. >> did you ask him? >> absolutely. the first thing i asked him when i got on to air force one, i said, mr. president, i said i really want you to come and see this because i said this is important for you to absorb as a father, but more importantly as the president of the united states, to see the humanitarian crisis and to also understand how you can move the border patrol forward. >> he talked about the president really said my hands are tied, i've got to get money from congress, similar to what he said about syria, i'd like to take action but i've got to get the okay from congress. the same president said weeks ago i'm going to have to go unilaterally with my signing statements when it comes to immigration because congress won't do anything. the president decides to play that card. i'd love to put the national guard on the border like you requested, governor, but i can't without some help and congress is not helping meevment here's the

president -- congress is not helping me. here's the president yesterday. >> the things that the governor thinks are important to do would be a lot easier to do if we had the supplemental. it gives us the resources to do them. there is a very simple question here and that is congress needs to pass the supplemental. >> that is not so easy. the supplemental sounds so innocuous. it is close to $4 billion, and what it would do essentially is it would speed up the process. once the illegals are in the country it would supposedly speed up the process. >> more lawyers, more judges. >> up and down the track, it would speed things up. however, it doesn't stop people from coming in. what they really need to do in this particular bill that the president is suggesting is it does not change the 2008 law. but yesterday brian had a news-making interview with henry cuellar, the congressman from the great state of texas and henry cuellar is working with the white house now on changing

that law. if that is true, that would be good. henry cuellar is the same guy who made headlines by saying this could be the president's katrina moment if he doesn't show up down in texas. you know what? he did show up in texas but he didn't go to the southern border because, as the president said yesterday, he's not interested in photo ops. >> this isn't theater. this is a problem. i'm not interested in photo ops. i'm interested in solving a problem. >> rather than going down there and going and touring these facilities as well, where these children are being held, as a father, as rick perry mentioned, just show some compassion for the kids, show some compassion for the people in the outlying areas who are realizing this is going to be hurting my wallet, this is going to be hurting my medical care, this is going to be hurting my kids' education in school, all those potential unintended consequences. but the president says i'm not interested in photo ops. but how many times have we seen the president doing

just that? >> photo ops? take a look right there. >> yesterday you had him playing pool. you also had him drinking a beer yesterday while playing pool. you have him in white coats trying to pass obamacare. people were handed lab coats, these doctors, before they went on to the white house lawn. remember the selfie with david ortiz. of course he's shopping at the gap in new york city. he also did a photo op at the bored with a big fence -- at the border with a big fence behind him. he did photo ops after super storm sandy. what happens with the president being here? he gets a chance to see the people. see the people, feel the scene and maybe understand more fully. now it seems as though maybe nothing gets down and he does have an idea and he's had his homeland security down there five times and he's now in central america, it would be something at this point it seems both sides are stubborn. why don't you go? i'm not going to go. but he stays in texas again today to finish up another fund-raiser with another

billionaire. >> he's down in austin at this hour. it's curious, ted cruz tweeted out a picture with a little map. hey, mr. president, it's only 230 miles to get down to the southern border and here are routes you can take. of course you probably didn't see that if you're watching the other channels. zero coverage on a lot of these topics and zero coverage on this as well. yesterday house oversight released an e-mail where darrell issa tweeted out lois lerner intentionally sought to hide i.r.s. internal communications from congress. let's take a look at some of these e-mails and you be the judge about what lois lerner was trying to hide, if anything. >> this is in april of last year, april 9, 2013. i was cautioning folks about e-mail and how we have had several occasions where congress has asked for e-mail and there have been an electronic search for responsive e-mails. so we need to be cautious about what we say in e-mails. someone asked if o.c.s. conversations were also

searched. that is like instant message. i don't know but told them i would get back to them. do you know? the response to this is is o.c.s. messages -- like an interoffice instant messaging system -- are not set to automatically save the standard. however the functionality exists within the software. that being said the parties involved in an o.c.s. conversation can copy and save the contents of the conversation to an e-mail or file. the response from lois lerner. one word: perfect. >> think about what this means in context. we're trying to find out why and how two years worth of e-mails get dropped. they disappeared. the hard drive smashed. this is why lois lerner took the fifth. then we find out this communication, as you add this to another layer, seems toe a woman in charge trying to find out how much information could possibly be obtained through e-mail. you factor all that in and it makes one wonder, one's eyebrows get raised, what is really going on here. john koskinen appeared again at oversight, at his own request. we'll talk to darrell issa

tahmooressi explained how he ended up crossing that border accidentally with three legal guns in the back of his truck. and while the judge didn't let him free, his lawyer says he still remains optimistic. listen to this. >> we feel the hearing was a success, and we feel we are finally on the right track in order to achieve what every one of us is ultimately hoping for. >> the judge did allow andrew's mother to sit down with her son for 20 minutes after the hearing. his next court date is set for august 4. she was shot in the head, and inches from death but imagine this. a 15-year-old girl doing the unthinkable. she was still able to call 911 and stopped her father's deadly rampage in its tracks. the gunman who is not being named killed six people, including four of his own kids in spring, texas. this is just outside of houston. he was headed to the grandparents' house when his daughter, the one who

survived, called the cops. >> he was going to, the information we received from the constable was the grandparents were also targets. fortunately they were brought out of the house before that could happen and we would have had more tragedy. >> the suspect surrendered after a three hour standoff. his daughter is in critical condition. he wrote the book how to survive the bulls of pamplona, but the books didn't care. bill hillman was gored on the streets of spain during the annual running of the bulls. it seems to happen every single year. one of the animals breaking loose from that pack. that is when hillman and another guy were gored. hillman underwent surgery on his right thigh. lucky to be alive. >> you know the boys from the classic walt disney movie pinocchio?

appears to be around it? >> they are frustrated. they tell me that the government says if you speak out, if you tell people what's really happening here you're not only going to be fired but we're going to throw you in jail too. there is a significant threat there. people are really wondering, wait a second, they're not let congressmen in, they're telling people you're going to be fired if you speak out and now they're not letting pastors in. people are wondering what the heck is going on in those government-controlled camps they don't want us to know about. >> what do you think? >> we've heard the speculation but i think it is clear we have a government-sanctioned invasion. president obama has time to take a selfie but can't go past austin to see what is happening with this humanitarian crisis. it seems this administration is more concerned about kids in other countries than kids who are here in this country. >> it is a sad indictment of what's going on down there and to think the president met with

and you think they're covered and they're not. >> when hot weather is going on, is it good to take a cold shower? is that more effective than taking a warm shower? >> you would think so now that is fiction. why? the cold water in a shower 30 minutes your blood vessels down and you don't get the coolness effect. the coolness doesn't get in. you know what works? sweating. sweating is the body's sprinkler system. if you're hot and sweating, you may not like it but you're cooling down the body. we have our own ability to cool down. >> how about the sun can damage your children's eyes? fact or fiction? >> that is absolutely a fact. and it is why i want my children and every child out there to wear sunglasses when you go out, when you go to the beach, out in the sun in the summer. we often forget the eyes. you can get eye damage that way. you can even ultimately get skin cancer in the eyes. you've got to watch it. sunglasses, number one. >> you worry about skin

cancer on, you know, on your skin too obviously. every time you get sun burned, you think, hey, it's going to turn into tan; right? is that right or wrong? >> that is another fiction. studies have shown the point you just made is 100% correct. you sun burned earlier when you were a kid, your risks of skin cancer go way up later on. you must not think i'm going to burn now, it will turn into a tan later. it doesn't work. you damage the skin and it never becomes a tan. >> you have a big barbecue in the backyard and it is time to go swimming and mom says you need to wait 20 minutes. >> mom, you're wrong on that one. that is a myth. the reason is we have plenty of blood flow. we can cover muscles and digestion. you do get more blood flow to the stomach after you eat. we have plenty left over for the muscles. there's never been a case of drowning due to a kid saying finished that barbecue, got to get in the water. i say it's safe. that's a myth. >> thank you so much.

hurt the environment, refuse to pay the fine? soon the epa might be able to garnish your wages without culling a court. the agency claims it has authority to garnish nonfederal wages to collect delinquent nontax debts without first obtaining a court order. this sounds like a joke, but it's not. judge andrew napolitano is here. judge, how could this be legal? >> it is not legal, brian. the epa is yet again, it's not the first or second time, probably not the last time, trying to add to its own authority, add to its own power base on its own. congress never authorized it.

congress couldn't authorize it. it blatantly violates the constitution. here is what the epa is trying to do. they drive by your backyard and see you built a pond without getting a permit from them. they're not going to charge you with doing it wrong and prove the case against you in court. they're going to send you a bill. if you don't pay the bill, they're going to come here to fox news and try and garnish your wages. absolutely unconstitutional because the constitution says if the government wants anything from you, your life, liberty, your property, your money, it has to -- you have to have a right to a hearing. >> the only time i could think this happens is with the irs, when you owe the irs money, next thing you know, it could come out of your paycheck. >> when you file a tax return and shows you still owe the government money, you admit you owe it that money. the government can go to your bank -- >> how is this different? >> entirely different because there is no admission with the epa. the epa is simply saying, again an example of your backyard, the

mcallen. air force one is pretty fast ride. i think about the criticism that george w. bush received when he didn't go to new orleans, katrina. this is no different. >> did you ask him? >> absolutely. the first thing i asked him when i got onto air force one, i said mr. president, i said, i really want you to come and see this 'cause this is important for you to absorb as a father, but more importantly as the president of the united states to see the humanitarian crisis and to also understand how you can move the border patrol forward. >> the humanitarian crisis, the crisis, whatever type you call it that needs the national guard down there -- >> man-caused crisis. >> right. worse than hurricane katrina, as many folks are saying, but that needs the national guard on the ground to stop this problem, to secure it. and the president says yes, i'll do that, but first you have to give me nearly $4 billion. a lot of republicans are saying we don't trust you with this money.

you need to make sure you're going to stop this problem and not continue to ask every few months for billions and billions of dollars. >> as peter broke down yesterday what the money are go for, about $4 million, they say some will go to border security. people aren't convinced it will get there. a lot will go to more judges and pro bono representation for the kids. the problem is the kids are disappearing. according to a report, the kids that have gotten here, they are suddenly leaving these military bases and when people show up to pick them up, we're not even asking if their parents are legal. >> that's a great point. there was a hearing on capitol hill yesterday where -- i think it was coburn and then there was another one later with another senator, who said to the dhs, i believe, said okay, so now when you call somebody and say okay, can you come pick this kid up, when they put that child in the adult supervision, do you check whether or not that person is in the country legally?

they said no, we don't check immigration status, to which coburn, i believe you're right, brian, said, well, you know what? that's a little on the crazy side. and why is it on the crazy side? if somebody is in this country illegally as an adult, do you think they're going to take the kids to their court date in two weeks? no. they're going to vanish. >> if they show up, how do we even know it's their kid? it could be an uncle, the crazy in-laws. >> why not prosecute the family members number within for being here illegally if they are. but number two, for hiring these coyotes and putting these kids in danger to get here. >> a better life. they're trying to get a better life. >> what i found incredible that the president said yesterday, one thing he said, i'm getting sued by the congress. i can't have those orders that governor perry wants me to have to put the national guard on the border, which is disingenuous 'cause last week he said he was going to implement his programs

on his own. can't have it both ways. number two is, the president by most part, by definition, by stuff you have to do and choose to do, you do photo ops. when there is a horrific school shooting in connecticut, you show up. when super storm sandy in new jersey, you meet the republican governor and walk around in a wind breaker. when you have a crisis on the border, how hard would it be to show up? the president says i don't do photo ops. >> listen. >> this isn't theater. this is a problem. i'm not interested in photo ops. i'm interested in solving a problem. >> oh, come on. the president has absolutely right, brian, done a lot of photo ops. for instance, take a look. far screen right, there he is in denver playing pool. he had time to play pool. then you got him going to the gap, a complaining about income

inequality, even though the gap pays more than minimum wage. you got him posing with bergdahl's parents. that didn't work out well. there he is with guys in lab coats. the president, despite the fact saying he does not do photo ops, he does a lot of them. and that, i believe, is one of the reasons he didn't want to be down on the southern border. he doesn't want to be seen with that picture of all those kids. john mccain was up on capitol hill yesterday and he was asking, why exactly, if i go and i looked at these kids in these facilities, why can't i take my phone? >> isn't that unbelievable? >> we don't want you to take any pictures of the children's privacy. how come we've got all those pictures that we've been showing you -- >> because they want us to see. it's a shroud of secrecy. >> can't do interviews, can't take pictures. but you can walk in facilities they point you to. >> it seems like the president is trying not to presidentialize and not take ownership of this and blame everybody else, blame congress for all of the problems and say it wasn't them -- this

president obama last night not only sitting down with texas governor rick perry, who is shaking hands with right there on the tarmac about the immigration crisis, he also invited faith leaders to the meeting in a dallas area yesterday. >> one prominent leader didn't get the invite. pastor robert jeffries because of his view of the bible, says the law comes first. pastor jeffries joins us now. pastor, thanks for being with us. >> good morning. >> some have said that you're cold and callus and unchristian if you think these kids need to go back to where they came from. but at this point, i understand you think our border security is more important? >> well, i think the most compassionate thing we can do for these children is to secure the border. here in texas, we have what we call the attractive nuisance laws. it basically says if you're a homeowner with a swimming pool that doesn't have a fence around it and the neighborhood child wanders in and drowns, you're

liable because you have enticed that child into a dangerous situation. the remedy is to build a fence not only to protect yourself from a lawsuit, but to protect the child from danger. what we're doing by having these unsecured borders, we are enticing children and mothers to make this dangerous journey. our attorney general, greg absent, was talking to me this weekend. he said this hundreds of these children and mothers are dying, many are being raped, all because we have not secured our border. so i think yes, we want to show compassion to the children who are here, but the most compassionate thing we can do is to secure the border. >> sure. it is curious, reverend, that you're invited, since you are the leader of one of the largest congregations in the dallas-fort worth area, and dallas-fort worth, they're about to release 2,000 of these children into the general population. >> well, and first of all, i

today after three delays for failed test runs. today is opens and here we go. it's all downhill from there. mr. kilmeade, over to you. my next guest is up for reelection in the indiana state senate. that's not big news on its face. but he's running uncontested, also not big news. but he's expected to win. there is just one problem. he just got word he's being deployed to afghanistan. we're talking about state senator and reserve navy officer jim banks. senator/lieutenant, welcome to "fox & friends." how do you feel about this news? >> well, brian, thanks for having me on to talk about this experience. it's an honor for me to serve in both capacities. first as a state senator and also as a navy officer and this is my opportunity to do my part. i'm looking forward to doing that. >> if things go as scheduled, you'll be taking your oath via skype from afghanistan, correct? >> that's right. it's a unique situation.

it's never happened before. in indiana, we have a provision in our state law that allows for a temporary leave of absence, which i will enact. i'll be sworn in via skype the day after election day. i'll immediately submit a letter of leave of absence. that will trigger an opportunity for my district to choose someone to represent them while i'm away. that makes me a lot more comfortable knowing that my district won't be left without representation while i'm being deployed. >> senator/lieutenant, what do you think it brings to your job here state side to be somebody who serves over there for your country? >> this experience isn't unique to me. tens of thousands of members of our country, our service members have deployed, have been deployed or are deploying. this gives me a perspective that they have. i've always appreciated the sacrifice that our service

members make when they deploy. but i didn't fully recognize the stress that it places on their families. the worst part of the situation was breaking the news to my wife and i have yet to tell my young daughters that i'll be leaving for extended period of time. all the stress that comes with that. that's an experience perspective that i'll bring back and i think at the end of the day, it will make may better state senator, too. >> you're basically doing things like offering a a soldiers tuition bill. so you're able to take your power with your experience and do some more good. take a look at these stats. this came out last week. as of 2013, just 20% of those serving in a u.s. office, whether it's the house or senate, have served in the military in 2013. compare that to 1971 when 72% served. what do you think the ramifications of that are? >> it's a troubling statistic. the indiana senate alone this

she took the fifth, you remember. in an e-mail, chairman of the house oversight and reform committee darrell issa joins us now. chairman, this came out yesterday, but yet these e-mails, this correspondence was revealed to ways and means a couple weeks ago. you discovered it yesterday. what do you get from this correspondence? >> what we get is perhaps what cnn was asking me for a couple weeks ago, smoking gun. this is lois lerner clearly cautioning people not to say things on e-mail and being delighted to find out that the local instant chat that they have, this microsoft product wasn't tracking what they said so that they could do this instant messaging back and forth at the irs without any audit trail. i think the important thing is she was trying to make sure that on april 9 of 2013 that, in fact, her people weren't being tracked and she was still using words like caution. why? she didn't want an audit trail of what they were doing.

they're covered. real question, of course, on april 9, 2013, had she turned over her paper e-mail files of what she was supposed to keep? no. so at that point was she also being cautious in what she considered making available versus what went in the shredder? >> if someone told me there would be a major story about irs targeting, if you want something universal that affects everybody, it should be the ways and means of the irs. why do you think so few outlets are covering what you're uncovering? >> partly because this has gone off the rails a little bit. the real story is lois lerner in concert with some other people that we haven't yet been able to identify, all of them, was targeting conservatives, trying to overturn a supreme court decision, clearly in concert with the president's views and the cover-up is they're slow rolling the answer. i think -- brian, the important thing that makes this a front page story is this could be your

16 minutes after the hour. from finding out some facts hidden from you about your new house to discovering you're the cosigner on legally binding paperwork, fox news legal analyst bob massi is answering your e-mail questions. these are straight from our viewers. thanks for being with us. good morning. >> good morning. >> the first one comes from brenda from las vegas. she says, can a company take you to court out of town and then attach my wages? >> yes, probably what happened here is that somebody sued her. they go to a default judgment. i talked about this a couple months ago where what happens so often is people get sued even in small claims court. they become afraid, they throw it away. they never respond. somebody gets a judgment against you and all of a sudden one day, your wages are garnished. the answer to that question is yes, if they have a proper judgment and then they get that judgment recognized in another state or another part of the state, then the bottom line is yes, they can take your wages and they can actually execute on your bank account. so the message to our viewers, if, unfortunately, you get sued,

don't throw it away. go get some legal advice. it's a lot cheaper than after the fact. >> and also open your mail even if you think it's junk mail. >> very much so. good point. >> e-mail number two. i bought a house and the seller didn't disclose important facts about the house. so i sued the previous owner and realtor. the case is very expensive and i'm not sure what to do. please help. can you help her? >> i actually called connie and spoke with her about it 'cause i was concerned about some of the facts of the e-mail. one of the things i told her is look, in our business there is nothing cheap, unfortunately, because the courts are so jammed and so time consuming. try to talk to your lawyer to go to a mediation. mediation is where a third party, usually retired judge or experienced lawyer will try to resolve the dispute to mitigate the amount of expenses that you have. you generally can't force that. it's something that has to be agreed to by all the parties involved. but if you could talk to your lawyer and say look, could you at least go to them and see if

we can go to a settlement conference to get it resolved, it saves a lot of time and money. i talked to her about it, gave her a couple more tips. at least for purposes of our viewers, if you're in a dispute, you have the right to ask your lawyer, is there any way you can go to mediation to get this resolved? that's for any kind of case, generally speaking. >> could save energy, too. thanks. and number three, from joanne from florida. weeks ago you covered the legal issue distinguishing between cosigner and guarantor. i went and looked at the papers i signed for my son. guess what? i am a cosigner and i thought i was a guarantor. what can i do? what's the difference between the two? >> first thing, pray he never defaults on it because when you're a cosigner for your children, it doesn't matter, anybody, then you are equally responsible for that debt. what you're guarantor in, what that means is if you guarantee a debt that i have obligated myself to and i default, then you, then the lender, then the bank, then the credit card company, whoever it is, comes to you, anna, and says wait a second.
