10:00 am
here. we have to wrap it up. on our web show outnumbered which is doing well. tweet or facebook us. and click on the overtime tab above the video. happening now, starts now. right now three developing stories, massive surge of illegal immigranting. both parties are pleaing the blame game over the crieses. israel stepping up the aerial offensive on gaza as it comes in an intense barage of missile. it is a conflict that shoes no signs of easing up. epa has the power to take your pay if you are accused of breaking their rules. back lash on the southern border
10:01 am
amid the surge of illegal immigrants and now concerns of disease spreading. i am jenna lee. >> and i am eric shaun. they are overwhelmed and government facilities bursting and over crowded and more being planned as president obama who is in texas for democratic fundraiser ruled out visiting the border to see it himself. he met with governor rick perry and u.s. drones to stop the flood. the president said congress should approve the throe.7 billion emergency flood -- fund to deal with the flood. >> and we are not giving the president a blank check. it is a problem of the president's own making. he's been president five and
10:02 am
half years. when is he going to take responsibility for something? going to dc we have ed henry standing by. >> reporter: interesting what you are hearing from speaker boehner. last night when the president met with governor perry. the president off loaded responsibility on the congress and republicans in the house and also on governor perry and say it is up to you to call republican colleagues and get them moving on a emergency request and they are to blame and the crisis is up to them bypass the money quickly as possible. senator john mccain said the presidented instead of fund-raising should get his hands dirty and the president defended his decision not to go to the border. >> i think it is clear by not
10:03 am
going to the border or lack land air force base where thousands of the children are showed a lack of sensitivity to the issue. >> i am not interested in photoops. i am interested in solving a problem. >> the president saying there he's not interested in photoops. and there is tweets flying around of official white house photos of the president in various photoops last night in denver shooting pool with the governor of colorado and beer. and you can see it across the social media and the banner has the president's names in lights and will he be talking up his economic plans and on the way here, stop for coffee with the university of texas student. he does this on the road and has a photoop. yesterday he department want to
10:04 am
do that and today back to it. >> thank you, ed henry. to the middle east the terrorist are attacking israel and the sirens wailing as more rockets fall. israel coming under intense rockets from hams and targeting the heartland of the jewish state. just a short time ago. the israeli military confirmed four rockets were fired in jerusalem. you can see the iron dome intercepting two of them. there is no word of the other twochlt and israel is stepping up the aerial offensive in gaza and hitting 320 targets. the rockets from hams keep on comprehending. a rocket was launched one every ten minutes. and in a clear sign of the vast arsenal hams has. believed to have more than
10:05 am
10,000 and no signs that the hams militants will stop. >> they are getting rockets by iran. and israel facing the advanced weapons. those terrorist added this rocket to the arsenal. m302 and it is called a game changer. the reason it is it a game changer. some of the long range capability it has and can reach the heartland of israel and putting major population centers at risk. joining us now from tel aviv. we understand the siren just went off a moment ago and difficult for us to understand here because obviously we don't have it happening on american soil. if it happens in our interview today how much time dow have to get to safety. >> we have 90 seconds to seek shelter and it might happen
10:06 am
while we speak, i am in the south and in the southern city of israel. we have 15 seconds and it is not easy when you drive your car to look for shelter. it is in the home front and i am the father of three children to explain to my daughter why to go in the middle of the night. we are willing to pay the price in order to allow the idf to strike against the hams. and to make sure that we are determined in order to allow the people of israel to live safely and sleep safely. this is something that is a given in the israel. here it is not a given. >> the united states taxpayers are involved in the defense of israel because of the contributions of the iron dome missile system that intercepts the majority of the rockets and hopefully provides safety for the israeli people. it is a joint project between our two countries.
10:07 am
how crucial is our cooperation right now to the safety and security of israel? >> the cooperation is important for us and the iron dome is giving a feeling for the people to overcome the threat of the missile. but we have to be cautious. some people feel too safe and will not look for shelter when they have to. and when you look at the numbers. more than 400 rockets in three days and we have no casulties, thank god. and we have that with the kopgz of u.s. and israel is important. the hams and al-qaeda, if they being send a missile to new york city they would have done it. they cannot. but they can feel the hatred from the iran and islamic forces. >> i am curous to your assessment, the united states
10:08 am
government's rollover the last few days in the current crisis. how would you describe the actions from our g. has it been enough? and do you need more? >> we hear the comments of the right of israel to defend itself. i think it is too early. i imagine you will hear the voices to stop. and i am sure there will be pressure on our prime minister to stop. we need to do the right and not stop. when they attack us. we have to fight back and be determined and i think the time of checking the relationship between israel and the u.s. comes when the eu and un. i am not hearing un condemning the flying missiles to tel aviv tonight. >> and coming from a wider perspective, it seems that the
10:09 am
pattern of rockets in gaza follow a familiar matern. the fire burns hotter and then subsides and never goes out because hams, the terrorist group still exists. i am curious about how it is different? how dow fight to win this time and what is the intentions and goal? >> there are two options. the first option i prefer is to fight deeply inside gaza and to make sure we take care of all of the hams terrorist in gaza. it is costly and long- term operation and eventually we'll have to do it. and the second option hit back hard and demand a yield. and then we would be back fighting hams again. i prefer the first option. >> what does that look like,
10:10 am
that operation you are describing? >> we haven't decided that yet. the cabinet would have to sit and decide and decide whether we go all the way or not. if we have to attack ground troops and go inside gaza and make sure the terrorist that are using civil population, they are doing a double war crime. they use the civilians and hospitals and schools and send the missile in civilian population as well. you have to send in the troops and make sure they don't use the civilian population as they used to do it. >> the civilian population is why those in the united states and israel that said that israel needs to she restraint. you are critical of prime minister netanyahu not being hard enough at hams. how do you defend your position? >> we have to be aggressive when
10:11 am
you look at hams and al-qaeda forces and you have to speak with them in a different language. they don't understand our language. and we are doing this on a -- you can't give gasoline to gaza. and unfortunately sometime, even though we are a democracy and western society, we have to speak with the islamic radical force in a different language and they only understand strength. it is a pity, and i wish we had better numbers with canada and mexico. we have to deal with these neighbors in a rough method. >> and we appreciate your time today. and we look forward to having you back on the program. thank you for your time. >> thank you very much. one of our strongest allies coming under attack.
10:12 am
>> looking at the white house. the obama administration is facing a crittism on the immigration. and now democrats are trying to use that to launch attacks against the republicans. how could it affect both pears in november. we have to go to fox news.com/happening now and click on america's asking and you can join the conversation. you mean you win. yes i do. the citi thankyou preferred card earn two times the thankyou points with no annual fee. to apply, go to citi.com/thankyoucards.

10:15 am
a scandal facing the obama administration from benghazi, to fast and furious and irs political targeting and the va health situation and the southern border immigration crisis. democrats are trying to shift the blame to republicans. john conyer said some of our republican colleagues are willing to exploit a humanitarian crisis to attack the bum pumadministration. and benghazi barbara boxer said it is a political witch hunt and a campaign tactic to gin up their base. >> and i don't think there is any doubt about it, it is a tactic that the republicans are trying to employ. and the republicans are trying to to unsuccessfully to link this scandal to the white house. that is from a member of the
10:16 am
investigating committee. are both sides trying to score points. a b stoodard and jenna goldberg with the national review. welcome to you. jona h. the flood of immigration now the president is trying to turn it on the republicans. do you think that the president will escape? >> i don't think he will escape. the president lost credibility with everybody but his base and that's all he's talking to at this point. he is talking to the people who he needs to show up in the 2014. he lost the independents and lost republicans a really long time ago. and now just spinning his wheels. it is important to point out, they have done this since the beginning of the administration, and if think so, they haven't paid attention.
10:17 am
republican opposition, they paint as illet jit mate and irerational and selfish and bigoted and this is more of the same. and i don't think it works well except for the people they need to get to the polls. >> is this just part of the political purposes? >> well, they are really in a hole. it is not just a second term scandal. it is a real crisis that looks like it will go on for a long time. and the administration is sending a message that this can't be stopped and we'll fill military sites with child refugees, it is a huge problem for the president. it is not something he can write off approximate a few rogue employees.
10:18 am
this is a national security issue and an economic issue and something we can't afford and until he said this is my plan to stop it. and this is a narrative that is billed about the competence of the administration and inability to manage things like the veterans affairs and agency and things get away from them and they can't control them. and so even if you are a democrat or independent that believes it was started on political reasons is ridiculous, it looked like something that the president can't droll and that's why it is so difficult for him. >> this is a basic failure of imdpragz policy and where the u.s. government is supposed it enforce the border ares and under the obama administration is not doing it and you have 52,000 or so flooding up from central america. why don't they cancel the
10:19 am
foreign aid to the central america countries get tough tore stop the humanitarian crisis from continuing? >> a b said even for people who think it is a conspiracy and done on purpose that's crazy. the cartoonist version is crazy and he's deliberately flooding america with little kids. but he is playing political games and he could micromanage and turn the valve and basically anybody if they are not a felon and they would never be deported and that sort of fine-tuning created incentives and that encouraged more and more kids to come here. and it is all part of a political approach. i don't think obama wants the crisis in the border.
10:20 am
he's incompetent and handled it incompetently and now he's caught in the the switches and they ask why he doesn't do these things, it is because the latino activist groups that unless you murder or rape or commit a serious crime, you should never be deported if you are an illegal immigrant here. that is an argument not against immigration policy but that is argument of borders at all. it is an extremist group and argument. but the media doesn't cover. it >> you are talking about laras a. ngroups like united we dream and activist groups that say deportations of any kind are simply wrong and that is an invitation to have 1.2 billion come to the united states. >> how does it change. >> he can change the 2008 law. no more people can come in and we deal with the the 50,000 or
10:21 am
more. he bowed it pressure earlier in the week not. to and people are waiting to see his response. it continues and the president is there and not going to see it for himself. thank you. >> and a massive land slide caught on camera. >> we'll show you where it happen and what caused it and an alleged profititude charged in a google executive death. investigators say it was done in cold blood. >> she was so callous in gathering her things she was stepping over the body and one point grabbed a glass of wine and finished the glass of wine.

10:26 am
chicago and a big public event and security. >> reporter: is of utmost corn. we are hearing from prominent chicagoans that the second citycant handle the violence on its own. you mentioned the shooting on the dan ryan express way. a mother of five shot in the head and she was pregnant at the time. her family is no stranger to violence and her brother was gunned down a year before and that comes on the heels of a deadly week woke. 13 killed in gunfire. and reverend jackson and mayor emmanuel stopped short of critizing the president. but calling on the federal government for resources in the troubled areas. >> the fbi must intervene. and secondly, if we can find the money, and necessarily to it help the children on the border.
10:27 am
2 billion can come to chicago with that same kind of money to make it liveable and safe and secower. >> i put it at the dorof washington d.c. it is a long time they stopped investing in our children and they need to invest in our kids. >> and last night in the city, four people were shot and there are a number of contributing factors, almost all of them are gang, land vendetta and supported from heroin sales and good weather plays a role. you get more interaction and gunfire. back to you in new york. >> thank you, mike. the environmental protection agencies pushing a new plan to garnish people's wages and trying to do it without a court order and who it could hit and the epa said they have a right to do this. and the alleged prosecutor accusing a google executive.

a controversial new proposal from the environmental
10:32 am
protection agency. garnishments of wages. it is the latest example of government overreach. here's more on this story. >> good afternoon, the epa said the constitutional authority is grounded in a measure signed in law called debt collection improvement act of 1996. that mandates federal agencies to collect what is called deling kwent nontax debt owed to uncle sam's treasury. and that's what the epa does in the steady increase of the debt. the rule would mean they would not have to obtain a court order and the history of interm management and track of over reach should make it the last agency to gain irs- like power. >> they have gone after a rancher in wyoming who had
10:33 am
built a stock pond. and he had approval from the state. and went after a family in ida ho and the supreme court ruled in favor of the family. the epa has gone after law- abiding citizens. >> epa officials told fox news that the rule complies with all applicable laws and it would have targeted protection. the garnishment would apply only after delength kwent debts and treasury try attempts to collects the debts and provides notice to any garnishment and an opportunity for the debtor to enter into a repayment agreement. and outlines a procedure for the hearing. epa might withdraw the rule if
10:34 am
it receives adverse public comment. if not it goes on the books september 2nd. >> thank you. >> he is called an allegeded upskate prostitute and facing murder charges for an goggle execute and i have it was all caught on camera. >> hello, eric. 51-year-old forest hayes was found dead on the yacht last november and now an alleged prostitute is charged in his death. the 26 year old alex was a high-priced call girl with 200 clients and had an ongoing relationship with hayes. a google excutive with a wife and five kids and surveillance video from the yacht escape showed her injecting him with a drug and leaving when he overdosed. >> showed her injecting him with heroin and her callousness after
10:35 am
the fact as he starts to have medical complications and no effort to call 911. >> the have finished her glass of wine and stepping over the body and lowered a blind to conceal him. and she took steps to conceal the crime after the fact. she works in a website called seeking arrangement police arrested her setting up a sting. and charged with felony manslaughter and she was a signed a public defender and her bail set at 1.5 million and this might be just the beginning, we learned now that police in georgia are looking at the 2013 heroin overdose of a man connected with tickleman. alex tickleman called 911 to
10:36 am
report dean rea pal overdosed on heroin. they are looking at that death now. >> defense attorney diane joins and keisha joins us. this woman, alex and now news out of georgia that broke on the associated press. with the situation in california, does she have a duty to act? we hope we would try to save somebody. but did she have a duty to act here. >> there is i case that is on point and said her doubt to act happened when she caused the harm and chlor there is in fact harm. he had a medical emergency and overdosing. if the video footage is not chlor and looks like he is high and reacting to heroin, they just met that night she has no duty to act and she can leave
10:37 am
and no criminal liability with respect to that. if it is clear he is in need of medical attention, she must call 911 and get him medical attention. >> apparently they had met many times before. and they had a relationship going and he was a married father of five. >> right. >> and so now there is a video. how crucial is the video to this case? >> i think the video is very crucial and tells what happened and shoes here injecting the heroin in hayes body and it is clear and it is enough evidence to cop nikt her of manslaughter. that act is what caused hayes to die. and i think it is going to be what the prosecution needs to convict her. >> about there are those coming out, because it is a surprise to the friends and community. how he died was not chlor after
10:38 am
his death and now it is coming out, there is some what of a chitter chatter in silicon valley about this particular woman and how many people she's hooked up with and perhaps her friends as well. and the question about the community over all. do you think the police will want more information from her and used as a plea deal here because of who she ashes parentally could be? >> i believe it is. >> it is possible. she has 200 clients in the silicon valley area. in california silicon valley is hands down one of our most powerful industries. and they have connections to prosecutors and judges and i think that the issue is going to be how much information can she divulge and people she could harm and light a fire to get her a better deal to keep her from talking.
10:39 am
>> we have a report out of georgia and a facebook talking about murdering people and smiley faces and also a case of a former boyfriend, what they think is a heart attack and there were questions about that as well. are we dealing with somebody who should be allowed to deal with prosecutors or dealing with a serial killer. >> i think the fact that there is a boyfriend may have died from heroin over dose and she called the police. it shoes she has knowledge what the side effects and what it looks like when someone is overdosing and they could die. it is very damageing to her and good that the police are opening up the case to see if she is a serial killer. >> great to have you both. >> thank you. >> thank you. >> and jenna, you are in the market to buy a new home, some spot fellow americans are getting stiff competition.

10:41 am
the u.s. there is weak. and frankly a distrust of the chinese government by wealthy chinese. and they rather put their money to work in the u.s. where you can trust the government more. and immigrant communities and think of los angeles, san francisco, and even las vegas, that's where the majority of the buyers are going and putting down their money and in particular in parts of los angeles, the story is they have immigrant communities that are there and buy a home in la and rent it out or there is something else that is happening and we'll see it in new york city. they are sending their children to school here in the united states. why not send them to nyu or ucla and buy the property and you got the money and the children can learn english and get first class education in the united
