>> first today from the deck, the man accused of executing six members of his ex-wife's family collapsed in court today as prosecutors were reading the charges against him. here's the video. he collapsed again about a minute later. sheriff's deputies eventually wheeled him out in a desk chair. the prosecutors say the accused killer, ron haskell fainted, because it finally hit him that, quote, this is real and there are real consequences. his attorney says the evidence will show his client suffered from a mental illness. we're learning more about his violent past. last week his mother got a restraining order against him after a fight outside their home. he tied his mom to a chair, choked her until she passed out and then thenned to kill her for speaking to his ex-wife. court documents show police in utah arrested haskell in 2008 after his wife reported he had

attacked her. she said then, quote, he dragged, threw me out of the room by may hair. i gave up and got in bed with the kids. he came in and dragged me out of bed, then hit me in the side of the head. court documents also showing haskell violated a restraining order from last year that his wife has filed against him by showing up at one of the children's school. she filed a divorce a few months later on valentine's day. now fast forward to wednesday this week. that's when investigators say the gunman forced his way into a home outside houston and demanded to know exactly where his ex-wife was. police say he tied up five children in the house and their parents and shot them each in the back of the head. the children, who died, were between the ages of four and 14. a 15-year-old girl survived by playing dead, and managed to call 9-1-1 to report the man was heading to heir grandparents next to kill them. today the grandparents called her a hero for saving their lives. diana iceman is a criminal

defense attorney and former prosecutor. good to have you today for your expertise. i've been reading through your notes. you say the headline here is classic premeditated murder. why is that important to note? >> you know, it's really a very classic case of premeditated murder. he planned the entire attack. he dressed up like a fedex man. he went to the house, forced his way in. he tied everybody up and he made everybody wait until his ex-wife came home. and that just shows lying in wait. it's a kidnapping situation, where he holds them against their will while wait forking another person to come in, and then the executes them all. there is absolutely no defense. it's a capital case in any state where there is capital punishment. >> i don't know if you can just see the video. that is one of the times the guy hit the floor, and you're not fazed by what he did in the courtroom today. >> not at all. the theatrics of this individual do not faze me. i don't think they're

convincing. i don't think they're convincing anybody, not the judge, not the jury pool-not anybody who has any sled of intelligence. this man is guilty of premeditated murder, is a monster and the devil. >> they wheeled him out in a desk chair. you didn't see a lot of people crowding around him so you talk about theatrics. we don't know what the medical experts will say but they certainly didn't react in a way that would suggest they were that concerned. what is he facing and do you think prosecutors reached farred enough? >> i think that capital murder is as far as they can reach. i think they definitely reached far enough. what i'm concerned with is why it is he wasn't prosecuted for other crimes. he was being accused of violating restraining orders or the issue with his mother where he committed domestic violence against her. she indicates in her report he choked her until she passed out. that is battery, assault, possibly great bodily injury. i'm nye clear why he wasn't

facing charges for those as well. >> if your assess. turns out to be correct and what the prosecutors and others said he looked shocked a maybe because he potentially had gotten away with things would be his react. the investigators feel they got a break. the 15-year-old, god bless her, she was able to give them information. >> that is the one saving grace in this whole thing, the bullet just grazed her head and she was able to regain consciousness, contact the authorities and notify them of where he was heading to. that saved two lives, and i think it definitely shortened the investigation in this case in that he was -- they didn't have to do a long search for him. there was no issue of who did this. she could identify him. it's going to make things easier for prosecutorsenforcement. >> before i let you go, what's the special circumstance crime? >> so, in california, for example, special circumstance

crime is murder that occurs during the commission of another offense. so, for example, lying in wait to commit murder, or murder while kidnapping, those are special --s that would warrant the filing of a death penalty type case, which is exactly what this is. >> our expert on deck, thank you very much. we appreciate your time. >> thank you. >> now to the hunt for tenses internal revenue service. that tax agency is back in court as a conservative group is requesting a computer expert to get to the bottom of the missing e-mails. agency officials say they lost the communications involving lois lerner when her computer crashed three years ago. she is headed up he agency's tax exempt program, and was the first to reveal the irs had targeted some political groups, namely consecutives and pro israel groups in a separate lawsuit a judge gave the agency 30 days to explain, under oath, what happened to lerner's e-mails. the group in the lawsuit accuses

we witnessed three rockets fired almost simultaneously, headed in the direction aviv. all those rockets were intercepted. and a short time earlier tonight, we saw israeli apache helicopter overhead, firing a hellfire missile. the missiles are designed to pierce heavily targeted fighting equipment. also, we should point out that today the israeli military put into place, harris, it's eighth battery of iron dome system and they say it's working to 90% effectiveness, but it's not perfect. two israelis were injured today in rocket attacked. there have been more than 100 of them. the israeli prime minister is taking the position right now, nothing is off the table, including a possible ground incursion. harris? >> before i let you go and because you have show much experience in this region, want to brooch one things.

rockets are reaching jerusalem, areas -- some of the cities are used to this. you heard john hudy say they're getting baby food together, donning protective gear and have been through this before. now for the first time you're hitting communities this is new to what is the mood among the israeli people? >> this is not new to the israelis. the lebanon war in cities throughout the country, people came under fire. both the south and the north. you're right, though, for the first time, though, especially during this conflict, we're seeing cities in central and northern israel, such as haifa, being targeted by hamas but there are air raid sirens and iron domeóño;dystems in place. israelis are not complacent about this but it's something they're all too familiar with and they seem prepared to accept the fact that this ongoing conflict may continue for at least many more longer. >> david lee miller reporting

know what the prosecutor knows. all they know is what was released publicly in the media and the court documents and the big information came at the preliminary hearing. so, we just don't have any idea of which way the difference is going to need to go in this case. this is all circumstantial evidence. and just like any other case involving circumstantial evidence, it can be open to interpretation. so, all we're seeing is bits and pieces of the jigsaw puzzle but we're not seeing therñ?ñ?ñ?ñ?ñe picture yet. so we have to wait and see whether or not the prosecutors can connect the dots. >> phillip, before i let you go, how does this play a role? we're getting details from the medical examiner and i commended how the child must have suffered. cooking inside that car was well above 110 degrees and he is strapped in. when you start to hear the details, how does that play inside of a courtroom? >> that's about the only thing that people agree on, is that he did die a horrific, terrible death, horrifying.

the toxicology, i place that squarely in the neutral column. i doesn't really say anything whether or not it could have been planned or premeditated or could have been an accident, which is what the defense claims. this toxicology evidence is neutral. they do it in every case. it's standard, routine, every autopsy. >> so no matter how horrible it is to hear, it's neutral inside the courtroom unless something pops we don't know about phillip, we appreciate your time today thank you. very much. >> thank you. >> we're just getting video of a wild road rage attack. first the background. it happened in utah over the weekend. drivers chased down a truck that was well-swerving all over the road. police say those drivers cornered the truck and went after the man behind the wheel. trace gallagher? >> police initially thought the drivers were good samaritans

trying to get a reckless driver off the road. turned out to be good old-fashioned road rage. watching this video, all the cars and drivers surrounding this truck, they all know each other because they just come back from a kayak trip. look at the truck pull out there. that's because one of the drivers walked up to him and actually broke open his window and then the truck pulled away and ran him over. here's how they actually had the truck becomessed in. he was swerving in and out of traffic. they thought they had him but then we when the guy brakes his window, the driver of the truck said he felt like his life was in danger, and he ran the guy over, busting his leg. there was a witness that saw this whole thing. we just got the brand new 9-1-1 call. listen to this. >> somebody must be aggressive and got out of their truck and trying to break the window inning this other guy's truck, and the guy in the flatbed truck

the parents who got blasted for bringing their two young daughters on a sailing trip which ended with a rescue separation say they plan to sue their satellite phone provider over it. we told you about this when it first happened off the mexican coast in april. the parents kept sailing, even after their one-year-old came down with a fever and a nasty rash. they say they called the coast guard which was going to check with the doctor, but they say their satellite phone stopped working and never got a call back so they signaled an
