again, thank you for watching us tonight. remember that the spin stops right here. we're definitely looking out for you. breaking tonight, new questions about leadership, credibility, and trust in washington as well as our media. after "the kelly file" exposes the latest whopper to the american public. i'm megyn kelly. what is the result when politicians mislead us? intentionally or otherwise. we ask that tonight thanks to nancy pelosi, but it's not all about her. yesterday, ms. pelosi held a media briefing used in part as an opportunity to attack the supreme court's decision in the hobby lobby freedom case suggesting the five justices in the majority changed the laws on

contraception. listen. >> we should be afraid of this court, that five guys should start determines what contraceptions are legal or not. that court's decision was a frightening one that five men should get to the specifics of whether a woman should use a diaphragm and pay for it herself or her boss. it's not her boss's business. >> that would be frightening if it was true, but it was not. despite the pelosi's leadership position and that the media ran with the position, not one media outlet bothered to challenge her on her purported facts. not one until this broadcast last night. nancy pelosi either doesn't know what she's talking about, or is intentionally misleading you. first of all, the gender of the justices in the hobby lobby majority is irrelevant. it's an attempt to stoke resentment. when row v. wade was decided, it was men in the majority, were

those justices ill-equipped to fairly decide that case, or is it only when a judge disagrees with ms. pelosi that his gender is an issue? if speaker boehner made a comment about the female justices, nancy pelosi would be crying sexism, and that's what she's guilty of here. moreover, the five men in the hobby lobby did not, i repeat, did not, quote, determine what contraceptions are legal, nor did they, quote, get down to the specifics of whether a woman should use a diaphragm, end quote. what a gross misrepresentation. news flash, all birth control that was legal before this decision remains legal today. the high court simply found that a religious freedom law, which was cosponsored by none other than, wait for it, nancy pelosi, sometimes protecting corporations from being forced to violate their religious believes. she cosponsored the law that gave them that right.

nigh to the high court nor hobby lobby took issues of mandating behind closed doors with obamacare was passed that companies cover 16 forms of birth control, but they had the right to covering just four forms of birth control that happen to terminate a fertilized egg, which some believe is abortion. the diaphragm was never discussed. it was not even one of the birth control forms at issue, which ms. pelosi should know because she famously promised us after obamacare was passed, at some point, we'd know what was in it. outraged that my hair was standing on edge. it calmed down today. late today, the fact checking website, politifact took up our challenge. they looked at the statement and not surprisingly rated it false. when they called the office for a statement, her media person

said the minority leader, quote, misspoke. she misspoke. what part? when she said five guys were determining what forms of contraception were legal, when she said how frightening that is, when she doubled down and alleged these scary five men, quote, got down to the specifics whether a woman should use a diaphragm? give me a break. one of the marks of a real leader is owning up to one's mistakes. oh, yeah, honesty helps a lot too. why does this matter? because trust in our government is at historic lows. because the majority of americans think this administration regularly lies to us. because those falsehoods can be told with impunity if a come police sit media stands idly by. joining us now is mark, an american enterprise institute fellow. thank you for being here. kirsten, starting with you on whether it matters and whether

the american public should sit idly by as the media has and just say, uh-huh, yeah, she misspoke, that's fine. >> of course it matters. and i think that the idea that no media questioned what she said when it was so clearly wrong, unless maybe -- i don't know, megyn, did they not know enough about the case to know that's not what happened? that no one would question other than you, would question the fact she's attacking five members of the supreme court. basically alleges because they are men, they are not allowed to rule on supreme court cases representing on what they ruled on. it's very important and part of the reason people lost trust in all institutions in this country because these kinds of things are said. nobody challenges them because you're the only one who challenged it, and it makes people feel like they are going cra crazy. do we care, mark, like, okay, it's nancy pelosi. she only happens to be the house minority leader.

it's not like she said it at a cocktail party, but at her media briefing. the media was standing there, but does it matter? do people say, you know what? you all lied. they lie to us day in and day out. to be fair, it happens on both sides. >> well, sure it happens on both sides, but there's, i think, if this was just one individual thing, it might be forgivable, but it's part of a pattern. nancy pelosi sold the same lies for obama that you can keep your health care plan and keep your doctor. in fact, she said it long after he conceded it was not true. you know, there's a pattern here of misspeaking, and president obama was just a few weeks ago complaining about cynicism in the country. why is why people are cynical because they believe their government lies to them on a daily basis. there's a fox news poll in april that 61% of the american people believe president obama lies on important matters most of the time or some of the time. not on little lies, but important matters. if you through in the people who

say from time to time, it's 84%. that's a stunning people of the number of people who think the president of the united states knowingly lies about important matters. >> is there anyone left to root for in washington, kirsten? i want to take you back to 2008 when barak obama was called the annoyance nointed one, and repu voted for him because they believed he would be a different politician and change washington. i showed this moment because he went to colorado, and it was crickets, you heard them chirping because no one greeted him and no politicians wanted to be seen with him. we contrasted to this moment in 2008 when so many believed he was the change. watch. ♪

>> what do you think? anyone? is there anyone left to root for in washington? he did not turn out to be the politician so many thought he would be. kirsten? >> yeah, look, i voted for him, and one of the reasons -- many reasons i voted for him, but one of the reasons was precisely what you said, and i voted for him over hillary clinton in the primary partly because i didn't want to go back to the clinton era where i felt there was a lot of things going on, too much partisanship, and he promised a post partisan presidency. i think we all remember that, and he's one of the most devicive and most partisan presidents we've ever had. that's not to say the republicans have done a great job. i don't think they have. the trust in government is not just because of the -- the low trust is not just because of

obama, but also republicans. there's nobody i think a lot to say positive about, but the did say he was going to restore trust in government. >> he said it, and people believed it. you know, looking at the 80,000 people, they believed in him. they thought he was going to be a transformational figure. mark, instead, when he got to office, you know, it was -- it's not just the president. it's those he surrounded him with and a lot of the leadership under him, and under his administration, we've seen, you know, misrepresentation after misrepresentation. here's just a little of the highlight reel. >> first of all, if you've got health insurance, you like your doctor, you like your plan, you can keep your doctor. you can keep your plan. >> the single adjustment was made. those talking points, were changing the word conflict to diplomatic facility. >> does the msa collect any type of data at all on millions or hundreds of millions of

americans? >> no, sir. >> it does not? >> not wittingly. >> with regard to the potential prosecution of the press, that is not something that i've ever been involved in or heard of or would think would be a wise policy. >> no mass corruptio>> not event even a smidgen of corruption. >> one thing we're going to do in the work period is ensure women's lives are not determined by virtue of the white man. >> these are not -- these are not minions, mark. these are major, major figures in america right now. >> no, absolutely, and, look, i think kirsten's right that there's blame to go on both sides, but i think the people are frustrated more than -- they are snot just frustrated with dysfunction in washington, but they are knowingly lied to by their elected leaders. president obama's signature initiative was sold on the basis of a lie. they -- the president of the

united states lied to the american people about the nature of the terrorist attack. these are big, big things, but i'll inject a note of optimism. is there anyone to trust in washington? the answer is no, there's no one to trust in washington. well, there's a few, but gallop found 62% of americans have confidence in state government. what you had in the countryside is a lot of -- while obama's been in washington, beneath the surface, there's a republican takeover the state government. you have not a single republican governor lost since 2007. you've got half the country living in states where republicans control both the state house and legislature. it's been a huge increase of republican line, and you got reformers like scott walker, like casic, governor snyder doing things people approve of and like so i think you have outside of washington political leaders who are reformers, going to bring a change to washington, and that's the reason for hope, even if washington is mired and

breaking tonight, israelis say the terrorist group, hamas had 600 rocket attacks in recent days. this as we get new video of palestinian protesters raining cocktails down on israeli defense forces. know, apparently, just a waiting the word to rush gaza, tens of thousands strong. joins me now, charles kroud hammer, author of "things that matter" a new york times best seller for nine months now. charles, great to see you.

i want to start with the news of the day whether you believe a ground invasion of gaza is likely tonight. >> no, i don't think it's likely tonight. i think it's the last thing the israelis want. they will do it if they have to, but their octobbjective is degr capacity of hamas, knock out as much rockets, launchers, batteries, and high level hamas operatives as they can. they have no desire to go in because that could be very difficult. it could cost them lives. up to now, no israelis died, and that brings a lot of international pressure on them. the other reason is this. the leadership of israel, particularly the prime minister, see the big gain, important gain, and the really only important issue is iran and existential threat of the bomb and the negotiations now going on. they don't want to be distracted. they don't want to be dragged into a war. they will do a ground incursion if they can't succeed from the air. i don't believe if it happens it's going to be trying to

overrun gaza or take it over. it might be an incursion of a mile or two. reluctant to do it, but can do it, but right now, days away, if at all. >> you have been critical of the president and administration, including john kerry on the subject of israel and the middle east peace process. this week, there was an op-ed by a german editor in "the new york times" coming out suggesting that president obama is governing like a moral politici politician, the world knows when the american president finds things unacceptable, it doesn't carry meaning anymore and says there inlies the lesson to the american friends who want to be less involve the and more european. there's no second america to back you up when you drop the ball. you wrote a similar piece just a few years ago. is that what's happening now?

that we've retreated? >> i think it's absolutely the right diagnosis. i wrote this in 2009. in fact, it's the last chapter in my book. in 2009, it was predictable. obama was acting and talking like a european, not just in foreign affairs, but domestic. he sees himself as a social democrat trying to expand the size of government, the reach of government, regulation, high taxation, entitlements, obamacare, for example. when the europeans undertook that right after the second world war to become these entitlement states, they understood they'd have to give up something. the money had to come from somewhere. it all came out of defense. you know, the line in britain is that the national health service ate the british navy, and they did that because they knew they could rely on u.s. navy and the u.s. military. obama's the same kind of politici politician. he shifted huge amounts of resources into his domestic

initiatives, entitlements, draining, bleeding the military. we just heard today we sent out notices to army personnel in the field in afghanistan that they will be separated, potentially kicked out of the army very soon because of the budget cuts. we are eating our military, and we have a president who doesn't see a use for it because he's not interested in intervening in the world. that's why he draws a red line here. it means nothing. a warning there to the russians. you have hours to stop your support of the ukraine rebels. it's been weeks. nothing has happened. the german writer was right. the europeans could rely on us. we have nobody behind us. that's why there's such disarray in the world and fear among our allies. >> do you believe as some of the president's critics suggested

that this conflict we're seeing right now in israel tonight is, in part, due to the so-called daylight he's put between us and israel because he's backed israel in words, some say in deed as well with the money put towards iron defense. >> look, i do think he's put daylight early, especially in the first term, and it led to a collapse of all peace negotiations which had been doing fairly well between israel and the palestinians, but i do not attribute the conflict today today light. this is clearly hamas trying to test israel, trying to see whether they can inflict damage on israel and gain advantage internally over the rival because they will be upcoming elections. they want to show its tough, and that's why the israelis are responding to make hamas pay a very high price. this is far more of an intrapalestinian dispute and

>> well, in a piece of political irony, sales of hillary clinton's best selling book "hard choices" are falling fast. despite the fact she was reportedly paid a $14 million advance. and now adding insult to injury, mrs. clinton's book has been bumped from its new york times best seller spot by a book from one of her harshest critics. we have more from the west coast bureau, trace? >> that's edward kline, former editor for news week and new york times magazine, compared to bob woodward of the post, and the critics on left and right long accused him of being heavy on block buster accusations and very thin on sourcing. his new book "blood feud" describes the relationship between the clintons and obamas, which if you believe him, make the hatfields and mccoys seem lovy dovy. the details of the back that there was a physical altercation

knew immediately that benghazi was terrorism. 37 46 page letter from house government oversight committee issa to the chairman of the benghazi select committee describes a pattern of obstruction by the state department. on the fox news report, the letter says e-mails sent to capitol hill had names blacked out, personnel redacted. e-mails released by the federal courts to the conservative groups, judicial watch, show e-mails that the fox news report went to more than a hundred people beyond carney including a white house list, and it allegedly hid important documents about the 2012 attack behind an administration talking point. the 25,000 pages had been vooi provided, and issa said it's code for providing meaningless paper and holding back documents that instructed administration officials including former u.n.

absolutely amazed when you threaten mekkah in the islamic world, you are taking a step too far, and they have threatened to destroy the black square piece of stone that the prophet muhammed is supposed to have bless and been a part of. it's absolutely unbelievable, and that's why we should not get involved with it. >> some predict the threat of mekkah, the most important beacon of the muslim faith, but some suggest if they continue with the destruction of shrines and tombs and so on, we are going to see iraq plunge into violation make what we saw in 2006 with the beheadings look like nothing, shiites who have been restrained will rise up and say that's about enough of that, and it's going to get extremely bloody and violence very soon. >> yeah, that is one course of action, a dangerous one of the we'll have the violence.

a second course of action, of course, is anbar, the other provinces there that the sunnis there will throw them out. they let them come in this time due to the ineffectiveness of the president maliki, and the sunnis in the region stood back and let them come in. let's remember there may be 10,000, 15,000 of them, not a large force, and the things they are doing and enraging the population, i believe the sunnis themselves may take them out with the help from the turks, maybe the egyptian, and maybe the saudis that will not tolerate this kind of behavior there, particularly threatening mekkah. >> why would they do it? so far they're about the propaganda and ridiculous hideous videos put out with the beheadings and terrible

telling the irs to do what? >> well, first of all, i think one of the things people do not realize is all the times that the irs commissioner has been testifying in before congress in the congressional committees, and you know this as an attorney, but his testimony would not be admissible in any federal court because he's not testifying from personal direct knowledge. everything east saying is here say. it's something that he's been prepped for and told to say. that's the point that we made today to the federal judge which is everything that we've heard is all hearsay, not add missable. we need someone who has direct knowledge sign underoath what has happened with regard to lois lerner's e-mails. that person, whoever it is within the irs needs to sign under oath and declare certain things to the court, and that's what the court yesterday

ordered, and that's what the judge today has ordered. >> what's amazing to me is the irs resisted this. they have nothing to hide, and they are very confident as suggested to congress said, it happened as they say it happened, a legitimate computer meltdown, tried to look into it at two levels and it was not retrievable, the e-mails. why submit a declaration under oath, this is what happened, and if they want to send in a forensic expert to look at the computer and system, welcome. she'll sign a confidentiality agreement, she won't repeat what she says in terms of other people's tax information, but a at it. >> well, that's a good question, and that is one of the points we kept making to the judge today, which is that the stories kept changing, and that we still have not heard from the people who were responsible for reviewing and investigating the so-called hard drive crash. we don't know really what happened to the hard drive. as i pointed out to the court

today, look, i was a gs 2 clerk typist in oklahoma city many years ago, and every piece of equipment in that air force base had a federal serial number on it. i mean, you just don't lose federal property, and so the judge ordered today that that property, that hard drive needs to be located and they need to tell the judge what happened to it and what efforts were made to recover it and see why it is that the data can't be recovered. >> sounds interesting. >> slowly but surely judges are moving towards making someone in the irs with direct knowledge have to testify under oath, and that's a first. that's a first. >> before you go, what do you think of the idea of repsive stockman to go arrest lois lerner with the house sergeant at arms? >> you know, look, let's all remember why it is we're mad at lerner. she disregarded the rule of law, took it upon herself to create law and direct a whole agency, a

department of the federal government to quarantine and have exempt status because of the name and political believes. i don't think that we -- i think we need to be very cautious in terms of how we approach things and make sure we don't fall into the same trap, and i think the judges both yesterday and judge walton today did not give us what we asked for, a complete forensic investigation, but cautious saying this is an extrords their measure, and i'm going to be very careful about following the right procedures and following the law. i think that's good. we all have have remember this is a nation of laws and what we're upset about with the irs is that they abandon the rule of law. when we abandon the rule of law as a nation, we lose what our country's all about, so that's what worries me about a proposal to go arrest lois lerner because i would rather see the house of representatives take action to hire their own lawyer, go into
