again, thank you for watching us tonight. remember that the spin stops right here. we're definitely looking out breaking tonight, new questions about leadership, credibility and trust in washington as well as our media. after the kelly file exposes the latest whopper told to the american public welcome, everyone, i'm megyn kelly. what is the result when elected officials mislead us? intentionally or otherwise? we ask that thanks to nancy pelosi, but it is not all about her, yesterday, she held a weekly media briefing using in part as an opportunity to attack the supreme court's decision in the hobby lobby case. suggesting the five justices in the majority change the laws on

contraception. listen. >> we should be afraid of this court. five guys should start determining what contraceptions are legal or not? that court decision is a frightening one that five men should get down to specifics whether a woman should use a diaphragm and it's not her boss's business. >> despite her leadership position and the fact some media ran with the statement, not one major media outlet bothered to challenge her on the facts. not one, until this broadcast last night. >> nancy pelosi other doesn't know what she's talking about or is intentionally misleading you. the gender of the justices in the hobby lobby majority is irrelevant. when roe versus wade was decided it was all-men in the majority.

is it only when a judge disagrees with miss pelosi his gender is an issue? if speaker john boehner made a similar chent about female justices nancy pelosi would be crying sexism. the five men in the hobby lobby majority did not determine what couldn't exceptions are legal nor did they quote get down to specifics. news flash, all birth control legal before this decision remains legal today the high court found a religious freedom law co-sponsored by nancy pelosi sometimes protects violations from violating their religious beliefs.

neither the high court nor lobby lobby took issue with nancy sebelious mignons that companies cover birth control, but the majority did say hobby lobby had the right to reject to four forms of birth control that happened to terminate a fertilized egg. the diaphragm was never discussed which miss pelosi should know since she famously promised us after obamacare was passed we'd know what was it in. >> i was so outraged my hair was standing on edge. today, the fact checking web site politifact looked at miss pelosi's statement and now, raided it false. when calling her office for a

statement her media person said the minority leader quote, misspoke. she misspoke? which part? five guys were determining what forms of contraception are legal? when she said how frightening that is? when she alleged these scary five men quote got down to the specifics of whether a woman should use a diaphragm? give me a break. one of the marks of a real leader is owning up to one's mistakes. oh, yeah. honesty helps a lot, too. so why does this matter? because trust in the government is at historic lows because a majority of the americans thinks this administration regularly lies to us and those falsehoods could be told with impunity as a complicit media stands idly by. kirsten, let pee start with you whether it matters whether the

american public should sit idly by and say yes. she misspoke. it's fine. >> of course it matters. the idea no media questioned what she said when it was wrong, unless maybe i don't know, do they not know that? not know about the case to know that is not what happened? and nobody was questioned other than you, will question the fact she attacking five members of the supreme court is, i guess alleging because they're men, they're not allowed to rule on supreme court cases this representing what they ruled on? so i think it's very important. i think it's part of the reason people have lost trust in all institutions in the country is because these kinds of things are said. nobody challenges them. you're the only one who challenged it. it makes people feel like they're going crazy. >> do we care, mark? it's like, okay. it's nancy pelosi.

it's not like she said it at a cocktail briefing. it was at a media briefing. did they say you lie to us day in, day out. it does happen on both sides. >> well, sure, it happens on both sides but this is one individual thing, it might be forgivable, but it's part of a pattern. nancy pelosi telling the same lies barack obama you can keep your health care plan and doctor. she was saying it long after he conceded it wasn't true. there is a pattern of misspeaking. the president complaining about cynicism in the country this, is y they believe their government lies to them on a regular basis. there is a fox news poll in april that 61% of the american people believe that barack obama lies on important matters most of the time or some of the time. not a little lie. important matters. if you throw in people think from time to time it's 84%.

that is a stunning figure. of the number of people that think president of the united states knowingly lies to them about important matters. >> is there anyone left to root for in washington? i want to take you back to 2008 when barack obama was some called him the anointed one. and even many republicans voted for him because they believed he was going to be a different kind of politician. he was going to change washington. and i showed this moment this week because he went out to colorado. you can hear crickets chirping. nobody was there to greet him and none of the politicians wanted to be seen with him. we contrasted it to this moment when so many believed he was the change. watch.

>> what do you think? anyone? is there anyone? left to root for him in washington? he did not turn out to be the politician many thought he would be. kirsten? >> yes. i voted for him and one of the reasons, there were many reasons i have to say one of the reasons is what you said. i voted for him over hillary clinton partly because i didn't want to go back to the clinton era, i felt there were things going on, too much partisanship. he promised a post-partisan presidency. he end upped being one of the most being the most devicive president we've ever had i think the trust in government isn't just because the -- the little trust is just because of obama. it's because of republicans. there is nobody, there is a lot

lied to the american people about the nay you're of a terrorist attack. these are big, big things there is nobody to trust in washington not many. there are a few. gallup found that in america, 62% have confidence in state government z so what you had out there in the countryside, while obama sat in washington there has been a republican takeover of state government. you have not a single republican governor lost since 2007. you've got half of the country living in states where republicans control both state house and legislature. it's been a huge increase in republican leadership. you've got reformers like scott walker, and governor snyder, who are doing things that people approve of and like. you think you have outside of washington, political leaders who are reformers going to bring change to washington. that is the reason for hope, even if washington is mired in assumption. >> great to see you both.

the day whether you believe a ground invasion of gaza is likely tonight. >> no, i don't think it's likely tonight. i think it's the last thing the israelis want. they will do it if they have to, but their octobbjective is degr capacity of hamas, knock out as much rockets, launchers, batteries, and high level hamas operatives as they can. they have no desire to go in because that could be very difficult. it could cost them lives. up to now, no israelis died, and that brings a lot of international pressure on them. the other reason is this. the leadership of israel, particularly the prime minister, see the big gain, important gain, and the really only important issue is iran and existential threat of the bomb and the negotiations now going on. they don't want to be distracted. they don't want to be dragged into a war. they will do a ground incursion if they can't succeed from the air. i don't believe if it happens it's going to be trying to

overrun gaza or take it over. it might be an incursion of a mile or two. reluctant to do it, but can do it, but right now, days away, if at all. >> you have been critical of the president and administration, including john kerry on the subject of israel and the middle east peace process. this week, there was an op-ed by a german editor in "the new york times" coming out suggesting that president obama is governing like a moral politici politician, the world knows when the american president finds things unacceptable, it doesn't carry meaning anymore and says there inlies the lesson to the american friends who want to be less involve the and more european. there's no second america to back you up when you drop the ball. you wrote a similar piece just a few years ago. is that what's happening now? that we've retreated?

>> i think it's absolutely the right diagnosis. i wrote this in 2009. in fact, it's the last chapter in my book. in 2009, it was predictable. obama was acting and talking like a european, not just in foreign affairs, but domestic. he sees himself as a social democrat trying to expand the size of government, the reach of government, regulation, high taxation, entitlements, obamacare, for example. when the europeans undertook that right after the second world war to become these entitlement states, they understood they'd have to give up something. the money had to come from somewhere. it all came out of defense. you know, the line in britain is that the national health service ate the british navy, and they did that because they knew they could rely on u.s. navy and the u.s. military. obama's the same kind of politici politician. he shifted huge amounts of resources into his domestic

initiatives, entitlements, draining, bleeding the military. we just heard today we sent out notices to army personnel in the field in afghanistan that they will be separated, potentially kicked out of the army very soon because of the budget cuts. we are eating our military, and we have a president who doesn't see a use for it because he's not interested in intervening in the world. that's why he draws a red line here. it means nothing. a warning there to the russians. you have hours to stop your support of the ukraine rebels. it's been weeks. nothing has happened. the german writer was right. the europeans could rely on us. we have nobody behind us. that's why there's such disarray in the world and fear among our allies. >> do you believe as some of the president's critics suggested that this conflict we're seeing

right now in israel tonight is, in part, due to the so-called daylight he's put between us and israel because he's backed israel in words, some say in deed as well with the money put towards iron defense. >> look, i do think he's put daylight early, especially in the first term, and it led to a collapse of all peace negotiations which had been doing fairly well between israel and the palestinians, but i do not attribute the conflict today today light. this is clearly hamas trying to test israel, trying to see whether they can inflict damage on israel and gain advantage internally over the rival because they will be upcoming elections. they want to show its tough, and that's why the israelis are responding to make hamas pay a very high price. this is far more of an intrapalestinian dispute and

this, this will be republicans pushing it too far, let the process play out, holder's got an investigation underway, eric holder, and if you do this, you create empathy for lerner and backlash for the gop. >> how many people sympathize with someone destroying documents and pushing that kind of an agenda? i challenge people to side with this long record. i don't think the sympathy is there, i mean, i don't feel it, my constituents are happy in the sanction, and i don't think the average citizen looks at this and says, well, if the irs destroys documents, why can't i? there has to be a standard we're all held to. >> what about the fact there is a process underway? i realize most republicans are not happy with erik holder and doj looking into this, but there is a process underway, and if they determine at some point illegal behavior took place, criminal behavior, you know, we'll have to see what they do, but why get ahead of the, you know, that case?
