americans, including some minorities who generally back president obama on just about everything. in chicago, where black children are being gunned down in the streets, the president's call for almost $4 billion to deal with immigrant children, is being met with disdain. >> the president setting aside all of these funds for immigrants and forsake african-american community and african-american families, i think that's a disgrace. >> in houston, there is also growing anger. >> it's not right. now billions of dollars want to be borrowed from the white house to help feed and house them. what about the god damn kids here in our neighborhood? in our country? not just in this neighborhood but in our country? >> now, it's easy to understand why poor americans resent the illegal immigration intrusion. there are other big problems as well. feds are now shipping illegal aliens all over the country but not informing the states about what's

going on. >> a couple days ago senator johans found out that 200 illegal individuals have been sent to our state. no one has been notified of the -- notified us of that why are they conducting a secret operation, essentially, transporting them all over the country and now we learn to nebraska and the federal government won't tell us what's going on. >> in just a few moments. is it legal will tell us if the federal government is violating the rights of the individual states. in iowa, the governor there flat out says he will not accept illegal ail illegal aliens. >> just because we are sympathetic and supportive country doesn't mean that we can take everybody, people need to know that there is a legal way to come this country and they need to follow the rules. >> obviously president obama is facing a crisis on illegal immigration. on his watch, more than than

2 million illegal aliens have been apprehended. many allowed to stay in the u.s.a. just to get a hearing is an ordeal. close to 400,000 cases are pending. nobody really knows how many illegal aliens are here. estimates range from 12 million to 20 million. what we do know is that the border patrol can't control the present situation. >> our agents don't like to see these kids in these conditions. and especially coming off the long journey they have been subjected to, and then the diseases that some of our agents are contracting. we had one get a bacterial pneumonia a couple days ago. a lot of guys are coming down with scabies or lice from these people. >> also the washington free beacon reports outbreak naval base where foreign children are being processed. talking points is not using scare tactics but inconceivable that huge influx f foreign children will not hurt americans. it will. one vivid example in lind, massachusetts a working

class suburb of boston foreign students have increased by more than 500 in the past three years. last year in lynn, nearly 250 students from guatemala alone enrolled in the public schools there that puts an incredible burden on the local citizens of lynn who are not generally affluent people. just the language problems alone strain the system: there comes a time when americans have to realistically assess their federal government. and if you are paying attention, that assessment is grim and getting worse by the week. and that's the memo. now for the top story tonight, is it legal. here now attorneys and fox news analysts kimberly guilfoyle and lis wiehl. >> so the law regarding taking immigrant, whether they be children or adults, doesn't matter. and secretly sending them to various states, in various capacities. that's okay? >> that is legal as now written and the supreme court said in a couple years ago they said immigration,

the immigration is federal and federal only. if there is a state, federal conflict, the feds win. so, they, no, legally they do not have to tell it the state. could they? absolutely they could tell nebraska. >> courtesy they would do it. but i still don't understand the legal aspect of this. once the illegal alien crosses the border as in the custody of the federal government, all right. the states are pretty much out of it. all right? they are out of it because the federal government is adjudicate whatever happens to the person who illegally comes here. >> but the burden still falls on the state. >> but now the obama administration says hey, nebraska, hey massachusetts, hey, new york. we are going to send these people to your property, to your property. >> and you have to be responsible. >> and you have to pay for it. >> you are going to have to pay for it. >> hearings or anything like that. but certainly to house them

here between two and five years before they get a hearing. >> you bring up a great point. even just the hang wage issues are a strain. not just to mention the mental and physical issues. what about the families i want to stay on the law. >> the law is nebulous in certain ways. the federal government as stated in the 2012 supreme court decision with immigration laws affecting arizona has widespread authority to over all of immigration issues. so they are saying to the states, we're in charge. we're the big boss. you are going to do what we tell you to do. >> i think a law has to be passed then that says the federal government has to reimburse the state and locals for any expenses. >> you you know who has to do that? congress should get involved with the power of the purse and say you have to reimburse these states as they put forward their individual expenses and what expblrks not that the obama administration would care because they don't seem to care what kind of deficit they run up. >> no, you were talking about that nearly 4 billion that they're asking for. the administration is asking for. put a rider in that.

>> attash it, in other words, to that bill and congress could say all right, administration, we will get you your 4 billion or whatever it is. >> you have to reimburse the state. >> and for costs. >> tell the states what you are doing. >> the lynn school district north of boston, they have to pay for it themselves. >> well, they do state of massachusetts doesn't do that proper notice to the states influx. >> put that in the rider, too. if you have to give proper notice they are coming. this is such a big scandal. tell congress what happened to the emails, right, guilfoyle. >> this is great. within one day, you have two different judges, one judge reggie walton, a bush appointee and you have u.s. district judge emit a clinton appointee telling the governnt you have got to turn this over. there is something nefarious going on. we want to know all the information you have about the emails. >> under oath. >> under oath. >> fill out an affidavit.

circuits liberal circuit in the country. this is no accident. what they are claiming that is that anybody under the age of 18 who has come across the border illegally should have a taxpayer funded attorney to fight any immigration proceedings against him. this is unprecedented suit because the supreme court has held repeatedly that for americans there is no right to taxpayer funded attorneys in civil proceedings which moirsz immigration proceedings are what they are asking for is something that no american has a right to ask for, which is a taxpayer funded attorney in order to prolong any kind of deportation proceeding. >> fiscal year alone with a 400,000 backlog and you have to give them, each of them an attorney, which i think would be impossible. and the costs would be astronomical.

factor follow up segment temght. is the national media getting tougher on president obama? abc news white house correspondent jonathan karl has been leading the way, putting the obama administration on the spot. >> you see, the situation with terrorist group taking over bath territory. you see russian crew rainy. see concerns about chinese aggression in the south china sea. it doesn't seem like a time to be touting tranquility on the international scene. did you think the president's foreign policy bears any responsibility for any of this or is there is anything that he can do about any of this? >> i think what the president has been really clear about is that he will allow one core principle to guide his thinking about what we can can do to advance u.s. interest in each of these hot spots that

you have mentioned and that's the national security interest of the united states of america. >> that's gobblably gook that statement means nothing joining us from washington rick klein political director for abc news. millions of americans believe all the networks, cnn, nbc, were very soft on president obama until recently. do you see it that way? >> i think there has been accountability throughout. i do think that what you see now and maybe it's naturally part of the sixth year of the presidency. maybe it has to do with the fact so many hot spots out there and so much going on. i think you have seen a little bit more scrutiny. more scandals, semi scandals and mini scandals and definitely more ways to question the obama foreign policy. >> you guys were late to the table on the scandals. i mean the benghazi and the irs. we have done a number of stories counting up the minutes that abc, v cbs, and spent on, very small, minuscule. and now it seems that the tide is turning. and not only did karl -- and

i think karl is a good correspondent second only to ed henry, our guy. but, you see it at cbs and even nbc. i mean, when nbc starts to pound the president, you know something is going on do you feel that there is a disintegrations of the administration? >> i think this a lot of it attracts public support. less cynicism and trust of this president certainly before his election than even when there was a year ago. when you add to that a volume of things. if you asked the president throughout his first term and even through his second term about a lot of problems he faced. stock reaction has been to say look at what i inherited. no doubt he inherited a lot of bad things. that becomes less, and less credible as time goes on. >> especially when the problems get worse. >> that's right. >> you say something very interesting. you say it attracts the polls. i don't think network news coverage should track the polls. we certainly don't track the polls on the factor. we do the stories that we believe are important for the american people to know about. but i think you are right. i think that the network newscasts in the evening,

morning kind of doesn't even do anything anymore. they are more entertainment-oriented. but the evening newscast they are late to the buffet. do you know what i'm talking about, rick? i think everybody would agree that you guys weren't tough on the president as these things were developing. >> i think if you look at benghazi, i think we were very aggressive in our reporting early on in that it and john karl as you mentioned was outfront in a lot of that. also look at the imirt entirety of coverage. that 30 minutes you see at night is just a piece of what abc news represents. for all networks, no question this is a different phase of the presidency. i think in terms of how their ambitions have played out. in terms it of how the scrutiny has been applied. things are different now. it is a different stage of presidency. >> why is it different now? is it because the failure is so glaring? >> look, there is more out there. i don't think there is any question that there has been more quantity of scandals and stories to cover. >> you are a savvy guy, you are the political director of abc news. do you see the administration failing at

this point? >> no. i don't think that's a fair assessment. i don't think an overall assessment of failure. there is plenty of ways to ask for accountability and say look, this is not working the way it is supposed to be. look at irs scandal and benghazi. lots of legitimate questions to ask. >> you don't think he is he failing. will it change if iran walks away from the nuke negotiations? >> i just don't think it's a kind of on-off switch around failure or success. >> are you satisfied with jay carney and the new spokesman at the white house giving rank gobbledygook when you ask a directed question. >> i don't think that's a direct question to john karl. more times you get direct answers. spin involved in any answer from the white house press secretary. i think that was what we saw with jay carney. you see that now with josh. you kind of expect that i don't think that's going to be the form. >> i didn't see that from the late tony snow and dana perino at the bush white house. i didn't see that. >> big fans of the late tony snow as well as dana. i think there was definitely politics laid from the podium under them as well. always going to be frustrated by the answers

that human d.n.a. is present upon conception. that has caused some people to question whether abortion is the destruction of a human being. the supreme court has ruled otherwise in roe v. wade which is the law of the land. some individual states like texas are now passing restrictions to abortions making them tougher to get. that has angered senators richard blumenthal, democrat from connecticut and tammy baldwin from wisconsin, also a democrat they want a federal law passed that knocks out most restrictions overriding state law on abortions with us now to debate the issue. monica crowley from washington kirsten powers there is a hearing today in congress on this and how do you see it, kirsten? >> well, first of all it's obviously an election year stunt. it probably won't each pass the senate let alone the house. this is something to get the women wind up in the democratic party base who, as you know, have been wind up before this the so-called war on women. this is part of that strategy i also think that

this is destructive becau it is -- most of these -- most of the laws that i think that they would like to roll back are laws that were put in place to make abortion clinics safe. for example, like the gosnell clinic in pennsylvania. these kind of laws were created to respond to what happened to women. there was a woman who died multiple women who died there. >> they don't want a waiting period. most of the laws center around a waiting period or a doctor's obligation what abortion would entail. here is what really disturbs pee about blume that you will and baldwin. we now know and you are a democrat, right, kirsten? >> um-huh, yes. >> we now know that human d.n.a. is present as i stated. that's beyond any debate so that there are individuals in america and these two senators among them who basically are saying we don't really care about that we don't care about it we want abortion as much made as easy as possible with no

moral, you know, moral consideration attached to it. i don't understand that. who are these people? to reject human d.n.a.? who? who are they? >> they are people who think that they dispute that that makes it a human life. >> and dispute. >> equal value. let me say. this of equal value to the life of a woman. >> i understand that they dispute that based on their own personal opinion with no data whatsoever. and that is disturbing. now, we know you are antiabortion. and all of that. but the point of the matter is, that these two people, blumenthal and baldwin are now putting themselves up to say to america, let's have more abortions. let's have as many as we can have. don't you think there is something morally wrong with that? >> they have about a third of the democrats. and it's a growing list that's actually supporting this bill, which they are calling the women's health protection act.

i would like to seat baby's health protection act. tris citizen is right when she says this is election year, they are trying to keep the war on women energized so this is what is coming out of it you are right to say that i think a couple of things, number one, they need women in the democratic fold so this is an appeal to them. this is also ideologically where they are. they are so heavily invested in the abortion industry and in stalled protecting women and reproductive rights that they continue to go down this road. so when democrats say that they want abortion legal, safe, and rare, we see things like this and we realize that's false. because what they really want is abortion to be universally available. common, without limit, and essentially paid for by the taxpayer. that's what they really want and that's what this act would do. >> do you agree with that kirsten? >> well, i mean, i can't even think of anybody in recent history who evens has said what the sort of famous phrase that bill clinton used about had the abortion should be rare on -- no, that's no longer the position of the democratic

party. i don't know if i would go. >> they want abortion to be as much as -- >> -- yeah. i think -- you know. from their perspective, it's the woman's choice and that she should have as much availability and access to abortion as possible. >> i would say very few limits i know you have stated morally what you believe. how you can stay in that party then? >> well, because there is no -- well, first of all, i'm a big believer that you should stay and advocate from within. there actually is a democrats for life and, you know, there are groups that are democrats who advocate for that and i think it's good to do that one of the only issues i disagree with the democratic party on. i can become a republican and disagree with them on pretty much everything. >> independent like me and smack both sides. yeah, i could become independent. >> let's give monica the last word. >> we would welcome kirsten on the conservative side. >> what's interesting about this.

foreign minister floated this completely worthless proposal is to give john kerry an excuse to go back to washington, which he is doing right now, to now. to consult with the president and to say that there's enough promising in this new offer to make us extend the deadline. i assure you that's what's going to happen. >> all right. so they're going to extend the deadline ofnegotiations, and meantime, iran continues to develop its nuclear weapons program. >> absolutely. >> netanyahu, the prime minister told brit hume on sunday, that the whole thing is a farce, and i don't believe that israel is going to give it much more time before they go in and start attacking some of the nuclear facilities inside iran. >> but imagine the box the israelis are in, they are the ones who are most directly immediately threatened. iran has written on the missiles, we can see it, in the parades they have, they have on

them written death to israel. we know where the missiles would be headed. it would only take three of them to destroy all of israel in an afternoon. it took hitler six years to destroy -- it would take them less if they had the nuclear weapons. >> the problem with where they are now, the iranians are a this remember hold nuclear state. they are three months, six months away from -- if they decided to go for a weapon, they would have it in six months. under the proposal they're talking about now, they would simply freeze what they have now. there's not an iota of dismanned elling or even taking stuff away, let alone talk about -- >> well, we'll freeze where we are, we're six months away, and we'll violate it any time we want because that's what we do. >> what they're demanding is the

total relief from sanctions in return for doing nothing at all. >> what president obama should do, in my opinion is come sunday when they don't say we're going to dismantle. impose all economic sanctions against them, which really hurt iran, until they say they're going to start dismantling. that's pretty simple. >> that's awhat you would expect from a serious president. here you have a president who's foreign policy has collapsed everywhere, in ukraine, in syria, in iraq, in libya, he's gotten nothing to claim. and as susan rice reportedly said to the president a month ago, we have to put points on the board. and what they would like to do, and they will do by extending negotiations is to come up with a figu leaf of a deal that will appear to be containing the iranian nuclear program.
