>> everybody's excited in my house too. there's oscar. >> maybe he can ungrumpify him. you never know. >> thank you very much for joining us. we've got a fox news alert to start with. yesterday we told you that bowe bergdahl started his job on base, and today we're finding out that bowe bergdahl, who has been accused of being a deserter has a lawyer. he's all lawrd up. there's -- he's all lawyered up. there is the guy, eugene fidell, a well-known law attorney. he teaches at yell, -- yale, taught at harvard. they met last week in person. >> fox news confirmed they met in person. >> it is good to have peter johnson, a well-known

lawyer. you've been look noog this guy. what about him? >> mr. fidell is one of the founders of the national institute of military justice. one of the interesting things about him is that he's kind of created a career on his own in terms of putting in amicus briefs to court of appeals. amicus means a friend of the court brief. he's been a friend of the court trying to protect the right of so-called terrorist detainees, enemy combatants. in several cases, the hamdan case, and others, he's spoken out on behalf of detainees, enemy combatants, at guantanamo bay. >> he's been -- he is used to working against the u.s. military complex? >> he's expert on military law, but his institute has made it one of its specialties to put in these amicus briefs on behalf of

detainees, on behalf of enemy combatants at guantanamo bay. in fact, he helped overturn the military commissions act here in the united states supreme court. he's an activist lawyer in every respect. >> fascinating choice here. >> it is an interesting choice. >> in terms of what may come, in terms of perspective. peter, that is insightful. glad to have you right by our side. >> one other tidbit, his wife is a well known former "new york times" reporter. there she is right there, linda greenhouse for years covered the court, u.s. supreme court and other courts for "the times." a well-known and well-respected journalist but also known in some quarters as a liberal journalist. there have been some reports in the past that criticized ms. greenhouse for not revealing her husband's relationship in cases she covered including the enemy combatant detainee cases in which he put in an amicus brief,

friend of the court brief. more to come on this. a lot of questions. >> a lot of questions surrounding this. at the pentagon, the spokesperson answered questions as it relates to bergdahl's restrictions. will he be able to fly? will he be able to travel? is he a flight threat? this is what he had to say. >> are there restrictions on his movement given the ongoing investigation? >> no. he's an active-duty army soldier. just like any active-duty army soldier, he's free to leave base. he's not under any particular restrictions. i would remind you, he's not been charged with anything. there's allegations, but just having allegations posed against you in the military doesn't restrict your freedom of movement or place you in any kind of restricted status just by the nature of somebody alleging wrongdoing. there will be a fair, complete, comprehensive investigation into the circumstances surrounding his departure from that base and then we'll move on

from there. >> you could say he's a flight risk -- >> he's under no restrictions. there is simply an ongoing investigation into the circumstances surrounding his departure. thanks everybody. >> the rear admiral, i think, was appropriately pointing out the importance of due process. there is a 60-day investigation that began june 16. perhaps there will be some resolution by the middle of august. major general kenneth dahl is leading the investigation for the army. >> in the meantime bowe bergdahl is free to roam about and he's got a job. a lot of people say he's a deserter and shouldn't. we're going to talk to tony shaffer, military guy for many years, about that. in the meantime, the other top story is the fact that we've got this invasion across our southern border of all these illegals. many are children. the president has said he wanted congress to act, and they're having a briefing tonight on a bipartisan bill. as it turns out, harry reid

will not support this bill by henry cuellar, a democrat of texas, and john cornyn, a republican of texas, that would essentially speed up the deportation of these kids. harry reid is of the opinion that these kids are refugees, that we should slow things down. let's have more money. we don't necessarily need to secure the border because extraordinarily that border down on the rio grande, nobody can get across it. right, harry? >> he says they were smuggled -- >> for me, no, i won't support it because i've been told the cornyn-cuellar legislation covers a lot of other issues. remember, had we done comprehensive immigration reform, would he wouldn't be having this issue. and everyone here, the border is secure. >> it's sounding -- wait a

second. the border is secure? are you on medication? >> not enough. >> harry reid saying the border is secure, you've got to wonder whether he's really on his medication or not. that is -- we saw at the beginning of the show the report from john roberts. how many do we have now? 16,000 theeft kids who come -- 16,000 at least kids who come over and we are helpless. >> what a conundrum. at 5:30 today we have all 500 lawmakers gathering for this bipartisan offering of a bill. yet harry reid before he walks in says, no, i'm not going to play. and in fact, the border is secure. >> in terms of asylum, in terms of providing relief to so-called refugees as senator reid describes them, it appears to be the quickest, best solution affording those children an opportunity within seven days to be said, yes, you are a refugee, or no, you're not a refugee and you should go back.

his son, lecroix answered the phone. police say he was able to get into the house through an unlocked door. he was apparently inside that house, police believe, for three hours before he was busted. the white house defying a congressional subpoena this morning. the president's senior advisor will not be appearing in front of congress today. david sema was supposed to testify on potential violations of the hatch act. the hatch act prevents government employees from using their office for campaign-related activities. the white house insists that there is no evidence of wrongdoing. former secretary of state henry kissinger recovering after having heart surgery. kissinger who served under presidents ford and nixon had his a or -- his aortic valve replaced. >> listen to this one.

this is interesting what germany is looking at doing or so they say. if you don't want other states to spy on you, use a type writer. politicians say they're thinking about using manual typewriters for sensitive documents and seriously considering ditching e-mail altogether. this of course after the germans learned the n.s.a. tapped german chancellor angela merkel's cell phone. and those are your headlines. >> seeing the type writer reminds me of typing class in high school. 70 words per minute, 25 errors. thank you very much. last week the president of the united states made it very clear he hates photo ops. yet yesterday he was just outside washington, d.c. there he is right there in a car simulator at a highway research center. and he was promoting different things regarding our depleted highway trust fund and what not. he said he had a great time

behind the wheel of a fake car right there. but nonetheless, that's a photo op. our own fox reporter asked about the president who doesn't like photo ops being part of them. >> the president said he didn't like photo ops and he seems to be having a pretty good time. >> i think what the president's concern is people who put photo ops ahead of finding solutions to problems. if there is an opportunity for the president to appear at a photo op that will reenforce the value of the opinion the president put forward the president won't hesitate to participate. >> or perhaps the value that could not be on his mind is the border. >> the road. >> i didn't see border patrol. he wasn't getting pulled over. any way, the president doesn't like photo ops unless, i guess, they're helpful. >> or on instagram or twitter. coming up, it's the worst case of customer service

>> how are you? >> i'm okay but a little puzzled. bowe bergdahl has been accused by his platoon mates as being a deserter. he left a note said he was disillusioned, didn't like the u.s. mission in afghanistan, and he's going to take off. it seems to me he probably shouldn't be loose at this point. >> steve, you're actually correct. bergdahl has done as much damage in my estimation as did p.f.c. bradley manning. we all know manning sat in quantico during the time they ran an investigation. the idea of bergdahl being free to go and come, come and go is totally insane. what your audience may not understand is ncis, naval criminal investigation service did an investigation on this in 2009 when he walked away. the reason that report is not being highly touted is because it basically confirmed what his platoon mates just said. and so, there's clear probable cause to restrict him to at least quarters

probably even more severe than that. >> if there's evidence to keep him under lock and key rather than out and about where he can go anywhere, you know, who is to say he's going to stay on base or stay in the country, why is he free? >> my judgment is that it's a political narrative issue from the white house. if you recall, steve, the president himself welcomed the bergdahl family to the white house and they down played his, quote unquote, bad acts. i think what you're seeing here -- and this investigation can go any number of ways that they're conducting. 56 is considered an informal investigation, quote unquote. the question now becomes what is the political narrative that may be the pressure point that is on the military to come up with a certain course. it may go against the very facts. that's the issue right now. >> the fellow who is doing the investigation right now, this general dahl, is a friend of yours. you say he's an upstanding, terrific investigator. but what he's going to do with his findings is give them to his bosses and they

don't have to stand by them, do they? >> a lot has to do with the investigator you assign. i've seen them assign hack divorce attorneys to come after people who had no clue what they were doing. dahl is not in that category. dahl is a competent guy who, by my friends' accounting who worked with him, will do the right thing here. the question becomes what happens after the investigation? this is considered, it is considered an informal investigation. those results go to the commanding officer and they decide what they want to accept or not accept out of that investigation. >> it seems like a slam dunk case because you just pointed out there's already been a criminal investigation and there's evidence against the guy. this would seem to be pretty easy. >> one would think. it is never easy. let's remember two things about the current situation. this is the ucmj, uniform code of military justice. you have the administrative side and criminal side. this could get kicked over

hours between brazil and senegal. beautiful experience. >> what does it mean to give such meaning again to this name? >> i'm reminded every single day what legacy amelia left and it was all about having a personal passion for adventure, getting out there and challenging the boundaries. having this name has led me down such an adventurous path. this is my life's goal. i'm 31 years old so i'm sure i'll do other things in flight. when i cross over holland island it was special. we handed out scholarships to young girls who get to learn how to fly in honor of the first amelia. >> that must be the fly with amelia foundation? >> exactly right. i started that because it was difficult for me to learn to fly. it's very expensive. so i wanted to give young girls at the high school opportunity -- high school level the opportunity to learn when they have all that enthusiasm. >> congratulations and our best to your copilot as

the border crisis continues and a new poll shows the majority of americans disapprove of how president obama is dealing with immigration. of course those numbers could change if he lets more people into america. >> sad but true. you know, we've heard from the government, you know, people are concerned about where are they keeping all these kids. we've heard a lot of them are being placed with families. when i heard that, i figured that means they've got relatives here in the united states. actually maybe not, because there is an ad that has been running in a number of papers across the country looking for families to take in some of these illegal immigrant children. and if you do that, you could -- and you keep them for a year, you could actually make north of

$70,000 a year taking care of some of these illegals. >> that's right. a family services in orange county placed this ad in penny saver asking for a foster family to take in illegal immigrants, $6,054 a month. the final reimbursement is based on size of home, age of kids. the ad is running in california. incentivizing taking illegal children into your home. >> the federal government has requests for proposals in the sum of hundreds of millions of dollars for the same kind of be provided, because we don't have anywhere to put these children except military bases. >> i was reading on-line one of the stories about this and one of the bloggers said essentially this has become taxpayer-subsidized foreign invasion. the crittendon family foster center that placed the ad put this statement

of. did you know that the united states spends millions of dollars training mexico's military, and your taxpayer dollars are covering it? overnight we learned the united states spent $15 million last year to train the military there. that is a $3 million increase from the year before. that training is supposed to help mexico fight the war on drugs and organized crime there. in order to get food stamp customers to eat healthier food the usda is considering giving them free movie tickets, one new idea the government has. more than 47 million americans are currently on food stamps and the government wants them used on fruits and vegetables instead of junk foods and other kinds of junk they might buy. other ideas they're considering to promote healthy eating include talking shopping carts and better lighting for vegetables. okay. >> more cramped and uncomfortable airline seats may be coming your way if you fly on an airbus made

plane. airbus submitted a patent for retractible bike-style seats. look at this thing. hard to imagine how you can sit on that. airbus acknowledges that is not exactly a passenger-friendly design. the aish's bicycle seats would be like -- the airbus bicycle seats would be like a folding seat in a ballpark. that things like pretty uncomfortable but airbus says we file for lots of patents every year so this wouldn't necessarily be in an airplane. nevertheless, they're considering it. >> if it were an actual bicycle you could get a workout on a cross country flight. >> not comfortable. >> let's go out to the streets of new york city. maria molina back in town after the all-star break. she looks at the weather at 48th and 6th avenue. >> good morning. a little bit of siren activity here in new york city, very typical sound of the big city. i want to take you to the

to go to the emergency room. it is when we're the busiest. a lot of times people think i'll go to the e.r., 6:00 at night, everyone is having dinner, no one is going to be there. false. the best time to go to the e.r. is between 3 a.m. and 9 a.m. that is when we're statistically the slowest. i would say between the 7 and 8:00 hour because the nursing shift changes around 7 a.m. so you've got people with fresh legs rather than those who stayed up all night. >> what about calling 911 where should we do that from? >> from a land line. when you call from a land line the 911 dispatcher sees your address flash on the screen. a cell phone will take about 25 seconds to locate and location isn't as precise. call from a land line. >> a lot of people think if they call an ambulance they'll get seen more quickly. true? >> false. what we do in the emergency department is triage our patients. we give you a number one through five depending on how serious your medical problem is.

"fox & friends" confirming that bowe bergdahl has hired a civilian lawyer. we spoke to the lawyer earlier, declined to come on of the with you we found out information here. that they spoke as late as last week and that they actually met in person. that lawyer is eugene fidel and peter johnson, jr., we understand you have some interesting information. >> he's a coast guard veteran, but also a co-founder of something called the national institute of military justice. he's been active in preparing so-called amicus briefs to the united states supreme court. it's friend of the court brief. he's been a friend of the court with regard to the issue of enemy combatants.

he has spoken out to the supreme court on behalf of detainees at guantanamo bay and submitted a brief that helped derail the military commission's act here in the united states. so he's been a proponent of rights for enemy combatants detainees in guantanamo bay in the past. he's a well-known military justice lawyer and obviously an outspoken advocate for the issues that he thinks are important. >> sure. we understand as well at yale where he now works, he teaches military justice. he teaches about disasters and gitmo, interestingly enough, to your point. >> yes. he's an expert on gitmo and his wife is linda greenhouse, well-known and respected reporter. but also known in some quarters as a liberal reporter. so it's an interesting choice that mr. bergdahl has made going forth in this particular case.

>> the investigation is why bergdahl walked off base early on. we said there is proof he walked off willingly. we heard from platoon mates there. they call him a deserter. so yesterday the pentagon was facing some harsh questions there. is he restricted in terms of travel? is a flight threat? this is what they had to say. >> there is allegations, but just having allegations posed against you in the military doesn't restrict your freedom of movement or place you in any kind of restricted status by the nature of somebody alleging wrongdoing. there will be a fair, complete, comprehensive investigation into the circumstances surrounding his departure from that base and then we'll move on from there. >> could say he's a flight risk. >> he's under no restrictions. there is simply an ongoing investigation into the circumstances surrounding his departure. >> thanks, everybody. >> additionally, in the first

hour of "fox & friends," we had tony schaefer on, also worked for the c.i.a. he said that a couple years ago, they already completed a criminal investigation into mr. bergdahl's disappearance. keep in mind, they did find the letter. he wrote about how he was disillusioned with the military mission in afghanistan and he had had enough and he was going to walk off base. tony also said that this particular fellow, bowe bergdahl, has done as much damage as a guy like bradley manning. here is mr. schaefer. >> bergdahl has done as much damage as did bradley manning. we all know manning sat in quantico during the time they ran an investigation. the idea of bergdahl being free to go and come as admiral kirby said is totally insane. naval criminal investigative service did an investigation on this in 2009 when he walked away. the reason that that report is not being highly touted is because it basically can confirm

hour. a developing story, police just busted an intruder. fox news alert. this intruder apparently broke into the famed kennedy compound. >> joining us live from hyannis port is our reporter. >> reporter: yeah, a big scare in hyannis port. a lot of questions this morning about how an intruder managed to get into the historic kennedy compound in broad daylight. it was around 9:30 last night when police got a call from a man saying that he owns the irving avenue home, report ago suspected intruder. that caller now believed to be teddy kennedy, junior. he had just called to check in on his teenage son when a strange man answered the phone, identifying himself as james la croix. right away officers were sent to the compound. they found a black vehicle parked in the driveway and an intruder in the kitchen as well, who then again identified himself as 53-year-old james la

when our attorney general eric holder appeared on abc this week program, he was not asked on air about the irs'ññ?ñ?ñ?ñ?ñ. thi"ujráe two judges one deadlinefañ?ñ?ñ?ñ?ñ? for inforn before ordered days before. in fact, the scandal has only been mentioned in the mainstream media once since that order was issued on page 17 of the "new york times" on friday. so does this lack of coverage have any impact on why holder refuses to appoint a special prosecutor or special investigator? joining us right now to react is the attorney representing many of the targeted tea party groups. good morning to you. >> good morning, steve. >> so in that interview that abc selectively aired parts of it, eric holder said that the f.b.i. agents and his investigators are doing a good job. would you agree with that? >> well, it's hard to tell. i have talked to them.

they called me the day that i submitted testimony to congress in february saying that the department of justice investigation was a sham. that afternoon they called me and i have talked to them. i met with them and when i say them, i mean two attorneys from the department of justice, barbara bosserman was one of them and a couple of f.b.i. agents and a couple from the treasury inspector general. i have spoken with the lawyers for other clients -- there are three lawsuits filed against the irs over the irs targeting scandal. and as near as i can tell, the only people that the department of justice has contacted are the lawyers for those groups as opposed to the hundreds -- there are hundreds of organizations. to my knowledge, they have made little effort to reach out and really talk to all the victims, all of them. >> because a lot of them don't have attorneys and so they haven't reached out to the

attorneys. what's curious is you got to actually sit down face-to-face with barbara bosserman who is heading up the department of justice investigation into whether or not the irs targeted tea party groups. she's the same person who many have labeled a political hack because even though she's a career litigator for the department of justiceofñ?ñ?ñ?ñ?e oney in the past to barak obama and otherínñ democrats. >> well, it's very disturbing. she did sit through my conversation with the department and what was interesting to me is i mentioned one of the things i referenced was a phone call, conference call in february of 2012 after hundreds and hundreds of groups received these very ownerus, oppressive questionnaires with the case of true to vote, had 119 questions. and so there was a national conference call talking about that. the only question she really asked in her whole interview,

morning. the university of texas can now continue giving preferential treatment to minorities. a supreme court ruled that they can continue to use race as a factor in its admissions process. >> it's important because all of our students, regardless of their ethnicity or race, are going to be out in a very diverse world. >> the university of texas supporting this decision, but the whole case, which made national news, started back in 2008 when abigail fisher, this girl here, who is white, was denied admission to the university. she said that she had been discriminated against because of her race. last year her case went all the way to the supreme court, but it was kicked back to the lower court and now the lower court has ruled. the police couldn't crack this case, so this guy did it himself. jacob rogers was riding his bike in georgia when he was hit by a car. the driver of that car took off.

so what did rogers do? he tracked down the suspect's silver car at a nearby apartment complex and he even found a piece of his bike stuck in the grill of the car. police eventually went on to arrest the driver and they charged her with a misdemeanor hit and run. nice police work that he did for himself. and he might be small, but this morning a three-year-old is being called a giant hero. listen to what happened here. a 68-year-old, bob king, was trapped in his car after his doors automatic low locked and it was very hot out that day. he was too weak to open the door with the temperatures quickly rising in the hot tennessee sun. he started banging on the window, hoping to catch someone's attention. three-year-old keith williams was walking by and then he grabbed an adult to help. listen. >> you know, i don't know how long he had been, i'd say if had been another 20 minutes sitting in there if he hadn't notified

off student loan debt. so if it sounds too good to be true, it is. that's number one. number two, if they're asking for large fees and up front costs, be sure that you stay away from those 'cause you would rather that money be going off to pay your debts. the programs that don't exist, so make sure you're not giving your money to those and also services that you can find for free. these companies promise those kind of services, so obviously don't give your money to those. >> people get so desperate sometimes. we've seen the scope of trillion dollars that students owe in this country. let's talk about some specific tips now that you've pointed out some of the pitfalls. what can people specifically do to help themselves in these situations? >> first and foremost, again, don't fall for these debt settlement companies. stay away electric those. take all that cash you would be putting toward those companies to pay off your debts. so make a plan to get out of

debt. and first and foremost, i tell people to do the debt snowball. this is where you're going to list out all of your debt, smallest to largest, regardless of the interest rate. pay minimum payments on everything and attack that smallest debt first. once that's paid off, roll the payments you were paying on that to the second smallest debt. and go until you're completely debt free. that's the best way to go about paying off your debt. also find extra income. so go take a part-time job, sell some stuff. do whatever you can to get extra cash to put toward that debt. >> you say realize that it's a marathon, a long race. not a sprint. >> that's right. it's going to take some time. you obviously want to do this as quickly as possible. but remember, it's going to take time. especially the student loans, which a lot of people have. that's probably going to be your last debt 'cause it's the largest debt most people have. so yes. be forceful with it. put as much money as you can toward that debt. but remember, it may take some

clients have been the detainees at gitmo. >> he's spoken out on behalf of them. they were not actually his clients. he put this a friend of the court brief in several proceedings in the court of appeals and the united states supreme court. so he's a well-known lawyer. an interesting choice going forward for mr. bergdahl. >> he's traded -- he was traded for the five top taliban officials after some say he deserted. his platoon mates. it was proven through documents. the pentagon was facing a ton of questions as to this investigation and the status of bergdahl. is he restricted in terms of travel? should he be allowed to fly? this is what their spokesperson had tovrñ?ñ?ñ?ñ?ñ say. >> tujurj allegations, but just having allegations posed doesn't restrict your freedom of movement or place you in any kind of restricted status just by the nature of somebody alleging wrongdoing. there will be a fair, complete, comprehensive investigation into the circumstances surrounding his departure from that base and

the idea of bergdahl being free to go and come as admiral kirby said is totally insane. naval criminal investigative service did an investigation on this in 2009 when he walked away. the reason that that report is not being highly touted is because it basically can confirm what his platoon mates just said. so there is clear probable cause to restrict him to at least quarters, probably even more severely than that. >> we understand mr. bergdahl has not been questioned at this point, nor has he been charged. he is not charged with any crime under military law. >> said to be making over $350,000. >> he could, if it's determined he was a prisoner of war, $350,000, back pay, and p.o.w. bonus. >> even though he left a note and said i've had enough with this war and i'm leaving? >> correct. there is an investigation that's ongoing. it began june 16. they hope to have findings by the middle of august. i don't expect really it will be done by then. but let's see what happens.

first of all, the in flux of thesish which from central america was predictable as early as january, even back last year. i think we should have been much better prepared for the influx than we were when they all started showing up in greater numbers. secondly, there was no notification to local authorities, to my office or to anyone really before the kids started showing up in southern arizona. those are two big mistakes. now we have to solve the problem. that's what i've tried to do by signing onto a bill that was introduced by my colleague from texas, congressman cuellar. >> which harry reid says he's going to take no part in. he doesn't want to part in because the border is secure. do you believe the border is secure? is harry reid delusional? >> well, i wouldn't want to characterize the majority leader any way like that. but i will say this, that the people i represent in southern arizona, and i have 83 miles of the border with mexico -- don't feel secure, don't feel safe in their homes.

you heard president obama requesting $3.7 billion from congress to handle the crisis on the border. how much of that money is actually going towards the u.s. military, the group that's been housing illegals at its bases and patrolling the border? zero. is the president shortchanging our armed forces by involving them in this crisis without boosting their funding? joining me now is congressman and veteran of the iraq and afghanistan war, adam. good morning. >> good morning. >> there seems to be a disconnect here. the president saying spend almost $4 billion, but not a of that appropriation seems to go to national guard or active military. what's that about? >> yeah. i think it's an issue. at the end of the day, the president's probably, if he really wants to solve the border crisis, at least in the short-term, is probably going to have to deploy national guard

soldiers to alleviate what the border patrol is having to do that's not apprehending people at the border. like president bush did in 2006 with operation jump start. at the height of the iraq and afghanistan war, he still sent national guard to the border of mexico, specifically in arizona to build up that border. the president is probably going to have to do the same thing. we're also trying to alleviate some of the drug trafficking and narco terrorism we see in central and south america. south com needs to be able to be well resourced to combat the reason why we're seeing so many kids come up and also you have these kids that are being housed in military bases all around the country right now. so the military is finding itself carrying a share of this burden and frankly, at a time when the military's budget has been cut significantly and there is a lot to be asked of them. i think as part of this, we need to talk about insuring the military has all the resource it is needs to protect our country

and be able to do what the country is asking us. >> you're not only a major in the air force, you serve in the reserves and you served at the border. we hear more and more about drug cartels funding and sponsoring this invasion of undammed immigrants into this -- undammed immigrants into this country. isn't that a pressure point that our military should be looking at in central and south america and doesn't that cost money? >> yeah, absolutely. i've worked the border in multiple capacities. one was in 2006 with operation jump start taking troops to the border. but then more recently i actually fly an aircraft and intelligence aircraft and we flew the border to look for people crossing in. this was before the influx of children we were seeing a lot of peopleómñ?ñ?ñ?ñ?ñ crossing and g border patrol, many of whom had drugsóoñ?ñ?ñ?ñ?ñ which were mule drug cartels. now the cartels have figured out that not only can they make money on bringing children up here, but they can also use that
