kill him. that's according to her lawyer. the suspect, here she is in court wearing that red prison jump suit. and she pleaded not guilty to manslaughter and other charges. prosecutors say she left the google executive forest hayes to die aboard her yacht. her attorney says hayes was responsible for his own death. >> this case is about two adults engaged in mutual drug usage in the context of a sexual encounter initiated and encouraged by mr. hayes. >> in other words, he started it. he was married with five children. investigators say he met her on a quote sugar daddy dating site called seekingarrangement.com. police say under surveillance video shows her injecting that man aboard his yacht and making no effort at all to help him when he collapsed. they say she cleaned up the scene and even stepped over his body to finish her glass of wine. verdicts have not released that

under surveillance video, but they describe her behavior as glacially cold. her facebook page filled with photos of her modeling gothic clothes. it includes poems about drugs and vengeance. meantime, police in georgia say they're reexamining the death of her other boyfriend, a former boy friend, after he died last year of -- an overdose of heroin. plus, alcohol and painkillers. we'll talk to a former roommate of that couple just ahead who tells quite a story. but first, to our own claudia cowan outside the courthouse in santa cruz, claudia, what are we hearing from the defense here? >> shepard, go everyone the lured details, the defense is doing damage control, claiming she is a professional young is grateful 206d someone like forest hayes in her life. >> she appreciated his generosity and she had a motive, if any, to elongate, not end the

relationship. at the end of the day, all the speculation and the sensation and the hype is not evidence. >> there was no sign of hayes' children or wife of 17 years at today's arraignment, which lasted all of four minutes, she barely look up and spoke only a few words to her attorney. the judge zinc her bail to request her bail be reduced from $1.5 million, suggesting she could be a flight risk. her father, a tech tek executive was on hand along with her mother and sister. but they left without talking to reporters and, shepard, everyone returns october 20th for a preliminary hearing. >> so, claudia, there is video of the death. are we ever going to see this video? >> yes, it could be released at the preliminary hearing, possibly by the defense, more likely by prosecutors as they arc you she was legally responsible for hayes' death. >> this video is the prosecutor's best friend.

even if this was a consensual relationship to begin with, when she saw him in distress and she walked away and left him to die, that is a huge piece of the puzzle for the prosecution. it shows a callous disregard for human life. >> reporter: but the defense will put the victim on trial and portray forest hayes as a wealthy risk-taker who had been with her before, he knew what he was getting into and that his death was a tragic accident. but no crime. shepard. >> claudia, thanks very much. christina brooker u.s. is she used to live with this woman and that former boyfriend i mentioned who died last year now we know after an overdose. she is live with us from atlanta this afternoon. thank you for being here, you had restraining olders against the woman who is alleged to have killed this guy and the former boyfriend who died of an overdose, himself. >> i did. >> why was that? >> when i was there, alex's drug behavior had gotten completely out of control. so i quit my job's a nanny.

alex was sending me all kind of threats. >> threatening what? >> she was threatening to kill me, to ruin my career, to make sure i could never work at a new job in atlanta ever again. she had done it from both her phone and his phone. >> so you went to the authorities t. authorities granted you a restraining older against not only her but the ex-boyfriend. >> yes. >> the ex-boyfriend is dead. the torts tell us he died of a drug overdose. you didn't think that was the reason, right? >> right. there was -- this is a man that didn't even take aspirin, so to hear that he got a drug overdose was insane. >> so, wait, now she was taking heroin and as far as you knew, she had been taking heroin all along. but when she was in the relationship with this other boyfriend who died of a heroin overdose, he never touched any trucks? >> no, actually, the only reason she was living in the house was because she had come out of rehab and he had told me when i lived there if i had ever found

out about her using drugs to let him know and there were several occasions where he had kicked her out of the house, catching her with drugs and alcohol that she wasn't supposed to have to begin with. >> they're reopening that investigation now, that kind of makes sense to you now, huh? >> yes. >> so what are your thoughts on that? >> i think that heroin is a powerful drug. so to hear that, you know, she was, you know, disregarding any, she didn't care about any other people that passed away from this. to hear she was very calm during the deaths of both of these men on the 911 call for the man here in georgia and the under surveillance for the man in california, i'm not surprised. heroin makes you like that. to hear that when i was viewing dean's autopsy, it said that he had oxycodone in his system and alcohol. you know when you mix those two things, two or three oxycodone can make you pass out, become very lethargic. i think that would have been her opportunity to inject him with heroin. i feel she had something to do with this. i hope the investigators find

some sort of investigation. >> were you scared of her? >> i was a lot bigger than her. this is a girl that's got a skeleton style physique. she looked like a back of bones with skin stretched over her. >> yet you got a restraining order against her? >> yeah, anyone that made death threats. i wanted them to stop. they were obnoxious, they were annoying. that was my whole goal in that. >> when you heard that the police claim they had this video, wherein, she injects him with heroin, then walks over his body and coldly as they put it leaves this crime scene, were you at all surprised? >> i mean, it's just surprising in general, but i think this really sheds some light on the power of heroin. if you look at regular heroin addicts, people in rehab, you see that behavior. heroin users are very overly calm. you know, it's very disturbing to see someone who uses heroin,

brand-new today, what a bombshell. workers at general motors knew what caused some of those deadly car crashes linked to the faulty ignition swims. they knew and still they didn't say a thing. that's according to reporting of the new york times newspaper which cites documents obtained from the freedom of information act. the times reports gm found ways not to answer simple questions. quote, in at least three cases of federal crashes gm said it has not assessed the cause. while in another fatal crash. gm says that attorney/client privilege may have prevented them from answering. prosecutors say gm waited nearly a decade to recall 2.5 million people after 13 people had died.

now the crisis in the middle east there is word hamas proposed a decades long peace meal. peace for a solid decade. we promise it right now. it will ends rocket attacks in the holly land, only if the israelis meet all of hamas' demands. that's according to es ral's channel 2 network. there were lots of international media there. a crew from nbc was there. the uncle of those palestinian boys is calling it a cold blooded pass kerr. the israeli military reports it's investigating. israel launched new airstrikes on hamas targets and homes of the group's leaders. hamas has agreed to fire into israel unless and until it gets a cease-fire deal. israel's can el 2 news is reporting hamas is spelling out those demands in its own proposal for a truce. remember hamas wasn't even consulted on the israeli and the

egyptian truce deal. they didn't even get a phone call. among the conditions here, israel must release palestinians rearrested after a 2011 prisoner exchange. it must open the gaza border crossings. in other words in israel and i presume into egypt and end a seven-year naval blockade of gaza. bill richardson with us, a former ambassador of the united nations. this is a fawn starter, isn't it? >> yes, it's a non-starter. it's not a good deal forisse ral t. good news hereby, if there is any is that the israeli pounding, the israeli military operations have at least brought hamas to say they're ready to negotiate. that's the good fuse. the other good news is egypt has stepped up with a cease-fire proposal, which israel accepted, but the hamas rejected. why is that good news? because we had wondered where

the egyptian government was going to go in the middle east peace effort and its relationship with israel. so that's good news that moderate government in egypt is stepping up and acting as a peace-maker. we should get behind this effort by egypt to get both sides to the table. but the, what hamas announced, it's pretty outrageous. at least they're saying, we're ready to talk. >> i wondered about that, that lcc negotiated truce idea. i mean, hamas wasn't even consulted. they didn't get official word. none of the things that they're requesting were mentioned in any of it. i wondered if it was even real. did you see it as a real thing? who thought hamas would go for that? >> well, i thought it was a real thing. i think what egypt is ready to do is work with a moderates in the palestinian movement on the west bank. the abas group.

abas publicly said he supports the egyptian cease-fire. so i think what egypt is trying to do is move hamas towards a more moderate elements within the palestinian authority. now, whether that's going to happen, i think the big player here, too, is iran. what are they doing? are they giving hamas weapons? are they messing around again? this should be a part of our goes, get iran to be more responsible. >> i wonder if israel's time was limited. there were lots of reporters around in gaza a reporter is kicking the ball. he auction walks away, anise real missile falls and all these little children are killed. a mom is wailing and screaming on sidewalks screaming where is the world? where is the world? as they reported, the world is not there.

the fox news defect. investigator itself in moscow were reportedly charged two subway workers after yesterday's deadly train derailment there. verdicts say the crews did not properly install a switch. the train jumped the tracks. people in moscow donated flowers and donated blood to the victims. the cash killed 22 people and injured more than 130 others. officials in california approved fines up to $500 per day for people who waste water when they wash their cars or run sprinklers on their lawns. the state is dealing with their worst drought in almost 40 years. fines start in august.

the mother of the ga toddler who roasted to death in an suv is devastated over the loss. she is blaming the media for not letting her grieve. that's according to her lawyer in the first statement we've gotten from her side. remember the boy's father is facing murder and child cruelty charges. police in atlanta say he left his son inside that car on purpose last month for seven hours. during those seven hours, police say he sent naked pictures to women and even and underaged girl. cops say he claims he forgot to drop off his son at the day care before he went to, who. warrants also indicate both parents admitted they searched

the internet for information on deaths in hot cars. but so far the police have not blamed the mother as a suspect. in a statement, her lawyer writes, again, the first statement, he says, leann na harris is living every parent's nightmare. the child she bore and loved every moment has died. for most parents it is difficult if not impossible to comprehend such a thing. forleann na, that nightmare is all too real. the lawyer also said the coverage of the mother is getting, is not justified and that she wants to be left alone to mourn her son. fox news senior judicial analyst janet napolitano is here. first our keefe correspondent jonathan hunt has more. >> attorneys repeatedly emphasized in this statement just how difficult all there is for little cooper's mother saying, for instance, she will never again be able to tuck him in at night.

she mourns couldn'ter's death deeply in her own private way. she takes comfort from a strong faith in god, but the loss is still overwhelming. getting through each day seems almost impossible. and the attorney, lawrence zimmerman, accused the media of turnling a grieving pots into a suspect in the public mind saying, quote, newspapers, television and online pedia have fostered a poisonous atmosphere into her action or failure to cry in front of a crowd is scrutinized for some supposed hidden media. he appealed to the media not to indulge in innuendo and speculation. >> he left out facts, facts coming from police. >> this was interesting. certainly, police officerr police officers seem at the very least bemused by some of leann fa harris' actions and behavior, including her reaction when she got to the preschool where her son whereas supposed to be on

the day he died and was simply told that he had not been there. listen to the detective. >> in front of several witness, all of a sudden she states, ross must have left him in the car and they're like, what? there is no other reason. ross must have, no other explanation, ross must have left him in the car. >> now, she said, ross must have left him in the car before she was told by police that that is, indeed, what had happened. justin ross hrts, her husband you see him there, remains in jail. he, of course, claims all this was simply a tragic accident. so far, leann na harris is standing by her man. although, interesting to note, in this relatively lengthy statement from her attorney, not a single mention of her husband. >> jonathan, thank you. let's turn to the judge, our senior judicial analyst is with us. lawyers do what they do. they set up their defense. they protect their clients.

he's a bit disingenius here. >> this is more a statement written by a pr person, a pr flack i should call them in this business than a lawyer. it's tough for me to get a handle on this, in the instance of both of them. the husband and the wife, there is a lot of extraneous material. one way to look at it is sloppy, stupid, coincidental. another is a conspiracy to kill this kid. this statement, ross must have left the baby in the car is absolutely incredible. but it is also potentially damming. so here's a couple interesting observations, georgia has no spousal privilege. meaning she can be compelled to testify against him. meaning, they can charge her with a crime and trade her freedom for her testimony against him if they want to do that. you can't do that in every state you can do it in georgia. i also think that the police have more there than they're releasing. because if this were just a simple accident, russ would be

out on bail. the chances and opportunity for him to do this again, his motivation to flee are slim. so i think there is more there than meets the eye. yet, they have not charged him with a more serious version of murder. they have just charged him with this criminally negligent homicide, which is the moral equivalent of driving a car into times square. you don't intend to kill anybody but your chances of doing so are good. >> when you add according to police both the mother and father separately searched on the internet forwhat it takes to dry in a hot car. >> that's the conspiracy. now, conspiracy to commit murder carries the same penalty as murder, itself. either life in prison or capital, depending upon what they want to do. let me suggest to this there is evidence of conspiracy to murder your own child. are you talking death penalty. >> thank you both. >> you are welcome. liftoff. we have a liftoff. 32 minutes past the hour. liftoff on apollo 11.

>> 45 years ago today, nasa launched the spacecraft that would put a man on the moon for the first time and all these years later, the achievement still ranks among the greatest of the history of mankwiend. neil armstrong and buzz aldrin, armstrong died in 2012. so this is the first major five-year anniversary without him. our leah good-bye yell recently sat down with buzz aldrin in his home. >> reporter: he is one of a dozen astronauts who put their own foot prints on the moon. eight are still alive. he acknowledges there will be fewer still around to celebrate tear 50th anniversary in five years. so he says he'd like the president to honor them by giving them the time of lunar ambassadors, ambassador or not, you get the sense that dr. buzz aldrin has a full appreciation of the feat he accomplished.
