"factor" begins right now. >> hi, i'm bill o'reilly. thank you for joining us tonight. americans outraged over the border. that is the subject of this evening's talking points memo. well, the initial data is in. gallup took a poll of more than 20,000 adults and asked the question, what do you think is the most important problem facing the country today? 17% said illegal aliens, second,

dissatisfaction with government, third the economy, fourth, unemployment/jobs and fifth health care. so right now in the usa, the poorest border and the foreign children suffering because of it is the most important issue the country is facing, not only that, two other polls are out. just 28% of the americans approve of the way president obama is handling the border, 56 disapprove. washington has it 58 disapproving. only 23% say the republicans are doing a good job solving the immigration mess, a whopping 66% say they are not. it is long past time for washington to secure the southern border, everybody knows it, we have been lied about it for years, and everybody knows it. both sides are responsible. but it is up to president obama to fix the problem. the drug enforcement agency has

an intelligence arm that has released 230 illegal aliens detained on the border. most of them say the reason they're coming here is they believe they can stay. the myth that the far left is putting out, that countries like el salvador and guatemala, are actively harming their populations is destroyed by that survey. it is directly affecting all parts of the usa, some governors are condemning the president for not informing them before they move illegal aliens into their states. that is terrible. even in ultraliberal maryland, there is dissent. >> i want to point out, what are you going to do if they can't find their parents? put them in the compound? no answers. >> over the last week, pointing to the problem there is very little leadership coming out of

congress or any other leadership, because of that, a war may break out in the middle east, terrorism is on the rise, hundreds of thousands of illegal aliens continue to flood into the country. i can't make the president or congress do anything. but you guys can. americans have got to make their disenchantment loud and clear by directly contacting senators and representatives and by voting in november. let's throw the bums out. and that is a memo. now to the top story tonight, will the republicans be able to capitalize on this in november and on the campaign trail? no president in our lifetime has been able to secure the southern border, why not? >> well, it is tough. some of them have tried. reagan signed a bill that he thought would bring about an end to our immigration difficulties.

it didn't, it made it worse. bush 43 doubled the size of the border patrol, tripled the budget, and ended painfully catch and release, temporarily. for example, in 2008, there were 4,000 unaccompanied minor children apprehended at the border. but there were 8,000 returned across the border because bush was working through the back log of people already here. and fy, last fiscal year, there were 20,000, nearly 21,000 minors caught at the border and we returned 1900 because we have a huge back log developing. but it is a tough and thorny problem that requires consistent presidential leadership and even taking the necessary steps. >> i hold every president, every one since lbj accountable for not securing the border. >> well, you have to go back even further than that. john kennedy was the one who put in place the family reunification law.

crisis. they simply just don't think it is the president's fault. they believe the republicans -- i'm not saying i believe. they believe inside the white house, right behind me in the west wing that if republicans had worked with the president in the last five and a half years on both securing the border and in comprehensive immigration reform that maybe we would be in a better place. >> well, that is and hypothetical bs. >> well, hypothetical -- >> so then it becomes the question i ask mr. rove. are the republicans just going to sweep all over the place in november, take the senate, cuff the president, he can do the executive orders but not much. all right, they will come at him from every angle. is the white house very worried about that? >> they are very worried about losing control of the senate. that seems like a very real possibility right now. and if the border crisis gets worse, and health care crisis continues, we'll see if it gets

worse. it is still lingering out there, an issue that nobody knows how it will play out. so all the crises have been building. and when you talk about some of the polls suggesting people have just given up on washington, yes, there is democrats and republicans on the hill we have to worry about. but ultimately the man in the oval office, even though his name is not on the ballot his leadership is on the ballot. >> you don't want a leader who is deluded, living in a fantasy world. i'm worried that is happening. and you say they're not worried how the health care crisis will play out? i know, and i'll tell you how i know. a good friend of mine and his wife, both in their 70s, signed up for obamacare and they just got their deductible for their health insurance. do you know how much the deductible is? $9500 each. that is $19,000 before they see any health insurance benefit coming in. and these are regular folks.

course, young black men growing up without fathers. unfortunately, nobody in the in his media has the courage to touch that subject. >> well, of course, i do, but mr. bergen can be forgiven for not remembering that. subsequently, he quit. should the guy have been suspended, howard? >> no, and i'll tell you why. he knew he was breaking the rules but he did a courageous thing by speaking out on a very incendiary subject. >> what are you talking about? do you really think a reporter, a man or woman should be able to editorialize about anything they think? aren't you a news guy? >> now, wait a minute, lauren, the problem with his report is that part of the report was the blowback from police officers angry that news 12 put a woman on the air, the mother of the

murderer who condemned the police force. that is part of the story. so isn't mr. bergen explaining why that is happening and how dangerous it is, isn't that a legitimate explanation? >> when i was on the streets of washington, d.c. covering the worst crime areas possible, covering stories just like this, i reported the facts. you report the police are upset, you get the victim or the victim's family and then you can talk about issues. but you don't state your own -- >> what is the line you would have suspended him for? where did he go over the line? >> he went over the line by saying nobody will touch this, this is an issue that is in need of discussion. >> but isn't that true? >> it is not his job. >> to report the truth? >> it is not his job to do anything but report the facts. >> i will agree he got a little

. factor segment tonight, how to solve the border mess, joining us from washington, senator marco rubio from florida. so senator, top of the program we told the audience about the polls coming in on the border crisis. president obama is getting hammered. the vast majority of americans believe he is doing a terrible job there. however, just 23% of americans believe the republicans in congress of which you are one are doing a good job. 23%. so you guys are getting a blast as well. so my question to you is, if you were the president of the united states how would you stop this humanitarian disaster down there? >> well, first of all it wouldn't have happened because i never would have signed an executive order granting a deferred action to the people in the country illegally. he is showing a tremendous amount of compassion but that is not the right way to do it. you see the disaster that

followed. the second thing is, the all-out effort to finally put to rest the illegal immigrant problem in america. that means deploying the significant ground measures like drones to secure the border of mexico. it also requires employers to require the people they hire are legally here. 40% of our illegal immigration problem are people that enter the country illegally. that would be the first step, only after you do that is then, move to step two, reform the illegal immigration problem -- >> i agree, you have to stop the madness first, the kids now because this is the humanitarian crisis that the whole world is watching. number one, you have no fence in these hot sectors, you say we should. and i agree.

number two, governor perry of texas is asking and has asked for years, the national guard to get down and help the border patrol? do you favor that? >> i do, that would be a part of manpower that would be part of the effort to secure the border. >> so you put the guard down there, show the world the pictures of the military on the border. right away just those pictures would de-incentivize the people who are paying the terrible cartels to human smuggle. so you would have a solution. all right, now, why do you think the folks are holding it against the republicans -- are they believing president obama when he is trying to blame you guys for the border madness? >> i think it is an indictment of all of washington, of the failure for more than ten years to deal with the problem that we know exists. unless you are in favor of the status quo and look at what is happening and say i think this is working for america you have to be in favor of fixing it. so that is not really the debate, the debate is how do you

fix it? and in my mind the first step to fix it is to stop the growth and problem we have right now with illegal immigration, and then to begin to erode the number, to lower is so you can move to step two, which is reforming the illegal immigration problem that works for our merit and the 21st century. >> okay, would you send the kids back? >> yes, and i'll tell you why it is important. because the word of mouth that is spreading that if you have make it to the u.s. with an unaccompanied minor and a family with children then you will be treated differently than anybody else. so that word gets back, imagine somebody coming across the border, now released into the population, with a notice to appear, and of course they never will, or do. what happens, they call back home, people see you made the way safely, and it gives others the incentive to do the same thing.

>> you would give the increased courts, the judges down there to get them back, that will be an increased thing if it happens. how many times have you spoken to president obama personally about immigration reform? >> well, we've spoken a couple of times, not in more than a year. and my conversation always begins with, anyone who is in favor of immigration reform must first be in favor of border security. >> and how does he reply to that? >> well, number one, they say the border has never been more secure, which is true for a handful of the sectors, but not for the other sectors, not for the rio grande, the tucson sector where people are crossing. and that is the real problem, where he mocked people who said we needed more border security by talking about how we would insist on a moat with alligators in it. and in fact, we've seen now the border is in fact not secure. >> all right, senator, we appreciate you. when we come back, miller time. the border, and some are saying
