status that a family might be eligible for. if that were the case. it would be better for them to be able to apply in country. >> okay. so going and starting in honduras if these kids are trubledz and if there is a situation where they want to come to the united states they would go through a presceeng process there republicans say this is only -- they get to skirt this law. when give them refugee status take them out of that law and come to the united states. >> would they have a sponsor year? i believe they would be lined up with a sponsor in the united states. >> they would have to. depends on how this pilot program unfolded if they change it again, it's just a pilot program in honduras. a lot of these kids coming here with distant relatives

diversity plan for the school a lot of campuses and public universities are moving in this directions of being more inclusive. in policy was actually calling for under represented populations to have more of a chance of getting into popular classes. select your courses that's a random process. now if you are under represented. you are a minority, you are a female, if you you are under represented you should get into these courses as well as you should be receiving grades of students who are working hard in these courses, so to me. >> grading on a curve? is that what's going on here? >> a curve or being graded based upon your diversity. if you are a minority student and you feel as though you should be earning as student next to you who happens to be white. if you are under performing minority. they are reviewing minorities as a disability.

which is what the liberal left tends to do when they put in affirmative action policies. i don't think it helps minorities. it hurts them in the long run. we saw this out in california when they tried to reinstate affirmative action policies. a lot of minority groups came out and protested and said, hey, this isn't fair to us anymore. we want the same opportunities. >> ashley, i want to read you a statement from the school because they are coming out saying this is bogus. the idea that you would start to base student grading or makeup on race or ethnicity has circulated. nothing could be further from the truth. is that a emphatic denial. >> the the statement was made by the chief diversity officer so why the campus even has one, i'm not sure. seems like an interesting position to hold but essentially he came out and said this was in another document that we had out in 2009 where it basically showed the research of a researcher in here and we're not going to implement this

but the outcome of these policies would be that this grading would organically happen among these under represented minorities if we include them more on campus in these courses in these popular majors. and the grading, would just happen naturally. clearing they are moving towards this system but they are not saying that this is a policy they are going to implement but this is something that should happennor began nicly as all the are of developing better diversity policies. >> 10 seconds left. what are the students saying about this? are they offended? >> that's the thing. the students are realizing, especially minority ones, that these policies don't help them. this is something that hinders the bureau gress of minorities. we just conducted a study that showed that out of this 2014 graduating seniors class 7 5% of students were gender studies. what's really happening on campuses, clayton? >> interesting question.

of course this week joseph wood was the convicted murderer out in arizona, was sentenced to be put to death there by lethal injection. there he is. and he's a brutal murderer, right? then what unfolded during the lethal injection period was two hours of excruciating back and forth where he didn't pass away, he was gasping for air, he wasn't dying. and his lawyers even had time to make a phone call to try to stop what was unfolding. ended up passing away before they could get any kind of an injunction. >> you heard about the judge says why don't we bring backfiring squads because you know it will be quick, it won't take two hours for shall be ss die. >> and although he killed somebody -- killed a couple of people in cold blood, the united states in our constitution, we're against cruel and unusual

punishment even in death. so with this judge saying should we bring backfiring squads, is this a more humane way to be put to death or is this barbaric? we had a couple lawyers on the show debating the topic earlier. listen. >> this is the third time in six months that they botched it where the person that they were trying to kill, they didn't kill right away and they suffered. so we haven't figured out how to do it the right way with humans. so it has to be done another way. killing by firing squad is not something new. 70 countries do it and it works. it's quick, painless, the idea of a firing squad is barbaric, cruel and unusual. in the united states of america in 2014, we can't have this barbaric way of doing it. >> so many angles. we have a long history of firing squads during the civil war and lining them up. thousands and thousands of them. in the united states, there are two states that have death by firing squad, though you as a

out later as the situation continues to deteriorate. a convoy left the embassy in dawn under the cover of f-16 fighter jets and drones. they drove all the way out from tripoli west to the tunisian border. they have gotten out safely. the embassy is closed, at least for the time being. they are suspending operations. tripoli has been the scene of increasing chaos and violence. essentially it has become a lawless city. there is no government to speak of, no real military, simply warring militias. you are looking at pictures of the airport which has been destroyed by fighting. a lot of explosions and fighting there. that made driving out the very best option. the defense department source tells fox news that the pentagon had been saying for a long time that it was time to go. finally, the state department

governors are demanding answers from the president. voicing their concerns in this letter. >> it says, "we are concerned there will be significant numbers who will end up using the public schools, social services and health systems, largely funded by the states." north carolina governor pat mccrory is one of the governors behind that letter. he joins us now. good morning. thanks for being with us. >> thanks, mike and anna. appreciate being here. >> how have you decided this has now reached an all-time pitch, peak, where you need to take action? you are not in a border state but this is putting a strain on your system? >> first of all, the immigration issue has never been just a border state issue with texas or california or nevada or arkansas -- i mean arizona. it's an issue for all states, including north carolina. right now, we anticipate we probably have over 1,000 kids who have come to north carolina. communications has been very, very poor. our major concern is they are

being connected with sponsors. we as governors are asking, who is doing the background check on those sponsors? we are also finding out many of the sponsors are themselves illegal or undocumented workers, which we asked the question, if they are undocumented, how can you do a thorough background check to protect these children from using these children in prostitution or drug activity or other activity not safe for these children? >> some people are saying this is a refugee issue more than an immigration issue. try to explain to us what this pilot program the president is talking about. these refugees out of honduras, we screen them a little bit, bring them up and place them in north carolina with a sponsor. again, tell me more about your concerns about these sponsors. >> the sponsors then, first of all, we don't know who these sponsors are. based upon our conversation with the new secretary of health and human services two weeks ago, many of these sponsors are themselves illegal or undocumented.

then the sponsors are supposed to be bringing these kids back after a certain period of time to immigration themselves. you need to ask yourself a question, what's the likelihood of an illegal immigrant who is a sponsor bringing back a child to immigration and getting that child returned to their home country where they came from? i think the likelihood is very slim, which means we have a permanent situation on our hands in north carolina which impacts our schools, impacts our medicaid, impacts all of our health and human services. and to a degree of such large numbers and such a small period of time, this is going to have a huge impact on all the states that these children are delivered to. >> echoing what we had at the top of the show from that sheriff saying it's affecting all of us in our social systems and schools and hospitals and everywhere else. >> and there is no funding for these kids either. the state does not have funding to take such a large volume of these children. >> right. we have plenty of our kids in our own backyard we need to take

concerns. so it's a low-level crime, the issue isn't whether officers are enforcing low-level crimes or other types of crimes. the issue here is when an officer attempts to effect an arrest, and for whatever reason there is resisting arrest and physical force becomes involved, bad things can happen. can happen to the suspect and bad things can happen to police officers. >> is it okay to back away once you start this initial fight, do you have to stay with it? >> think about this, if a police officer went to effect an arrest for whatever crime and the suspect would say, i don't want to be arrested. should the police officer walk away? what impact would that have on society in general? officers are, once they place a suspect anderson rest, they are going to go through with the arrest. the quo with is is force going to be used in cases where force is not necessary. >> he said 11 times, "can't breathe." good to see you. there is more show. yeah, a wall of dust took over
