a long battle, conner? >> reporter: the intensity of last night's shelling and today is unlike we have seen in the last ten days or so. it was some of the heaviest shelling we have seen. much of gaza was alight between the fires that were raging and the lights that were pounding all over the gaza strip last night. even today hitting targets that they hit in the past including a the spot that hamas launched rockets right by our hotel. it was a huge hit a hundred or so meters away. it is a spot that israel targeted and hamas continues to fire are rockets. and we have seen that in the gaza strip. israel is pounding the gaza strip. and hamas firing rockets and mortars. there is more talk of a ceasefire but neither side

agreeing publicly. and last night as i said was heaviest shelling we have seen here. israeli planes and artillery hitting the manpower station here. power was on four hours a day at best. and taking this out will reduce the ability for pour in gaza. the house of the top hamas leader was struck and fighting up and down the coast for the last couple of hours. and the death toll is mounting. 1100 palestinians and 53 esrally soldiers and civilians as well. there is a fear it is escalating and israeli officials will move out the 40 percent of the gaza strip that they control and focused on the tunnels and we may see a escalation and may be a negotiation ploy on their part to get the best terms.

and we'll get to her numbers in a moment. thoughts of whether or not president obama should campaign for a democratic candidate is kind of interesting. obviously he's going to go out and raise money especially. but some democrats are going to suggest that he doesn't need to visit their state? >> you hit the nail on the head. he's doing a ton of fund-raising for the democratic committee all over the country this year, and yet, we haven't seen him showing up in the campaigns. and look, i don't think those numbers are unrelated. a small gap of democrats having a lead on republicans in the congressional polling, but democrats historically have a bigger gap when the republicans wen the seats. come election day, you expect the republicans to have a mid- term election that is good.

>> in his personal popularity polls, biggest drop in recent weeks were amongdemocrat. we don't have those to put on the screen for you. but if you look at the democrat nominee. asking who would you like to be your nominee 64 percent say hillary clinton. 12 percent said biden and then on down the list. elizabeth warren and cuomo and o o'mall o'malley. >> it is clintons if she wants it. >> we have seen that before in 2008. you have more unified democratic party behind her. and there is no barak obama- like that is capturing the imagination of democrat. her numbers are softer now.

it is 69 percent of the democratic party behind her and the other people are not rise nothing a way to suggest that there is a challenge to her right now. >> does that suggest buyer's remorse over the candidates that the democrats chose the last few times? >> there is polling that suggested that. i think there was a bloomberg news poll that basically showed a majority of the americans thought that the country would have been better off if hillary clinton won the presidency in 2008. it is easier to be the candidate people wish for when you are not governoring. there is a lot in the world that barak obama can't tamp down. certainly in the middle east and russia and ukraine. we haven't sewn a deescalation

of hostility there. it is tough to govern and bark bookkeeper obama's poll numbers reflect that. ninteresting that we could so another clinton bush campaign race, i guess you would say. although neither one of them said they are in it. but if the look at gop nominee presidential, the number one name is jeb bush. again neither he or hillary said they are running. and governor peri12%. and chris christie ten percent. and ted cruz a nine percent. and somebody is going to shake out and win the nomination, johnathon. >> this is a wide open republican field right now. the most interesting thing in the poll, a lot of upward movement for rick perry.

>> a man in court in new hampshire accused of kidnapping a teenage sxert 15 year old is inside of the courtroom to face him. her name is abgal hernandez who disappeared from home. and the man in question that we mentioned isna thannial kirby. who is charged with kidnapping. there is a lot of questions and the answers may come out in court. our legal panel is here. and one of the big questions in

the center of the case, we don't know the circumstances of her disappearance and we don't know the circumstances of her reappearance. like she just showed up at home. why does that matter? >> first of all, you got it right. her neighbor and mother, she just walked in the door and surprise. that is unusual. and highly unusual in a kidnapping case for someone to return. she said in one of her statements, thank you for your prayers everybody. otherwise i would not have been released. released is like i was held captive and not a run away. i was released and that is key to me in this case. >> we have a picture of abgal and her mother who are in court and try to get that. we understand that that is abgal sitting next to her mother. how typical is it that the

victim would be in court at this point. it is not unusual to have the victim there and everybody knows that the case is getting a lot of attention and there is dramatic affect. and there is a lot more information we need to know and having a press conference and what were the circumstances under which you were missing and when she came back. she wrote a letter to her mother and that it will be important. >> we don't know who it is from. it was delivered to her mother a month after the kidnapping. we are not raising and blaming the victim in this, but there are questions of what exactly transpired here. police look at this shipping container on this man's property. so in order to arrest this guy they had to have something. above the grouped container and

there is crime tape all around the container and that is the right point. and her testimony by itself and even the letter written while in captivity, none of that was problemicable cause as he was arrested for kidnapping. but physical evidence like this. the cops went in the container and saw dna and that would be problemicable cause for the arrest. >> what happens if no one saw her grabbed and no one knows the circumstances and it turned in to a he said, she said court case with kidnapping? >> another legal issue would be of course, breaking down her testimony and given her age and if it is a straight one-on-one, it could be tricky. it is interesting. a lot of times, i know this as a problemable prosecutor.

they get up at 3 o'clock and sleep deprivation can affect the brap storing information and processes memories. it is no surprise as the found, when people try to recover or recall memories that either they are trying to recall following a period of sleep deprivation, there could be inaccrazies in it. >> dr. ash. we know that eyewitness testimony is unreloyable anyway. 70 percent of over turned convictions with dna evidence there was unreliable eyewitness testimony. how do you know if it is sleep related or bad memories. >> it is fascinating. and sleep does impair your memory, you will start to see defense lawyers asking witnesses, how much sleep did

you get and bring in question the credibility of that witness. it is a study out of stanford, critical thing for memory is sleep conti nuity. can you imagine a defense lawyer asking a witness do you snore? you are out of here if you do. >> and part of the research they were able to insert false memories in people's minds based on the evidence they were trying to get people to remember. >> that is right. memories that were manipulated and they thought they saw this information in the original crime photos they saw. it is a problem. the cvc in 2014 said insufficient sleep is a public health epidemic and 30 percent of the americans get less than six hours of sleep.

and so imagine 30 percent of the witnesses are impaired thachl is a big number. >> it happen before dr. russell, that lack of sleep figured in the trial. the jet blue pilot who went running down the aisle yelling terrorism and he was acquitted but one of the factors that he had not had a lot of sleep. the court and judge said got to let him go. >> that's right, john. sleep deprivation gets severe enough it produces delusions and si cosis and to build on what dr. ash said. i think it is particularly scary in the courtroom context with memories that were formed in sleep deprivation. in this case, even if the weapons is well rested in the time they are trying to recall

with their own health care, what are they supposed to do? >> they are supposed to rely on the president of the united states. there is a legislative branch and if i could fire the va folks, they would be fired out of work today. but the acting secretary just came to the job on friday. and the other secretary was loyed. to >> i apologize. we can have more on the conversation. >> i hope we do. >> and then that is florida jeb and in the center of the bipartisan deal. what broke the impasse and got you to the point where there is a bipartisan report. >> we continue to negotiate. people who said the deal dead last week was misinformed. both of the conference committees knew we were up against a dead line.

and it was important to vote before we went home. >> dr. sam foot commented and he was positive about it and said they need to implement things to help today, tomorrow, and right now. not pie in the sky and years down the road. what would be the immediate affect if you were able to get through the house. what would impact veterans based on this bill? >> once the president signs it, the secretary would have the ability to fire people who are fudging the numbers and lying and cheating or stealing and changing the culture in the va would take a long time. being able to contract out to private care providers it will a leviate the wait list that is out there. they had an ability to do it before. but there was no incentive to go to private care because they

would lose bonus or promotion if they did. >> what incent vising them? they got bon us. is there something to hold them accountable to provide basic good care for veterans? >> first of all that is what people should do. and the secretary will have the ability to fire people not doing their job. it was in the senior level and people supervising and it will send a signal in the va, you will not do business as usual combchlt accountability and access is two paramount things in this legislation. being able to have a veteran make the choice of whether to stay inside of the va system or go to private care, is the largest change in the va system in the entire history. >> that is getting a lot of

attention. some are questioning the ultimate cost of it down the long. one senator wants to wait for the congressional budget office to give a projection of what the bill costs. what is your reaction? >> i appreciate his concern for fiscal responsibility and i share the same concerns and the cvo is very slow. and we know they have scored the main part of the bill and we have scaled it back wards. and so when we look at numbers that we estimate will cost over ten years, it will probably come in just under 10 billion in mandatory spending. no body wanted to go that route, but we have to get the veterans off of the list. >> there is emergency funding, that is part of the bill to go directly to providing for more doctors and hopefully get to veterans right away.

and the other part of the bill, 10 billion that you mentioned that has to be allocated in the proper ways that appropriations can allot that money. is there anything in the bill that makes sure it will go to the va and not that there is another crisis that emerges and money is better used elsewhere? >> no, first of all, $10 billion doesn't have to go through the appropriation's process. it is not subject to the cap or going through regular order. however, it is a three- year program and if we run out of the $10 billion. we'll have to go back to the appropriators and they will go to the process and cost additional 25 billion to do this over the second year. we don't believe that is the case. we believe that 10 billion will carry over.

we'll go back to the appropriators and the program is authorized and we'll look for funding in the program. >> i know we only have 30 seconds here. can you tell get it through not only the house but also the senate? >> we'll see a vote in the house tomorrow. i fully expect it will be a wide bipartisan vote and the senate, i'm hopeful, that folks will allow it to come up for a vote. those that oppose it can vote against it. those that support it should vote for it. obviously get it to the president. this is important. >> congressman miller, great to have you back on the program. thank you so much. israeli forces digging in against hamas seeking out a network of underground tunnels used by militants for supplies and sneak attacks. also, one of america's national treasures under attack by wildfires. how far mother nature could make a difference in this battle. >> we still have tremendous fire activity within the fire and depending on whether winds --

>> a thunderstorm is expected tonight which could bring rain. bad news it could bring lightning and high winds making a bad situation worse. yosemite gets 4 million tourists a year, mostly in the summer, but many areas the tourists come to see are partially visible due to smoke. 5% contained. there's enough fuel to burn for days. >> certainly a difficult situation. one of the main mitigating factors is the drought. this is the third year of drought conditions. we only had a 30% snow pack last year. it was about a third of normal. this is after two years of only a 50% snow pack. >> reporter: also in the sierras, the sand fire is now 80% contained. the cause not lightning or a campfire but a vehicle driving over dry brush. it's exactly what started the fire earlier this month. prosecutors initially charged freddy smoke with illegally
