bit. taking a few days off. bill: bet you're sad about that. like fourth-grader in may. sky is blue. grass is green. you want to be out there. martha: have a great day, everybody. see you later. jon: word that the white house plans to take major actions on immigration without approval from congress. good morning to you, i'm jon scott. >> i'm arthel neville, in for jenna lee today. reports that president obama is considering dramatically scaling back deportations as well as granting work permits to potentially millions of illegal immigrants now living here in the u.s. jon: the president expected to make a move in the form of an executive order. he is already warned he will act on his own because of congressional inaction as he puts it on immigration legislation. all this reportedly set to happen after labor day and ahead of the midterm elections.

and it could set off a political firestorm. joining us ron fournier, senior political columnist and editorial political directonal " what is the idea here? the president would potentially issue millions of work permits already in the country illegally? >> yeah. i think it's a very good possibility, up to half of 11, 12 million people living in the shadows will get work permits and safe haven by stroke of the president's pen. jon: what is that, is it legal first of all? >> you know, my guess, first i'm not a lawyer. i barely got out of college. my guess is, it will be challenged and it will be up to the courts to decide whether or not it is legal. the executive branch has a lot more authority than we often realize as layman. he is not the first president to use executive authority. he is pushing the boundaries. much more than any president in modern history except for maybe president bush. it will be interesting to see if

the courts push back. jon: there are, ronald reagan worked with democrats in congress to reform the immigration system back in the 1980s. >> right. jon: this president has said, congress just, i can't work with them. i'm going to go my own way. why not sit down and try to come up with some kind of a compromise? >> well that's a good question. look, we've got bad actors all around here. the far right-wing of the republican party doesn't want to have anything to do with bringing these people out of the shadows and making america the melting pot it has always been while securing our borders. they just won't listen to anything. the far left, based in the oval office, really either doesn't have the ability, talking about the president, either doesn't have the ability or willingness or both to reach across party lines and find a way to compromise with republicans, to help republicans find a way to get themselves out of a

long-term political hole f republicans don't get in front of this issue, really soon, we might not have a republican president again in our lifetimes. the demography is stacked against the republican party. we have a republican party for a lot of reasons unwilling to bend and a democratic part unwilling or unable to try to help them figure a way to bend. at the end of the day this will be the president's legacy. at end of the day we'll have very, very polarized electorate out of this. i think this could spiral in some ugly ways when the president does something that is this, despised by half of the electorate. it could really take what is already a gridlock and polarized country and make it even more so. jon: yeah, because i mean, we didn't elect a king. we have a congress for a reason and -- >> we didn't elect a king but we elected congress that isn't getting the job done. so we have a president, who in my opinion isn't doing his job

very well. we zoo have a congress who in my opinion isn't doing its job very well and, except for folks on the right who are pretty embedded and folks on the left who are pretty embedded, rest of the country, still majority of the country saying come on, guys, get your act together. we need to have reform here. we can't have 12 million people live negotiate shadows. we need these people to be part of our society. we need to secure our borders. why don't you idiots there in washington get something done? jon: the lawsuit they're talking about in congress, talking about filing against the president, that involves health care and their belief he can't just, willy-nilly suspend the more onerous requirements of his own signature law until after the election. >> i'm sorry. jon: go ahead. >> it is a stunt. it's a stunt. president bush willy-nilly wrote amendments to bills. they were called signing statements but executive branch writingments to bills without them going back to capitol hill. jon: presidents done that too.

>> other presidents have done generally what president obama has done here. i think, the, what, speaker boehner is doing is a political stunt trying to hold off the clamor on the far right for impeachment. i can understand why he is doing that. legally it will not have much merit. what is more likely to happen is challenge coming from the private sector like we saw with the hobby lobby decision much the hobby lobby decision did put a brake on the president's use of executive authority. said, no you have gone too far but it came not from one party creating a extra constitutional fight. it came from the private sector. probably what has to happen here as well. jon: as you point out, this is a president swept into office in large part based on his promise to change the culture of washington. >> not in large part. that is why he was swept into office. the fundamental promise of his presidency, to reach across party lines and, change culture of washington is a lie.

has not happened. he has broken that promise. now he can blame the republicans quite a bit, fairly so. he can blame structural problems with our democracy right now quite a bit but at end of the day he is the one who looked at the country, look the at state of washington looked at is skills, said you know what? i can fix it and he hasn't. jon: but if this, well if this issuing of work permits for millions of illegals, if, if he does that, i mean it is pretty hard for a court to undo it. pretty hard for a court, even if a court were to rule it was somehow illegal, it is pretty hard to run around to those six million people or whatever and take those work permits back, isn't it? >> right. my point is, even if you agree with the idea that this has to be done somehow, that we do have to do something with these folks who are living in the shadows right now, that we can't deport them and they won't self-deport,

this is not the way of doing it. having one branch government impose it on one another and broader, having one part of the electorate, tell one part. electorate, we don't care. we'll do it anyhow. that is not healthy for democracy. at end one day we have one speaker of the house and we have one president and they haven't gotten it done. the president will take this step and divide us even further. it worries me. really worries me. jon: again i remember, when the reagan administration immigration reform was going to fix this problem once and for all. here we are again, a little less than 30 years later. >> problems never get fixed once and for all. reagan administration, congress at the time took care of the problem for a while. you know what? it is our generation's time, this political generation. those folks are gone out of washington. they have to fix this. they have to address it. instead both parties are interested in prove being the other party is a little bit worse than they are. that is no way to run a circus.

she top stopped for gas with the taping more than half full. her mother texted her at 6:22 p.m. that night. 13 minutes later her phone stopped working. jennifer and her husband kallen are a week away celebrating 10-year anniversary. he has taken and passed a polygraph test this week. he said jennifer was stressed out coming home from work but did have a headache for three days but wasn't severe enough to earn warrant a doctor's appointment. many in the community have been helping search for jennifer. >> we're all reaching out trying to do the best we can. i know i have driven many roads looking and searching after work and sharing facebook and just trying to get the word out there. >> reporter: police have searched several places huston likes to go, a state park, wildlife he have are fueling but nothing. they have gotten more than 200 tips of sightings as far away as

michigan but none confirmed. instead of scaling back they called in the am hill sheriff's department to lend a hand. arthel? jenna: dan, thank you very much for the update. jon? jon: israel hours ago declaring a new temporary cease-fire still in effect right now but a spokesman for hamas dismiss it saying it has no value because it excludes some border areas. all this comes after israel dropped leaflets warning gaza residents of a new phase in the coming military operation and it is all on the heels of some of the heaviest filing to date in that nearly month-long conflict. john huddy live on the israel fast is a border. -- israel-gaza border. >> reporter: jon, i can tell what you we're hearing and seeing on ground. we're hearing artillery fire and machine gunfire in the distance. we also heard several large explosions in gaza. in fact i think you can see it. smoke continues to rise in gaza, this as israel continues its

operation. a main goal of rooting out and destroying hamas's network of cross-border tunnels, cease-fire or not. we got to see one of those tunnels earlier today. take a look. going into the tunnel right now. you can see, it is very deep underground here and it is pretty tight, the entrance here getting in. very tight right here but it starts to open up, as we continue to go deeper into it. the israeli military says, that the tunnel is about mile 1/2 long. it was discovered at its midway, point, a quarter mile inside of israel from the gaza bothered. it is 50 feet underground. we found it opened up more as we went deeper in. little more clearance and walls are really thick, very well-reinforced. this is for, this was used for electricity. let me show you this down here. it was used for the transport of

near the weakage. president obama plans to join european countries to hit the country with sanctions on banking and energy industries. we have a congressman from south dakota, member of the house armed services committee. what is the mood in congress, congresswoman, regarding president's new round of sanctions. >> i think everybody was glad to see the president take decisive action. we really believe with europe's cooperation on these sanctions it will have big impact on russia and maybe slow them down in tear aggressiveness on this issue. jon: is it enough to make vladmir putin back down? >> putin is interesting individual and potentially not. i do see some businessmen in his country, the economy, people tied close to that are weighing in. as they see money withdrawn out of their country and impact on local economy, they will realize this was not a good mood and recognize these sanctions are considering impact and need to

slow down the help to the separatists. jon: what about prospect of offering more military hardware, not necessarily weaponry but radar jamming capability and that kind of thing to the ukrainian government? >> well the ukranian government hasn't necessarily requested or need lethal force yet but they need help which we have secured through long-term loan guaranties, other things to prop up their bought during this insurgency they have seen happen in their country. you know when we look at other equipment they may need, if those requests are made, we're certainly willing to help much we want to make sure that the ukrainian army is having some success. i see they're taking action to block off some support russia has been providing to separatists. we encourage that. we hope they continue to do that. meantime we ask that these impacts on russia be significant enough it getting them to think twice about the actions they have taken so far. jon: ukraine is a long way from south dakota. what do you tell your constituents about why we need to be concerned about what is going on there? >> the people in south dakota

are very motivated by our national security. we have a high service rate in the state. we're home to an air force base. they recognize that national security need to be our number one priority and number one priority of the federal government. so they understand this is serious. they don't want to return to a cold war situation or, they see the unrest that is happening all across the world and are very concerned. so they recognize the united states has athey would like to e much more aggressive on energy policy. one of the reasons russia has so much influence over that region because they supply the natural gas supply. that is something the united states could do something about. if our president went out there and took up hr 6, which the house passed which expedites our natural gas exploration and permitting processes, we could soon in a year or two, be providers to step in and take away russia's market we have. that would be dramatically impactful on russia. they would recognize our actions will really hurt them economically into the future. jon: i want to turn your

attention to one of the big domestic issues, the immigration situation on the russian border. the house will apparently take up the $659 million measure that would help stem flood of illegal immigrant children coming across the border. senate majority leader harry reid says go ahead and pass that. he wants to attach some other items to the bill and turn it into comprehensive immigration reform. what do you think about what is going to happen here? >> well harry is playing politics. we want to fix the problem. we recognize that we need to have reforms to some of our policies that make sure that these countries get the message they can't send their children to live illegal lifetime in the united states. we want to take care of them and expedite the process and make sure they can be reunited with their families back hope. harry wants to kill our bill because politically that works for him in this election cycle. american people are tired of it. we recognize that the house is doing the work. we're hopeful that we get the by passed which looks very optimistic and harry will

congress to cover exports to europe and third one that jumped out to me, increase u.s. banking sanctions on russian businessmen close to putin including personal property as well. talk to me about that. >> there are certain things the european union countries and united states congress can do to help alleviate the pressure on france. it is clearly going to be a huge economic bro to france to cancel these warships, no question about it. arthel: right. >> but we can help alleviate that. there are things we can do within our trade relationships and other european countries can do to help minimize that impact. let's help the french make the right decision. there is another thing we need to do. u.s. congress needs to act immediately to change the laws so that our gas companies here, can start competing in europe. the fact of the matter is it will take a long time. that is not a short-term solution. that is long-term solution. arthel: you have to start at some point. >> got to start. change the laws immediately. one thing sanctions yesterday

arthel: a fox business alert n now. fewer people are going after the american dream according to the commerce department. home ownership in the u.s. fell again in the second quarter to the lowest level in nearly 20 years. let's bring in lauren simonetti be at what is driving this? reporter: we're looking at the lowest rate since 1995, not even 65% of americans own a home. that number peaked a decade ago at 70% during the housing boom. the concern is the current level could fall even further.

jon: a new snapshot of the overall financial health today according to the u.s. commerce department the economy grew at a strong 4% annual rate in the second quarter of this year after a sharp contraction caused by winter be at the strongest pace in a decade, much higher than previous estimates. let's bring the chief economics correspondent for the "wall street journal." a fox news contributor. three surprised at that number, john? >> little higher than what the consensus was but it is important to look through the quarterly changes which can be . a big increase in the second quarter, that overstated what is happening. if you look at the change from a year ago, 2.4%. an economy growing modestly stumbling earlier in the year and getting back on track. jon: what about the turmoil overseas?

you have the shootdown of an airliner in ukraine, battling between russia and ukrainians, why is that not taking more of a toll in the market? >> not only is the u.s. economy getting past that, but the stock market all over the world's way of this year not only in the u.s., but in asia, double-digit gains in india and pakistan. the u.s. economy is still the growth engine of the world, eight times larger than russia and if the u.s. economy is picking up momentum of consumers feeling a little more confident and spending money, that is where they are placing their bet right now on the american economy and american consumer. jon: it was that the previous quarter was so bad because the bad winter weather is so much of the united states, if that put a damper on economic activity when

the weather warmed up, people bought a bunch of stuff. >> i think that helps, here in washington it is beautiful in the 60s and 70s, so did things really feel that bad in the first quarter? i don't think so, they were a little more stable than the numbers suggest which means 4% numbers you're going to see blair did headlines tomorrow aren't quite as strong as they suggest either. jon: we still have an unemployment problem. much higher than people thought it would be this long after the end of the recession. >> that is why it is so important to look forward a couple of days, the labor department will be putting out new numbers for july. the unemployment rate has been behaving a weird way coming down

a lot faster than people expected given how modest the pace of growth is. we will have to see if that keeps coming down. it is still higher than it is intended to be over the long run, but that is also improving little bit. the economy is taking a very long time but it looks like it is gradually getting back on its feet again. jon: u.s. economy eight times the size of russia. if we want to use economic leverage to take him on, we have the means to do it. >> the problem we have is europe is so exposed to russia. europe depends on natural gas from russia and the european economy is very fragile, it is not growing very quickly and because of that the europeans have been reluctant to antagonize put into much because they are afraid he is going to shut off the natural gas
