please always remember the spin stops here. we're definitely looking out for you. breaking tonight, the irs claimed under oath that it's targeting of conservatives was never politically motivated. but tonight we have learned that the woman at the heart of the scandal, well, we now know what she really thinks about republicans. turns out lois lerner was very frank in her just-produced personal e-mails which we now have. welcome to "the kelly file" everyone. i'm megyn kelly. earlier today the house ways and means committee released an eye opening string of e-mails from lois lerner. e-mails lawmakers believe show her dislike of conservatives. we do not know who was on the other end of these e-mails because that information has

been redakted. but the lengthy back and forth took place days after president obama's re-election in 2012 and gives us new insight into ms. lerner's mindset. at one point the person on the other end writes to ms. lerner saying "well, you should hear the whacko wing of the gop. the right wing radio shows are scary to listen to." to this lerner responds, if we are through it's because there are many blank holes. jim jordan, republican and member of the house judiciary and oversight committees and just took part in the hearing in congress today. congressman, thank you for being here today. she goes onto call gop radio hosts crazies who will "take us down" and refers to them as blank holes as i pointed out.

let me just before i get you to respond take you back to then acting irs commissioner steven miller in 2013 and what he had to say about what was and was not at play in the irs's targeting. >> the concept of political motivation here i did not agree with that in may, i do not agree with that now. we were not politically motivated in targeting conservative groups. >> your thoughts. >> it's just flat out wrong. the score card is 104-7. 104 conservative tea party groups were targeted, sometimes for years harassed. seven progressive groups were put on a list. all of them received their status. so the score card is 104-7 and most weren't and some had to wait years. then we have the e-mail that you referenced, megyn. from lois lerner who's in an agency that's supposed to be nonpartisan, not bipartisan,

nonpartisan, and she calls conservatives crazies, terrorists, whackos and obscene names. >> yes. >> every day in this investigation we learn something new. when we depose people, we learn something that contradicts commissioner koskinen's testimony. again, we just keep digging and every day we find out something new that adds to the case of why we need a special prosecutor, why we need eric holder to agree with every single republican in the house of representatives and more importantly 26 democrats who voted for a special prosecutor why we need a special prosecutor. >> the evidence about lois lerner's partisanship continues to mount. now, we know that she was coordinating with the department of justice trying to help them with respect to potential criminal charges against regular american groups that were right leaning based on what she thought was too much political activity. and then we also found out a couple of years ago, this is happened to be a month before i

gave birth to my son, so just keep that in mind when you see this clip. but a man named al salvi out of the state of illinois who had run for the senate seat now held by dick durbin, who is a democrat, salvi did not win this race. democrat dick durbin did. he talked to me about how when he was running she, lois lerner, was heading up the federal election commission. and went after him full bore on charges that were never substantiated and repeatedly thrown out. when she finally gave up because she couldn't make the case, she tried to extract a promise from him. listen to what he said. >> she asked mef politics for the rest of my life. i asked her, lois, would you put that in writing, and she said no. >> my team edited out the very pregnant me, which is very nice. congressman jordan, let me ask you if we now have proof

positive that this woman is a partisan, that she did have ill motivations at heart whether they in fact motivated her behavior, we can only surmise, but wouldn't it be nice to have somebody look into it? >> yeah. exactly. and the evidence keeps pointing in that direction. what we do know, megyn, and you referenced it is that lois lerner was working with the justice department in 2010 and gave them 21 disks of information about c4 organizations, some of that, a small bit of that, had confidential donor information. but the irs gave that to the justice department, the fbi had that file for four years. and then you get the testimony that you got from mr. salvi. it all points to this was -- and maybe and this is why we're looking into it, some coordinated effort to go after people, again, exercising your most fundamental right, your right to speak out in a political fashion in a political nature against your government. and that was targeted by this administration. >> you know what's really crazy

about the al salvi case, she goes after him, loses, tries to extract a promise that he'd never run for office again. then dick durbin wins on the seat and he turns around saying we need to crack down on these con zefbtive groups and lois lerner was only too happy to respond. congressman, i've got to go. thank you for being here. >> thank you. breaking tonight on the battle between israel and hamas. the white house has now joined the united nations and countries around the world condemning a rocket attack that hit a u.n.-run school in gaza earlier today. at least 16 people were killed including innocent children. a white house spokesperson today saying "israel needs to do more to live up to its own standard to limit civilian casualties." national spokesperson for muslim community usa and author of demystifying islam, tackling the tough questions.

and bridgette gabrielle experienced being used as a human shield herself by the palestinian liberation organization when she was a child living in lebanon. we begin first with harris. harris, thank you for being here. i want to ask you, obviously this is a terrible attack on this school and now the u.n. has said israel is responsible although israel says it's still investigating. the truth is, however, that they have found hamas' rockets in at least three u.n. schools. and so israel is turning around and saying we're investigating, but even if this was an inadvertent hit on a school, hamas has only itself to blame. >> well, megyn, just another example of unfortunately a growing list of reckless attacks on civilians. hundreds of whom are women and children, then we need to collectively say that we need to re-evaluate the strategy. beyond the blame game, the rhetoric of the blame game, lies

something a lot more precious, human life, dignity, self-respect. if we keep doing the same thing every few years and hope that it will have a different result at a different time, that's a textbook definition of insanity. so that's why we are instead of getting involved in the blame game as muslims who believe in messiah, what we're calling towards is peace, stop this violence, come together to a dialogue. that's the only way we're going to come -- >> but if they back off now, if they allow this what they view as a propaganda war by hamas, to win, it's only going to encourage them a group that does use civilians as human shields to do more of that. >> well, both sides, megyn, justify their actions with arguably the same type of rhetoric and same type of credibility. >> israel does not use civilians as human shields. >> well, let's be perfectly clear here. give me the opportunity to be perfectly clear. the hamas rockets need to stop immediately. i absolutely condemn the rockets that are being sent.

but to think that this is a conflict with hamas is to think this is a 27-year conflict which is a juvenile view of the situation. this is a conflict that's been going on for 65 years. >> but speak to the human shields because, i mean, we have video of hamas using children as human shields. there's no question that they do it. and so how are we as americans supposed to look at these -- look, here it is. supposed to look at these situations and say, oh, it's all israel as oppose today hamas putting these children in harm's way? >> well, fortunately the two of us are talking right now and neither of us are saying it's all hamas or all israel. we take a lot more adult mature view of this. hamas using women and children as human shields, condemnable, reprehensible acts. but to think that the 1,400 palestinians that have been killed, you can claim all of those are die to human shields. we know that's not true. the u.n. school if it's proven to be true, the four boys on the

beach, we have plenty of incidents to know that there are innocent women, innocent children being killed, being massacred not because of any human shield but because this view that we need to win this offensive. and that's simply not going to be the case. and that's not the way to resolve this issue. we're calling for a solution to bring -- >> harris, thank you. joining me now for the other side. author of "new york times" best seller "because they hate." thank you for being here. so your response to harris as a person who was actually used when you were a child as a human shield by the palestinians, your thoughts? >> the palestinians have perfected using children to win the world's sympathy. and this goes back 30 years. i as a child between 1975 and 1976 was used as a human shield in my bomb shelter. we were nine children hiding in a bomb shelter. my mother went out and begged the palestinian leader who used

to park their rocket launchers in front of our home, launch at israel fully knowing that when israel retaliates we're going to make the evening news. and they would move their rocket launcher from home to home, fire one rocket in front of each home and move away. when israel retaliated, actually it hit one of my neighbors' home and the mother was wounded along with the two children. and guess what was on lebanese children that night? people wounded because of israel. and lebanon television was saying look how horrible the israelis are. they are killing children. the palestinians have perfected the propaganda war. they cannot win militarily against israel, so what they do is they use their own children as disposable collateral in order to win the war of public opinion against israel. >> you know, tonight they are taking heat, israel is, because the u.n. claims it gave israel 17 times the coordinates of this school that was hit. and the suggestion seems to be israel has gotten reckless with civilian lives in gaza. your thoughts on it.

>> israel is always careful with civilian lives. israel goes out of its way. what other country drops leaflets by the thousands warning civilians to leave because they're going to bomb in 48 hours? what other nation gives such notice? they do it in lebanon, they do it with hezbollah and lebanon during the war. they do it with hamas and gaza. if the civilians do not leave, we need to ask why. why are the civilians are not leaving fully knowing that within 48 hours their homes are going to be bombed? let's also not forget, megyn, that of all the rockets hamas launched at israel, over 100 rockets fell short into gaza fired by hamas. so all the casualties that hamas is talking about are not exactly israeli casualties or because of israel. it's because the palestinians do not value the lives of their children. and they are willing to sacrifice their children in the cause of jihad. >> i should point out that israel does question some of these numbers in terms of the

report tonight. trace. >> megyn, the conversation reportedly lasted 35 minutes starting with pleasantries and then getting very tense with president obama telling the prime minister, "i demand that israel agrees to an immediate unilateral cease-fire and ends all attacks, especially air strikes." obama goes onto say that in return he believes hamas will stop firing rockets. when netanyahu points out that hamas has violated all five previous cease-fires, the president simply repeats his demand. then mr. obama reportedly tells the prime minister that turkey and qatar would broker a deal with hamas for a permanent cease-fire. a stunned netanyahu then replies "qatar and turkey are the biggest supporters of hamas, it's impossible to rely on them to be fair mediators," to which the president replies israel is not in the position to choose mediators. both washington and israel say the transcript is fake with the state department taking it a

step further. listen. >> i know you don't want to talk about the alleged transcript, but -- >> i'll talk about it. because it's complete crap. >> complete crap? >> technical term there. >> critics also say the transcript reads like robots are talking and not heads of state. but israeli reporter orrin najari stands by the story saying he got the transcript from a senior american official. he's the editor of channel 1's foreign desk. he's an award winning journalist, author, and said to be a walking encyclopedia of jewish history. we looked into his background and couldn't find any cases of shot shotty journalism. >> wow, thank you. joining me now colonel north, what do you make of it? >> megyn, given what we know of the way obama has talked to netanyahu in the past, it's certainly likely this is a transcript. it's interestingly enough the

source -- if it's a u.s. government source, and i believe it probably is if that's what he claims, appears to be a person in the u.s. government who is emp thetic if not sympathetic to israel. >> uh-huh. >> because the transcript clearly showed the obama administration to be just as feckless as we know it really is. look, the person who provided this transcript either asked for or was offered the generic cover of a u.s. government source. i doubt the reporter or his news outlet would agree to lie about that. the u.s. government source however isn't completely safe. i have some experience with that. back in the 1980s i was on the nfc staff and was sent to give a background brief, a tick tock as we call it, minute by minute, on how we managed to capture the hijackers -- the white house and the magazine agreed i was to be described as a senior u.s. government official. in the piece that's how it was expressed. and that was why i was sent by the national security advisor.

well, in the aftermath of the u.n. -- becoming public in november of 1986, "newsweek" announced i was the source of the story and described me as a leaker. thankfully i had the e-mail from my boss, the national security advisor, telling me to talk to "newsweek." so much for the integrity of the so-called mainstream media. i don't think a reputable -- >> you weren't exactly a leaker. what do you make of the content of the exchange, if it is not a fake as the administration claims? that the president expects israel to stop all of its military activities unilaterally? that he wants turkey and qatar to broker this deal? and netanyahu is saying they are big supporters of hamas, they can't be fair mediators and the president saying you're not in the position to choose the mediators? >> i'll tell you, absolutely dead on except one thing. it tells me by the way it's

probably spontaneous. i mean, it's not a robot talking on either end. what obama has obviously chosen to do is to take not only the side of -- which is alfani kykuzdcyky?ñsqis what would happen... if energy could come from anything? or if power could go anywhere?

james amos makes serious and heartbreaking allegations, that the marine corps leadership was never serious about investigating the death of lance corporal greg buckly jr., never serious about briefing the families and issued a kallating press lease of the verdicts so the "marine corps could get in front of the story with its own self-serving account issued late friday afternoon to minimize press attention and to prevent the buckley family from responding". >> that is a classic public relations spin move at the expense of gold star families. and it's an outrage. >> at the heart of that case is an afghan police chief who allegedly molested the shooter as a child. a warning about the police chief and his victims was sent by a reserve officer and new york city fireman jason resler. his warning was ignored, but the marine corps went after him for holding classified information and for sending the warning from his personal e-mail account. a spokesman for the come daunt

tonight they voted to go ahead with their lawsuit. it comes after we have heard lots of democrats recently talking up the prospect of actually seeing the president impeached by the republican party. at the same time the white house is getting some folks all riled up with reports of dramatic executive action on the millions of illegal immigrants living in the states. could it be they're trying to actually get the impeachment train rolling? why would a sitting democratic president want to get the impeachment train rolling? chris stirewalt, our fox news digital poll editor, why? >> well, they're about to lose the senate. they would not like to lose the united states senate. it would make the president's last two years in office so uncomfortable if he had to be vetoing stuff instead of just rubber horse head stuff and the going out and the photo op stuff. if he had to actually sit at his desk and veto about a billion bills that the house and senate would pass and send to him, he would not like that. so if he can frighten enough

democrats to give enough money, if he can create enough of a sense of urgency that something really bad could happen beyond just him having to vee to all that stuff, then they might be able to hold onto it and limit the republican gains. >> we should tell the viewers that this democratic push saying they're going to impeach him is working. they pulled in $2 million just over the past weekend by these blast e-mail alerts saying impeachment. but the question is, i mean, boehner came out today and said we're not dpoing to impeach him. so just stop that. however, what's true today may not be true tomorrow. and there's a report over the weekend from the associated press suggesting the president may be getting ready to use an executive action to basically give amnesty or some sort of massive provision for up to 5 million illegal immigrants in this country. and what would that do? >> do you remember the trillion-dollar coin? do you remember that during the government shutdown? the 14th amendment. >> that was going to pay off our

debt, right? mint it and pay off our debt. >> mint it and have the coin struck and he would not need a debt increase because he would just have an extra trillion dollars. and so it's cool. the left was pushing the president hard to just absolutely circumvent congress and go it alone and do that. it made republicans crazy. the president's under similar pressures from the left especially from immigration activists right now to go, go, go and do it big. there's appeal there for the super cynical set that says what if we troll the republicans into actually impeaching, not just suing but actually impeaching because it can't go anywhere because it needs two-thirds vote in the senate. what if they could get the republicans to actually impeach and then obama could do only what bill clinton has done which is under the threat of impeachment in 1998 managed to actually gain seats. he's the only president in recent memory in his second term who has actually done that. the president would like to replicate that and needs some republican help. >> so it allows him to sort of play the victim. >> oh, yeah.

>> poor me. and you sort of heard that in the sound bite we bumped in with, stop hating, don't hate all the time, republicans. which is like how do you go out there and antagonize the other side day after day after day and then they punch back at you and you say stop hating? both sides are very guilty of chiding the other along. but, you know, to come out and sort of pretend it's all the other side and he hasn't done anything to upset the gop is a little disingenuous. >> it is said haters got to hate. but i guess this is true. this is one of those times where politicians may actually do something consequential to really effect peoples lives and harm people. all of this spinning, all of this talking and pumping and gassing and on and on about impeach this and don't impeach that and people off the right raising money off impeachment, people on the left raising money off impeachment, we're going to end up in a constitutional crisis. it's going to be very unhappy for a lot of people. and all this cynical dret is going to wash up on the shores

of ordinary people who haven't done anything wrong and we're going to end up with a huge constitutional crisis. it's going to be a mess if people don't behave themselves. not a ton, just a little restraint. >> the hating will continue. chris, good to see you. >> you bet. >> joining us now with more is andy mccarthy, author of "faithless execution," building the political case for obama's impeachment. i want to get to the book and the controversy over the word impeachment and how people circle this back to you in a minute. but the notion that the president would come out, sort of get people -- the democrats would come out and get people, impeachment, that's crazy. impeachment, come on. and then drop a bomb like amnesty for 5 million illegal immigrants to set the republicans up to then say, now that's impeachable, but they've already laid the foundation for how crazy the notion of impeachment is. i mean, if that's what's actually happening here, pretty

sophisticated political strategy, is it not? >> it's way beyond the people who it's being attributed to. i don't think that that's at all what's going on. and if it is that calculation, i think it's a terrible calculation. why is it crazy to impeach president obama? because there's no chance of success in the senate because everybody knows that no matter how outrageously lawless the president conducts himself, the democrats will never impeach him. >> let me stop there. so the democrats are already trying to fund raise off of the i-word, right? and they use books like yours to say, see, look at the lunatic right wing fringe, which you are not, but they would have them believe. they want to impeach president obama. but here's a little fact check for you. that's not what your book argues. and they continue to use it to say, you see, explain. >> my book is about the fact that impeachment is a political remedy, not a legal one. and before you haul off and try

to impeach someone, you have to make the political case, which hasn't been done. and i actually argue that it would be a mistake to file articles of impeachment if you don't have public support and you don't have a prospect of success, or at least open mindedness about whether -- >> the gop would get hurt if it does that. >> right. >> but you do have figures like governor sarah palin calling for president obama's impeachment. there's no question that it's out there in some republican circles. >> it's true. and i try to knock down the argument in the book. and i actually, i think, palin's done a great job of cataloging obama's lawlessness going back to 2009, but she hasn't molded it into a kpcomprehensive case. you can't just convince people who agree with you. you have to actually convince a cross section of people. >> so if the president wants to go ahead, if he's confident he's not going to get impeached because of everything we've discussed, what do you think would happen if he granted amnesty for 5 million people? >> first of all, i don't think the republicans will do

anything. the bally hud lawsuit -- the news today. how come immigration's not in the lawsuit? i thought they were bringing a lawsuit because it was their duty to uphold the constitution? the thing they seem to have left out is immigration. why should anyone think that if he does something even more outrageous than what he's already done on immigration that that's suddenly going to move them. they are not going to impeach obama. i think they've been very clear on that. i don't think there's any prospect of it. but i think obama's making a big mistake if he thinks that this is good for him to talk about impeachment. because, again, the reason impeachment is crazy is because his guys will protect him. it's not that he hasn't done anything lawless, and the more there's talk about impeachment the more the focus is going to be that this isn't a manufactured claim. impeachment is in the air because the president does a lot of high crimes and misdemeanors. >> in other words, just gives people the opportunity to discuss the said lawlessness

position. four hours later they changed it, revising it to many u.s. lawmakers strongly back israel in gaza wars so somebody decided as well it sounded perhaps a little biassed as originally said your thoughts? >> well, there is a tweet referred to a news article that was planted as that. that news article could have been written by hamas, or ap press releases for hamas. it's indistinguishable and makes a mockery of journalism. whoever is writing the news stories for ap is on the side of hamas in this conflict it's like the washington post got caught with it's hand in the cookie jar for their reporter covering an anti-israel rally in washington then turning around writing editorials against israel for al jazeera. >> but they got rid of that

reporter as i understand it. >> yes. but this is what we're catching. this conflict of interest being that they have their personal biases at play here. hostility towards israel is not new, it's been going on for 25 years this, conflict going back to the late, great peter jennings and the plo in the 90s a one-sided coverage against the israeli position. it's only continuing today >> i want to ask you about nancy pelosi. >> by the way if these things are humanitarian, those are humanitarian bombs falling on israel. >> you're pulling that term from the house minority leader on her show over the weekend, on sunday but here is what is interesting. i want to ask you about how this ends nancy pelosi says something that is very eye opening right? i mean you can argue shocking.
