steve is enjoying a little time off. >> thanks for joining us this morning. we begin with a fox news alert. police in riot gear, they are not stopping protesters from continuing violent clashes in ferguson, missouri, more than a week after a cop fatally shot an unarmed black man. heather childers has been following this. what can you tell us this morning? >> good morning. the st. louis suburb looking for like a war zone overnight. look. police firing tear gas, smoke bombs, rubber bullets, all of that trying to disperse protesters. >> you in the front line up there? >> in the front line, yes, and they just start shooting. >> here's the thing. they are demanding answers -- the protesters -- after the death of 18-year-old michael brown. police are set to meet with brown's family later today for the first time. two reporters covering the protest, they were arrested

at a mcdonald's after a swat team swarmed in and told everyone to leave. they were told they were, quote, trespassing and were later released without being charged. the police officer who shot brown was injured in the incident and had to be treated in the hospital for swelling on the side of his face. his name has not been released and the decision to withhold the name from the public has only further tensions. missouri's governor has canceled everything on his schedule to make a visit to ferguson, we're told, later today. >> thank you for that. ferguson is breaking out into ultimate chaos as we see. as you look into the background of that area, there seems to be a long line of problem between the constituents of ferguson and law enforcement there. they did a study at the university of los angeles in california and say we have issues.

the police chief did something i think is relatively controversial. he said i am not releasing the name of the officer involved. >> we knew here in new york city right after the incident unfoldd with eric garner and the choke hold incident. >> we had the video. >> it was still mysterious. you couldn't see a face. he said i'm not giving out the name yet because there have been death threats. >> we heard from police chief thomas jackson. last night he spoke with sean hannity about that. >> we originally believed we had an obligation to release that information to the public and to the press, but what happened is another officer's name was released as being the officer involved in the shooting. he was not, but his picture was put up on the internet, his facebook page was hacked and death threats started coming in. that's when we weighed the benefit of releasing the information right now versus the safety to the officer, his family and his

neighbors and the rest of the police department. >> some of the other officers involved have been told take vacation, get out of town until this blows over basically. a lot of questions as to the violence unfolding there, people going into stores and looting stores. >> is that helping? >> al sharpton shows up. >> is that helping? >> he doesn't go to chicago to talk about the 26 people killed there but he shows up here and says stop the violence. one man goes on an epic rant, goes viral -- i don't know if you saw this -- basically telling his fellow men and women in that community stop it, we've got to make a change. watch this rant that is going viral. >> it is not helping. change is not going to come until we change it. and i hate to say this but i'm going to tell you what you need to hear as opposed to what you want to hear. all we know how to do is blame the police and white folks for our actions. all we know how to do is march and riot and loot.

i'm sick of it! i'm sick of it! i'm not going to tell you and tell you we're going to march, we're gone do this, we're gone do that. i'm gone to tell you damn it, let's change. >> you can hear the frustration. many would say about families and what's happening to inner city families, i was staggered to see this country. what about the dropout rate in the country? 11.2% overall. for african-american students, 28.2%. take this, 70% of african-americans who drop out of school will spend substantial time in prison. one is linked to the other is linked to the other. >> the sad thing is the boy was killed, michael brown, 18-year-old, just finished high school. he was set to start college this week. his mother was quoted as saying do you know how hard it was for me to stay in school and to graduate. do you know how many graduate? not many. now they're going to wonder

why they go through that and why they're living any way? they're going to try to take me out any way is there mind set. she was devastated beyond belief to give an indication to this mind set, now fueling many of the riots we are seeing. >> the president and department of justice getting involved pretty quickly in this. there was criticism before on the trayvon martin case on the left saying where's the president in this. they were slow, dragging that are feet on it. there was the acquittal of the george zimmerman trial. now the justice department saying they're doing a separate investigation in ferguson, separate from what the state and local police have to do. eric holder getting involved right now and a lot of people wondering as the summer unfolds, we pick up the newspapers, there is violence across the globe right now. where is the president's leadership as he is there in martha's vineyard. >> maybe to give reason behind the angst that many americans even outside of missouri are feeling right now. when asked about president

obama's job performance, he only has 35% approval on foreign policy. 43% right here. and we're going to go back among independents here and saying which better describes obama's presidency among independents? 49% think he does too much. and 36% said he does what it takes. sort of a split there. is he a dictator or is he a do-nothing president? the question there yet to be answered. maybe if you look at it domestically versus foreign policy, you know where that 35% approval rating fits. maybe we think he's not doing enough in foreign policy as a nation and doing too much domestically? >> let's go further down the fox news poll when it comes to the economy, in terms of approval, 43%, health care, 32%. disturbing news coming out about obamacare as it gets closer to november. when it comes to iraq who are the 52%, who are the 37% that approve? it's been an abysmal

failure. >> the economy is at the top of the list. >> 42% is great. >> foreign policy, 35%. immigration, 33%. on the heels of that, even the french foreign minister says hey, mr. president, you cannot go on vacation. come back to work. and that's a country that tells their people to take a vacation all summer. >> seven hours of the day they're eating baguettes and cheese and relaxing. the president in martha's vineyard enjoying ice cream cones and riding his bike. >> would you want to spend summer vacation with him? >> an interesting question. there is a poll would you rather spend your summer vacation with president obama and michelle obama or george and laura bush? i don't know what to say. i think of what they do on vacation. you know george bush when he goes on vacation, he goes to crawford and spends all day clearing brush in

100 degree heat and goes on his bike. that's not vacation. >> it's hard to catch up with him. >> those polled would rather spend their summer vacation with the bushes rather than the obamas. by 1% but still. what if the choices were the obamas or the clintons, who would you rather have summer vacation with? the clintons are taking the lead with 42%. over 25% that wanted to spend with michelle. >> regardless, we're not going to be able to. let's talk about yesterday. vernon jordan at a party. he got a call. hillary clinton knows she is going to be seeing the president at that party. she called ahead of time saying you're not really mad about that atlantic policy where i called you out on your foreign policy initiatives. we weren't patched into the call but they hugged it out together.

prior to arrival at the party former secretary of state clinton signed books and was asked this. >> great to be back in the vineyard. are you going to hug it out with the president? >> absolutely. yeah. we're looking forward to it. going to be there tonight. >> clearly she made huge news this week when she said when it comes to iran i'm dubious about anything coming out. when it comes to the israeli gaza con nict, the yilz have a right to protect themselves and blow up the tunnels. when it comes to syria i would have armed the rebels first. boom, boom, boom, she landed repeated blows. >> but they hung out last night and were in a cheerful mood. she called earlier in the week to apologize for those comments. steven hayes said she can't have it both ways. >> it looks opportunistic no matter what she does

now. what we heard from her representatives has been absurd. she comes out with and gives what i think is probably close to her real views on syria on a number of issues and she's critical of president obama, more critical than she's been in the past. then you have her spokesman come out and try to clean this up and patch it up where hillary clinton said basically don't do stupid stuff. it is not an organizing principle. her spokesman says it wasn't a reference to president obama. of course it was a reference to president obama. those were his words. who else would it be a reference to? >> this is 2008 all over again. obviously the whole feeling of them coming together, the families putting it aside, that was just the primary. that was icy relations put on hold. this is 2014. if she runs for president -- which it looks like she is -- do you realize how bad this is going to get especially if the president continues to stumble on foreign policy.

speaks out and asks the question, a, why was tony stewart the only person who didn't happen to see kevin ward on the track? and this. he said the one person who knows what happened that night is possibly facing ten years in prison. is he going to say what he has done? this as tony stewart has gone into hiding. >> we were shocked this weekend when the story unfolded on "fox & friends." we were surprised when hearing from bob dylnar, he was hearing from their camp at the time he was set to race the next day. he already went over -- >> tony stewart? >> tony stewart was going to race the following day after this crash. it seemed like the pressure mounted and mounted. he was focused on winning the championship. if he backed out of the race the chances of winning were slim. now we're not hearing from him. >> he might have legal issues. they continue to investigate. as we hear more and more from the family, it turns out according to the dad, kevin never got out of the

car before, never acted like that on the track before. they looked at the tape. the dad does believe that tony stewart did clip him high and clip him moo the wall. he does believe -- he did not see the actual accident. he was scrambling on a four-wheeler because he knew his son crashed. he was going to help get the car off the track. then his dad comes out to see his son stretched out and watched as they tried to revive his son, hopped on the plans and then they realized he was dead. the family found out that their brother, cousin, uncle, whoever died on facebook. >> kevin ward sr.'s wife was with him at the time. they did miss the actual collision. what devastating news. such a young age. a sport that involves such aggression and a huge fan base is now just back on its heels wondering what the next steps are in this case. we're going to look into the details of it coming up in the show. >> i don't think we can comment on it.

you can see the black smoke in the sky. thankfully no one was hurt. no word on what caused it. a maryland state trooper being hailed a hero after saving the life of a man about to jump off a 90-footbridge. the trooper spotted the man and quickly jumped into action on the way to the hospital. the man thanked the trooper. >> back to real life now. fox news alert comes to you. dramatic new video we're sharing with you showing children and refugees swarming a military helicopter trying to escape the isis militants on top of mount sinjar in iraq. it seems like a desperate situation; right? we're live in washington with what special forces say they are now seeing. it seems desperate. it seems like there are not enough choppers in the world to help all these people, but a different story this morning. >> exactly, brian. that's what's coming out

from this u.s. special forces assessment team that went to mount sinjar to try to figure out if an evacuation is necessary. if so, how to do it. they were only through for a few hours but came back saying there were far fewer people trapped and they were in far better condition than they thought. this is the first time we know of that a u.s. team is getting eyeballs on the situation there going on for awhile now. video from the mountain shows a dramatic scene of men, women and children attempting to survive on a rugged mountaintop after running for their hives from isis terrorists after they had been surrounded. but u.s. airstrikes and kurdish fighters have taken some of the pressure off. meantime u.s. humanitarian aid drops helped. as you guys have pointed out, there are not necessarily enough helicopters to get these folks off. critics of the administration say the response is still too little too late to deal with isis. >> we've got the best

equipped, best organized jihaddist group anywhere in the world right now pressing key areas of iraq and syria. this is much more than a humanitarian crisis. this is a serious security threat the u.s. needs to be concerned about. >> the united states is still walking a very fine line. the administration says that while there are u.s. military planes flying above, advisors on the ground and the latest assessment team flew into territory under attack by isis, the white house still insists that u.s. troops will not be in a combat role in iraq. >> do you have any idea what we're doing with the people we are able to save? the video we see shows a desperate situation. special forces says it is not nearly as desperate as they thought. we know this, all the people that have been moved are sitting in areas that don't even have temporary tents there. is there a plan? and whose responsibility is it to have a man for relocating these people? -- to have a plan for

relocating these people? >> it would be up to the united nations to deal with these folks. they said this is a level 3 emergency, the highest level they have. as you point out, a number of these refugees have been able to walk off the mountain themselves oftentimes under desperate situations to escape a couple of hundred miles to a number of refugee camps, some on the syrian border, others near irbil and iraq. at that point they're getting help, a little bit of food, a little bit of water, those kinds of things. as many folks have said it is an urgent and humanitarian crisis. >> thank you. those images looking anything but improved from the reports we are getting. it doesn't seem those two things line up. a chopper went down because too many people are begging to get on it and people are dying left and right. is this a humanitarian crisis or a security crisis we're dealing with? it doesn't soam as though -- i mean, getting

somebody who lives in the area. he says police here are angry and people here are angry and frustrated. there needs to be justice. if you find a single person in the community who trusts the police, that is like finding a four leaf clover. what do you do in a community where the feeling is like that? >> well, this is absolute nonsense. people do trust the police. there are many, many more instances of the police doing great things and not only the black community, but across the nation and you get an incident like this where we don't even know all the facts and everybody is automatically jumping to the conclusion that the police have done something wrong. i don't know whether that's the case or not. what i can tell you is i would ask the folks in black neighborhoods, would you rather the cops not be here or would you rather they be here to protect you? >> do you think it matters in terms of the police force staff being reflective of the community there, community where two-thirds of it is black right now as the numbers show, but only three officers are black.

does it matter how many officers actually look like the people in their community? >> it's a great point, elisabeth. i think there is 53 cops on the force here and three of them happen to be black. if you were to use that logic, you would think that there would be no black people in fergu is t type of a ratio. the fact of the matter is, if the police are here to protect you and they're doing a good job, who cares what color they are. but the bigger point there is a lot of the police who are black have left the ferguson police department for better and easier jobs. >> you also say the role models, you say it's too bad it's not clarence thomas and too bad it is snoop dogg. >> right. my point there is that we've got to a point in the black community where we're idolizing the wrong people. here again, here is a neighborhood that says kill the police.

overnight because it looks like a war zone in ferguson, missouri. unbelievable images there as police are out in riot gear trying to calm the crowds as they're taking to the streets, looting stores all in response to the killing of the unarmed teen-ager, michael brown. what should police be doing? there is some criticism this morning that they have not released the name of the police officer, of course, who was involved in the shooting. death threats being leveled. how would you handle it? >> i wouldn't let it get to this point. i say shame on the mayor. i heard 70% of that suburb is black, yet the police department is mainly white. the police chief is white. i'm not playing the race card, but i'm saying that city it appears to me, does not, or the police department does not reflect the make-up of that city. the mayor should have known that. apparently he didn't have his finger on the pulse of the community and understand that the tension was rising between his police department and the minority community. i think they ought to reconsider this decision not to release that officer's name. being a law enforcement officer

myself for 37 years and a law enforcement executive, i understand the concern of the safety of the officer and his family. put the family and the officer in protective custody. put a plant in his neighborhood to watch the home. and meet these folks halfway in terms of releasing the officer's name. when the officer is on duty -- i have my name on my shirt. the public has a right to know who its public officials are and actually we have a rule that you have to give your name when asked for. now all of a sudden the officer gets involved in a situation. i'm not judging the shooting 'cause i don't know the facts. but now all of a sudden he gets involved in a shooting situation and we're going to not release his name. i just think they ought to reconsider. meet them halfway. >> if his name is released, what changes? >> nothing really. that's why i said -- and i'm concerned about the officer's safety. >> nothing would change but the officer's safety, sheriff. >> put him in protective custody. put his family in protective custody.

give these folks down there on the ground some indication that you at least have a sense of their frustration and anger and you're willing to meet them halfway and willing to work with them. right now this line that's been drawn in the sand and things aren't going to get better. i don't think al sharpton showing up helped the situation. >> does it ever? >> no. he's a divisive figure. if he was an effective leader and he's in a position to do so, he should be able to calm for calm and it should happen. what's going on down there is totally unacceptable. i understand their frustration and anger, but they have to find a more socially acceptable way to deal with that frustration and anger. it happened in new york city. you didn't see the rioting there. you saw peaceful protests. i encourage that thing. that's what our democracy is about. but i think this thing is being ex floyded by others, this looting and rioting, this criminal behavior. it's not protest. >> we had the niece of dr. martin luther king on the

show and she agrees with you on this cultural change that we need, not just rabble rousing maybe at the hands of al sharpton. listen. >> when al sharpton comes, sometimes, i don't know what his goal is, but people continue to riot and things escalate. so i'm asking now speak peace, reverend sharpton. speak love. speak justice. but you can have justice without violence. jesus christ showed that. gandhi showed that. my uncle martin, my dad, a.d. we do that in my pro-life work. peaceful, nonviolent conflict resolution with loving actions. >> your reaction? >> well, reverend sharpton with all due respect, he doesn't have those skills that we just heard about. that's why i question his effective leadership in this situation. responsible leadership. he has a responsibility. he can go there, if he's been invited by the family, that's okay. but go there for good and don't just go there and inflame the

great to see you this morning. >> good morning. >> fascinating question is a sign of the times with all the people moving in together. the first question is a couple moves in together, both bring aspects to the relationship. what should they do to protect one another so something goes wrong, they know where they stand legally? sort of like, i don't know, like a prenup without being married? >> yeah. what you have is young love is wonderful and it's blind and all these wonderful things going on and that's what you want out of young people, to enjoy their life. but many times they cohabitate together. they have no sense of understanding or foresight to think what if something happens? first of all, it's a difficult thing to approach because when you're young, you don't think that something is going to happen many times. but they should surely think about what's called cohabitation agreement that basically lays out what do they bring into the relationship? what's going to happen if it breaks up? they should literally see a family law lawyer. it's not an expensive thing to

do. it's more expensive after the fact if things go sideways. so as much as they're in love and building their future and they have great jobs and all these things, living together does cause and can have legal problems if in fact they split up. so that's something they should surely look to. >> who gets the dog. question number two, what is the most common error made that becomes regrettable in the absence of one of these agreements? >> all the time in and it's when one owns the house. they move in together. they're in love and they put the other party's name on the house, so now they're co-owners. sometimes joint tenants, sometimes tenants in common, things of that nature, which are legal terms. now something goes wrong. all of a sudden what was love ends up to be emotional extortion for money because the person that owned the home originally who is on the mortgage, clayton, who put the other party's name on the home, the other party on the home is not responsible for the debt,

we begin with dramatic new video out of iraq. children and refugees are swarming a military helicopter. they're trying to escape the isis militants on the mountain. >> joining us live from washington, d.c. is lee land vittert with the latest on this. good morning. >> good morning. there was a u.s. special forces team on the mountain yesterday only for a few hours.

they came back saying they were far fewer people trapped and they were far better condition than originally thought. this is the first time we know of a u.s. team actually getting eyeballs on the situation there in northern iraq. video from the mountain shows a dramatic and desperate scene of men, women and children attempting to survive on the top of that rugged mountain after running for their lives from isis terrorists. those terrorists had them surrounded. u.s. air strikes and kurdish fighters have taken some of the pressure off the situation. meantime, the u.s. says humanitarian aid drops have helped, as have evacuations by iraqi military helicopters. critics of the administration respond saying this is still too little, too late to deal with the isis threat. from the administration comes word that they say they have a clear mission right now in ira. >> we have a very specific objective with respect to the humanitarian situation that is to get food, water and emergency supplies to the population on this mountain and also as

>> passion and politics have overcome what the facts are and the facts are in dispute. let's look at what we know already and what is undisputed. it occurred on camp field drive in ferguson, missouri, slightly after 12. there we have a pullout of that. there are two different versions of what's going on. >> yes. one is from one witness, doran johnson. this is his take of how the events went down. >> he said get the f on the sidewalk. he just reached his gun out the window and grabbed my friend around his neck and was trying to -- as he was trying to choke my friend. and he was trying to get away and the officer then reached out and grabbed his arms and pulled him into the car. his weapon was drawn and he said, i'll shoot you or i'm gonna shoot, and the same moment, the first shot went off. his weapon was already drawn when he got out of the car. he shot again and he turned

around and put his hands in the car and started to get down, but the officer still approached with his weapon drawn and he fired a couple more shots. >> break down this time line for us. >> sure. let's talk about what he's talking about and his friend, michael brown, the fellow who got killed, 18 years old, 6' 4. he says dorran says the officer told the two men to get on the sidewalk. the officer then tried to exit his vehicle, but couldn't open the door because the two men were so close. according to dorran johnson, the officer grabbed michael brown by the neck and tried to pull him inside the car. then according to johnson, the officer pulled out his weapon and fired one shot striking brown. then the two men, johnson and brown, started running. the officer pursued them. finally the officer shot again. brown allegedly put his hands in the air, started to get on the ground. brown allegedly yelled, i don't have a gun. stop hoot shooting, unquote.

then according to dorran johnson, the officer stood over brown and fired several more shots. >> okay. the police version is a sharp contrast to that. this is st. louis police officer john bellmar and his version. >> as the officer was exiting his police car, allegedly pushed the police officer back into the car where he physically assaulted the police officer. there was at least one shot fired within the car. after that the officer came back out of the car. he exited his vehicle and there was a shooting that occurred where the officer in fact shot the subject and the subject, they were fatal injuries. >> so let's talk about what the chief is saying as to what occurred in the police version. he says the officer exited the car, and michael brown pushed him back into the vehicle. that person allegedly assaulted the officer inside the car.
