[explosions] outrage over the shooting death of michael brown renewed this morning. take a look at this new video of looters ransack ago beauty supply store and then these protesters actually standing guard outside of a store to prevent other looting. >> it's interesting. also this morning, brown's family is accusing the police of trying to divert attention away from the

shooting by assassinating their son's character. the police chief finally announcing the officer who killed prown is darren wilson. but then moments later releasing this surveillance footage. you are going to look at it in just a second. allegedly shows michael brown stealing cigars. you can sort of see them in his hand there. this was minutes before he was shot and killed. he shoved the store clerk. the family says the timing of the information is suspect and devious. >> family feels that that was strategic, they think it was aimed at denigrating their son. >> just hours later the police chief rev saying the ston cigars were not what led officer wilson to the deadly confrontation. >> what are you saying, chief? did he know he was a suspect in a case or did he not know? >> no, he didn't. >> it had nothing to do with the stop. >> it had nothing to do with the stop. >> at this point why did he stop michael brown? >> because they were walking down the middle of the street blocking traffic.
3:03 am
>> now the police seem to be saying precisely the opposite. either way the news is inciting anger among protesters in ferguson. >> you will cover up, you will cover up. >> it's going to raise a whole lot of attention because of the issue you are bringing up of robbery. the tension is going to get real high today. >> trying to bing the attention back to the shooting, one of brown's family members got down on his knees. >> this is a a universal call for i surrender, and can i hear my cousin's voice right now as i speak saying don't shoot. >> he wasn't causing any harm to nobody. we had no weapons on us at all. and then he was. >> meanwhile, an attorney of brown's friend and eyewitness dorian johnson has confirmed that johnson was with brown at the store during the time of the alleged robbery. >> but is he allegedly not accused of trying to be part of any sort of stealing of anything there at the store.

>> there is an awful lot that we don't know about what happened there in ferguson. rod wheeler joins us this morning. former homicide detective. you were there last night on the ground. what did you see? >> can i can tell you firsthand i was maybe about two or three blocks away from where we are standing now last night. i was right in the heart of all of what you just finished showing. and it was chaotic. i i mean it was totally chaotic. you didn't see many police initially though. i got here yesterday evening about 8:00 p.m. i didn't see any police. but it was crowds and crowds of people there was a lot of people walking around screaming. a lot of loud music. a lot of, you know, marijuana use. and it was totally chaotic. it doesn't seem to me, guys, like it's really organized protest at all. it's more of just some kind of a big party or something like that. >> what do you make of the disconnect between the new captain ron johnson who was brought in overnight on thursday to take charge,

highway patrol captain, and then, of course, the white police officer, thomas jackson who was releasing information and then ron johnson coming out and saying i wish the information wasn't released that way. i wish i would have been informed. seems like total chaos at the administrative level, too. >> it's total chaos. let me tell you, i was talking to some police officers last night. the police officers that i was speaking with, were from st. louis county. and they gave me the impression as if they didn't even really want to be here. we're in a city of ferguson. they have their own police department. but the county officers seem like they didn't want to be here. then when i started asking the officers questions about the state police, they gave me a look like rod, you know how it is. there is a lot of disconnect here. and i think in order for this situation to get undercontrol, the law enforcement agencies are going to have to come together. one law enforcement agency, guys, doesn't even know what the other law enforcement agency is doing. and it's not just the st. louis county. you have multiple agencies here on a mutual aid pact

think that hollywood will help a candidate and we have seen that over the past two presidential election cycles. in this case i actually think it can back fire on grimes because you have her pledging her support for the coal industry in kentucky, saying that she is going it fight obama's out-of-control e.p.a. and, yet, she is getting big bucks from these environmental zealots like decaprio and callen and barbra streisand, we know they despise the production of fossil fuel. who is grimes going to represent? these hollywood elites who are obsessed with global warming or kentucky voters? >> that's so interesting. we will put up on the screen some the dollar amounts that these different actors have given to the grimes' candidacy. 24 grand from barbra streisand. ben affleck gave almost 13. matt damon 10.5. it's interesting, they clearly know something or they sense something or they are hearing a dog whistle that the rest of us aren't.

convenience store and throttling the manager moments before he was shot and killed by ferguson police officer darryl wilson. the video released after seven days of riots and protests in that town. now the brown family calls the video's timing character assassination. why we strategically put this community and the world through a whole day of seeing those pictures when he had a video that was a far better portrayal? you have to ask yourself that question. we believe that he is strategically did that to asass assassinate the character of michael brown.
5:46 am
>> is the tape character assassination or something that's relevant? do we have the right to see it? joining us now fox news legal analyst peter johnson jr. not only do we have the right to see it is logical evidence. it's not character assassination. the issue is not what the police officer knew, it's what mr. brown knew minutes after strong armed robbery. he was shot by the police officer was he trying to evade capture evade capture whatever the state of mind was. that goes to his state of mind and what he did or didn't do with regard to assaulting or not assaulting the police officer. also, it's been made clear after a couple of statements yesterday that the police officer was aware that a robbery had taken place at that ferguson store. was aware that cigars were missing. was aware of the description
5:47 am
of the person who had taken it, and the family admitted that person was michael brown. so it's legally, logically relevant and in a trial it will go to prior bad acts much michael brown to determine what his conduct was that day. >> central to the whole thing. >> absolutely central. the attorney has been calling out for, you know, transparency. al sharpton has put his personage into that town. he says that michael brown was a gentle giant. >> he certainly is a giant. >> so what do you make of the political tenor of all of this? a police officer shoots an unarmed man. >> right. >> it's sad. it happens a lot. how did this get so wildly political so fast? >> it's out of control. i think the president has made it extremely political. >> why does the president. >> they have taken control of this, there is no doubt. he said he had spoken to governor nixon a democratic former attorney general in

that state governor now, governor put his own hand picked man in to control riots. riots have not been controlled. political determination not to police in ferguson. we heard it this morning from our correspondent on the ground that there were no police to be seen all night until 1:30 last night. rod wheeler, an experienced d.c. homicide detective knows the streets knows conflict police were not there. >> that seems crazy to me. >>, no, no. it's one particularly uferlly democratic. democrat proud some days solution to handling riots. it's patronizing concept. let it fizz out. let the people show their anger. let them them do what they need to do. here we see people looting a store, a store owned by a man or woman or corporation whose profits count, whose employees count on being able to go to work.
5:49 am
do you think the people in that store today are able to go to work? now, should the state troopers in missouri be proud that fox news cameras and other cameras were allowed to see this and they did nothing? they do nothing in the face of looting and shooting? they should absolutely be ashamed. so, it's been politicized. i believe in absolute transparency. let's see all the records. let's see the police officers' records although they are not relevant. these folks, the lawyers and al sharpton on other folks are calling for the death penalty for this police officer. there is a death penalty for murder in the state of missouri. if he is guilty of it, he should be executed, but all people are considered to be innocent until proven guilty. and there should be a call for a rule of law in this state. the rule of law seems to have disappeared in this political melee big time. >> this is scary. >> big time it is scary. >> peter, thanks a lot for coming on.

6:02 am
the protests on friday were relatively peaceful. police and police officers involved in a tense standoff. at one point cops fired tear gas at demonstrators in the street at 1:30 in the morning. >> looters ransacking stores, including the same convenience store we just learned that michael brown is accused of robbing earlier in date that he was killed. the police chief releasing this new surveillance footage allegedly showing brown stealing cigars minutes before the deadly confrontation and moments before the chief released the name of the officer who killed brown. 28-year-old darren wilson who had six years of service on the force. brown's family and attorneys say the police chief's timing is devious. >> the family feels that was strategic. they think it was aimed at denigrating their son. it was a character assassination attempt. that is pretty much the sentiment of everyone i discussed.
6:03 am
they think the timing is suspect. >> the family argues they never claimed their son was a perfect kid they say police are just trying to divert attention away from the shooting. >> rod wheeler, fox news contributor and former d.c. homicide detective is live from ferguson. he was there last night. rod, he were at the store as it was looted what did you see, who did you talk to, what happened there last night? >> last night it was totally, totally chaotic. let me set the scene. i got here yesterday evening and i was actually with the reverend jesse jackson. we were in the street talking to people. it was relatively calm at that team. later in the evening after the reverend left, i stayed around and there were thousands of people lining both sides of flosson street. it's the main street where everything is taking place. it's one block up. just to give you an idea, it is a four-lane roadway.
6:04 am
two lanes were only open. one in each direction. here is the thing. there were no police to be seen at this time. around 12:00 midnight last night, i was right there at t quick mart sitting in my car. there were thousands of people around there. that's when all hell broke loose. people started throwing bottles, starting throwing rocks. it turned into a riot. i was hoping police would come. they eventually came around 1:30 in the morning in riot gear. that's when they started firing the gas. at that point it was wise to try to make my way out of there. i thought i was going to get hit by one of the canisters. it was a totally chaotic scene. i was able to go inside some of those businesses that was looted last night. i saw the people running up the liquor bottles. it was horrific. i talked to some of the business owners. one woman told me she is moving out. she says she can't take it any

more. >> you are talking about, you said fake hair. you are talking about the fair salon there, hair extensions, that type of thing. the former d.c. detective, was your personal reaction to everything you've seen? we are talking about ferguson is a small town. still, it's not that far away from st. louis. >> right. i actually feel sad and i kind of feel bad for the police department here because it's obvious to someone like me that this department was well over their head with this situation. in the d.c. area, in the city of new york, we are specially trained to handle protests and riots and things like that. here in this police department that, didn't happen. that is not the criticize them. the other problem, the major issue that is going to have to be looked at, the communication between the ferguson police department and the missouri state police is totally in disconnect. they are just not even talking
6:06 am
to each other. the officers shared that with me this morning. that is a major thing to look at. >> maybe in over their head with the militarization and all the equipment these small police departments are getting. rod standing for us in the rain on the ground in ferguson. only the rain is keeping people off the streets at this hour. >> they've got to prevent this. we've seen this movie before. between 1965 and 1968 there were riots in scores of u.s. cities. it destroyed cities for 40 years. we grew up in a country where cities were dangerous, suburbs were safe. why? because of the riots. newark, los angeles, detroit. they never came back, some of those cities. this is a big deal. people have no right to rob liquor stores or steal wigs out of beauty supply shops in the name of civil rights. it's nonsense. >> then you have the police department melting into the background because they want to see the people get their
6:07 am
frustrations on the street and let them vent. there is this other aspect we were talking about with rod a little bit, this militarization aspect. has a lot of people concerned about the types of equipment, pieces of equipment going to these local police departments and municipalities. in over their heads in many respects. i maintain it's almost like the hall monitor syndrome. the little guys get these big land mine tanks, mine-resistant ambush vehicles, more than 860 armored vehicles? >> people who are not trained to use this type of equipment. the military is trained. they go to boot camp. not to denigrate these small towns, but this is not equipment that is -- >> do you need an armored personnel carrier in some of these small towns? >> it depends. if you're fighting isis in iraq, maybe you do. who are these weapons being used against, american citizens. we are liberals on this, by the way.
6:08 am
they used to have concerns about civil liberties. now it's the obama administration who are abetting the militarization of these police forces ought to be ashamed of themselves. >> it started with the war of drugs in the regehra and continued to the bush era and accelerated now. what infuriates me about this piece, "the new york times" go through some of these pieces of equipment. over 1/3 were never used in the wars in iraq and afghanistan, never touched. we were fighting two wars and had a surplus. how much does that tell you about the amount of money taxpayers are spending on our defense budget and the stuff collecting dust. and donating it to our police departments. >> again, without in i trainer. albert wrote on facebook, to be effective, you need more gear than some of the crooks you go after. >> protect and serve let the national guard have the equipment, not local police

departments. >> the police obviously don't know when not to use this equipment. when you have a hammer, not everything is a nail. >> that is a good point. this didn't just happen yesterday. this has been going on several days now. the state really needs to get on the ball there. you were talking about nixon and how he has -- governor nixon, yeah. things not coming together. the right hand is not talking to the left hand. we want to switch quickly to iraq and the situation there. you remember the grief former president bush took when he appeared before a banner that said "mission accomplished" in iraq. president obama has been more explicit saying things are great in iraq, things are getting better. listen to this. >> bottom line is that the situation on the mountain has greatly improved. americans should be very proud of our efforts. because the skill and professionalism of our military

6:18 am
one is that the national guard are just now being deployed down to the border. this will take several weeks, maybe an entire month in order for them to be fully fleshed out around the border what they will be doing is assisting local law enforcement. they will be assisting border patrol agents, assisting the texas department of public safety providing additional man power to help all these law enforcement agencies do a better job securing the border. second thing that ties into your point, that is that we are going to see a greater influx of people coming across the border if historical patterns are consistent. in the month of august when it's incredibly hot down there you usually see a decline in the people coming across the border. as it begins to cool off as we head into fall and winter, that's when we see it pick back up leading up until the month of may. our presence down there already has decreased the number of people who are coming across the border. >> so you see it as a deterrent.

that was my next question which is they are making this horrific trek from honduras, el salvador, guatemala through mexico on the backs of these trains and so forth. they get to the border, a few national guard troops are not going to shoot these individuals. is that enough deterrent to keep them crossing the border after this horrific journey? >> it is to are this purpose. remember, these aren't just hapless children who happen to show up on our border. these kids are being brought to the united states of america by cartel members, by gang members, by smugglers making $5,000 to $10,000 per person. our goal is to go after those smugglers, arrest them, deter them, prevent them from being involved in this humanitarian crisis. we know how to target them. we've done this repeatedly with sporadic surges. every time we had one of these surge operations on the borders during the time period of that surge, the number of illegal

crossings has decreased. our goal here is to increase under more permanent basis the border presence so we will permanently decrease these smugglers bringing children or others across the border. >> mr. attorney general, i have to ask you about what unfolded last night. what do you make of governor rick perry's indictment which came from a grand jury in texas, calling an abuse of his office, abuse of power. where does that stand? what do you make of that indictment? >> well, i'll preface this saying i haven't looked at the wall. i'm unfamiliar with the details of the facts. what strikes me, the governor was using his veto power. i'm not familiar with the situation where a governor has been indicted for vetoing a law he thought should not be signed into law. i just don't know what to think of it. >> greg abbott, texas attorney general, keep us posted.
