thanks to my panel and to all of you for watching. i'm paul gigot. hope to see you right here next week. fox news alert. violence flaring up again in a town that has seen its share this week. neighbors in ferguson, missouri, cleaning up a convenience store after a mob broke in and ransacked it. the evening started paegsfully enough, but finished with another showdown between police and protesters in ferguson, missouri. welcome to "america's news headquarters" on 0 this very busy saturday. i'm leland vitter. >> i'm molly line. that convenience store, the ferguson market, now at the center of the story. police allege 18-year-old michael brown robbed it the same day an officer shot him to death. our mike tobin is at that store. mike? >> reporter: hi, molly.

we moved up the straight because something developed out here. what you can see is dramatic change in tactics. in the days leading up to this, the police were nowhere to be seen, avoiding dmon 0 straighters. now you see an ad hoc demonstrations that took to the street and started marching. there are police at the front end of the march protecting them from traffic and police back here on the back end making sure cars don't come up on the scene. they're securing the intersections. if you look back behind me, there are guys with the yellow vests, also directing traffic to protect the demonstrators as they come and go. now, you think about that, strategy leading up to this was no police presence, therefore you can't have clashes with police. and still ferguson got the scenes they wanted to avoid last night. out on the street, rows of officers in tactical gear, a row of demonstrators squaring off, soon the pepper spray came out, the tear gas.

following that was looting. one place that got hit was sam's meat market. sam's has been hit twice now. they called the police, got no response. the looting of that store only stopped when the owner and his friends showed up with guns. here's his story. i saw you today reach into your own pocket and give cash to a woman because you can't fulfill her order because all the meat was stolen. why did you do that? >> yes. she make an order. that's not her problem. you know, she come in here all the time. she's my customer. she come in here to grab her stuff. she pay for it. and now the store closed, i have to give her the money back. >> reporter: what does any of this have to do with death of mike brown? >> nothing. nothing. >> reporter: to speak of the death of mike brown, the family meat market had been looted. they showed up to help with the cleanup. now we're following the dmron straigss continue, premierly

because the rain stopped and this time with the change of tactics, the police are out here securing the route. guys, back to you. >> mike, thank you very much. very sensitive situation in the city of ferguson. >> no doubt. police brutality the focus of a rally this morning led by al sharpton here in new york. it clowed the family of aaron garner who died last month in staten island while in police custody. sharpton wants to address police policy toward petty crimes. in a few minutes we'll speak with chris coster, the attorney general for the state of missouri, on the status of the investigation and how to end the violence there in st. louis. new american air strikes in iraq targeting an area near a dam held by islamic terrorists in mosul. iraqi and kurdish forces are trying to recapture that dam because it's considered a major strategic asset. meanwhile, iraqi officials say isis massacred over 80 yazidi

men in a northern village while kidnapping women and children. greg is live in erbil, iraq. >> reporter: molly, we have some important new information about those attacks on the dam. fox news can confirm that f-16, f-18 u.s. fighter planes as well as unmanned drones have been hitting those militant positions all around that strategic mosul dam. there have been six strikes this morning local time. and official sources tell us that a short time ago all of this is air cover for a joint kurdish fighter/iraqi army ground operation to retake that dam to be launched. sources say all of this is to keep isis from blowing it up or letting it burst. that would be devastating for the region. this as yazidis here are still reeling from the news of that massacre that happened near the town of sinjar. take a look. it is a long way from sinjar to

erbil, about 150 miles. but that's how far these yazidi refugees have come. the horror, the terror that isis militants have created around their towns and villages still very vivid in their memories. the yazidis at that shelter were shocked, but they were not surprised at the news they have firsthand knowledge of the brutality of isis. one man told me 29 members of his extended family have been kidnapped by the militants. isis gave residents of the village an ultimatum, convert to islam or die. they refused. then it happened. we are told that u.s. surveillance spotted the massacre from the air while it was happening and then launched air strikes. they killed militants involved, but it was after the fact. the reason why the humanitarian crisis is exploding in one northern iraqi province alone, 400,000 refugees, 1.5 million across northern iraq, as a vast

surprised by the grand jury's charge. >> what strikes me, though, is that the governor was using his veto power. i'm not familiar with the situation where a governor has been indicted for vetoing a law. >> governor perry's statement is coming up. we're going to bring that to you when it's available. and don't miss the texas governor on "fox news sunday" tomorrow on what he has to say about the charges. check your local listings for times. nearly 300 russian trucks are parked near the ukrainian border. the convoy, which russia claims is full of aid, is waiting to the go-ahead to enter the country. inspections go on by red cross, this as fighting between ukrainian forces and pro-russian separatists goes on all around them. ukraine is hesitant to bringing in that aid, believing it is a disguise for an incursion. >> a lot of people are calling that aid convoy a trojan horse. we'll see what happens. we're learning brand-new

time for a quick check of the headlines. police arresting an upstate new york couple suspected of kidnapping two amish sisters on wednesday. investigators are now saying they may have planned on taking even more children. steven house and nicole vozy are each charged with kidnapping with the intent to physically harm or abuse the girls. the coach of notre dame's football team saying he has to do a better job of making his players accountable for their actions. this after the school banned three players as an investigation suspected academic dishonesty. and germany says its foreign intelligence agency may have spied on the united states. they reportedly listened in on phone calls made by secretary of state john kerry and hillary clinton who, of course, claim the calls had been accidentally collected. president obama's foreign policy is under fire from russia's meddling in eastern ukraine to the rampage of islamic state terrorists in the middle east, not to mention the

battles in gaza, all posing challenges to the white house. and take a look at this brand-new fox news poll. a majority of voters disapprove of the job the president is doing on all of these crises that are breaking out all at the same time. for more on this, brad blakeman, former deputy assistant to president george bush, also a professor and a radio talk show host, thank you for joining us here on this lovely saturday. t tough numbers for the president. there are his critics who say a lot of this is all his fault. then supporters who say he's not the one to control it all. brad, let's start with you. your thoughts on just how much the president can control. >> well, i think the lead-in into the story, congressman peter king was right. that is that the president should have foreseen what was happening around the world and presidents are supposed to prevent crises, merely respond to them and not respond well and still a lack of confidence to

our allies. and there's no fear to our enemies. so president obama has missed the opportunity to lead. and therein lies the problem. he has to rally our allies and do the right thing before it reaches a crisis stage, no matter whether it's in russia with the ukrainians, in the middle east, around the world america is looked to for leadership. and when we're not there, bad things happen. >> i hear you talking a lot about leadership. you also mentioned the word eye fear." seine tina, your thoughts on that. should the american president be doing more as far as leadership is concerned and should fear in any way play a part in that? >> well, you know, i don't believe in fear-based thinking. the fact is, presidents lead. polls do not. leaders are supposed to mold opinion. they're not supposed to be molded by opinion. he's not the president of the world. he's the president of the united states. and today, quite frankly, americans are more interested in ferguson than fallujah. there is a june "washington

post" poll that 65% of us did not want to put american boots on the ground in iraq. what's going on 0? we want peace and prosperity at home. it doesn't mean we don't wish people well abroad. we do. but there's a new world being ordered. seven of the ten fastest growing nations in the world are in africa. where wiare we in that mix? the brick stations have organize 0ed a bank counter to the world's bank. where are we in that mix? look, i want everyone in the world to enjoy peace and prosperity, but we need it first here. i hope that the president will read the poll but i think that he should really sit down and come up with a policy that makes sense not just in the present but for paosteritposterity. and not just foreign policy but domestic policy. that's what we need. >> satiti you bring up an interesting point. previous polls have shown americans don't have a big appetite for a big intervention. but we have a poll, this is asking registered voters how they feel about president

obama's foreign policy, disapproval very high right now, certainly more so than it was in 2012. remember october 2012, this initial number, came really in the wake of what had happened in benghazi. so since then, the disapproval has grown. why do you think it's grown in this way, brad? is it because of the pileup of crises around the world? >> well, peace comes through strength. if america's not strong, then we're going to project weakness and give the opportunity to those who seek us harm to do us harm. so these crises should have been foreseeable by the president. we should have stood with israel. the president tried to be all things to all people. and it doesn't operate that way. we have to stand with our allies against those who seek to do them harm and us harm. and when you project weakness, you get incursions like we're seeing in u 0 crane and you get atrocities like we're seeing in syria and in gaza. the president's lack of leadership, his inability to rally our allies, his inability

county prosecutor to handle the investigation and wants the state attorney general to take over. chris coster with us now, the attorney general for the state of missouri. i want to start with this. you saw images that came out last night after what was a calm thursday and violent friday. what is your reaction as we begin saturday afternoon? >> it was disheartening. a lot of people went to bed last night believing there was a period of calm that had been established. when the news was seen this morning, it was heartbreaking. we went out, myself and some people that i work with went out to the neighborhood, talked with business that's had been looted last night. and tried to bring in -- increase that sense of communication that is so needed at this point between elected officials and the community between law enforcement and the community. this sense of communication is desperately immediate order the streets at this junkure. >> when you talk about that

sense of communication there's a lot of questions of who is in charge. the ferguson police chief, st. louis county police chief. you have the fbi investigating, you have calls for you to take over the investigation which is legally difficult. give me an understanding there. who is really running the show in st. louis? >> as of thursday of this week, captain ron johnson was put in charge of this. i think as the country has had a chance to view this individual, over the last 48 hours, you can see that this is an extraordinary human being with a great presence, great sense of solid must and communication skills. captain johnson comes from the neighborhood. he went to the local high school and has would daughters, son and date their live here in the community. he has immense concern about how this is progressing and there is a lot of trust in his leadership now. >> as you said, you have been on the streets will and have been talking to folks in ferguson. some of the shopkeepers.

you have deep ties into the african-american community. we see the vial men's the pictures. is there an ability to put the genie back in the bottle or are folks in for a long run? >> the passion and the anger and the from ustritiustration is go. law enforcement is going to balance in a chaotic situation is how to provide for the free expression of the frustration. geographically, up and down, over different periods of time drg the morning, during the evening hours, overnight if that's when it needs to be expressed. but also at the same time to give community members a sense that they -- when the police calls go out that they will be protected and people in the neighborhoods will be protected and that the businesses and livelihoods will be maintained. every day has posed new challenges with finding that balance. law enforcement and community

members as well are trying to learn in real-time how to address a very, very challenging situation on the ground. >> one of the new challenges here here's going on at least we heard over in the past 24 hours is this idea that the a least the county prosecutor doesn't get along so well with some of the other politicians there in the county and a number of -- one county official is asking for your office to take over this investigation. is that legally possible in missouri? are your hands tied at this point? >> there is no legal authority that an attorney general has to remove a prosecutor from a case. the prosecutor under the law under the state of missouri and i served among them for a decade answers directly to the people. the voters of st. louis county have chosen mr. mccullough seven times in a row. he has as much experience as if not more experience than any prosecutor currently serving in the state of missouri. and i -- i would not second-guess the voters of st. louis county. >> i want to get you one last

>> good afternoon. travis county grand jury charged perry abused his office and tried to compaerce a public servant. perry made good on threats to veto state funding for her office. perry will soon be arraigned at the county criminal courthouse just a few blocks about the governor's mansion. the special prosecutor in this case has donated to a democratic campaign fund in the past. but he has also received high level republican support in his failed bid for a federal judgeship. the facts of this case sent perry in a statement -- conclude the governor's three tow was lawful, appropriate and well within the authority of the office of the governor. today's action which violates the separation of powers outlined in the texas constitution is nothing more than an effort to weaken the constitutional authority granted to the office of the texas governor and sets a dangerous

precedent. texas democrats swiftly upload ad web page adorned with a photo of the embattled governor looking stern and asking users to demand pair write's resignation by entering their e-mail addresses and zip codes. after which steps history teaches us fund-raising solicitations usually follow. governor rick perry has brought dishonor to his office. his family and the state of texas said texas dem craftic chair holsa. adding we call on governor perry to step down from office. texans dereal lich and this is unbecoming of our governor. from the unlikely source of david axelrod the democratic political consultant from chicago widely credited as the architect of barack obama's elevation of the white house, a tweet that sned essence that absent additional evidence this indictment, quote, seems pretty sketchy. combined the two fell my charges against governor perry carry a maximum punishment in classic texas tradition of 109 years in prison. once again, rick perry expected

to speak out at this hour. >> all right. thank you so much. we appreciate it. we are keeping an eye on this and taking a look at austin, texas, where the governor is speaking. >> governor,i took an oath to f uphold the constitution of the state of texas. a pledge i have kept every day as i worked on behalf of texans for the last 14 years. that's the same constitution. that clearly outlines the authority of any governor to veto items at his or her discretion. just as i have following every legislative session during may service as governor, i exercised this authority to veto funding for an office whose leadership had lost the public's confidence by acting inappropriately and unethically.

i wheoleheartedly stand behind y veto. and i will continue to defend this lawful action of my executive authority as governor. we don't settle political differences with indictments in this country. it is outrageous that some would use partisan political theatrics to rip away at the very fabric of our state's constitution. this indictment amounts to nothing more than abuse of power. and i cannot and i will not allow that to happen. i intend to fight against those who would erode our state's constitution and laws purely for political purposes and i intend to win. i will explore every legal avenue to expedite this matter and bring it to a swift

stopped for a dwi with a blood alcohol level almost three times the legal limit and an individual who when booked in had to be restrained, was abusive to law enforcement and was kicking the door. i think americans and texans who have seen this agree with me that that is not an individual who is heading up an office that we can -- we can afford to fund. the people of travis county may decide that that is the type of individual that they want in that office. but as the -- the governor of the state of texas, the individual who has the authority constitutionally to decide whether we will spend state dollars on that, i made that decision and i said no. and given that information and given that choice again, that is

exactly what i would do? afterwards that after -- the veto that you are dropping some dash you could restore the money if she would resign. did that happen? is that appropriate? >> listen, the details of my decisionmaking were very clear. i said early on that i was going to clearly veto those dollars as long as think have someone in that office who i -- lost confidence in. and i did exactly what pit said i would do. >> governor perry -- >> you had your hand up. >> the question seems to be -- it is not whether or not youtally have the constitutional veto. it is attaching what people say is a threat to that very tow. what's your response? >> i disagree with you. i think there are a lot of people on both sides of the aisle. democrats and republicans who

have looked at this and understand it to be exactly what we are seeing. a political decision that has been made in travis county. i am going to continue to do my job. i'm going to continue to deal with the big important issues that are important to the people of the state of texas. for that matter, this country. we have a border that has -- it is not secure. because of what the federal government has failed to do. i ied to the mother president of the border patrol agent who was gunned down in cold blood and in front of his family, by an individual who has come across this border multiple times. a criminal alien. that mother expects me to do the job and keep the citizens of this state safe and that is what i'm going to do from today until i leave office in january of

2015. thank you. >> all right. that was the governor of texas, of course, making his statement today. talking about this indictment that has been handed down. he considers this to be political in nature. he says he stands by the veto a essentially and he won't -- this thing shouldn't be settled in this country, political differences should not be settled through indictments. james, were you listening as well. your thoughts on what you just heard? >> its was a very spirited public defense by the texas governor. he made clear that he views this indictment as a parse, as he called it, abuse of prosecutorial power. also emphasize his exercise of gubernatorial power in sign thing veto to deny state funding to this prosecutor after she refused to resign in the wake of her arrest on drunk driving

charges was an appropriate use of gubernatorial power. of course, he did mention at tend he is leaving office in january 2015. rick perry has presidential ambitions. it is unclear whether this statement will be enough to spare him the development of this all being used against him by his rivals. perhaps senator rand paul, republican of kentucky, with whom perry engaged in a very public spat already this. it was also interesting to see governor perry tried to bring more attention to the behavior of rosemary lenberg in this case. talking about how she was inebriated to the point of three times the legal limit for intoxication. how she grew apparently violent with the law enforcement officials who were trying to book her during that arrest. we will see if that plays into the public's decisionmaking about this entire set of affairs. >> all right. thank you so much. giving us further insight into what is a legal and political story as well. thank you so much. >> any time you have governor

perry involved in this, certainly when you have both sides of this the d.a. involved in this, is known as an avid democrat, i want to bring in david hawkings from roll call for your reaction to the governor's statement. is this enough? this isn't really the reaction you would think of for somebody being indicted criminally. this has real political overtones to it. >> sure. absolutely. i think -- i think governor perry is reacting in time. this is less than 24 hours since this indictment was announced. this indictment took -- certainly took me by surprise. i think it took most people outside of texas by surprise. i did live in texas and cover texas for a while. about 28 years ago. i do know this. i think, which is -- the governor -- governors of texas don't actually have all that much power. it is considered one of the weakest governorships in the country. and one of the few powers that a texas governor does have, however, is the power of the veto. which is pretty broad and pretty

much without caveat. when he comes on and says strongly this is my authority to do this, i exercise my authority, it was absolutely unrepentant, unequivocal and no caveats. probably politically his best move to come out quickly and emphatically and say this. not let it fester even for one day. >> just so our viewers can put this in context, as i understand the case, please correct me if i am wrong, rosemary the d.a. there, in travis county, has a dui arrest and then governor perry asked for her to resign and heard him talk about this. that she's lost public confidence and she says that no, i won't resign and he says if you don't i'm going withhold the $7.5 million in funding. he fulfilled that promise and vetoed the law as we see it. what do you make of the fact that people on both sides of the aisle now seem to be coming to rick perry's defense? we heard from senator ted cruz of texas. full-throated defense of governor perry.

the time stamp showing this happened just minutes before brown was shot and killed by officer darren wilson. could this video play a role in a legal case possibly against officer wilson? joining me now is robert and quiche keisha. you are both prosecutors. you have a lot of legal ground to look at this case. it is a really difficult case. a lot of high emotions in this case and it is difficult to see the video of the victim being released. and to watch all of this unfold. how can it be used in a possible court case? >> if the -- officers are charged with manslaughter of the murder of michael brown, his defense attorney absolute i is going to try get it into evidence to show the violent nature that occur ten minutes prior to his interaction with michael brown. we know the officer's story is he became violent with me, reach flood the car and tried to grab the gun. the judge will be the overall determining factor. something called probative va e

learned him to be. the story that darren wilson is giving initially gave that day is going to be very telling as to where this case moves and where his defense moves. he is locked in now. he can't come in and change the narrative. if he does he will get him on the witness stand. if he testifies when this case moves forward. >> what about the timing how the video was released? 8:00 or -- nearly 9:00 in the morning, the police chief release it is name of the officer and then also this video. does don't a lot of clarifying as to why it is being released and later on, 3:00 in the afternoon, by the way, the -- officer didn't know that mr. brown was a suspect. >> right. i think that it really destroys the credibility of the police department because it almost looks like they are trying to distract away from what that officer did in killing this man and to say look, he was a bad guy anyway. it was justified. i think that if it did come into the -- legal case, it is not going help officer wilson. it is going to basically make him look like okay, you didn't even know that this robbery took place. therefore, it was no link

between that and the killing. >> it was just about noon that day the family came out and said, hey, this is air actor assassination. >> to a point. you have to understand that is if officer -- wilson is indicted and the case moves forward the prosecution and police had an obligation to turn over to him and his lawyer all evidence that could exculpate him or benefit him at a trial. it is called brady evidence. if they did not turn it over and he went to trial and was convicted it is found out -- the manner in which they did it, it does not jive with -- >> they turn it over the the media and they did it and -- in a very disrespectful way because it is like okay, we will tell you how the officer is. look at the video. i think you should have came out in the course of scoffry and the trial and if -- if it goes to trial but not in the way did it. >> cover mulled multiple trials attorneys on one side tore other make an argument the media itself the coverage, cause things to not be fair at trial. make an argument about moving

the u.s. military role in iraq appears to be deepening with another round of air strikes today targeting militants that have taken control of a key dam. this after a week of attacks religious refugees under siege by the terror group and now more than 100 additional u.s. troops are on the ground. it all begs the question -- are we going back to iraq? have we already gone back to iraq? mark dubois, cliboidubois. i want to start with this. how difficult is it to stop one of these missions once they began? a couple of months ago it was adviser. then it became adviser and equipment. now it is adviseors, equipment and air strikes plus more adviser. how do you put the brakes on something like this? >> well, i think the reality is that -- it is not mission creep. this mission was never over. everybody acknowledged that except the president the fact of the matter is the president's

decision not to leave a residual force u.s. military force in iraq, decision not to support sunni moderates has really created this crisis and president has been -- reminded by reality that our role in iraq only deepen. >> assuming that it only deepens to what point do you finally say the iraqis have to deal with it on their own or is this a situation where at some point the iraq was broken and the only way to hold it together is with u.s. military power? >> look, i think iraq and syria, they are -- sort of a middle east version game of thrones on steroids. i don't think we are ever going to be able to fix iraq or fix syria. i think the primary objective right now is to destroy this islamic state, this terrorist organization that actually has taken hold of -- the size of new england with oil revenues and captured military equipment. we have to destroy the islamic state before it comes and destroys us. >> obviously president obama has taken real credit or at least he did in the past for ending the war in iraq and we obviously

have seen the promises that have come out from the administration saying no boots on the ground. you can parse those words however you want. in many ways there are american boots on the ground. at least so far the administration says they are not involved in fighting. would it be better to simply say all right, we are going all back in? this is an all-in mission rather than piecing it out over time? >> i think here's going to be the reality. i don't think the president can bring himself to actually acknowledge that. i think in the next 2 1/2 years, his primary mission, as i said, would be to destroy this islamic state. i don't think it is possible to do that without american boots on the ground. i think this should have been 10,000 american soldiers left there as a residual force which i think could have prevented what we are seeing unfold now. we may end up back to exactly that situation before the inauguration of the next president. >> in speaking of the inauguration ration of the next president, how is this going to play into the -- not only mid terms but also the president at election coming up in 2016? it seems as though if you are

listening to politicians on both sides of the aisle are trying to position themselves for the race coming up, it is a much more hawk i shall approach than what we have seen from the president a la hillary clinton's latest statements. >> exactly. i think everybody will be running away from this president. you see hillary already doing so. she's already -- coming out and making it very clear that she disagreed with the president on syria and disagreed with him on iraq. she's disagreed with him now on gaza. i think it has become very clear that the president's foreign policy at least the perception is that it is failing his popularity is plummeting and i think democrats will be running to the right of him. he does open -- opens up the possibility someone like elizabeth warren may run to the left of hillary clinton in order to try to get the progressive vote. >> do you get the feeling that both republicans and democrats are going to begin using this as a political football? or if president obama were to make a major policy shift say, okay, i'm going to take my medicine, i was wrong, we are going back to iraq, would both
