force. >> reporter: how are you planning to enforce this is curfew? >> i'll let -- the best way for any -- we will hear from him. we'll hear from him. we're here -- you know, inthe bt way for us to get peace is for everybody to help to make sure that everybody gets hope i've tonight at 12:00 and gets a good solid five hours sleep before they get up tomorrow morning. and that we're going to -- the captain -- >> governor nixon, we want justice. >> why are you focused on security and not getting justice? >> if mike brown was outside, he would be in jail. we want justice!
1:31 pm
>> why was a police officer -- >> if we want justice for those that -- i'll let you -- just a second. i'll let you yell at me next. if we want. >> attention, please. >> if we want justice -- we cannot be distracted, we must be focused on making sure that people are allowed their first anticipate rights but we do so in i an peaceful fashion. we cannot have looting. and crimes at night. we can't have people fearful. >> killing people. >> ma my question to you, how do you plan top enforce the curfew? >> you want to go? >> governor, last night -- >> excuse me, sir. please hold it.
1:32 pm
>> now, last night, police presence but there was looting for two hours straight. wait a minute, wait a minute. story owners. >> let the man talk. >> store owners with their own firearms. will we have police guarding our homes and businesses? >> colonel. >> captain. >> i'm going to talk to the gentleman here that asked the question first. and i'm going to tell you that what we're doing now is not who we are. it's not who we are. yelling at each other is not going to solve that. we're all talking about the same concerns and the same passion. the frustration is in your home, it's in my home. it's in my home. and i've given you all the answers that i know and i'm going to continue to give you that. i don't care who you are, be how
1:33 pm
old you are. i don't care if you were a peaceful protester last night or a rioter last night. you will still get the same answers. tonight we will enforce that curfew. we won't enforce it with trucks or tear gas. we'll communicate. we'll talk about you know what, it's time to go home. it's time to go home. have you not seep a hand in hand approach last night some things were different that precipitated that. you saw that. but i can tell you because someone's standing in the street there's not going to be an armored truck come out. you saw people sitting in the street and they got a chance to get up. that's the way it's going to continue. >> yes. here. >> why are the police not. >> we're going to answer one question at a time. >> even though you're a commander, you are not aware s.w.a.t. teams were being deployed there? did you know about them? >> yes, i did.
1:34 pm
and last. >> you gave that order? >> yes, yes. >> you ordered the tear gas? >> no, can i answer your question? can i answer your question? >> there are reports that this happened without you knowing it. that's why i'm asking. >> let me answer the question. last night, we had several officers that were trapped on' parking lot. they tried to get out. we sent an armored vehicle to help them out. we sent two armored vehicles to help them out. we had three officers injured. one officer deployed one can of tear gas. he was there. he made that decision. i got a call on the phone and i said i'm back en route. i got back out of bed and i said make sure we are not going to use any force that's not necessary. and it was one can that got out. i removed those officers out. and the next thing that you saw was a group of officers standing on the roadway and yes, that
1:35 pm
happened. >> the officer that killed him. >> ma'am, that is not a part of my investigation. listen. we can't answer that. we cannot answer that. because -- listen, listen. >> would you be willing to work with the brown -- to communicate with you when all of those -- are gone and those who don't intend to keep peace are the ones remaining? will you be in direct communication with us? we have -- two-way radio. can we have direct contact with someone who can say all of these are out. >> yes, you can. i've seen you out on the street and out with those gentlemen with the black -- red ban dans on their face and i talked to them. some of them were angry. some didn't like what i had to say but i didn't walk away. i've talked to them every night. i will continue to do that. we will be in this together. >> will you provide for our
1:36 pm
leader, our two-way raid raio so we can say all the peacekeepers are out before any additional action is take? >> we're not using a two-way radio. when i'm there on the ground, you can talk with me, you can walk with me, be seen with me. >> after curfew has ended and everyone is not gone, how do we find you to let you know that all those who are gone and hose who don't intend to keep peace are ---ing >> we'll talk. we'll talk. >> on the street, kill me. >> okay. the gentleman -- we've got a question. i'm going to -- you're next. you're next. >> you're next. >> whoo. >>. >> [ inaudible question ]
1:37 pm
>> let's answer this question first. >> hold on one second. this is very important. >> what's your question? >> sir -- >> that's a greatquette. >> can we work together? i'll get with you tonight. >> you going to answer that one? >> yes. >> i'm the president of black -- for justice. you well know on thursday night, that my group that my organizers along with the nation of israel, we are the ones that put those men in the streets and we controlled the flow of traffic. i personally shut down the avenue at 2:00 to cars and cleared everybody out. there were no incidents on thursday night. okay? so and you were there. and you witnessed that. so what i'm saying is, tonight,
1:38 pm
curfew 12:00 midnight, it seems to be a tight curfew line that could be a prescription for confrontation. i don't know if that is as easy as it is asking people to leave at that time as you believe. what i'm saying is right now, we're organizes and we have 100 or 150 men working with the various organizations i just named and the national action network to make sure that this doesn't deteriorate into a situation where everybody's using tear gas and demonstrators -- and so is there any way that curfew could be pushed back some and that there are some -- there is some dialogue here for some rules of engagement because i don't believe that the police can enforce the curfew without
1:39 pm
confrontation. i do know that there are forces under our command that can bring this to a conclusion. also able to bring this to a decent conclusion. >> okay. okay. >> my specific question is, my specific question is, can the time extend itself and can the burden of any -- the demonstration tonight, can that be on us oh we don't have the what happened last night? because it was falsely reported on friday morning -- not even by -- it ended because we ended it and we have the rapport with the demonstrators. they respect us. and we can talk to them and get them to leave. every time the police show up,
1:40 pm
they -- >> can i -- let me -- we will talk. i will talk with you. i will talk with you. i'm going to answer. i'm trying. i'm trying. can i answer your question? >> yes, sir. >> first of all i want to say those groups he talked about that helped us on thursday night, he's absolutely correct. and when i met with the governor that next day, i said i know the name of those groups. and i said but they were gentlemen in black pants and black shirts. i said they got out there and they did their job. i told that to the governor. i'll tell that to the nation. those groups helped and they're a part of this. and the curfew is going to stand but i ask that you still help us and get it out. we have citizens that live in homes elderly citizens that live in homes with kids and kids are going to school saying we've got to have our rest. we've got to have our rest. we're angry. i may not be able to get out of my home and go protest. i don't want to stop that.
1:41 pm
what they're thanking me for is we're allowing them to voice their opinion. and i walked up to them today, there was' motorcycle group out here who walked up and said you tell us what time. hold it. you tell us what time. i ask that you help us. i'm going to tell you we can't do it. we can't do it. there was a gentleman in the crowd and of was saying captain johnson, great job. su turned this around. you had the crowd gone. he said captain johnson, you go ahead and do it. he said because we're out there. i said you're right. captain johnson didn't do it, you do it. it was some of those young men helping you. and i appreciate it. >> how long the state of emergency? >> call 911? >> nobody was able to respond from 3:00 a.m. to 5:00 a.m. with the citizens that you're asking to help you we called 911, called the county, we called the local police. and everybody was pushing the buck. it's like we're chasing our
1:42 pm
tail. asking us to help but we don't know how. >> can i answer that? that's why we're going to clear the streets. we did have citizens who called and we were unable to get to them. we're going to handle those sick cases. we're in the back room talking about 911. people are calling 9 r and not getting their calls. we talked about that. the representative talked about where should they call. i said you have them call 911 and you'll see a state patrol car or county police car get there. that's why we have to clear the streets. people get sick at 1:00 in the morning. people get sick at 2:00 in the morning. we're going to work and we're going to do that. let's work and get this part done and see what gains did we make. we are going -- [ shouts from the audience ] >> how long is the state of emergency? >> i can tell you this, listen, this morning -- this morning we talking about investigation. you talking about the governor.
1:43 pm
listen, can you get somebody else to investigate? he's been all the way to the white house. you saw 40 fbi exactlies out there today. they're coming back. they're getting cards. they're going to -- that's what they're doing. they were there today. they sent these cards. i brought these cards. i said i want you to give me a card so everybody can know they exist. >> why hasn't he been indicteded? >> how long is the ---ing >> if i could. >> how long will the curfew last? >> stop killing our people, police. stop it now! >> if i could please, please. please. >> to make sure that there are incidents at curfew. will the media be allowed to report after curfew? will you allow legal observers, mediaia out this week to
1:44 pm
report -- [ inaudible question ] >>. >> so the question is, governor, will the media be allowed to be out in the streets? governor nixon, how long will the -- >> can you explain -- >> i'm going to ask this one first. >> focused on the anger of the people for a week now because people are demanding justice. there has been no arrests and no indictments and people know that this poor child, this 18-year-old young man was killed in cold blood. there has been no arrest.
1:45 pm
and people are demanding justice. that's why people are on the streets. now this whole -- has been turned into an explanation of why you are controlling are the anger. >> question over here. our hope is that we'll get situational awareness tomorrow morning. our hope is with the help of all that tonight will be more peaceful night than last night. while allowing the appropriate emotions and energies and allowing folks to speak out. >> answer the question. >> just a second. the second question. the second question and then i' i'll -- our full hope and
1:46 pm
expectation is that you know, is we'll ---ing >> the chance. will you please let him answer the question. >> okay. clearly, the media has a role in helping here and clearly -- >> answer about the length. >> as i said before, we're going make a decision tomorrow morning. this is -- this is not normal. and our hope was that we would turn back to a peaceful normal. >> wait, wait, wait. >> every day. >> let the governor answer. >> answer that question, please. >> i'm going to ask representative pearson and congressman wants to say something. >> listen. listen. listen. no, reggie excuse me. and excuse me if you would.
1:47 pm
excuse me. >> why can't these officers is be in front of all these businesses and instead of putting on testimonies -- officers in front of these businesse businesses. >> stop, stop, stop. that is not -- >> something you want to say? >>. >> that's our problem now. we keep having hope -- >> never stop. >> get on my knees and beg. >> [ inaudible question ]
1:48 pm
>> the question is, we need to control the security ourselves. point of distinction but be able to -- >> i've heard a lot of concern about prosecution. and let me clear up some fakes for you. can you hear me now? let me clear up some facts will prosecution of this case. first of all -- on monday, i asked attorney general eric
1:49 pm
holder to take over the entire case and to prosecute it as a civil rights violation. and i will continue to pursue that. but i think for some in this room roop, your angry is misdirected. on a state charge of murder, the county prosecutor files the charges. now, so if you -- i agree with you. i'm willing to go. i agree with you. i agree with you. but he hasn't filed the charges. and -- wait a minute. it's very peculiar that the victim -- i'd rather we get -- i would rather that we get to all the facts. let the process go forward. and let the feds prosecute. because you're not going to get a fair trial in st. louis county with this scenario.
1:50 pm
>> real quickly, just if i could. >> if i could, one thing for the press, one thing for the press. one thing for the press. one thing for the press. please. captain johnson will define an immediate stapling area that you can get to that will allow you then to have access to the zone tonight to make sure that transparency is carried out during this process. he will have a staging area that will then allow folks to get in. we want to make sure as we're doing in that there is transparency during the process. i can guarantee you that will captain johnson will make that area available and make sure the members of the press have access to openly and fairly record openly and fairly see and openly and fairly show the country the world whoever what's going on. thank you all very much for your time.
1:51 pm
>> governor jay nixon of missouri now declaring a state of emergency in ferguson, missouri after another night of violence there saying the curfew goes into effect from midnight to 5:00 a.m. he left out xwhaets going to happen if anyone violates the curfew saying if we're going to achieve justice we have to maintain justice. it the eyes of the world are upon ferguson, missouri right now. >> captain ron johnson of the missouri highway patrol credited with helping to create such calm under very difficult circumstances also spoke a lot. he tried to talk to people at the press conference how the investigation is going forward. he says he's not in charge of the investigation but he tried to reassure them that there were federal investigators in town repeatedly holding up a card that the fbi had provided and had taken to various homes in the area. we have our reporter mike toe bin has been doing a tremendous job under very difficult circumstances there standing by to give us an update. more insight into what's happening there. >> mike. >> clearly this one got away
1:52 pm
from captain johnson and the governor. i think a lot of the sent mxt was summed up by one of the hecklers who said let me get this straight. you've got the power to suppress the people but you don't have the power to arrest a killer cop. and that's accurate because he's brought out here for crowd control. a lot of people weren't taking the time to understand the process, understand that a grand jury is at work and the whole process is going to take time. they want a scorecard. they want to get even. they want to feel like somehow something has been made right because the demonstrations thus far and because you've got the looter out there on the street, what you really see is more heavy handed tactics by the police particularly now when you have captain johnson who made such an effort to embrace the people, tried to show some sympathy for what they're going through and again, you had a repeat of the situation last night. captain johnson explaining that you had a police officer was trapped in a parking lot and trapped in a parking lot and
1:53 pm
receptive to that at all. >> mike, captain johnson made a point during this press conference, as did the governor, to say that most people are peaceful and there is a few agitators who are causing all the problems, looting in one of the stores you were in. i'm wondering if that's the feeling you get on the ground. is this a peaceful crowd that wants to be heard or an angry crowd that wants vengeance? >> what we hear over and over again is that it's the minority that is out there doing the looting, that is out there causing the trouble. i can tell you through the day, if you walk through the crowd, you certainly won't feel threatened or see a lot of the anger. as night fall, particularly yesterday, there was a lot of drinking going on, there was a lot of pot smoking going on and it ramped up throughout the day. -- throughout the night i should say. after dark, the situation changed. the dynamics got a little more aggressive out there at night and then you saw finally, once the police showed, then
1:54 pm
everything melted down last night. the situation, particularly captain johnson didn't want to be played out on the streets played out on the streets. >> this is a tough press conference for the local leadership. a lot of tough questions being thrown at them. one of the questions that was asked was how will this be enforced, this curfew from midnight to 5:00 a.m? captain johnson tried to put clarity to that saying we will enforce, but not with trucks, not with tear gas. so knowing what you know and how you've been on the ground, what do you expect tonight? can we expect anything? is this open in the air? >> it's got to be really hard i think for captain johnson to make good on that promise because you heard it right here. some people saying, i'm not going to sleep until that cop has been charged with murder or convicted with murder. they've got a result if they want and anything short of that is not going to be satisfactory. then when you get them out on the street at midnight now, someone is going to have to enforce this curfew.
1:55 pm
people are defiant, then that ramps the game up a couple of notches and i think it's going to be hard for captain johnson to make good on that promise that he's not going to bring out the nonlethal force to clear the street. >> at least from what captain johnson was describe, at one point last night he said there were three officers injured and somebody who was clear will he in a precarious situation that they had to go rescue. is there a turning on the police here? is there an anger towards the police or is there just a want to demonstrate? >> there has been an anger toward the police from the start and that really is what got this all going. there is an anger about the death of mike brown. there is a feeling among the black community here that it's been open season on young black men. the situation certainly got aggravated yesterday with the disclosure that mike brown was not stopped because of the robbery. mike brown was stopped because he was walking in the middle of
1:56 pm
the road, according to the chief and the situation melted down from there. but you've also got a lot of people, as you can see from the press conference, who aren't learning all the facts, aren't taking the time to ingest what's happening. they're just angry. and they want a result. they see a black man who is killed and they want a white man charged. that's very clear from the crowd at this particular press conference. >> mike tobin, thank you so much for your reporting there on the ground. difficult days behind us, possibly more difficult days ahead. this new curfew that's the big news coming out of missouri from midnight to 5:00 a.m. >> it starts in exactly eight hours and four minutes from now in st. louis. we'll be back here at 6:00 o'clock on fox news. thanks for staying with us.
