by a separate federal medical examiner in addition to the one that was already performed by the state and one requested by the family to be performed by michael baudin and all of that happening while there is a lot of questions as to what led up to the original shooting. attorney for dorian johnson, who is the friend of michael brown with him at the time, and he spoke to judge janieanine pirro and he said that the officer stopped e two men out on the street, and became a tussle and the off is ser ended up with one arm on brown's shirt and the other on his neck. >> the officer, then, according to my client pulls up the gun and my client can see the gun clearly and he can touch mike brown as well as the off se, and officer tells mike, i am going to shoot you sh, and they had m words and then all of the sudden, he says, pow, and he shot. >> it is still not known when or if officer wilson knew that michael brown had stolen cigars,

and what caused the confrontation to become physical and what led to the use of dead lay force. molly? >> mike, you been there on the ground with the crew for days now watching it unfold, and seeing what happens as darkness falls, and what have the streets in ferguson been like? >> well, today the streets in ferguson have been largely empty. a lot of people were at church today. of course, it was a much different scene last night. they did not make it through the first night of the curfew without more clashes with the police. however, the state police captain ron johnson has been deliberate in making sthaern ei that the people know that the clashes were not related to the enforcement of the curfew, but rather response to gun fire in the area, and one person who had been shot, an information that people had broken into a barbeque restaurant there and in fact, had gotten up on the roof. community leaders said that what they want is transparency and more information and particularly about the original shooting. people in the crowd say what

they want is an arrest and conviction of officer wilson. molly. >> mike tobin in ferguson for us. thank you very much. meantime, with we are learning more that, learning more that 20,000 people have now signed a petition seeking a special prosecutor look into the shooting death of michael brown tflt investigation is currently being held by the st. louis county deputy's office, but the organizers behind the petition is slamming the office as being impartial. the justice department and the fbi are looking into the shooting and considering whether or not to file charges. and fox news alert on major developments in iraq. the u.s. is launching new air strikes around the mosul dam. brand new video showing some of the first images of the air strikes and hoping that the kurdish forces who have retaken part of mosul dam from the isis terrorists, but the fight is far from over. greg is live in erbil with the

latest. >> that is true, molly. we have heard from the sources on the ground, and they tell us that kurdish and iraqi forces have not taken completely that dam, but close. if that proves to be the case, large thanks have to go to the united states. america has been the really air force for the locals here for the last several days. u.s. bombers and jet fooin ight and drones have made air strikes today destroying 20 different isis militant assets including armed armored vehicles and humvee humvees and all around a strategic point around that dam. and in the meantime, the kurdish fighters that we have spent time with and the iraqi special forces have reportedly won back several towns captured by isis on the way to the dam. all of the while dodging militant landmines and ieds and they admit that there is a lot of fighting right around that. all of this is critical, as it is feared that the isis

terrorists if they held on to the dam could let it burst or blow up the structure which has devastating effect for the region. one of the many tricky things about the operation, with we are told that the locals want to retake the dam without destroying it. meanwhi meanwhile, the refugees in the hundreds of the thousands drifen from the homes of the isis militants would be pleased if they were driven back, and this is amid reports that yazidi men are kidnap and killed by the people. and it is the scene of a m massacre that left 80 people dead on friday. and in this area, churches not ravaged by isis are filled with christians praying to get their lives back. two of the villages retaken back today were and will be again christian enclaves. and molly, one last note, the foreign minister here is saying that his troops will go on after they take this dam and retake the all of the rest of the region that has been captured by this isis militants. and if that is going to happen,

that the convoy is not part of an invasion. texas governor rick perry is standing his ground saying that the grand jury indictment is politically motivated. he is accused of abusing his power against a a public prosecutor who refused to resign after drunken driving arrest. earlier today, governor perry stressing that he would make the same decision all over again if he had to. peter due si is live in washington. peter? >> well, molly, two important numbers the know to figure out how the texas governor found himself indicted. the first number is $7.5 million and the second number 0.239 and this is how they fit together. governor perry says he will not give $7.5 million texas taxpayer dollars to a public integrity unit chaired by rosemary landberg who was convicted with dui. >> i publicly said that as long

as that individual is going to be running the agency, i had lost confidence in her and the public had lost confidence in her, and i did what every governor has done for e decades which is make a decision on whether or not it was in the proper use of state money to go to that agency, and i vetoed it. >> governor perry has said that he wants rosemary, the travis county district attorney to step aside and his critics say that those public statements and the veto threat make perry a bully. so those critics support the felony charges against perry. >> it is not about the veto. we believe that he had the right to veto it. it is his decision to veto it, but it is about the intimidation before the vie toeshgs and about him using the veto as a coercion tactic to get her to do something that she did not want to do which is to quit her job. >> and in the next few days, governor perry is expected to turn himself in and in the course of the booking process, perry who may want to run for

the so-called serial stowaway released from a california jail released early. the woman was caught early w wandering around los angeles airport a day after the authorities had ordered the 62-year-old to stay away. f following multiple attempts to sneak on to flights from other airports. police say she was released because of overcrowd iing. we are now awaiting a rally in ferguson, missouri, attended by the family of michael brown. he is the black teenager shot by a white officer a week ago.

it is likely to be peaceful unlike the violence that has raged on the city streets once darkness falls. and now the former police commissioner is joining us to talk about the situation. it is ongoing and you like others across the country are watching this unfold across the street streets. ferguson is much smaller than new york city, and what have you seen as far as the police department is concerned. what are they doing right or wrong? >> well, more communication from the beginning. some of the information they have given out, they should not have, and system of the information they did not give out, they should v. and the initial response to peaceful protests didn't look too good, but then again, you have to look at the overall circumstance there now. that is that they can't let a bunch of, you know, this criminal element sort of bogard the community. i feel bad about the brown

family for the community itself, because you a small element of people that is really distracting from what is should be going on with these throwing the molotov cocktails and robbing the places, and busting the place up, and destroying the people's personal property, private property, and if that stuff quelled,they had real peaceful protests, i think that there would be much better communication between the police and the community. >> what we have seen there in ferguson has raised questions across america about the militarization of police forcs.s do police forces across the country need the kind of heavy equipment that we have seen rolled out in ferlgson in some case, and did the equipment need to be used in the case? >> well, overall, you have the look at a post 9/11 world, and the terror threats that we face, and look at the history over the last several years that we have had active shooter scenarios in schools, theaters, and if we didn't have the hardened equipment, and the tactical e

responses that we do, we may be a lot worse off. i personally think that the terror threats are going to continue if not get worse in the future as the time goes on. however however, in this circumstance, we had a riot situation, and disorder situations where where i don't think that the equipment that was brought in was actually needed at the time. you should have that stuff in a standoff position, but just the riot control personnel, they don't need that heavy is artillery that we have seen. that fueled some of the fire between the community and the police. and hopefully, hopefully, we have learned a lesson from that, and not only in ferguson, but around the rest of the country. >> and one of the things that is happening as well is that the fbi, four different agents brought in, and the department of justice and independent federal autopsy will also be performed. is that the right move here to

bring in outside federal investigators to be part of this? >> well, now, i think that it is part of the municipality and the local and the state government and in this case, they were re e questionsed. if i requested that and the nypd, they would come in and as per my request. that is what has happened here. honestly, for all of the community unrest and the questions and the credibility of this investigation and the interaction between the community and police will probably be better off there, and it is going to be quite thorough, and i don't think that they are going to miss anything between the state and the local and the federal investigators and i think it will be coming out fine. >> and the tone between the police protesters and the police are eroding and what should they do? it all about communicatios s and going into the community and

talking to the community leaders and also the community leaders keeping the people out that don't belong there. i honestly believe that i don't think it is the people of ferguson that is doing the damage in these protests, in these disobedience and the lawlessness and the looting and all of that stuff, and i think that the people of ferguson should try to keep those people out that's taking this opportunity, and you know, the opportunists come ing ing in to damage and pillage or whatever they are trying the do, and i think that this hurts michael brown's family, and it hurts the community, and it hurts that relationship between the police and the community. >> all right. commissioner kerik, thank you for helping us to understand this all. >> thank you. and now, it may be a long time before a solution is found. we will have the details.

advocacy groups stepping up the pressure on senate democrats urging them to take action on immigration before the midterms. they are starting to fear president obama is being purchased not to use his executive powers. now, most americans want lawmakers to find a solution. michael warren, staff writer at the weekly standard joins us now to talk about this. i guess the -- the president's been criticized for using executive action, but on this issue people really do want to see something get done. if the president does take executive action, could it actually be a positive for him.

>> i don't know if that poll reveals that everybody wants the same thing done on immigration. he is more likely, even more so than i thought a few days ago, to do something executively in immigration. you have all these senate seats that might be up. if the president does something dramatic on immigration, he could put those democratic seats in danger. the immigration activist groups are putting a lot of pressure on the president and also a belief within the democratic party that if they do something dramatic on immigration, then they'll have a lock on the hispanic vote for generations to come. those are two real strong forces that are moving the president's hand on this. i do think that it would be in their thinking a very good move for the president. i'm not so sure it would actually work out the way they think it would. >> so you believe that democrats, particularly those

running in these red states, might be worried about this actually happening and affecting their election prospects, right? >> right. but we've seen this before. you think about a few years ago when the obamacare debate was raging. it was basically going to lose democrats the house, which it eventually did. this president i don't think cares whether it's going to affect his party or not. i think that you saw that with the obamacare debate. they pushed it through as best as they could, even after scott brown won his seat and republicans looked like they had a hold on the senate there, they kept pushing it through. i think the same thing is happening here. i think he's thinking more long term, the president that is, and not so much the next election. if i'm any of them, i'd be worried i think in the next couple weeks. >> the president has gotten a lot of attention about this

issue. is there an opportunity for republicans to get in there and to do something at this point? >> you do hear from a couple of republican senators. i think jeff sessions from alabama is maybe the most vocal about this, that republicans should hold the line and make sure that the president and some senate democrats and republicans don't do anything that would create amnesty for a lot of illegal immigrants. i think there's a real divide within the republican party on this particular issue. i think they're really trying to grapple. do they believe if they do something, that can help them with the hispanic voters, or would they lose more middle class blue collar workers. that's a debate that's happening. i don't think the party's quite figured out the answer. >> we have the briefest amount of time to quickly tough on something. on the irs, the federal judge saying he wants more answers, and what about other devices.
