result of the order to mask up. they have put on their gas masks . some of the guys don't have on their masks. they are talking. i am trying to listen to what he is saying. it is something about the street behind me. you can see what is happening. a crowd is forming up on the street. we are on the north side looking south. they took those road markers and not really cones and put them in the center of the street. there is also a road sign that they pulled out of the ground and took it to the center of the street. they are forming another line and taunting the police. don't steal the road signs. it is unlawful that you may be subject to arrest. we were watching that process and now we are watching them beef up their tactile gear. we haven't seen movement out of the officers, but it seems clear that they are ready to in the event the order comes

wow. >> do you need a mask, mike? no. i don't. um, all right. a good bit of tear gas went out. sounded like firecracker that's got everything started up here. i don't understand why they did that. people just standing around on the side of the street. why did they fire this? well, there are people who are in the middle of the street, shep. a lot of people in the middle of the street. they've been taunting the officers for some time. they'd blocked the street, barricaded it, if you will, with a bunch of different objects some road signs they pulled off the street. and you heard the order of the officer to mask up. i see them pulling a fire on some of the smaller powder balls i've seen those before. a lot of flag ban-- flash bangs

going off. you can see how much of it is out there. another flash bang. they cleared out this area pretty well. shep? >> they, it's clear they did clear it out. on the earth end of the street, steve harrigan, on your end, what's happening there? >> we have a daredevil here, in a civilian vehicle. he's faced off alone against a line of four-deep police, including s.w.a.t. vehicles. they're trying to get him out of the car. >> step back. >> steve harrigan is on a remote unit. some times, cameras go down. this is a camera just down the street from him. do you see him, he's talking about the daredevil. steve you're live, go ahead. >> someone tried to challenge the police line with a civilian

vehicle. he was pulled out of the car. and handed over to the police. >> what did he do? >> what did he do? >> he just drove his car down the center of the road in a faceoff against the police i'm not sure what his goal was. he is carried away in flex cuffs right now. >> i'm assuming everybody was down where the tear gas was now moved to where you are, steve, is that fair? >> no, they're still down there. i think tear gas has attracted some of the people. they want to take a look. and they're moving actually towards the tear gas if you can understand that. just one point to keep in mind numbers, earlier we saw perhaps a thousand protestors around twilight. a lot of families now, mainly young people

let's keep numbers in perspective. on this end of the street probably 150 protestors, max. so when you're talking about a city burning or on fire, we're seeing very few at this end. probably 400 police. 150 protestors. >> cameras can be ill lumnating and they can distort. we're watching the police with flash bangs and all the rest. then, residents trying to keep the peace others many are from outside, running around in a hooligan sort of fashion and hundreds of media with cameras it seems like if there weren't a sad beginning to it all, a horrible comedy of the absurd.

get here, keep your camera where it is if you can. you can see the authorities here, you can hear mike tobin coughing in the background they've set up a response to someone firing a weapon. if you can communicate has this been a change? >> no. we've got police looking at both sides of the street looks like they're using their vehicles for cover. looks like interest is on the east side of the street then west side of the street. we heard there was someone with a gun on the west side of the street we heard gunfire coming from the east side. that seems to be where they're paying the most attention we're on the ground right now to avoid possible gunfire. if indeed it flares but i can tell you that the closer you get to the ground the worst -- worst

be held accountable for actions on that given night. an investigation is underway the president of the united states has spoken the attorney general is headed there three autopsies being performed. now, on one end of the street, mike tobin is on the ground with lights off. as authorities look for someone who they believe may have a gun. and our steve trying to explain the reality of what's happening now that in the middle of the night a bunch of people are out for a show. it feels like in instances it's kind of our fault because those who have a vested interest of what happened are at home and in bed. there we are with the tear gas and the what at times seems like key stone cops and media. and the cameras. it's just. i don't know whether we should just let you go. and handle it as best you see

in this area. and kind of emerging from the back of this house is like a lot changed smoke went away and a number of officers went away. looks like more tactical vehicles showed up. it doesn't look like they're on alert for a major threat at the moment. >> makes sense. they're edgy. you can see them moving fast. looks to me like they're ordering them to get in the vehicle and they're about to ll out. so whatever they're after here seems officers don't feel is here anymore. it's aproblem they want to deal with at the moment. >> someone, somewhere is in control? >> back towards harrigan's direction. now, immediately, there is still tear gas out here. immediately to my south you can

>> i want to begin by thanking the brave men and women of law enforcement who tonight took another strong step forward at restoring order to the city of ferguson. throughout the night these officers acted with restraint and calm despite pockets of disorder and coming under violent attacks on several occasions. tonight began peacefully with calm and orderly protests. other law enforcement officers and i interacted with protesters who shook hands with officers and expressed their opinions. this was a freedom of

expression that we are committed to protecting. another 9:40 p.m., more than 200 people walked toward police officers at the corner west morrison and florence avenue. they were loud, but not uh tbres sigh. they came to the line of police officers and chanted and then seemed to be turning around and thinking out. police did not react. in fact, several of the protesters encouraged the crowd to turn around. indicating their message had been heard. that's when bottles were thrown from the middle and the back of a large crowd that gathered near and within the media staging area. these criminal acts came from a tiny minority of law breakers. anyone who has been at these protests understands there is a dangerous dynamic in the night. it allows a small number of

violent agitators to hide in the crowd and then attempt to create chaos. the catalyst can be bottles thrown, monthly to have -- molotov cocktails and shots fired. protesters don't clash with police. they don't throw molotov cocktails. it is criminals who throw molotov cocktails and fire shots that endangers lives and property. in the dark of night, there were at least two people shot. we have been criticized for using s.w.a.t trucks during protests. we did not deploy those until the crowd -- until things deteriorated. tonight we used a s.w.a.t truck and another large vehicle to get into a violent, dangerous area to extract a gunshot victim.

those vehicles not only provide protection for officers, but tonight they helped us get people who were wounded by gunfire and get them to safety. there were numerous reports of shots fired. we had two fires. one at a business, and one at an unoccupied residence. in the area of west florence and kentfield our officers came under heavy gunfire. our officers confiscated two guns during a car stop near the media staging area. these are mott acts of protestor -- these are not acts of protesters, but acts of violent criminals. our officers acted with professionalism. once again not a single bullet fired by officers despite coming un-- under heavy attack. four police officers were hit by rocks and bottles and

sustained injury. because of the dangerous pull tonight, i want the good people to come out and protest during the daytime hours. make their voices heard and where you can be seen and you are not the cover for violent agitators. that is my suggestion. i like the people concerned about peace in ferguson to consider that. as of 2:00 a.m., 31 people have been arrested tonight. there is many a criminal element coming to ferguson are not from this area. tonight some of those arrested came from as far as new york and california. i want addressed to the media that what is going on here,

media repeatedly had to be asked to return to the sidewalks and get out of the streets when the clashes were going on in the streets. if these situations going on, we need to have that area clear. this is a matter of your safety and the safety of others. we need the rods clear so we -- roads clear so we can quickly move vehicles to other sectors where people are in threat. please clear the roads when asked. please don't interfere with officers and give attention to the peaceful and not those determined to the rough and call attention to themselves. let's not glam more rise the act -- glamorize the acts of criminals. finally i want to say i am inspired once again by the citizens of this who carried a peaceful demonstration and encourage them to move on to other areas in the situation as it is deteriorating.

they are part of the energy and goodness of this community. that energy can light up and inspire and it can help us move past violence let us do that together. the people of the community deserve that. the businesses here in ferguson and all of north county deserve that. we all deserve that. i want to thank mrs. tihair and she was cleaning up bottles. she came from south county to clean up the streets of west morrison. on the table you can see two guns we confiscated tonight. these guns were in a vehicle that we approached that was right across or near the media and where each of you was standing. the vehicle pulled into a parking lot and had his windows down and prior to pulling in there, our air unit had followed the vehicle as it

fired shots near an apartment. when our officers approached the vehicle several in the media who were at the location began to cross the street and take pictures and walk up prior to officers securing the vehicle. here on the table you also find a molotov cocktail. many have been throwned last night and today. i told you in the media you have not seen these being thrown, but our peaceful protesters haven't seen these. a lot of times they are thrown without their knowledge, and as many of you saw today, you saw the bottles, the frozen bottles and the glass. we had one individual who walked between us as we were standing there and lined up across the street and threw down a fire work device.

it was an attempt to agitate the crowd as if law enforcement was throwing out some object i will take a few questions. >> the shooting victims, any updates on the condition? >> we do not have updates on their conditions right now. >> they both were male? >> they both were male. >> you said people should protest during the daylight hours? are you suggesting a curfew tomorrow? >> no, sir. i want our peaceful protesters to come in the daytime. all of these criminals at night that are masking themselves and hiding themselves behind peace let them come at night so we can put them away and we can make our -- ourselves clear. they can no longer mask themselves behind the peaceful protestor.

in the back who was shot. ii saw a car pull up and he was shot and dazed walking down the street. we cannot have that. we don't want any citizen hurt. we don't want any officer hurt. you are shooting into apartment complexes. children are laying in bed in an apartment complex and bullets are flying through the air. the old saying on the streets they say is a bullet has no name. we do not want to lose another life in this community. >> if you don't like violence, how come your cops are dressed like the military? >> why are our first amendment rights being infringed upon? >> you mention some of the people are coming from new york or california. is there any effort -- >> and were they journalists, the people arrested? >> these people were not

journalists that were arrested. i need to answer another question here. i am going to tell you in the midst of chaos when officers are running around, we are not sure who is a journalist and who is not. yes, if i see somebody with a $50,000 camera i am sure. but some journalists are walking around and all you have is a cell phone because you are are from a small media outlet! some may just have a camera around your neck. we may take some into custody. when we do take you icustody ane a journalist we have taken the proper action. in the midst of it we cannot -- in the midst of chaos we have to be safe. we have to be safe. we are providing protection for journalists. we had a journalist who was trapped in the midst of the gunfire and in the midst of the chaos.

we are providing protection for them. we took journalists back to their truck. i will tell you this nation is watching each and every one of us. the nation is watching law enforcement and watching our media. i will tell you if we are going to solve this, we have to do it together. i want you to think about that tonight. we are going to have to do it together. i can tell you i talked to one journalist and he talked about issues about the s.w.a.t vehicles and the s.w.a.t outfits they had on. i told him when we stood on the line and the businesses were being looted and now the families are saying we cannot re bound. it is rewinning our livelihood. the next thing i walk off and the media station said we did not do enough. i stood on that line and officers were crying and angry at me for standing on that line and letting that happen.

today some of those officers walk by me because they are hurt and uh named that we stood there. i will tell you we will make this neighborhood whole and make this community whole and we will do it together. i am not going to let the criminals who have come out here living in this community define this neighborhood and what we will do to make it right. have a great day. >> thanks, guys. >> we have been listening to a live press conference from captain ron johnson, the head of the missouri highway patrol. he was speaking there at the end saying we are going to make this neighborhood and this community whole. during the press conference he discussed the criminal acts he said being committed by just a few and not by protesters. others have been coming in. he said people have been

arrested from as far away as california and new york. this is ferguson, missouri, a suburb of st. louis. he said the police came under heavy gunfire on some of the officers. they said it was not an act of protest. it was an act of violence and the police have not fired a single shot in return. they were hit by rocks and bottles. he again pleaded what he saw the good people of ferguson to protest in the daylight and not be a cuff for violence in the evening -- be a cover for violence in the evening. it will cut down on the chaos they have seen since the shooting of michael brown. he has been inspired by the local citizens, but he showed two guns confiscated near meed yew area. he said several media were taking pictures and uh -- approaching the car fnlt also showing molotov cocktails.

and there was a fire work near the police line to try to intau gate trouble from the crowd. no word on those who have been shot in tonight's protest. the violent protest there and the demonstrations. he went on to say that the nation a watching and the law enforcement and the media say if we are going to solve this we have to do it together. he said the peaceful protesters and the local protesters come out during the day. they are not calling for another curfew, but calling them to go home in the evenings so they know who the troublemakers are. it is not enough to prevent further unrest in this troubled st. louis suburb. the town has been shattered by a black teenager and white police officer. he hoped for a calming scene.

authorities also setting up a designated protest zone for the nightly demonstrations. they can march, but not congregate. they will urge calm will condemning governor nixon's decision saying it could escalate the violence. tensions have been seething since august 9th when michael brown was walking down the middle of the street with friends when he had a confrontation with darrin wilson. accounts differ, but an autopsy said the unarmed teen was shot at least six times. >> it is inconsistent with the witness accounts that michael brown was shot while rushing to the police officer. >> it could beacon sis assistant with his -- be consistent from going forward or backward.

>> the fallout is being felt all the way to the white house. on monday president obama denounced the violence in ferguson. >> i understand the passion and the anger that arise over the death of michael brown. giving in by looting and carrying guns and attacking the police only to raise tensions and stir chaos. it under minds rather than advancing jus tig. justice. and our right to speak freely and assemble and report in the press must be safeguarded especially in moments like this. there is no excuse for excessive force by police or any action that denies the right to protest peacefully. >> attorney general eric holder will travel to ferguson this week to meet with fbi and other officials who are carrying out an independent federal investigation into brown's death.

recapping now, another night of confrontation between police and protesters leading to more violence, teargas, stun grenades and arrests in ferguson, missouri despite the presence of the national guard. there was lar -- more unrest in the suburb. the trouble began on august niength with the -- august 9th. it started with the fatal shooting of a black teenager by an officer. the report said michael brown was shot at least six times. we will keep you updated throughout the morning on any other significant developments. i'm robert gray in los angeles and now back to shepherd smith in new york. getting to be taxing and old. >> well, shep, i'm from st. louis, i have been here all my life. i've been here ten years now. and i have never seen anything like this. it's tiresome, going on every night, it's on tv every night.
