jon: for the tenth night, protesters marched in the streets of ferguson, missouri, but a glimpse of hopeful news, no reports of flying rocks or bottles or tear gas. welcome to "happening now." >> a grand jury hearing evidence today in that police shooting that killed 18-year-old michael brown. jon: and we're hearing from eric holder calling for an end to the violence. promising a thorough investigation as well. mike. >> take you there with live pictures right now, their devastating there because that is where the grand jury as opposed to convene. everything is on schedule but the grand jury is subject to witnesses, whether they show up. one person who could be a witness is the officer himself,

he does have the right to testify on his own behalf. we almost made it threw off the net without a clash of the demonstrators and police but it happened just after midnight. some bottles filled with urine, police spotted with pepper spray and even dogs. the stress getting to one officer pointing his rifle into the crowd and says i will kill you. >> i will [bleep] kill you, get back. get back. >> put your gun down, what are you doing, man? >> police have heard the rumors of killing a cop. last night they pulled the three guns out of the crowd.

there has been a lot of gunfire in previous nights. 47 arrests last night speaking to the notion of outside infiltrators. one person arrested for a third time last night from austin, texas. jon: mike, thank you. molly: now the horrific claim from isys terrorists who say it shows the beheading of u.s. journalist james foley. with the net in syria two years ago bit by u.s. intelligence community is analyzing the tape identify the landscape and possibly the masked executioner. they're trying to authenticate it but sources tell fox there is is no reason to doubt it is the real thing marking the first time the group we now know as isis killed an american citizen since the syrian conflict broke out in 2011 bringing the brutality of this terror group home to americans and raising the stakes in the u.s. battle with isis.

the video showing the execution of an american journalist, james foley. he appears with masks militants. foley starts his own call to the u.s. to stop the strikes and a grisly beheading with a knife. officials do believe it is the real thing and will be studying it hard to determine the authenticity and where the individuals could be. as for the reaction to iraq, witwhere talk to those driven fm their homes by bloodthirsty isis terrorists and call them monsters. they went on to say while the beheading is terrible, it is not unusual for isis. one said many family members of his were killed and others showed me images of beheadings on his cell phone that he had gotten online. for folks on the front line, they told me today they hope the

video is the longest held american is a former u.s. marine turned journalist who arrived at reports from syria in 2012. on august 14 of that year he was abducted. his parents who live in houston, texas, have heard nothing since that day. we talked to them last week to mark the second anniversary of austen's capture. >> there has been no contact, no responsibility, of course as you might imagine in cases like this we have had people attempting to claimant is something about us or had some ability to reach. all those faded quickly into nothingness. >> greatest fear is often is being held by the same isis group that just rudely murdered

four and casualty. american ukrainian who was fighting against the rebels. right now ukrainian troops are trying to surround the hotly contested city and drive out those russian rebels. the convoy of russian trucks remain parked at the border. many people in eastern ukraine have been without electricity for more than two weeks forcing them to cross into russia just to find food. molly: new concerns of the ebola outbreak as we learn a hospital in sacramento is now treating a woman who may have been exposed to the virus. live with more. reporter: the big worry for my health standpoint is exposure and transmission. what concerns some' is hospital and health officials in sacramento did not tell the public when or where this patient came from, what airport have ended, how long they have been in the u.s. or other facts

that may reassure people i did not bring contact with this patient. we do know kaiser permanente's treating a patient who may have been exposed to ebola. the cdc will test for blood later today. the agency says it is highly unlikely the patient has the virus yet never informed visitors or those being treated at the hospital of the possible patient. >> i'm speechless, i had no id idea. we have been in this hospital all day walking around. this is the first time we are hearing this. >> they should have let us knows we could take action among ourselves instead of hearing it from you guys, we should hear it from the horse's mouth. >> the cdc says ebola is spread only through direct contact with bodily fluids, blood, urine, mucus, of an infected patient. it is not transmitted through food, water and air.

yes the public can be confused with the doctors and nurses wearing full protective gear including hoods, oxygen when transferring a patient giving the impression of virus is airborne when it is not. more than 1200 have died from the disease, the u.n. and cdc are setting up centers in west africa to stop the out right from spreading by stopping travelers from getting on airplanes. so far the cdc has tested six samples of suspected cases in the u.s. back to you. molly: thank you very much. jon: now this fox news alert, a hostage standoff in illinois going on for the last 20 hours is over now. it began with two armed burglary suspects shot to officers and barricaded themselves in a home with multiple hostages. those suspects are now in police custody.

molly: texas governor rick perry looked on felony abuse of power charges. the governor turning himself in yesterday, fingerprinted and had his mug shot taken. the latest details on this sto story. reporter: not everyday you see a governor with a mug shot taken. next comes the arraignment scheduled for friday morning. the governor's case is on the docket for 10:00 a.m. eastern time in the criminal district court in austin. i have been told by his lead attorney the governor will not be in attendance on friday. he is headed to new hampshire. almost looks like he was wearing this as a badge of honor speaking to reporters before he went into beefing up and then booked and as he came out bolling to challenge what he calls a political stunt. >> i'm going to fight this injustice with every fiber of my

[applauding] and we will prevail because we are standing for the rule of l law. >> and now the photo that has gone viral after his mug shot was taken and he was fully processed, this showed up on twitter and his after he left the courthouse, governor perry stopping off for ice cream with members of his legal team on a hot august day in texas. people on both sides of the political aisle says this seems full of holes. some have said it appears like retaliation from a woman who was the district attorney down in austin, she was arrested last year for drunk driving more than three times the legal limit. a lot of people in the community demanded for the public official to step down including the governor himself. when she refused to resign,

perry said he would veto millions of dollars in funding the program her office oversees, and he did just that. he said very publicly he was going to veto and he says that is fully within his right as governor but critics say that alone is a textbook example of abuse of power charges. we will see if it sticks. molly: so many political and legal questions. thank you very much. jon: we are standing by for the arrival of attorney general eric holder in ferguson, missouri. there is little question race plays a big role in what is going on there. a powerful piece in the "wall street journal." juan williams looks at this town and america and how black and white need to close a look at the root causes of mistrust. he writes the imbalance among racial groups as well as long and difficult history of racism in the u.s. amplifies these

fears on all sides. juan williams is with us now. know you spoke to the attorney general not that long ago, what is this mission today, what is he trying to accomplish? >> i think it is reassuring people there will be transparency in terms of the investigation. concern the police department the way they have handled the case has bumbled it at times and has taken provocative actions rather than to assure people without regard to race, thereafter the truth of the matter. the attorney general by bringing federal attention to this again is offering reassurance to all sides. jon: some would say he is inflaming the situation, the pronouncements from the attorney general and the white house, the fact they are opening a federal investigation, it makes it look like local officials cannot handle the problem. >> the problem is you have had these riots now for several

days, several nights, and there is concern there has not been sufficient investigation or proper handling of the probe. i suspect that is what attorney general eric holder's after, think that is what the white house after to say to anybody protesting this is now in capable hands, it is not going to be a cover-up, there will not be any attempt to make excuses for what happened. no matter what the findings, will treated fairly in the american justice system, reliable trustworthy american justice system. jon: one of the leading causes of death of young black men. we will talk to you about that in just a bit on the other side of the commercial break. please stay with us. when you run a business, you can't settle for slow.

jon: back once again with fox news political analyst juan williams who wrote a thought-provoking police about what is going on in ferguson writes now. you say thuggish behavior as part of the problem here and the police police that video that showed the victim michael brown robbing a convenience store, 300-pound, 6'4" so-called kid. >> i think it is outrageous especially the civil rights community wanted somehow excuse this. i think so much of what we are experiencing in ferguson is a window into america's racial fears. stop and think about the reality not only in a white community, but black, hispanic, plea deal with reality about half the

murders committed in the country are against black people and typically by other black people. the number one cause of death among black male is murder. 90 plus percent committed by other black men, other black people. nobody wants to be near that kind of violence, thuggish behavior. extend to robbery, assault, other violent crimes. it is damaging every community, terrible, people are afraid. but then you say that out loud, don't say that, we don't want to say anything that makes excuse for the fact you had a policeman shoot at an unarmed kid. the racial fears feed the politics, the anger and i think it feeds conspiracy theories that are baseless but not only in the white community but in the black community as well, people have to be honest about it. jon: you talk at the end of your piece about the actors who

glorify this kind of thing. >> you are onto it. i can't tell you how upsetting it is to me. you see these actors and rappe rappers, i am a tough guy, a rite of passage, i went to jail, i shot so many men, ima tough guy tough guy, a scary like guy, that feeds stereotypes and caricatures, it is the worst. you don't see the black leadership saying i'm going to lead a protest against this effort to malign black men in the country, that is not the way we behave and not the example for young people who too often now come from single-parent families, lacked guidance and see these images and take to them being the authentic image. it is corrupt, corrosive and it hurts not only the image of black people among whites, hispanics, that it hurts inside the black community.

that video, showed it in english send a message and the video itself has writing in english is designed to intimidate, to deter the united states from conducting not just more strikes, but to arm and weapon eyes and train the kurds and iraqis. to deter from getting a strike against them in a future. molly: now they have this multilingual propaganda wing really. she may be very concerned about it being in english? >> in english it means they want to reach the united states public opinion, western, public opinion, but agencies of the government are looking into th this, many other videos where people boasting about the fact they are from britain, from australia, and involved with

isis. these individuals who have potential uk or western passports would be able to go back to those countries into the united states and conduct terrorist activities. molly: pretty to the rise of militants across the middle east, what does it mean he was held for so long. >> he was apprehended two years ago, other hostages, he was arrested in syria, monday they will clash with the united states, they actually engage against the iraqi government, and as soon as the united states strike against them, they have the beheading and are threatening to behead or kill another american citizen.

how has the media performed in this crisis and what about their assessment of president obama's performance? the fox news media analyst joining me now. thank you for joining me. we have all been watching this unfold, a dangerous situation, a very sensitive topic in some respects, how has media done? too much blending of facts and opinions? >> there is certainly no shortage of a polarizing opinion and some reckless speculation based on fragmentary accounts. we still don't know what happened here, but you look at the nightly reality shows ferguson has become, this media invasion, no question they have exacerbated the tension the outside agitators are drawn to the bright lights and some anchors and correspondents who are openly sympathetic to the protesters and kind of not terribly sympathetic to the police. molly: too much taking sides?

>> some are doing a good job, but others are grandstanding, some were almost seeming to provoke the police in order to get good pictures, and all of us are collectively guilty. of course every organization wants to cover it, but when you have some journalists not moving when the police tell them to move, they want to create friction or let's just say when there is a quiet night it is not very newsworthy. when there are a lot of arrests and violins and rubber bullets and tear gassing, that is good television. not good for combing down the situation. molly: i want to address your column about obama, why he cannot win on race. why can't he went on this issue? >> if you look at the remarks he made at the news conference the other day, he could almost put them on a scale.

too many young men of color are seen as objects of fear but of the same time he says young black men commit crimes who need to be prosecuted. made about toward excessive police force, and yet he got widely criticized, the president did, for being too tepid, not showing enough passion. despite the fact ferguson is a tinderbox and if there ever was a time when a president needed to show restraint, this would be the time, yet he has been graded by some of the media on style points. molly: thank you for joining us, keeping an eye on the media keeping and i and everything else in ferguson, thank you. jon: back to our top international story, that horrific video released by isis showing the beheading of an american journalist. making it clear james foley was killed in retaliation for the u.s. air strikes that have been so effective in iraq in the last couple of weeks. they threatene threaten the liff

another captured american journalist if the airstrikes do not stop. we just received confirmation from the national security council the video "is authentic." all this coming a time the country hopes a new leader can feel the secretary and divisions that have been contributing to the tearing apart of iraq. ambassador james jeffrey, former ambassador to iraq, i am sure your stomach was turned as much as anyone else by that horrific beheading video, but take a step back from that, what are the terrorists trying to say, how should we respond? >> it was terrible and we must keep in mind tens of thousands of innocent people in syria and iraq have suffered a similar fate to the hands of these people. the terrorists are trying to intimidate and provoke the united states. they suffered a major defeat,

what they are trying to say is we are back to pursue our agenda of a war against the rest of the global community and regional community and we taunt you to do something about this. jon: using the murder of this journalist to try to prove how strong they are, to prove they are in control. >> exactly, they will continue on their agenda open the door to what are we going to do. jon: and what do we do, what would you tell the president? >> the president had success using air power, he had good troops on the ground. there are similar troops on the ground. a similar government being formed, and a good chance they will have a better approach toward the minorities than the former government. all the pieces are in play for president obama to move forward

been fired from gaza at israel and that continues as i mentioned. israel has hit back with 92 airstrikes since yesterday in gaza including a house that apparently reportedly hamas military commander was staying in. now officials, intelligence officials with israeli military believes he was killed in the heavy airstrike but i want to be clear, we haven't been provided any official confirmation or proof that he is indeed dead. that said hamas has confirmed his wife and son were killed, but they deny he was killed, though he hasn't provided any information that he is alive one way or the other, so still waiting on more details at this point. the death toll since yesterday 22 palestinians have been killed including eight members of one family and among the dead three children, select this point what impact his staff and military

their kids out of class amid concerns the school district isn't doing enough to deal with the problem. a pediatrician at st. louis children's hospital joining me to talk about this. >> thank you so much for having me. molly: why are they dangerous, what are the risks for children especially? >> pcb is a chemical that gets stored in your body fat and is very hard to get rid of and builds up over time. associated with cancer and a host of other medical problems including the endocrine system and reproductive system, in particular can have an effect on the thyroid gland and neurological development, especially in children so exposure is associated with development and trouble learning so the last place we want it is in school. molly: how much should parents out there worry?

this is a problem in schools? >> every school district will be very different. every school in every classroom will be different so it is a difficult question to answer. pcb was used in the caulking around windows and doors and door joints between the 1930s-1970s. some of those can actually evaporate into the air, and are in the dock docs of classrooms. the malibu school district tested the classrooms and found them to be negative. some of the caulking was positive. families including cindy crawford are asking the school district to test every window and remove the caulking. the risk of the children in that school is very limited unless they are touching the caulk. i think i would send them to school, but i would tell them not to touch caulking. jon: what are your thoughts on cindy crawford of this, is she doing the right thing, being an

activist for her kids, or going too far? >> i think cindy crawford is trying to make a point and a very important point of the need for mandated testing. we do mandates testing for red and other toxins in the school but we do not mandate pcb testing. you have to weigh the risk and benefits whenever you make any decision for your children including pulling them out of school. you have to think of the cost of the lost school time given the rest is probably very low given the negative air and dust testing which is consistent with the regulations. molly: thank you very much, we don't hear a lot about this, we appreciate your insight, thank you for weighing in on this for us, thank you. jon: the unrest in ferguson, missouri, continues, police make dozens of arrests just last
