john and is part of an ultra mad cal group of isis fighters inside syria. he was a ringleader in a ransom swap for 11 other hostages. isis offered to free foley for $100 million and other demands but the white house would not negotiate with terrorists. >> in governments and peoples across the middle east there has to be a common effort to extract this cancer so it cannot spread. the group like isis has no place in the 21st century. >> coincidence or not his statement and details of foley's death occurred on the same day the pentagon discussed sending 300 more soldiers for security around baghdad. they also announced more air strikes around isis targets in iraq. there are still 2 other americans held hostage by isis.

changing by the minute. >> heavy rain not enough to keep demonstrators from flooding the streets. we are live on the scene where several people were just arrested. is that right, garrett? >> that is right. but really last night was the polar opposite of what we have been seeing for much of the previous nights here in ferguson. there were six arrests but that's compared to 47 arrests the night before. police say the crowds were smaller as well and that they were much more peaceful. they were down to around 800 compared to the several hundred that we have been seeing through out the last week. police say wethere weren't any major clashes between police and protestors. captain ron johnson called it a another small step in the right direction. >> tonight was a very good night in ferguson. crowds are smaller. they were calm. we had to respond to fewer incidents tonight.

there were no molotov cocktails no fires no shootings. we did not see the single hand guns. there were no confrontations. >> several supporters of darren wilson who shot michael brown and showed up to the protest as well they were quickly whisked away by police for their own safety after other protestors began to surround them. captain johnson this morning also addressed the case of an officer who on tuesday night pointed a semiautomatic assault rifle at a peaceful protester threatened to kill them. our cameras were there when it happened. take a listen to that.

in the fbi there were about 12 million arrests in the usa. that averages out to 30,000 arrests per day. in 99.9 percent of those cases the perpetrator was not killed by police. in fact, just over 400 fatal police shootings a year are reported to this country according to the fbi. 12 million arrests a year, 400 fatal shootings, many of them justified. al sharpton has the nerve to assault the american police community, men and women risking their lives to protect us. this charlatan has the gall to do that and nbc news is paying him. my god, why is that acceptable?

>> last night the most peaceful in days as the grand jury begins to examine all of the evidence in the fatal shooting of michael brown. here to breakdown the process is defense attorney eric guster. can you breakdown the process? >> the grand jury process is a secret proceeding where only the prosecutor will present witnesses and the autopsy report. the defendant can testify. >> there is justifying doubt if there can be an indictment. >> if charges can be formally filed in this case. >> that all depends on the evidence and we don't know much about evidence. we don't know what his reports say after the shooting.

>> that is one of the big issues with this case. the public wants to know exactly what's happened. that is what is very frustrating to the people of ferguson they want to know what the officer said what witnesses are saying. that's what we don't know. in the grand jury process those witnesses will take the stand under oath and testify truthfully. >> the officer's attorney his defense attorney will not be able to be in there unless he testifies. correct? >> correct. >> would you let him testify if he was your client? >> it depends on what he has to say. a lot of it depends on what he said after the shooting and what other witnesses may say. i know we have had witnesses who appeared on television but a lot of these witnesses did not. so attorney general eric holder sent fbi agents to ferguson to interview people. the defense attorney may have privy to that information but can't release it. >> in a political case such asuh as this is it smart to ask for a

the background of the picture. >> let's take a look at the image of the terrorist in question. >> the close-up image you are not going to get a lot of detail. when you back out you get the height, the stature of this individual, that is going to tell a lot. i know from criminal investigations we get -- we do know the height of the reporter and when he is on his knees you can gain the height of this individual as well. >> the voice as well. we heard him speaking had a british accent. very well spoken. what does that tell you? >> i will tell you that they would not put a guy in this p position for the world to see unless he was somebody of importance. the way he spoke with calmness and the fact that he is british is a message coming out clearly that hey we are not just from this region. we are every where. >> we have another image we were going to talk about the eyes and the hand here. what does this tell you? >> i has a weapon in his hand.
