james foley's parents were not done with their press conference and sitting there crying over the death of their son who had been beheaded. >> joe coming out on the democratic side saying if i was advising the president i wouldn't have advised that. >> it doesn't make any sense. it's not equivalent to the harm he discussed. and to step out on to a golf course. there's a lot of stink going on about the obama hitting the links. and americans are asking the question has he hit a double bogey. remember about ukraine? he spoke one minute when the plane went down. people are saying what is the disconnect? what is the incensivity? what is the lack of understanding of the depth of the pain of a family of the nation and how do you laugh at one moment we're speaking about things that are so serious. defenders say the president needs to come part meant lose.

who bombed us in pearl harbor. the idea is we made a terrible mistake for decades pre-9/11 in pursuing it as criminal offenses. as individual acts. rather than understanding that we have in isis an entity that is armed, has a ton of money, a ton of recruits, controls enormous amount of territory and declared open war on the united states of which the beheading of that journalist of that american was simply one instance. >> growing war on terror, too. it's something we've been dealing with for decade. he went on to say remember back in the late '90s we had an offer in order get bin laden offered to us by sudan and the clinton administration said we can't take it. we can't indict him. what are we going to do with the executioner once we get him? are we going to have him be a fall guy? these guys, isis is so well organized and sophisticated they're okay with that. and so probably they're not

scared of that. that's their cause. >> as a lawyer, what do you make of this? >> i think it's a huge and serious mistake. especially when you hear what general martin dempsey who is the chair of the joint chief of staff. he said it's an organization that has an apock limitic end of days strategic mission that eventually will have to be defeated. do you defeat them in a courtroom in the southern district of new york city? >> no. when you learn more about isis, i was raefding reports yesterday on isis and how they managed to radicalized the kids coming out of britain. it's remarkable because they -- first of all, many of the interior group of isis doesn't want to carry out some of the attacks. the younger individuals who are a part of isis are coming and realizing they're never going to return home. they're going to be martyred and one mission and one mission

only. to die on the battle field. they're never going back home. you going to beat them in a courtroom? it's remarkable. liberals even saying the strategy of the department of justice launching a criminal investigation makes no sense. >> common sense says it's incredible. >> your thoughts on that. another story. another fox news alert. the credibility of the key witness in the michael brown shooting now in question this morning as we learn details about his criminal past and a warrant out for his arrest. will this change the case? we are live on the scene with more. good morning, garrett. >> good morning, anna. two weeks ago, when michael brown was shot, his friend dorian johnson was there. now his account of that shooting is responsible for much of the fire storm that we have seen the last two weeks here in ferguson. here is what he said. >> he put his hands in the air and he started to get down but the officer still approached

with the weapon drawn and he fired several more shots and my friend died. >> but now the credibility 77 that account is coming into question. police records show in 2011, johnson was charged with stealing a package off someone's doorstep and repeatedly lying to police about his name and his age when they brought him into question and into custody. he never showed up to the scheduled court appear and the arrest record, which is in colt county, missouri, 120 miles from the st. louis area is still there. his attorney, though, he says that these problems with the law are really in his past. they should have no bearing on his credibility in this case. now meanwhile here in ferguson, the protest continued to die down. last night was another peaceful night. the missouri governor jay nixon is beginning to withdraw the national guard from here in ferguson, and police are saying it's just another small step in what they hope will be a

communication with mexico drug cartels looking for a way to exploit the southern border of america. rick perry said they may already be in america. >> there's the obvious great concern because of the condition of the border from the standpoint of it not being secure and us not knowing who is penetrating across, that individuals from isis or other terrorist states could be and i think it's a very real possibility they may already have used that. >> wow. the format are policiedy adviseo the homeland security committee joins us now. what do you make of these reports of isis collaborating with mexican drug cartels to exploit our southern border? >> i think that governor perry's

words are unfortunately very, very true. we have seen this administration in and the lack security, a lack of policy along the u.s. border. i think more importantly, they really have shown this administration a lack of understanding. they've absolutely under estimated the threat from isis. and almost now a i was advising senior members of congress on the threat from isis. so this is something that the administration -- that has been known to all of us for awhile. >> where are we pulling this information from? i'm curious. you point out the cartels have been collaborating with al qaeda going back years. are we hearing chatters. can americans rest easy that the fbi is watching the individuals? >> i think that the problem here is many fold, unfortunately. first of all, isis is group that

will do whatever it takes in order to accomplish its goals. it's not -- it's very brutal. it's very aggressive. they're going to do anything. if that means working with cartels, if that means working with other enlisted groups in order to attack the homeland, they will do that. other groups like al qaeda or other terrorist groups who have a desire to hit the homeland will also use that. however, the one particular sort of a difference here with isis is that we have americans that have left america and are now working, training, fighting with isis, both in syria and iraq as well as, you know, the numbers are vary but possibly over 2,000 europeans. and those europeans can pose a threat to the homeland. we have this sort of double front aggression toward american borders, which is why the administration needs to continue -- needs to start,

ebola disease. and the patient got the experimental serum several days, actually, after he contracted the disease. we don't know whether this is what resulted in his recovery. he may have recovered anyway with supportive care, intervene use fluids and measures. but at the end of the day he's done extremely well. it's easy to think he recovered because the serum. we don't know that. i remember talking to you the day he made it to the hospital and we saw him walking on his own. you thought he was going to be okay. >> i did, actually. i think the key here is that with the ebola treatment in western medicine, he got the right treatment. he was rehydrated. this is a virus. and so there's no actual treatment for his particular problem. there's no vaccine at the moment. there are studies going on. but the key here is the overwhelm iing snap sis causes huge dehydration. and it's what results in

brown and 43-year-old eric garner who died last month here in staten island, new york. do the rallies do more harm than good? joining us now is pat lynch president of the new york city patrolman's benevolent association. the question i have first is do the rallies of al sharpton contribute to any civil discourse to this city or any city in the united states? >> he take tragedy and raise his old profile. he's not doing -- >> it doesn't contribute to civil discourse. >> what happens is he's telling folks that, you know, you don't have to listen to the police. if we were in a situation where every job, even basic jobs are turning into resisting arrest jobs. it's dangerous for everyone. it's dangerous for the new york city police officers, the public, and even dangerous for the person being placed under arrest.

>> what about the notion of no justice no peace. is that a threat to a civil society? >> new york city police officers are what brings peace to the streets of the city of the new york. no one else. we go out there and protect your rights. we'll protect his rights tomorrow to march in staten island. we'll make sure he can say what he believes and coit safely. >> it's important that the police protect everyone in a society. there are some people in staten island, some business owners in staten island who say they're going to close up shop because they're terrified of what will happen during that march tomorrow. can you give them some assurances that it'll be safe in it's safe to keep their stores open tomorrow and during that march? >> new york city police officers deal with demonstrations every day by the thousands of people on the street corner. and we do it well and we'll do it peacefully. we'll do it, also, on saturday. we'll make sure store owners can do business, the protesters can be heard, and everyone else is safe in the meanwhile. >> what about the rhetoric that

has become popular and really wide spread across this country now especially in left wing media but police are occupying force. that their militarized and have no tie to the community. and the goals are destroying. >> 60% of police officers live in the confines of new york city. would we occupy our own town or schools? we're there to make sure it's safe for everyone. this making the police officer the enemy is absolutely wrong. we can walk down the street safely in this city this morning because new york city police officers took the streets and the street conners back from the criminals. they're the occupying force. we should never forget it. >> in staten island there's at least one police officer under scruti scrutiny with regard to the conduct of others. they say a choke hold was used.

you said it wasn't. were the police officers doing something right or wrong? will they be indicted? >> they were doing their job as trained. a take down maneuver. bring the person to the ground so we can safely place them under arrest. unfortunately, in this situation there was a tragedy and a lot of factors including his health that came into that. this is a tragedy for that police officer as well that has to live with the fact that a man has died. we were on the corner not as an occupying force but the community complained and the community council complained people said there's crime and prostitution and drugs. >> people are saying white and black. how do we bring people together in the country? new york city police officer shot and paralyzed by a young african-american boy. he not only forgave the boy but counselled him. is that an kpachl we can follow here in new york city? >> absolutely. there's a police officer black and white, police officer white

gunned down in the park. a hero to every new york city because to this day, he'll speak to the police officer and educate us. he'll speak to the children in the community and educate them. the reality is it could be any one of us that get the tap on the shoulder and say it's your time. >> it's shocking that educators and educators union that teachers union in new york city are supporting this rally tomorrow. what is that about? >> disgraceful. you're teaching your children not to respect new york city police officers. new york city teachers and police officers work hand and hand. when there's a problem in the school, they dial 9-1-1 and police officers shows up. on top of that, to us many teachers are family. our children become teachers and police officers. it's wrong for their union to put a separation there. >> thank you for being had with us this morning. >> thank you. coming up special needs kids forced to sort through the garbage. turns out it's part of their

nearly turns deadly one plunges 100 feet on a colorado glacier. dylan landed on his feet and he says it's all thanks to his back flip. >> yeah. matt campbell was with dylan when he fell hep joins us with the incredible story. nice to see you this morning. >> it's nice to see you, jim. how is dylan doing this morning? >> dylan is doing very, very well. a lot better than most would think. >> you were there witnessing the whole thing. take us through exactly what the rock face looked like and what happened when you saw him fall. >> so essentially it was a gorgeous day. beautiful august day. the rock face is a sheer rock face with a slight gray to it. but essentially they were cody and dylan were climbing together. they do a lot of rock climbing

they have multiple years of experience. and it was a freak accident. he lost his grip with his foot and then the rock pulled that he was holding on to and it snapped and broke. and, matt, all three of you are free climbing. which a lot of people would say you are taking some incredible photographs but you're asking for trouble here. yikes! has anything like this ever happened? >> no. and with the free climbing, it's not like we've just decided, oh, hey, there's a wonderful rock we'll climb it. both of the guys are extremely experienced. cody himself has been climbing about five or six years. and dylan is around three to four. so it's not like they're fools and just trying to jump off the rock base and, you know, ask for it. so they are certified and

multiple other things. >> and dylan a gym nist. he could have fallen any number of ways. he could have fallen any number of ways. how did he fall and how the way he fell save his life? >> so whenever he fell, because he lost his grip from the foot and the rock pulled. it caused him to fall head first. essentially from gymnastic and dance and all of his experience and background, he had aerial awareness as he was falling. and he did a flip in midair, landed to his feet and the entire time while he was tumbling down he was spotting and trying to grab on rocks. due to the momentum. there's no way of stopping yourself instantly. the entire time he was doing differenteuvers to spot and young grab and spot and grab and just fight the entire way down. >> without a doubt. his instincts helped him land on

his feet. he really hurt himself. his knees, his legs. tell us how his injuries are doing this morning >>well, he still has one more surgery, i believe he's having the surgery in a few hours today. it's going to be on his ankle. both of his knees have been worked on and there's going to be plenty more surgeries in the future. he had his kneecaps and a ten ton attached. his femurs had multiple surgery and he had some lower spinal injury. but good news is that he's not going to be paralyzed and we're going to get him back into gymnastics and he'll be flipping soon enough. >> but indian the three of you are never going to go free climbing again, is that right? >> absolutely not. that was sung even before the helicopter made. it was a pact made. it's just a horrible experience

garbage to find plastic bottles, metal cans, and the like. and he had to wear gloves and he had to wear a smock and he was dressed as though he was a sanitation engineer, or garbage man. is that correct? >> unfortunately, yes. >> when you objected to it, what did the school say? >> they basically told me -- they seemed to be extremely excited about their recyclable program and that this was teaching them life skills and it allowed them to have the finances to do things like go to the store or get on the bus, go to the store, buy some food to bring back to class to cook. so it was an overall life skills program that teaches them about money. >> were they teaching this about money to children who were not special needs in the school district? >> no. >> so it was only the special

needs. they put out a statement -- i want you to react to it. it's a long statement and they lay out what their rationale is. recycling is also part of a curriculum sequence of the functional skills class. in this class students collect recyclable materials. with the proceeds from the materials, teachers create mock bank accounts for students and in turn, students learn to keep a ledger, write checks and develop a budget. everyone has worked for the program and was aware of the program, ourselves included, believed it was educational and positive for all of our students. question to you, carmen, educational, positive and were you told about it before your son came home showing ticks, emotional ticks and you knew something was wrong? >> i'm in complete disagreement that this was okay. >> why? >> i do not believe that a, our children were not participating

with other students in the school and that's a part of inclusion. that's the whole reason they're in a regular school. so that made them feel embarrassed. it made them feel ashamed in front of the entire school to have to do that. i was not happy that there was a health risk for the children because a lot of them have compromised immune systems. and of course, we never consented to this. we were never aware that this program existed and why would they coo it on the first day? we don't even know about it. >> do you feel that your boy and the other boys and girls were stigmatized? >> absolutely. >> have they apologized to you for what happened? >> i saw an apology in a newspaper. >> in a newspaper? did anyone call you up and say mrs. wells, we're sorry that we put your boy through this. we hope he's feeling better and we're sorry that we may have compromised his immune system and that of other kids.

as soon as the kids go to school, we get the house back. let's check in with maria molina who is outside right now for the forecast. >> good morning. that's right. out here in new york city, it turned out to be a pretty nice day out. we woke up to showers and storms in the overnight hours. part of the reason why we're seeing this activity across the northeast is because farther off towards the south, we have a large high pressure system in place across the plains, southeast and around that system, that's where we're seeing the showers and storms across parts of the rockies and midwest and also into the northeast. it is going to remain a little unsettled out there in those areas today. severe weather is a concern in parts of kansas, parts of nebraska, western iowa, omaha, you are included. large hail, damaging winds and isolated tornadoes will be a concern not only today, but also into tomorrow. that shifts farther to the north across the dakotas and parts of minnesota. that heat wave continues from the plains to the southeast today. take a look at the highs and this is what it's going to feel like when you head out the door. 105 in kansas city and memphis.

voices aren't being heard because of the combination of all the things, from florida to chicago, to right here in new york city, all of these things make them feel like their voices aren't being heard and people are not responding to what they're saying. so i do agree with the fact that they do need to come together and be unified to say hey, something's got to be done. but when something has to be done, i think we need to allow the judicial system to do its due diligence, you know. >> if we lose faith in that, what do we have? >> we don't have anything. the prosecutor needs time to make a case. if you abort the time he needs to make the case, then what happens if justified homicide comes back? >> the reverend should be listening to you and the congress who is calling for the removal of this prosecutor. you can watch your show this coming wednesday.

>> wow. and here with his review is kevin mccarthy. i can't believe nine years, really? >> i know. i cannot believe it either. what's funny, the first movie i ever reviewed in the history of my movie review and career was the first "sin city" on my aol instant message to an audience of 50 people. and here i am nine years later. i was so blown away by the first movie that i saw it three times opening weekend. what robert rodriguez did with the special effects was amazing. if you're not familiar with the story line, it's bunch of stories intertwined into a film and you have law, revenge, brutality. very, very violent. not for the kids whatsoever. you have an amazing cast. josh brolin, bruce willis. but the amazing thing is that it was shot entirely on a green screen. no sets whatsoever. so imagine when janis and maria and rick do their weather every day on the green screen, that's how it looked for the actors on

the set. and they would have nothing around them. the environment was fully green and they add in everything later. there were times when actors actually walked on treadmills. so if they walked hundreds of feet in sin city down an alleyway, that was on a treadmill. it's amazing they're able to do that. the problem with the new movie is that they don't intertwine the stories as well and the third act is very, very, very weak. i thought jessica alba was great in the beginning, but i thought she overacted at the end. skip the 3d, but only see it if you're a fan of the original. i had a chance to talk to josh brolin. >> i still have any original sin city ticket stub. >> oh, my god. that's amazing. high five. >> this is when your character is driving. how did that look on set for you? what do you see?

took to facebook to say we're coming after you, isis. we need also boots on the ground. what do you think? >> when i hear people -- i've been 11 times to the war in iraq. 11 times to the war in afghanistan, somalia and every other crap hole in between over the last couple of decades. when people say just air power, i don't think people have seen what air power can do. if you saw the highway of death after the kuwait invasion when an iraqi army was wiped out by the united states of america air power, naval air and the united states air force, just air power is to minimize the power that we can wield from above. >> the balkans. >> exactly. we went to kosovo without a single boot on the ground. we can destroy their efforts. they have arrogantly taken our vehicles and they parade with

without missing a beat he said the absence of black fathers. so what are we talking about here? there were 7,000 murders last couple of years, average each year of black people, almost always committed by other black people. in chicago alone we had almost ten homicides, mostly blacks during one year. and most of those are unsolved. in the case of ferguson, at least we know who did it and the odds of an unarmed black person being killed by a cop is very, very remote. the odds of your being killed by another black person is much higher. in the white community with out of 100,000 people will be killed. in the black community, it's 14 out of 100,000. you're seven times more likely to be murder fundamental you're a black person than a white he person. what are we talking about here? >> you mentioned eric holder. he flew in on wednesday to ferguson, made this case well personal talking about himself quite a bit. take a listen to him. we'll get you to respond. >> national outcry we've seen speaks to a sense of mistrust and mutual suspicion that can take hold in the relationship

between law enforcement and certain communities. i wanted the people of ferguson to know that i personally understood that mistrust. >> he's talking about mistrust. 70,000 people signed a petition now to remove the st. louis prosecutor involved in this case. what do you make of what eric holder had to say? >> i'm used to hearing people like sharpton and jesse jackson make irresponsible comments about our criminal justice system. but when i hear president obama and eric holder make the same kind of comments, small wonder why so many black people believe that the criminal justice system is racist. you have president obama claiming that there are more black people behind bars in colleges and universities, when in fact when you look at college age black men, five times as many college age black men are in college and universities than in prison. you have eric holder falsely claiming that the reason that blacks are given somewhat longer sentences than whites for the same crime is because of racism, when in fact it's because the reason can be explained for legitimate reasons, closed quote.

punishment? >> after that, one of the classmates asked her what she had against the word bless you. she said there would be no godly speaking in the class. and that's when i said my pastor told me that i had a constitutional right and it's my freedom of religion and freedom of speech. and she sent me down to the office. >> jeremiah, the roots of bless you or god bless you goes back to like, from what i read, 77 a.d. does kendra have a constitutional right to say bless you to another student who sneezes in a class? >> fox she does. it's remarkable if you review all the stories we have of cases like this at liberty institute.org how often we're seeing this constant refrain that you can't have any kind of religious speech at school whatsoever. now we're debating whether or not you're actually allowed to say god bless when you someone sneezes. it's unlawful for a school to tell a student or tell any student that they can't engage in their faith while they're at school.
