means. thanks for watching us tonight. ms. megyn is next. i am bill o'reilly. please always remember the spin stops here. we're definitely looking out for you. breaking tonight in a "the kelly file" exclusive, a top congressman on the homeland security committee saying that four known terrorists from the middle east were allegedly caught sneaking across our southern border into the united states one day before 9/11. we will have that exclusive for you in one moment. but first -- also breaking tonight. after weeks of pledging no troops on the ground in the fight against the world's most dangerous terror group, there are clear signs the obama administration is reversing course contrary to its denials that it is. good evening everyone and

welcome to "the kelly file." i'm megyn kelly. the president's often repeated promise started to unravel yesterday when the highest ranking military official in this country, general dempsey, floated the idea that u.s.t! on the ground could, might, possibly be a very real possibility. >> if we reach the point where i believe our advisors should accompany iraq troops on attacks against specific isil targets, i'll recommend that to the president. >> that suggestion went a couple steps further today. first, former obama defense secretary robert gates, he also worked for bush, said this this morning. that the fight against isis will require u.s. boots on the battlefield if we hope to have any chance of actually succeeding. >> the reality is they're not going to be able to be successful against isis strictly from the air. or strictly depending on the iraqi forces, the peshmerga or the sunni tribes acting on their

own. so there will be boots on the ground if there's to be any hope of success in the strategy. and i think that by continuing to repeat that the president in effect traps himself. >> then the army chief of staff, the man largely credited with beating back the terrorists in 2007, told the "new york times" that "air strikes will not be the end all and be all solution in iraq." adding "you've got to have ground forces that are capable of going in and routing out the terrorists." and he says the iraqis are not that capable force. then president obama spoke at central command headquarters around lunchtime today. and listen to how he is freezing the issue now. >> the american forces that had been deployed to iraq do not and will not have a combat mission. they will support iraqi forces on the ground as they fight for

their own country against these terrorists. as your commander in chief i will not commit you and the rest of our armed forces to fighting another ground war in iraq. >> see what he said there? they will support iraqi troops without fighting. then the president's press secretary moved the ball even further just a couple of hours ago. >> what they would do in that role is they would be offering some advice, some tactical advice to iraqi security forces taking the fight to the isil on the ground. calling air strikes in support of iraqi security force -- in support of missions being conducted by iraqi security missions. but those american ground troops would not be in a position where they are personally or directly engaging the enemy in combat. >> what? ali north is here in a minute, but we begin with our chief white house correspondent ed henry live in washington.

ed. >> reporter: good evening, megyn. note the president's insistence as well that it will not be a combat mission. that leaves open the possibility though that the troops will see combat. it's technically not a combat mission, but they will be serving side by side as josh earnest suggested with iraqi troops who are in combat with isis fighters. and when josh earnest was talking about lining up those air strikes, having troops on the ground who are helping those laser pointed bombs, they're in the middle of a combat situation. and if they're fired upon, what are u.s. troops to do? the second important point to pay close attention to is the president doubled down on saying, look, we can count on the iraqis to be the ground troops. what he was ignoring is yesterday martin dempsey in his testimony, didn't get as much attention as other headlines, but said he estimated about only half of the iraqi troops are ready to be partners with the u.s. troops. general went further today saying it's not that the iraqi troops lost to the isis fighters months ago that put us in this position.

he said the iraqi forces just didn't fight. they gave up. they surrendered. that doesn't sound like they're ready to fight, megyn. >> ed, thank you. the president says if those troops are sent to the front lines, they will not be in a combat role. but will they really have a choice if they find themselves under fire? and if they do, god forbid, could they even pick up a weapon under this plan to defend themselves? colonel oliver north is host of "war stories" here on fox news and author of the book "counterfeit lies." good to see you. so the president says no boots on the ground, no boots, dempsey says maybe, gates says, yeah. president obama, again, well not combat mission. we won't be forward deployed. and by the way the iraqis are going to do it. they have to do it and will do it. >> they can't. and the sad fact of it is the iraqis -- about $12 billion worth of equipment we delivered

in the last three years, two-thirds to three quarters is either captured by isis, is broken or unserviceable. and on top of that the volunteers that showed up after mosul fell to isis driven by the leading cleric of the shiite faith in iraq, he called for volunteers 15,000-plus showed up. they carried their ak-47 that was rusty, a half magazine and showed up in their sandals. no food, no equipment. and essentially they got sent home. what you have is the only force capable of fighting right now inside the borders of what we used to call iraq are the kurds. and the kurds aren't even getting support directly from the united states. they're getting frit france and albania. >> what are we going to do? what does it mean that we are going to be with them but not forward deployed? >> well, look, in my military mind what you have is operation enduring confusion. what you have is a president who

cannot make up his mind what he wants. the coalition that john kerry spoke so eloquently of this afternoon on the senate foreign relations committee is nonexistent. the idea of arab air power aiding and abetting our mission over there, arab air power is an oxymoron. they can't do this. we can do it. but we would have to put american forward air controllers and joint tactical air controllers on the ground at the battalion level with the iraqis and kurds. kurds are not going to go fight to take damascus. nor are the iraqis. they couldn't. so the end result is you have a balloon you're squeezing at one end, perhaps in iraq. pinpoint accuracy with air strikes we're really good at, and yet no ability to go after isis in their safe haven that barack obama says they shouldn't have. >> why isn't he listening to the generals? we've got general saying you cannot do it with air strikes alone. you need capable ground troops.

and mr. president, that doesn't include the iraqis right now. and you've got bob gates saying you need troops on the ground. dempsey saying we need troops on the ground possibly. he doesn't seem to be listening. >> megyn, i've spent my whole life in and around the u.s. military. been on plenty of times with you from iraq and other places. i've spent my life with these young guys. i'm waiting for the general admiral who will stand up on his hind feet and say this is mission impossible given the constraints that you've given, we cannot accomplish the objective you have set. it is impossible to do. they're talking now about taking 5,000 of the so-called free syrian army, somehow exporting them from syria, getting them to saudi arabia and training them and sending them back in eight to 12 months. by then isis will number 45,000 or 50,000. 5,000 troops to fight a two-front war against assad and against isis. it's not something that can be done. somebody has to tell the truth.

some general or admiral at the pentagon or somewhere else in central command has got to stand up and say the mission we've been given we can do but we can't with the constraints you've placed upon us. the tragedy of it is that the disaster that befalls us is the first story you started with tonight with more and more of them coming into this safe haven in this country to threaten americans right here in the homeland. >> good gracious. colonel north, good to see you. we'll have that story for you in moments. as a chorus of military voices grows now questioning the president's plan for combatting isis, a new poll from cbs and "new york times" is also getting a lot of attention as it showed some 57% of respondents showing president obama is not being tough enough on these terrorists. chris stirewalt is our fox news digital politics editor. this was taken after the big speech last week. so what does it tell us? >> the speech didn't work. and it probably is an indication -- remember the white house has a lot more polling data than we do, the media

polling that we do at fox and that other outlets do. they got a lot of polling data. so they knew it didn't work. and i have no doubt that if it was political pressure that brought the president into the fight in the first place, it will be political pressure that will affect how he decides to carry it out. >> when you've got all those generals, as we just went through, saying we're going to need troops, we're going to need american troops on the ground to get this done, and i'm asking colonel north why isn't he doing that. and i ask you, chris stirewalt, take a look at this poll out again, cbs news/"new york times," do you favor or oppose sending in ground troops? look at the numbers. 55% of american public opposes troops on the ground. is that the reason the president doesn't appear to be following his generals' advice? >> it would appear the reason he's double talking about it and appear to be the reason he will not level with the people of the united states on this. that the boots aren't on the ground, the boots are on the ground, but they're not boots.

they're not forward deployed, they're not in combat, they'll stand next to the guy killing the guy but they won't kill them himself. and it is such a muddle. it's such an endlessly confusing muddle. it's no wonder that the "new york times" editorial page says they don't trust him to fulfill his promise about troops on the ground. that he was able to prove them right even within the day, even within the same day he was able to satisfy their fear that he would betray his promise. and that's the situation where this president is. he's made a lot of lavish promises. he does not have a good track record of delivering. >> it's incredible because others are looking at what the generals are saying saying why aren't you listening to them, mr. president. you've got "new york times" saying you are getting ready to listen to them and you better not because you made this promise over and over. and the ball is in the president's court and there are a lot of lives at stake as he considers it. chris, thank you. >> you bet. we also have breaking news tonight on reports of terrorists trying to cross our southern

to cross through the texas border who were apprehended at two different stations that do have ties to known terrorist organizations in the middle east. are you not aware of that? >> i've heard reports to that effect. i don't know the accuracy of the reports or how much credence to give them. but i've heard reports to that effe effect. >> and i guess that's my concern that you as a secretary does that information rise to the level of the secretary? >> all right. so that -- we needed to cut a little more of that. i'm going to explain why. that was congressman jason chaffetz grilling the head of the department of homeland security over new information that the congressman has suggesting that four people, four people known with terror ties to the middle east, were allegedly caught sneaking over our southern border into the united states one day before 9/11 of this year. and the secretary neither confirmed nor denied it. joining us now utah congressman jason chaffetz.

congressman, good to see you tonight. the reason we cut that wrong is you first asked him, have we ever apprehended anybody who's a known terrorist or suspected terrorist trying to come across the border? and he said sitting here right now, no specific case comes to mind. that doesn't mean there is none, perhaps fbi director -- can think of one. but nothing's coming to mind. and then you as a good lawyer zeroed in and said, well, my concern is i believe it actually did happen as recently as september 10th and it was four people who tried to come across and you tried to apprehend them and then he said i have heard reports to that effect. do i have that right? >> that's exactly right, megyn. he's the secretary of homeland security. you need to know this. he was sworn in on september 23rd last year. he says he doesn't know the answer to that. the answer unfortunately is yes. we captured -- there are 466,000 people that have been captured crossing our borders over the

last 351 days, yet by homeland security's own numbers 157,000 people got away. and the people we did capture, they come from 143 different countries, 13 were from syria, six were from iraq, four were from iran. we had four people with known ties from a middle eastern country captured having already crossed the border, our southern border in texas, four people captured from a middle eastern country with known ties to a terrorist country and he doesn't know the answer to that question? >> but wait, here's my question to you. do you believe he didn't know? or do you believe he did know and wasn't particularly inclined to share with you and the american people the fact that we've now got middle eastern terrorists coming across the southern border? >> i don't know which one scares me more. does he not know, is he oblivious to it as the homeland security secretary? or is he going to be deceptive and just try to, you know, run out the clock and not really answer the question?

that's not who we are as a country. we have a porous border. we are worried about every story on the news tonight is about isis. i'm worried about them actually coming to the united states and crossing that porous border and getting into the homeland. >> and you pointed out to him that the gao has estimated there's only 6% operational control of this border. only 6%. we've got the homeland security secretary sitting there talking about how he may or may not be familiar with the report you have in hand about these four terrorists. >> and i asked him. i asked him what is the operational control right now on the border? what is the operational control? and he said i don't know. how could he not know? he's the homeland security secretary. >> when you watch that body language, even the clip where he's scratching the nose, that's a dead give away. remember clapper with the hand to the forehead like not wittingly or trying to do a bewitched to get out of the room. congressman, good to see you. >> thanks, megyn. >> right?

we also have new developments tonight on the american citizen accused of trying to recruit isis fighters right here at home. and plotting to kill american troops. we reported last night right here on "the kelly file" that the man ran a convenience store in upstate new york, really western new york, rochester. and now new details are emerging from the alleged home grown terror plot. fox news's chief intelligence correspondent catherine herridge just filed this report. >> reporter: megyn, testifying on capitol hill the fbi director says isis is breeding a new kind of terrorist, the rec room radical. >> it's no longer necessary to actually meet somebody in al qaeda to get training and inspiration to conduct a terrorist attack here in the united states. someone can do it in their pajamas in their basement. >> reporter: and we're learning new information tonight from court documents about an alleged recruiter and his pipeline from upstate new york to the battlefields of syria and iraq. federal investigators say the 30-year-old naturalized u.s. citizen used one-on-one contact to build a relationship with

potential recruits and then use social media including youtube and twitter to reinforce his radical message. it's also alleged that he used a special messenger app, the content is not archived beyond 30 days making his conversations with operatives in syria nearly impossible to retrieve. the indictment also alleges that from his base in rochester he was driving recruitment of americans to join isis and other terrorist networks in yemen and somalia. we should learn more details tomorrow during his arraignment about this pipeline from the heart land to these terrorist battlefield overseas megyn. >> and coming up, the benghazi select committee opened its hearing totd just one day after reports that the state department staffers including some with direct ties to hillary clinton tried to scrub some documents before they went to investigators, just ahead. plus, a war of words over isis and islam. the terror group claims to be the islamic state, but our president and many others say

version of islam festering right now in the middle and it needs to be addressed honestly and without political correctness. whether one believes it is truly islamic or not, make no mistake about it there are dangerous factions within islam. and some of their practices are barbaric. in egypt and jordan, two of the more moderate countries, strong majorities support killing anyone who leaves islam and stoning women who they believe have committed adultery. in more hardlined countries it's far worse. just in the last two days we have brought you meriam ibrahim and ayaan hirsi ali. she had her genitals mutilated when she was a child. meriam on the left was sentenced to death by hanging in sudan for the crime of allegedly abandoning islam. here's a little from each of

them. >> within six weeks you were found guilty of these charges. did they give you the chance to renounce your christian faith? >> translator: i was given three days. in addition to that while i was in prison some people came to visit me from the muslim scholars association. these were imams reciting part of the quran for me. i faced a tremendous amount of pressure. >> individuals within islam who dissent are regarded as apostates and are banished. from outside islam who point to seven uncomfortable truths outside islam are declared islam-o-phobic. >> what was the response to her taking up this issue? first we spoke with a representative of cair or the council for american islamic relations. after his appearance he compared fox news and its viewers to the terror group isis. tweeting out fox news and isis

have something in common, they don't tolerate anything different. and their rhetoric invites calls for violence. then last night we asked a member of the one of the country's largest muslim groups to react to ayaan hirsi ali's speech. he came on being a point of reason defending her right to speak, or did he? listen to this. >> i defend her right to speak. and don't support any calls for her event to be canceled because my faith compels me to have that belief. although i do find it surprising that student group at a prestigious institution like yale would bring a speaker who has called for defeat of muslims -- >> what? now it's yale's fault? >> obviously you know that's not what i said. >> listen, does she not get to opine and say what she thinks about islam -- about radical islam, about islam having undergone what she did? >> well, megyn, i guess i have to say a third time that i do

defend her right to hold those views and to speak on her views. >> right. but then you criticized the university for inviting her. so she can speak all she wants as long as there's no forum for it. >> instead of -- we invite her to speak about and understand the largest single muslim community worldwide -- >> we would love to listen to her if she would say it in a way -- do you hear yourself? >> joining me now andy mccarthy, editor to the national review. this is a man who used to put terrorists in jail for a living. your take on that. >> this is what they do. what you see a lot in muslim brotherhood rhetoric is a reference to the prophet mohamed saying that war is deception. they council that looking the infidel in the eye and practicing deception is not only authorized, it's recommended. so this is exactly what happens.

you know, they dare you to call them on things knowing that they have created an atmosphere of intimidation where if you do call them on it, you're an islamophobe. you get dragged into court, you get barred from the media, barred from the campus. >> cair is a long standing problem. they have a long history of threatening to sue you, threats, they love that. >> cair is hamas. >> though they deny it. >> they deny a lot of things. >> he has come on the show and said much more reasonable things in the past. >> my understanding is i think the last time i was on with him he explained he's an -- >> nobody knows what that is. >> well, they get persecuted by sunnis because they're deemed to be apostates because they differ on various points. the things you find with these different muslim sects is they say that their islam is the true

islam and everybody else's is the false islam. so he then criticized ayaa ayaan hirs ali for referring to what you correctly point out is a mainstream interpretation of islam. islam islam islamic supremism. just because we wish islam is what ja far said it is. >> he came out last night, harris, and said, yes, free speech. i'm all for it. this is important. and she's entitled to say what she wants. but i'm so surprised that a university like yale would allow her to come out and basically bash islam. that's why she's gotten in trouble for not just speaking about her experiences as a woman but taking it one step further. they may have a problem with her doing that second step. but my point to him was, there's no reason to go through it again. you know what she went through. this is a man coming on the program. he didn't have to undergo it. and he wants to shut her up.

why can't she talk about it? why are so many in the muslim faith trying to shut up ayaan hirsi ali who at a minimum has earned the right to criticize those who did this to her and the religion in whose name they did it? >> because by pretending to be moderates and daring people to call them on it knowing that most people will not call them on it, they have a very good thing going here. >> because they get accused of being islamophobic if they call them on it. >> yes. from their perspective by portraying themselves, by feigning moderation, they have a great fund raising operation. and they're making real progress on the sharia implementation which is the thing by the way that unites the muslim brotherhood ideology with all these other groups like isis and al qaeda and the other jihadist organizations. it's a common ideology. they have differences about tactics, but their ideology is common. and they can't afford to let

anybody realize that because if people realize that the mainstream or the islamic groups that are mostly identified as islamic groups in the united states actually share an ideology with al qaeda and isis. >> not as extreme. you're not saying they're as extreme but they have extremist elements to them. >> i am saying that they all want to implement sharia. >> but the cair guy was telling me there's moderate sharia and there's crazy sharia. >> right. there's moderate islamist too. this is great, moderation, right? i'm a limited government conservative. i have no problem with social welfare programs, but i think the states should run them. i don't think the feds should. by saying that i'm a right wing whack job extremist nut. but if i was a muslim and i took the position that i want the united states constitution supplanted by sharia law but i'm not willing to blow up a bridge

affairs is claiming -- this is a man who wrote it for barack obama, claims he walked into the state department one night and that they were scrubbing documents. and he told sheryl he walked in and they told me, ray, we are to go through these stacks, pull out anything that might put anybody in the near eastern affairs front office or hilla hillary's floor in a bad light. he said isn't that unethical and was told, ray, those are our orders. con fi daunts were there including hillary's chief of staff. do you believe it? >> it certainly needed to be looked into first when you have a state department employee an eyewitness to what he claims to be a crime. that needs to be investigated. second, sheryl thinks this source is a good enough source she can report and break this story. third and probably most importantly, it fits the story, it fits the narrative. remember, this accountability review board was hand picked by

the people -- charlene lam, supposed to come up the next day, he calls up sheryl mills and said, hey, charlene is not going to be a good witness in front of congress. she's not going to reflect well on the state department. what is a guy supposed to do an independent investigation calling the chief of staff to secretary clinton and telling her someone's not going to be a good witness. what's he doing giving a heads up call to someone he's supposed to be investigating? >> you're basically trying to discredit the arb which hillary cl the state department continuously point to exoneration in their view for conscious wrongdoing on their part. >> megyn, i'm not trying to discredit it. it's already discredited. the idea it's the end all, be all, blue ribbon commission is not accurate. they picked the guys who were on the panel. and when the person who co-chairs the panel calls up the chief of staff to the secretary and says, hey, you got a witness who's not going to reflect good on the state department. how can you be given a heads up if you're supposed to be doing

new details tonight on a change of tradition for the united states air force. military branch announcing that airmen will now have the option to omit the phrase, so help me god, from the oeath that every airman is required to take. trace gallagher has the details. >> the air force claims it was never about religion, it was simply about upholding the air force code. prior to last year "so help me god" was optional. but then in october of 2013 the air force said their code required that the phrase be included. when an airman in nevada wanted to opt out of saying, so help me god, he was told to say it or leave the force. that's when the american humanist association which supports atheists threatened to

sue. the air force then contacted department of defense lawyers who recommended making god optional in the oath. the air force complied saying, quoting here, we are making the appropriate adjustments to ensure our airmens rights are protected. the humanist association also responded again quoting, we hope the air force will respect the constitutional rights of atheists in the future. even religious groups support the -- but make sure it goes both ways saying, i'm glad the air force allow airmen to omit parts of the oath with which they disagree because one day the air force will ask airmen to take an oath regarding controversial subjects like marriage. the army, navy and marines it should be noted already allow members to opt out of saying, so help me god. megyn. >> trace, thanks. let us know what you think.
