interview with cbs he did admit that intelligence officials underestimated isis and overestimated iraqi's military. the president pointing to a coalition air strikes hitting the group for weeks, recently expanding into syria. also mentioning recent congressional approval to train syrian rebel groups. >> part of the solution here is going to be military. we just have to push them back and shrink their space and go after their command and control and their capacity and their weapons and their fueling and cut off their financing and work to eliminate the flow of foreign fighters. but what we also have to do is we have to come up with political solutions in iraq and syria. >> you heard him there, the president also reiterating that lasting peace can only be obtained through political solutions. >> elizabeth, of course the question now is what are lawmakers saying about the

administration's strategy? >> right, well some are saying that's just not enough. there's a growing group who are dissatisfied with the president's continued position to launch air strikes gems the group without new congressional approval. that's just a start. house speaker john boehner says he along with some military experts do not believe the administration's strategy of using solely airpower to wipe out the terror network. boots on the ground, he says, shouldn't be ruled out completely. >> the other day, i think it's going to take more than air strikes to drive them out of there. at some point, somebody's boots have to be on the ground. >> we have a ground force on the ground, the iraqi security forces, the peshmerga forces as well. >> the public may be in agreement n a new wall street nbc news news poll says that -- the survey also found 45% of americans would favor ground troops if military officials determine it is the best way to, quote, defeat the isis army.

after a police officer was shot last night. it happened when the officer approached the men near a closed community center. the officer said the men then ran and opened fire. he was hit in the arm and is expected to be okay. now the police chief sees no connection to the recent turmoil over the michael brown shooting. >> in an area that's fairly secluded and i wouldn't have any reason to believe right now that it was linked in any way, shape, manner or form with the protest. this certainly doesn't appear that way. >> ferguson has been the scene of unrest since early august, and michael brown, an unarmed black teenager was shot and killed by a white police officer. the oklahoman suspected of beheading a former colleague has regained consciousness and now he's due to face first-degree murder charges.

brian, what are members of nolin's of course saying about him? i understand they're talking as well. >> the islamic society of greater oklahoma city stay nolin attended services and described the muslim convert as being nice, quiet, low key but a little odd. according to a report in the oklahoma newspaper, one senior imom said that nolin identified himself as a searcher, trying to connect with different religions and a society leader said that nolin never expressed violent sentiment or support for isis terrorists and the society has condemned nolin's attack. the fbi is investigating nolin's potential ties to radical islam when employees say he was recently trying to convert them to islam. nolin's facebook page shows photos of terrorists, references to jihad and sharia law. nolin posted a photo of a

beheading in march and in another post, he calls america and israel wicked. more police say so far there are no ties to terrorism and they are treating the attack as workplace violence on fox news sunday, chris wallace asked president obama's deputy national security advisor, tony blinkin' about the classification. >> it's not an act of terror, chris, we don't know. the fbi has an active investigation, i'm not going to get ahead of it let's see what they find. >> as we all know with nadal hassan, when she shot off and killed a number of american soldiers, the military called it workplace violence. are you prepared to call this an ablg of terror if that's what it is? >> nolin is expected to face charges on monday which include first-degree murder charges. >> and this guy has seen jail time before, right. >> the oklahoma county da, david

prater is telling local media, nolin should have been in prison the entire time, all along actually, he served less than two years of a six-year prison sentence for three separate offenses, possession of marijuana, possession of cocaine and assaulting a police officer, but he was released in march 2013, thanks to plea agreements and good conduct. nolin is on probation for assaulting that officer. >> all right, brian, thank you very much for that update. meanwhile miami police now investigating a shooting at a nightclub early this morning that sent more than a dozen people to the hospital. witnesses say they heard possibly 100 rounds of gun fire rip through a store front nightclub called the spot. police say at least one person is in critical condition. it is not clear how many gunmen there were or what caused that shooting in the first place. and a grim discovery as a deadly volcano claims dozens of

>> more than 30 people are believed to be dead after a volcano erupts in central japan. it happened yesterday afternoon. the volcano spewing huge plumes of gas covering the surrounding areas with so much ash, one climber said he was enveloped in total darkness. initially more than 250 people were trapped on the slopes, but most managed to get down. the volcano's last major eruption was in 1979. and despite a summer of turmoil in the middle east, the

prices of gas continue to drop here at home. the national average price for a gallon of regular now sits at $3.34. that is down nine cents from a month ago and four cent since the middle of june. sorry, inside joke, but we're all good now, right? >> yes, we are. >> the good news, this is great news, but what is causing this? >> let's talk about how grate it is and how completely unusual and rare this is. whenever there's mid east turmoil and we have got turmoil in russia and ukraine as well, you see gas prices and oil prices spike. you said 9 cents down from a month ago and that's really when a lot of the u.s. air strikes started. so this is really quite, quite unusual. now why is it happening?

a couple of reasons, number one, it comes down to supply and demand. and supply is high because here in the united states, we are creating drilling more oil. >> that's good. >> yes, shale, natural gas production, and oil production from the u.s. is at a 28-year high. demand is down as well. people are buying more fuel efficient cars, the economy has something to do with that, they're not buying as much. so there's a lot going in here. and the thing is, that we are also becoming less depen departme dent on overseas oil. that's really what it comes down to. the next share of oil imports, i think it's a 40-year low. so that's amazing. >> this is really good news, so this is the americans are actually being pro active in this as well. so do we expect this to affect our economy in some way in the future? and do we expect gas prices to drop even further?

>> okay, well, i'm going to show a number, two, okay. we could see gas prices below $3 a gallon. now it won't be a national average, because california and new york are high, but it's expected to be that way in about 30 states. >> wow. and we're expecting gas prices to say, gas money says they're going to fall about 20 cents by the time of the christmas shopping season. you asked about the economy, the les money we spend on gas, the more we spend on other things. and that helps the economy. >> that's good. i mean it's also a feel good effect, whenever we're feeling like something's happening in our favor and better for our possibility books, americans kind of get on board and feel a little bit more secure to go to the store, like you said, and put money back into the economy. >> absolutely, consumer sentiment has everything to do with it. and consumers are three-quarters of the buying power of the economy. and you said feel good?

pro-democracy demonstrators squaring off with police in hong kong. tens of thousands of people protesting because they want less political interference from china in hong kong's government. at times, the demonstrations grew violent. police using tear gas, pepper spray, and batons to disperse the crowd. hospitals reporting at least 26 people were injured. and details continue to unfold in that horrific workplace murder in oklahoma. the suspect, 30-year-old alton

nolan, has reportedly spoken to police after regaining consciousness. he was shot by another employee at a food processing plant after allegedly beheading one woman and stabbing another co-worker. police are classifying this crime as workplace violence. meantime, the fbi is investigating nolan's potential ties to radical islam. his facebook page shows photos it of terrorists referencing to jihad and sharia law. nolan is expected to be charged with first-degree murder tomorrow. joining me to discuss this, defense attorneys richard st. paul and alex little, who's also a former assistant federal prosecutor. good to see you both. so if authorities are unable to find signs that indicate nolan planned the attack -- they're checking, of course, his facebook postings we just reported. initial police reports saying there are no postings about job dissatisfaction. what would be the first line of

defense to get the first-degree murder charge reduced? >> i think it has to be his mental state. the question of whether he's had mental illness in the past, things like this. the sort of act he did was just so heinous and so despicable. it's hard to imagine someone who's not mentally disturbed committing that act. the investigators are going to want to know if there's more than a disturbed personal at play in motivating that act. >> fox news has been reporting nolen is said to be a recent convert himself. also, nolen posted multiple photos of terrorists on his facebook page, osama bin laden being one of them. in all those, some of former co-workers said nolen tried to get them to convert to islam as well. police are saying there are no signs linking the attack to terrorism. richard, here you go. is the workplace violence label good enough? >> yeah, yes and no. first of all, the investigation is ongoing. so we have to still determine

whether or not this was a lone terrorist act that will multiply into other terrorist acts. we all know isis has threatened attacks here in the u.s. we recently prepared here in new york city for possible attacks on subway. so there's still more investigation that needs to go on. to capitalize on what was said previously, not only do you have potentially an insanity defense, but we know murder in the first degree is coldhearted. you intended to murder that person. if we find out, for example, that there was some mitigating circumstances, for example that he was attacked by the woman there and he then responded to attack, you can then get to murder in the second degree. these facts are still something that need to come out. >> let's talk about some background facts here. last night geraldo interviewed betsy randolph, who said she was assaulted by nolen when she attempted to arrest him four

years ago. so she pulled him over for an expired tag, discovered he had outstanding warrants. nolen ran away from officer randolph. this ended after a 12-hour man hunt. as a result, nolen went to prison in march of 2010. all right. he was supposed to start a two-year sentence for that assault. plus, another two-year sentence for possession of marijuana. so nolen was released from prison after serving less than two years of a six-year prison sentence because of credits and a plea agreement. so, alex, does the food processing company bear any responsibility for hiring this man in the first place? >> no, i don't think so. i think we have a difficult problem in our society given the number of people we put in prison about how we resbintegra them. the convictions he had before certainly indicated problems with the law, but i don't think anybody would believe because somebody had a possession of

drug offense they're going to go behead somebody. >> assaulting a patrol officer? >> certainly shows he's a disaffected person. it may be one reason why he was so inclined to latch on to this ideology. how much of that desire to connect to this antisocial behavior like isis is motivated with any connection with any particular group, just like the columbine shooters latched on to a certain lifestyle. i think that's one thing investigators are going to look at. was there any connection to an actual group or individual abroad who was coordinateding this in any way. i doubt that, but that's what they have to find out. >> there's two issues here. there could be liability, but we need to know more about what happened. for example, if an employer doesn't conduct a background check on an individual, they could be held -- and i say could be held negligent for negligent hiring. even if they did conduct a background check, he does have

assault in his background and we don't know whether or not he's been written up for workplace violence previously, which then could have put the employer on notice that he has violent tendencies. there's still a lot to learn here. the question of liability is, did the company negligently hire nolen. that question needs to be answered to determine whether or not there will be liability. >> okay. we will leave it there. richard st. paul, alex little. we do appreciate your time this afternoon, gentlemen. >> thank you. >> thank you. >> absolutely. that does it for me. stick around.
