stink. >> isn't that always the case? so funny. i never liked my congress person. we're going to get a new one this fall but it's interesting because there's a lot of fear, a lot of airng -- anxiety and people feel the country has been on the wrong track and i think it's added, like the anxiety is coupled with this apathy and i honestly think the people are truly worried about the way the country is going but i don't think it's going to be enough to get them to the polls. >> guess what is still their chief concern? the economy. even though the worries have gone down somewhat and moved on to other things, still their chief concern is the economy. 40% of likely voters in the survey said it's the economy. people aren't feeling great about their financial situation. is that going to drive enough people to go out and vote? that's always going to be the big question. but i mean, in the face of a labor participation rate still sitting at a 36-year low, now add -- >> that's the number. that's it right there.

it's the labor participation rate. it's not the unemployment number which the administration would have you believing. exactly. >> harris, when you look at these issues, not one single issue is defining this election. typically it could be foreign affairs like in a presidential or it could be national security. this time around, it seems like people have ainxiety about everything. >> when we do hear from our elected leaders and those from the different organizations and government agencies, there seems to be a collision of talking points so people don't really think they're also being given good information that is useful for their own lives. the new orleans saints, told them to keep quiet and that law enforcement wasn't much help, either. the women adding that they were hardly alone. one of them saying, quote, we've told agents about it, called the nfl players association when things were really, really bad. they would say, oh, we're really sorry that you are going through this. we'll look into it. but you never heard back. there's no one available for the wives. do this, bernie, we were talking about it during the break, about how you are not even hearing a lot today about this nfl controversy. but could these comments from the nfl wives or former wives, reignite the flame a little here? >> i don't think so. i think the media fascination with this case has passed. i think he'll win this arbitration. i mean, he was suspended initially for two gameere was o. goodell said the policy will be six games. then the video came out and people were outraged all over again and then they suspended

him indefinitely. the policy was six games so i think they have to adhere to that. he's going to come back and it's all done, over. these fans, football fans, they don't care. for the most part, they don't care. >> i think people who love football want to see their team win. they're passionate people. they're not chimps. >> but i think mostly -- they mostly care about football and this is -- there was outrage. that video was horrendous. but i think they want to move on. sadly. >> i go back to just a month ago when people were saying the nfl was doomed. we were having a conversation day after day on this couch and i was saying, a year from now, let alone a month from now, nobody is going to talk about the nfl scandal. it does appear that's somewhat the situation today but this reinstatement of ray rice could have changed things. >> it couldn't. and it will be interesting to see where he lands. is he going to land in baltimore? because you have to remember his wife is sticking by him. she's still with him.

there are a lot of people. look at michael vick. there are people who will be able to rationalize and say that the guy was suspended, he went through the judicial system so therefore, he's learned his lesson. his wife is still with him. let him play. >> the judicial system that failed, though, the prosecutor barely even threw the book at him and that's the problem. the nfl has laks standards and the courts fail and the courts don't do their jobs and the prosecutors who knows what happened but he clearly was not given the appropriate discipline. what's the nfl supposed to do? the real issue is the court of public opinion has tried him and found him guilty. if you're running a team, who would take him? honestly. at this point. i would really question the mental sanity of the coach that takes him. >> from the general manager, from the baltimore ravens, he was like, i love you. we have a place for you. >> i think the players union, i know from reading and researching the story that his

legal representatives are going to take a page out of the book that you just opened up and that's the court system. and they will say, look. you can't punish this guy twice. just like you wouldn't be able to have it in the court system. that's what his attorneys are going to argue at this meeting today, this reinstatement appeal today. now, you mentioned that goodell doesn't have anything to do with the say. however, if the nfl decides to appeal, the judge is a woman, barbara jones. we haven't talked about that. if she finds that you can play, if you can find a team that will hire you, you're free and clear, the en sta -- instatement is ov. if that happens, then roger goodell becomes likely a candidate to testify. >> what is he going to say under oath? >> what is he going to say? i didn't punish him until i saw the video. >> is he going to perjure himself? >> after he learn about the wives ignored in the past, do you think that culture is now going to change at the nfl?

do you think that the nfl will perk up now when there are complaints that come through? >> i think that there have been some benefits to come out of this whole horrible episode and yes, there will be more attention paid to it and more harsher discipline without a doubt. this particular episode, the media fascination, goodell has weathered his storm. nobody can prove that he saw the video. this is over. ray rice will come back and the nfl season will continue. >> as it has. >> and as successfully as it is right now. yes. >> if a team takes him and there's very little outrage about it, i mean, there was outrage with michael vick in the beginning. dogs and humans are both equally important. but if a team takes him and there's not outrage about this and it just moves on, it's a very sad state of affairs. >> you think the timing makes a difference if they make? >> yeah. i mean, mid season probably would make a bigger difference. >> there are growing questions about the president's ebola
