get interested. record "hannity" the series. start your day with fox and friends first. thoivenls we'll see you back here tomorrow night. >> the factor is on, tonight. >> let's put the cards on the table here. >> the brown people coming from the south, the arab people coming from the east, the black people coming from africa. >> yes, that's right. the left now saying the ebola controversy is racist. so is the isis situation. so is illegal immigration. america is really a bad country. we'll have a special report on this madness. >> if you have a travel ban in place. it drives people underground. >> white house guy ben rhodes now backtracking big time as the administration does impose travel restrictions on the ebola areas. we will tell you what they are.
8:01 pm
>> counts 1 homicide, the sentence imposed is the 5 years. >> also, ahead, five years for killing a human being. that's south african justice in the case of oscar pistorius. we will tell you what happened today. caution, you are about to enter the no spin zone. the factor begins right now. ♪ ♪ hi, i'm bill o'reilly. thanks for watching us tonight. racist america. that is the subject of this evening's talking points memo. the far left once again banging the drum that america is a terrible country. nbc pedaling that here is happening today about ebola, isis, and illegal immigration. >> the brown people coming
8:02 pm
from the arab people coming from the east. the black people coming from africa, nobody is saying that in so many words. nobody is saying at all, but it's in the background of this whole discussion and anybody who would deny that doesn't know how this country operates. >> well, i deny it and i know how the country operates. we are not a racist nation. he is full of you know what. laws and high level decisions are not based on skin color anymore. in order to drive african-americans to the polls, race card is now being played with just two weeks before the election. thus, that disgraceful exhibition. on the ebola front, the administration is now backtracking on the travel ban as we told you it would. today it announced restrictions on anyone traveling from the west african nations affected by ebola. they will only be allowed to enter the u.s.a. at five airplanes, jfk, dulles, atlanta and o'hare in chicago. as talking points predicted, if there is one more ebola case, there will be an overall travel ban imposed. in just a few moments we
8:03 pm
will talk with the liberian ambassador about the situation. back to the race card. fair minded americans should be deeply offended, deeply offended that their country is being neared with the the bigotry brush. certainly there are racism, they occur within every ethnic group. no government can stop individual stupid stupidity. in america there are opportunity for all. unfortunately that opportunity has been beaten down recently by bad economic policies. democratic party believes washington should run the he economy. but that has failed. the republican party wants a free market economy with low taxation and aggressive job expansion. the problem is the free market economy was abused during the bush administration. and the economy collapsed because of it. that's what led to the election of the very liberal barack obama. who promised greater prosperity for all. that promise remains unfulfilled. as wages for working americans have gone down during mr. obama's tenure and unemployment among black americans remains higher than any other group.
8:04 pm
so, the far left is desperate. and the only way democrats can keep power in the senate is for african-americans to once again block vote. and they must turn out in great numbers on november 4th. that is why liberal zealots are trying to demonize their country by playing the race card. and that's the memo. now for the top story tonight, reaction, with us here in new york city, monica crowley and from washington kirsten powers. powers, where am i going wrong? i know i am in your mind. >> well, first of all, i don't think this is an election strategy. i think it is what howard fineman actually thinks is true and i think there are probably are a lot of liberals that think it's true. here's the problem. >> but what do you think? do you agree with fineman? >> well, i don't agree with him. but i don't think it is outland dish, i think as you think it is. but the reason i disagree with it is there is flawed logic in it the flawed logic is this. it suggests that if somehow the people beheading people
8:05 pm
in the middle east and overrunning iraq. are not brown people americans wouldn't be afraid of them. i think we know that's not true. >> why would mr. typeman say that? >> i think he is not thinking it all the way through. >> not thinking it all the way through it's a pretty simple equation. >> knee jerk reaction. >> knee jerk? >> you see commonality. you see brown people, black people and you say this, and it's the same thing with ebola. is he asking us to believe that if someone from sweden came into our country with ebola that everyone would be like, that's great. no problem. which of course we know also isn't true. >> you say it's a knee jerk. perhaps if we remove the word knee, we would have it and you say, what? >> i like that, o'reilly. >> thank you. >> look, i think that when you claim racism where it doesn't exist, that is the last refuge of a directly who has no facts and no argument. we have heard this destructive nonsense since barack obama was running for president and certainly when he is president.
8:06 pm
not about race but about policies. any time you disagree with what this president has done, the left has screamed racism as a way to dismiss and delegitimize not just you but your position of what you have to say so that they have tried to create a wide open berth for this president to get away murder and do everything that he wants to do and by and large that's been a successful until now. >> all right. but powers says that there is a strain of liberal people who sincerely believe. this and i think that's true. >> um-huh. >> but she also says that this isn't being used to gin up the african-american vote, which is desperately needed by the democratic party. do you believe that? >> i think both can be true. remember that the "new york times" reported that one of president obama's key pollsters is saying, look, unless you get the african-american base out, voting in two weeks, this is going to be a blood bath for democrats. so, yes, they can authentically believe garbage about race. >> on that cable network?
8:07 pm
>> this is also why that cable network has no ratings because. >> i believe that. >> this kind of thing is so absurd yes. >> that's a good point, powers. i don't want to get too microinto the television industry but widely published in the "new york times" and other places that the cable arm of nbc news is faltering badly. it is. the ratings last night were just almost invisible. almost to the point where no one is watching them. no one. liberals have add abandoned the network. i don't really know why. but i do think that this kind of stuff demon inizing the whole country is racist because we want to be protected from ebola and we want to take care of the isis criminals? i mean, you know, it gets to the point where you have got to turn it off. am i wrong? >> well, i mean i didn't hear it as demon mizeing the whole country. i heard it as demon eyeing certain people. >> he said this is the way america works. if you don't know that you don't know anything about america. we are racist on all front. >> i heard it and maybe it's just like a liberal thing and i heard it differently. >> you didn't want to hear
8:08 pm
it i know how you operate it? >> i heard it being more an attack on republicans. >> i don't think he mentioned republicans. it was america. >> i think he was suggesting that this is something that is proximate cause -- this fear is being wind ginned up. >> if what he is saying is true and this is all racest thean u.k. and france are racist because they ban the flights coming from west africa. senegal, my gearia, other west african countries actually closed down their borders, they closed down too. dhs department of homeland security who jay johnson is black. put on new restrictions. >> he has to be a racist guy. >> clearly i guess. nice try, kirsten tonight. nice try. even you know, it's just way over the top crazy. >> i have got to go because i had the liberian ambassador on deck. be here to talk about how

8:13 pm
mislead authorities and spread the ebola he had to two american nurses. what do you think about that? >> unfortunately, brother citizen of liberia thomas duncan traveled to the united states when he came up with this ebola. we came on cnn four nights ago to express sorrow to the american people for what happened. thought this would be the case in the united states and we are truly sorry for that. >> i know, i'm not blaming the liberian government. you have to understand countries like senegal and nigeria can't come here until you get this under control. shut the borders down. people in the u.s.a. go why aren't we doing the same thing in the proximity is
8:14 pm
obvious. but we have a problem here that we really don't know how to handle yet. it just seems to be the right thing to do. would you object to the u.s.a. saying until we get our medical people trained properly, we are going to suspend west african visas to the u.s.a. would you object to that? >> what we continue to see to the world is hip us to isolate ebola. but do not isolate those countries that are affected by ebola. banning travel from countries would just devastate those countries more and more. and we don't think that the united states will be willing to do that. >> all right but they will be if there is one more case so get ready for it between 1 and 150 west africaens. come from jfk airport in new york city every day. an incubationf folks. period 21 days, you know
8:15 pm
this, we have to protect ourselves is. i'm sure you understand that, mr. ambassador. >> we understand quite carefully. >> airport screen liberian traveling to the united states. >> you can't spot it because it's incould you baits for three weeks. so look, mr. duncan didn't have it when he left liberia. he it had but it wasn't demonstrated. it when it came here nobody knew what the heck was going on. you can't stop it when it's incubated into somebody's system. you can't. you don't know. >> i think the world has gotten liberians to know that if you have a relationship. had contact with anyone affected with ebola, it would be good to self-identify. >> 90% of people will do
8:16 pm
that but 10% like mr. duncan will not. that is the problem that you are relying on people's honesty when some of them are desperate to get here for treatment. i will give you the last word, mr. ambassador. >> at the same time, that's as i have said, international airport come up with tougher measures for people traveling, trustingly so, the united states identify airport, tougher measures coming. i don't think that is going to stop it but we will see. >> mr. ambassador, once again condolences to this country why hope this thing gets under control soon. >> pistorius little prison time for shooting his girlfriend dead. outrageous? you bet. we'll analyze. later, charles krauthammer on why the upcoming election is still so close. those reports after these me

fact for follow up seeing many tonight. 27-year-old olympic track star oscar pistorius sentenced today to five years in prison for killing his girlfriend. shooting her to death. reva steenkamp was her name. it's expected that pistorius will serve 10 months in prison and be placed under house arrest. the defense team told the world that he thought an intruder had broken in, then locked himself in the bathroom. the intruder did that, in the middle of the night. so, mr. pistorius shot through the locked bathroom door thinking he was defending himself. mr. pistorius' girl friend, sleeping next to him was not in the bed, apparently that did not concern mr. pistorius also there was testimony that a they had been fighting and woman heard scream before and
8:21 pm
during the shot. nevertheless, mr. pistorius was found not guilty of premeditated murder by a judge saying he only committed gross negligence. then the judge imposed an unbelievably lenient sentence. joining us from miami is judge ferrera. am i making any mistakes in my summation, judge? >> no, bill, you pretty much summed it up well. i think he claimed that he didn't know she left the bed. >> how could you not know she had left the bed? >> he said that the room was so dark that he didn't notice it but he also didn't make any attempts to notify his girlfriend that there was a burglar in the house. i really didn't buy his version and frankly i would have been likely to convict him of murder either premeditated or non-premeditated murder. >> in my opinion, what the defense attorneys put forth was preposterous. impossible.
8:22 pm
ridiculous in the extreme am i overstating it. >> that's one way of looking for at it. >> i am asking you as a judge preposterous. >> my take on it it was a version that was plausible that you could present to a jury but it was not the version that i thought was reasonable given the evidence there were witnesses that heard screaming. >> i have been doing this for 36 years. i have never heard in the united states or any other country of a burglar, an intruder going into a home and locking him or herself in the bathroom, ever, ever. not one time. and i don't believe there are any cases on the books where that has ever happened in the history of mankind. if you are a burglar and you go into a house and you think there is somebody in there with a gun, you get out. you don't lock yourself in the bathroom. >> they usually don't take a bathroom break while they are in there. >> in my opinion with all due respect to you it's not plausible, it's garbage.
8:23 pm
it's a lie. it's a contrived fiction that the judge, who should have known better, should have said, you know what? why don't you take a break, courtroom, come back and give me something better. maybe gone zilla came in he was aiming at the dinosaur and missed and hit his girlfriend that would have been as plausible. >> all due respect to me i would have convicted him of murder glt fact this judge didn't in south africa is appalling. the girl is dead. and this guy gets 10 months in prison and house arrest where he can call out for pizza and people can come in and play games with him and he can watch cable? come on, what is this? what kind of a world are reliving in here? >> let me say this. in the united states it would have been a different sentence. can i tell you from florida alone he would have had a minimum of 10 years in prison. facing a maximum of 30 years for manslaughter with a firearm. over in south africa facing a maximum of 15.
8:24 pm
allowed no minimum. the judge could have given him a fine. what i find amazing which i think you would probably agree with is that the steenkamp family, the victim's family said they were satisfied with the sentence. >> appalling. >> five years is lenient enough but they also have the possibility that corrections will let him go do the rest of his sentence in house arrest. >> >> that will happen. >> reaction of the family rasks the family inexplicable. if it were my daughter and some guy shot her dead, and there were screams heard in all the other evidence that was presented. and the guy gets 10 months, it's not just this, it's not even close to justice. >> not to mention, bill, remember also that she locked herself in the bathroom at 3:00 in the morning. what girlfriend goes to use the bathroom and locks herself in at 3:00 in the
8:25 pm
morning with the key to the bathroom door? that clearly in my mind showed she was afraid of him. >> >> thanks very much. is it legal? react to the situation and also to harvard university banning faculty and students from traveling to west africa. uhoh. later charles krauthammer on the upcoming election two weeks from tonight. we hope you stay tuned to those reports.

get right to attorneys and fox news analyst kimberly guilfoyle and lis wiehl. >> your reaction to pistorius. >> horribly lenient sentence. he was looking up to life if he had been convicted of premeditated murder. his story didn't make any sense. here is the tale for me on that. the defense went through the whole story saying he is not guilty. mistake, mistake. very very end they realized that wasn't going to work. they said he had a mental disease or detect at the time. >> it did work. the judge bought the preposterous story. >> maybe they should bring back the jury system which they apoll elishaed during abolished. >> she looks like she is in high school how do you justify something like this. human being hot dead. the story makes the o.j. simpson thing look credible. >> this is such a miscarriage of justice. grotesque, domestic
8:30 pm
violence, she is behind a locked door trying to protect herself is. what is the justification? >> premeditated murder because intent can be formed instant. instead he gets culpable homicide is like someone skiing too fast and they kill someone. >> doesn't make any sense to me. >> they were receiving financial payments from oscar pistorius every month and then they just recently stopped doing it. >> maybe they were bottom off you are saying? >> you know what? there might be some financial relationship in the future. >> all right. wiehl attended a harvard law school. and now harvard, a bags of bastion of liberal thought. would that be accurate? >> if you are a student or you are a faculty member or you are a janitor or you cut the grass or if you even walk by the charles river, you can't go. >> you cannot go. >> to west africa without our permission. >> not on official business.
8:31 pm
>> you can't go, nothing. >> nothing. >> fascism. >> no, i don't think it's fascism. and the provo says you are a doctor got to go through the screening doctor himself. he is the one that's going to be saying you can go and you can't go. >> it's a great idea. more universities should be doing it. >> is it legal to do that? >> absolutely. >> when i was a student there, they could tell me i couldn't travel somewhere in the world? >> if they have a public health issue, become obviously, they have a right to protect the student body. and the workers in that student body as well. >> harvard, my god compassion, where is it? >> it's not. guess what, the provost is a doctor, maybe is he following good sound medical advice why is harvard on the cutting edge ahead of where this country should be and doing something about it. >> so you both say it is legal. >> it is legal. >> you can't tell the students or the faculty. you can't go to spring break because bad things could happen. >> wait a minute, wiehl, if they can tell you, you can't
8:32 pm
go to. >> stuff going on in spring break, are you telling me that? >> it could be a public health issue. >> i don't know if people are going to guinea or liberia. >> spring break? >> they have beaches there. in virginia. there is a state law that is trying to protect people, thank gods by the way. >> very good law. >> from people stealing stuff pictures of you, and posting them on the internet. tell me about the law, guilfoyle. >> the law stipulate that anybody who dessem united states nude or semi nude content over the internet, either for profit or too coerce, hazard or intimidate another person without that person's consent is guilty of a misdemeanor. you are behind bars. 25. >> if you find a picture of someone, you have to get their permission to put it on the net. >> you can't post it. >> if i have it and she doesn't give me permission and i post it on facebook
8:33 pm
page then i'm in trouble. >> enter a jealous girlfriend, tell me what happened. >> so what happened is there were two people that were dating. they then brokethis is the jeals girlfriend. >> yes. >> charged. >> charged with this because her ex-boyfriend got a new girlfriend, okay. she got a picture of that new girlfriend nude on his phone, she posted it on facebook. that girl got very upset, went to the police department and said this was without my consent. i want to press charges against her and in fact that's what's happening. >> revenge porn. >> this is a good law. this is very -- >> -- this woman might get more time than oscar pistorius. >> you know oscar pistorius get 10 months and she could get a year. >> everybody know, guilfoyle. you don't have to tell america. everybody knows what is happening on the net. and there should be laws to protect people from it. >> awful. >> we applaud virginia. >> 13 other states. >> what i'm saying is i don't think this woman this jealous girlfriend is going to get anything. she will get a slap on the the wrist. >> i don't think so, bill. i think they are going to wanted to make a point of
8:34 pm
this woman in virginia to say look. you can't do that. >> $2,500, community service, counseling, some probation and probably no jail time. >> all right. if she does that again. >> but you should get it. >> "on the record" now as a misdemeanor. >> do you think that should be a felony? >> i do. >> that will stop people. knock it off. >> revenge porn laws now. >> all right, ladies, thank you very much. when we come right back, the university of california on the taxpayer's dime has instituted a proabortion class. unbelievable what's happening. then, krauthammer on why the republicans are not well ahead in the election polling with all the trouble in the u.s.a. factor is coming right back.

funded by california taxpayers will teach students online about abortion, medical procedures as well as other proabortion subjects. course is being taught by this woman dr. judy steinhour a proabortion zealot. no other point of view in the class. we sent adam housley to the university to assess the situation. >> one of the most sensitive and contentious subjects in america now includes free online education at the public funded university of california san francisco launches the first of its kind web based class focused on abortion. available to anyone anywhere. >> i don't think it's necessary. >> if you are offering it to your students who are medical students, that might be something that would be interesting for those students, maybe they will want to do abortions. maybe they won't want to do abortions. >> the six week class is offered using the course web site or app.
8:40 pm
ucsf says the class will, quote, disseminate high quality compassionate abortion education around the world. >> this course will provide health practitioners and students an opportunity to learn about abortion, a topic often excluded from training and give you a chance to reflect on your feelings about abortion. >> ucsf wouldn't provide an adoctor or administrator on camera to talk about the class. they wouldn't give us a faculty list or wouldn't tell us whether taxpayer money is being used to fund the course. they gave us a statement the class wouldn't how to conduct an abortion. may inspire some to seek medical training. the class isn't required or even part of the summer. sf coursework for medical students. the doctor leading the course jody steinhauer wanting to increase abortion access globally. we left multiple messages for dr. steinhour stopped by her office and even two locations here ucsf to no

8:42 pm
like a big propaganda, you know, get everybody behind promoting abortion, which is perfectly right to do if you want to do that. but not in the setting of an academic disguise. >> all right. joining us now from san francisco is adam housley. number one, you are taking the course, right? >> right. >> okay. has there been any pro-life stuff in the course so far? >> so far. no we are on week two. they have about six lectures quizes, pier back and forth so to speak. one of the topics, bill, teaching professionalism and abortion care. there has really within no pro-life. >> no balance, and we don't expect there to be. now, about the funding, all of the university california system is funded by the taxpayers out there. unless this was a privately donated money to this woman salary which it isn't, all right. it is a a taxpayer thing. that's in your face to all californians who believe that abortion may be morally

points. whereas the democrats are only 7 points underwater. now, i think the best explanation for that is very simple. people associated with the republicans in the last several years. actually over the life of the obama administration. as the party of no. the party that says. no i think that's a good thing. if the guy in power is doing the wrong thing opposition is supposed to oppose. however, they want to see something more positive. no will get you so far. it worked very well in 2010. but it only gets you so far. you don't sweep with no. and i think the reason is this: when you are the party out of power. particularly in year six. it's impossible to get together a national program. the only example where opposition party put together a national program was in 1994, newt gingrich and the contract. in a parliamentary democracy the opposition has its platform and cabinet.

it's not the same in our system. what do you need? the irony is if republicans can capture the senate, they can then develop an agenda, pass legislation in the house and the senate, dare the president to exercise the veto, and show the country that they have a vision and that would prepare them for 2016. >> here's what i would do if i were the head of the republican party. i think ryans arenas priebus is the head of it very few people know who mr. priebus is. i would take out ads in all of the states that matter and i would say the republican party stands for this: on a number of issues. number one, a travel ban from west africa with ebola because you capitalize on that. all right? just 30 second spot. the republican party stands for, this: immigration reform. taxes. and have short pithy solutions under the banner of the republican party

stands for. because right now, we have a distracted electorate. i don't know if the pundits understand that. that more than ever before in this country, people are developing their own fantasy lives on the internet. now, paying attention. every week we send jesse watters out and come back i can't believe they foe don't know what vice president biden looks like. you know what charles? they dent. that is why i don't think the republicans are getting any currency because they don't know what the message is the folks don't know what the message is. >> i don't think a 30 second ad by the party is going to make any difference. these are mostly local races on one side people are -- it's a referendum against obama and that's the reason there is wind behind the sails of the republicans, on the other hand, the democrats have relatively strong candidates in these red states. often with pet agrees names

like landrieu in louisiana. names like nunn in georgia. names like beggich in alaska. that carry as lot of weight. >> the republican party has to define itself in some do about these proble i don't think it's done in an ad. done on the ground in the senate, when you one -- win it and you pass. the house has passed a ton of legislation that dies in the senate because of harry reid. no one knows about that. >> that's right. they don't know who harry reid is. >> and the press is not going to. >> tell anybody. >> not going to talk about that because it's not interested in it. what do you do? you have got to win the senate which i think they are going to do. then you can have an agenda. you would start with the keystone pipeline. start with allowing oil sales overseas. and then you go to tax reform. corporate and individual. you go for the big thing, the thing obama talked about. the thing that will actually

effect everybody's lives. >> you, charles krauthammer, two weeks from the vote, are predicting the republicans will take the senate. is that what i'm hearing? >> i'm not exactly going out on a limb here. >> but you are predicting it? >> yes, i am predicting it. >> all right. >> i been wrong in the past. rarely but i have been wrong. i'm predicting the royals also in the world series. >> the royals are a good bet because they have momentum and it's a scrappy young team. you see that the know vote, the anti-obama vote is going to carry the day two weeks from now. last word? >> yes, i do. the president historically low numbers. again, relatively strong candidates for democrats in these states. but i think the odds are quite favorable. i would put them at three to one right now. >> wow. >> that republicans win the senate. >> all right. charles krauthammer. things that matters his book, check it out. good read. factor tip of the day how we, all of us, can help poor
