[gunfire] >> about this time yesterday, we were just starting to get our minds around the chilling scene inside canada's parliament building as a gunman -- who was a recent convert to islam and wanted to move to the middle east -- opened fire and killed a soldier and then the canadian sergeant at arms shot that gunman dead. officials in canada say the gunman acted alone, but we know there was a possible isis-related chatter targeting canada leading up to yesterday's attack. our david lee miller is live now.

david lee? >> reporter: harris, for canadians this is the day after. many of them trying to go about their lives like nothing happened, but a stark reminder the canadian flag flying at half staff. despite the shooting yesterday, parliament got underway as scheduled this morning at 10:00. the parliament's sergeant at arms, kevin vickers, credited with shooting the gunman, received a standing ovation after five minutes of applause, members pounded their desks in appreciation. vickers, who served in law enforcement for some three decades, had never fired a shot until yesterday. also this morning prime minister stephen harper addressed the parliament. he told canadians the country will not be intimidated by terrorism. >> we will be individual hasn't, but we will -- vigilant, but we will not run scared, we will be prudent, but we will not panic. and as for the business of government, well, here we are in

our seats, in our chamber in the very heart of our democracy, and our work is going on. [applause] >> the shooting at the parliament, the meeting of the parliament, i should say, took place some 24 hour t after the shooting at the war memorial. a canadian newspaper, the ottawa citizen, obtained chilling copies of the first 9/11 calls. 911 calls. >> call for shots fired. war memorial. we may have multiple patients. one soldier has been hit. >> reporter: authorities are now saying that the shooter, michael se half by bow, was a lone gunman. still not entirely clear whether or not there may have been other accomplices in some way assisting him. his own family saying, quote -- now, this is his mother -- she cries for the victims, not her

son. harris? >> david lee miller, thank you very much. >> meanwhile, we're hearing two very different reactions to what happened north of the border. just hours after the attack, canada's prime minister referred to the shootings as terrorism. >> fellow canadians, in the days to come we will learn more about the terrorists and any accomplices he may have had. but this week's events are a grim reminder that canada is not immune to the types of terrorist attacks we have seen elsewhere around the world. >> but president obama a little slower to call it an act of terror. listen. >> well, we don't have enough information yet. so as we understand better exactly what happened, this obviously is something that we'll make sure to factor in in the ongoing efforts that we have to counter terrorist attacks in our cup. in our country. >> meanwhile, congressman jason chaffetz, a member of the house

homeland security committee, says this isn't something to be taken lightly. >> when you see, you know, an honor guard killed, murdered, you've got to start with the idea that this is terrorism, not just, hey, let's downplay this. you've got to think is this part of a bigger, broader terrorist effort? and we're in a fight, and we've got to win this fight. >> kirsten, i want to go to you first on this. a man in canada walks up to the tomb of the unknown soldier and kills dead a soldier guarding the tomb. >> uh-huh. >> why is the president reluctant to call this an act of terror? >> well, what i -- my question would be why do you need to call it an act of terror the minute that it happens before you actually know all the facts? >> he still hasn't. >> when the president, when the president spoke, he was right. we really didn't, we really didn't know anything, whereas i noticed all the conservatives around me were saying from the word go we need to call this terrorism. i don't agree with that. i think that you should wait and get the facts. i think also this person sounds

like somebody who was, you know, not a particularly stable person. he has a very long rap sheet. i mine, he had been arrested for robbery -- i mean, he had been arrested for robbery, drug possession multiple times, one thing after another. there could be other explanations for why he did this. i think it's reasonable to wait and get facts. i don't know why people are so -- >> to kirsten's point, eric, to be clear, there's no single, adapted, universeally-accepted definition of terrorism. in fact, most agencies here in the united states, the fbi defense, state department, they all have different definitions -- >> right. >> -- of terrorism. >> to rebut kirsten's point, the reason why you do call it terror off the top is because you can employ certain assets that you couldn't employ if you don't call it terrorism. if it's a civilian who shoots somebody you want to call a person, a citizen shooting another person, then you have certain rights that you have to protect. if you call it terror right off the bat, if the guy stands up

and says allahu akbar and blows away 13 or 14 people at fort hood, he's not afforded the same rights of evidence, of privacy, etc., that he would if you didn't call it terror and just made him a citizen, which they did. so my point was this, i don't care what president obama calls a canadian shooting. that doesn't matter to me. i call what president obama calls our shootings, the ones that happened here. the beheading in oklahoma city, fort hood and anyone subsequent where someone stands up, declares, you know, affin the city for allah and kills americans, i would say that's terror and start playing the games of terror, not rights and evidence. >> what we're talking about here, we're actually talking about what happened in canada, and he didn't yell that, and we didn't know that. my point is wait until we actually know what happened. >> i would trust the words of the canadian prime minister, right? you would assume, sandra, because this happened in qanta and they've been watch -- canada, and they had been watching this guy for a long

time, they have more facts than we do. so if the canadian prime minister says this is terrorism, i'm going to trust that they have the facts just like when the libyan president called benghazi terrorism and jihaddism, our president didn't listen to him. okay? and so why, sandra, would we expect president obama to call this an act of terror when a hole that was large enough for 20 men to walk through was blown into our consulate, and he couldn't use those terms then? there is an apprehension and a hesitancy by this white house to identify our enemy. they won't even say we're at war. and do build on eric's point -- to build on eric's point, you have to identify the enemy, or you will never be able to defeat it. >> while the president was saying, you know, this tragic attack or terrorism, his words, our fbi was getting involved. and that does allow us to employ those assets that eric was talking about in terms of joint terrorism forces so that we are giving them the kind of support that they need so that if they do find out it's terrorism on their end and, obviously, andrea, they already feel it is,

they can then open the doors and the money doors, if you will, to be able to fight it. >> interesting that they're -- >> quick to deploy the fbi and the joint terror task force for the canadian issue, and we don't see -- >> or to ferguson. >> as an opposing view and, kirsten, please chime in. is it almost glorifying, you know, this killer, this gunman who shot and killed this soldier in canada? is it almost glorifying him to call him a terrorist acting in the name of isis, you know, convert to islam and for us to talking about when really this is a guy, you know, living in his mother's -- >> we hadn't called him acting -- >> well, i don't think we've heard about this isis chatter, but we need to know did he have contact with people? isis is happy to take credit for this whether they had anything to do it with or not, they're going to take credit for it. so i think we actually need to get the facts -- >> he had befriended a syrian

jihadist who called himself a home grown terrorist, so they do know that, and he had recently been kicked out of a mosque for erratic behavior. >> nidal hasan had direct links to anwar al-awlaki who ended up being the number one terror target by america, yet we still can't call that terror. >> but then, kirsten, is the decision by the president of the united states not to call this an about of terror -- an act of terror, is it political then? >> i hi it's cautious. i think he wants to have have the facts -- >> he's always too cautious, and this is the new paradigm of terrorism, right? the war has morphed into lone wolf attacks. in fact, sandra, the same lone wolf attacks that this administration warned us about. so it's a bit mind-boggling they're not identifying -- >> meanwhile, while this is all fresh on our minds and as the prime minister in canada calls this an act of terror, you won't believe this. some tweets during the chaos in ottawa causing a lot of

"sports illustrated" cover model chrissy teagueen, married to john legend, by the way, she's saying on twitter: active shooting in canada, or as we call it in america, wednesday. and plenty of people took offense immediately, saying the model was making a joke as a soldier was shot dead, and the whole city was locked down. teigen said it was not a joke, a fact. others critical of her, one person commenting, quote: a classless, arrogant american, as usual. can't americans discern times when bringing up political issues is not appropriate or at this particular moment? this one's tough to look at, eric. >> so i do a segment every week on "the five" called fool of the week, and i think the most foolish comment either said or tweeted -- >> thank any, i've never made it. >> not yet. stick around, you never know. dem. yes, after a series of flubs by the white house democratic senate, aides are lashing out, likening the the white house political arm to a jv squad. at an event earlier this month, the first lady mispronounced the name of a democratic candidate for an iowa senate seat, and just after that the white house senate e-mailed to supporters calling him a candidate for governor which he wasn't, which they quickly had to take back and correct. the president's remarks this week that candidates keeping their distance from him are the ones who vote with him. a national journal piece quotes one aide as saying the ineptitude has sunk from annoying to embarrassing. >> ooh. >> all right, kirsten -- [laughter] is this a series of sloppy mistakes, or they really do have jv squad running the show? >> i think the michelle obama stuff is overblown. it was stupid, but i don't think it's going to make that much of a difference. the problem here is that the president is trying to gin up

the african-american base, and because if the african-americans don't turn out, the democrats don't have a chance. and, you know, since he's not on the ballot, he's having to really make an effort to get them to come out, and most of these comments have been made in that context. one of them was made when he was on al sharpton's radio show, for example. so it's a weird balancing act, because he wants to get them to turn out, right? >> i'm confused, are you saying that the only thing the democrat party has to offer blacks is a black president being on the ballot? >> that's not even remotely -- >> i'm confused. why would he even be on the ballot to get the black vote in. >> you don't think african-americans have an i affinity to president obama? it's pretty clear he has overwhelming support from african-americans, and he is the best person to have turnout african-americans. so that's whoo he's traying -- what he's trying to do. >> but that comment, eric, that he made hurt a number of democratic senators that have spent millions of dollars --

millions of dollars that he spent time raising for them -- >> well, they're happy with that. they're cool with the money president obama can raise, but especially in some of the key states where the races are very, very close, they're all trying to push back from president obama. with 1 days left, or at the time i think there were 14 days left when he made the comment on al sharpton's radio show, he really blew it. every day counts, and there can be no mistakes especially for those eight big seats that are within two, three points that can swing the senate. so now every one of those republican competitors to all those eight senate seats are going to use that quote saying, look, they're pushing away from president obama, but here he is telling you that they're going to vote -- my opponent, the democrat, is going to -- >> i don't agree that he blew it. he needs to get these voters to turn out. >> you don't think given the chance to take that comment back? >> no, because he's done it a couple times. i think he's trying to make sure african-americans turn out and that part of the democratic base

that supports him turns out because they normally don't turn out in midterm elections. look, democrats were almost, there was almost no chance the democrats were going to win any of these races to start with. the fact that they are as close as they are is miraculous. almost all of these races are being fought on totally red turf. >> sandra? >> i think it's being overstated. >> kirsten's saying it's all about the base, the base, no treble. [laughter] clearly, they have a very sloppy operation happening and this just isn't these isolated incidents. we've seen the captain of the swim team, jen psaki, we've seen her look like the jv squad, all these people, it looks like a student council government. >> how sloppy does the administration have to be for debbie wasserman schultz to refuse to associate any of these with barack obama's policies? that's just fact. >> you're talking about something different though. that's about them wanting to

last year to save money. now they assured outraged lawmakers those were freed only had minor criminal record. but now new records obtained by "usa today" contradict. that they reportedly show some of these illegals face serious criminal charges including kidnapping, sexual assault, even murder. immigration and customs enforcement acknowledged the discrepancy but tried to pass the blame saying quote, the discretionary releases made by i.c.e. were of low level offenders. however releases involving individuals with more significant criminal histories were, by and large, dictated by special circumstance outside of the agency's control. so, kirsten, if you're in the white house, how do you handle this "usa today" report? >> i don't know. i mean i think if this is true, they obviously screwed up. >> do you think at the time they generally knew they were high level offenders, or do you think this -- >> they're saying, that these

were decisions were made outside of their purview. but i don't know what that means. they haven't been specific enough to say, why would that be why would it be out of their purview? >> beyond why they did this, what they knew when they did this, bottom line should somebody held accountable, eric? >> here is the issue. the one issue did they release 2200 people with criminal background as harmful as kidnapping, sexual assault, drug trafficking and homicide? the answer to that is yes. the problem arises when months prior to the release the administration saider, we're releasing these people for cost cutting reasons but don't worry, they're low-level, non-violent offenders. they literally told us there wasn't going to be people like this. now turns out through "usa today," foia, request, whatever it was, they were high level and dangerous criminals were being released. is the release justified? i'm not sure based on costs, maybe, but certain think no way to justify the white house telling us don't worry, will not

♪ >> welcome back to "outnumbered." the woman hired to make the sweeping changes to the nfl's domestic violence policy coming under fire for some controversial remarks. former essential crimes prosecutor lisa freel, says that the changes could take months. saying quote, changing the policy is far more complicated than i think people see. what should the standards of behavior be? what should the process by which we investigate allegations of a violation of the policy be? and she says she doesn't want the new policy to be too harsh against players accused domestic violence say simply kicking abused players out of the league, would be quote, a very, very bad idea because no one will report, if that happens. i think we need to have an opportunity for people to have a second chance. earn their way back into being on the playing field.
